TOWN OF TAGHKANIC, COLUMBIA
                                  COUNTY, NEW YORK

                                 RESOLUTION NO.                -09

                         SECOND HOME OWNERS’ RIGHT TO VOTE

        At a regular meeting of the Town Board of the Town of Taghkanic, Columbia County, New
York, duly held on the ___ day of ___________, 2009 at the Town Hall, Route 82, Taghkanic, the
following Resolution was proposed and seconded:

        WHEREAS, recent litigation, Fingar, et al. vs. Martin, et al., before the State of New York
Supreme Court, Appellate Division, Third Judicial Department, reinforced the case law defending the
rights of second home owners to chose which home they may select as their residence for voting
purposes; and

        WHEREAS, the plaintiffs in that litigation were attempting to suppress votes cast by absentee
ballots from second home owners on the theory that their second home is not their residence; and

       WHEREAS, a substantial number of the residences in the Town of Taghkanic are owned and
occupied by second home owners; and

       WHEREAS, a substantial portion of the Town and School taxes collected from properties in
the Town of Taghkanic are paid by other than full time residents.

       NOW THEREFORE BE IT RESOLVED by the Town Board of the Town of Taghkanic that
the Town Board

1.     Supports the right of second home owners to choose to vote in the town where they maintain a
residence; and

2. Opposes all attempts to disqualify voters, now and in the future, on the basis that their second home
is not a residence; and

Be it further resolved that the Town Board of the Town of Taghkanic values all residents’ voting rights
and will actively discourage any future attempts to disqualify voters on the basis that their second home
is not a residence for voting purposes.

Upon question of the forgoing Resolution, the following Town Council Members voted as follows:

          The Resolution having been approved by a majority of the Town Council, the same was declared duly
          adopted by the Supervisor of the Town of Taghkanic.
