                             ORDINANCE 84-15


          AN    ORDINANCE   OF   THE   BOARD   OF   COUNTY   COMMIS­
          SIONERS OF ALACHUA COUNTY, FLORIDA, RELATING
          TO SECURITY IN THE ALACHUA COUNTY COURTHOUSE;
          PROHIBITING FIREARMS, WEAPONS, EXPLOSIVES OR
          DESTRUCTIVE DEVICES IN THE COURTHOUSE; PROVID­
          ING AN EXCEPTION FOR LAW ENFORCEMENT OFFICERS
          CARRYING WEAPONS, FIREARMS, EXPLOSIVES, OR
          DESTRUCTIVE DEVICES; PROVIDING FOR ELECTRONIC
          SECURITY SCAN OF PERSONS ENTERING THE COURT­
          HOUSE; PROVIDING FOR EXCEPTIONS OF SECURITY
          SCAN FOR JUDGES AND LAW ENFORCEMENT OFFICERS;
          PROVIDING FOR SECURITY SCAN OF BACKPACKS,
          BRIEFCASES, PACKAGES, AND SIMILAR ARTICLES
          CARRIED INTO THE COURTHOUSE; PROVIDING PRO­
          CEDURES   UPON ACTIVATION OF SECURITY SCAN
          DEVICE, INCLUDING SEARCH OF PERSONS AND ARTIC­
          LES AND REMOVAL OF PERSONS AND ARTICLES FROM
          THE COURTHOUSE; PROVIDING FOR POSTING NOTICE
          SIGNS AT THE COURTHOUSE; PROVIDING A GENERAL
          PENALTY; PROVIDING FOR SEVERABILITY; PROVIDING
          A REPEALING CLAUSE; PROVIDING AN EFFECTIVE
          DATE.


     WHEREAS, Section 125.01, Florida Statutes, authorizes the

Board of County Commissioners of Alachua County, Florida, to pro­

vide standards which will ensure its citizens' health, safety, and

welfare; and,

     WHEREAS, Section 125.01, Florida Statutes, authorizes the

Board of County Commissioners of Alachua County, Florida, to pro­

vide and maintain county buildings; and,

     WHEREAS, Section 43.28, Florida Statutes, authorizes the

Board of County Commissioners of Alachua County, Florida, to
provide appropriate courtrooms, facilities, equipment, and

personnel necessary to operate the circuit and county courts; and,

     WHEREAS, the Board of County Commissioners of Alachua County,

Florida, as lessee and custodian of the Alachua County Courthouse,

has installed an electronic security system in the Alachua County

Courthouse to provide for the safety and protection of persons con­

ducting business in the Alachua County Courthouse and to provide

for the safety of personnel working in the Alachua County Court­

house, and to provide protection of County property,

     NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUN'fY     COM.~IS­


SIONERS OF AI.ACHUA COUN'ry, FLORIDA:

     Section 1.   Prohibition   Re~~£~!ns   Firearms, Weapons! Explo­

sives, or Destructive Devices.     No person, except law enforcement

officers as defined and provided for in Chapter 790, Florida Stat­

utes, shall carry firearms, weapons, explosives, or destructive

devices, as defined in Chapter 790, Florida Statutes, either

openly or concealed, into the Alachua County Courthouse.

     Section 2.   Security Scan of Persons.     No person, except

Ju.dges and law enforcement officers as defined in Chapter 790,

Florida Statutes, shall be permitted entry to the Alachua County

Courthouse wi thout being subject to an electronic securi ty scan.

     Section 3.   Securit~   Scan of Articles Carried.    Backpacks,

briefcases, packages, and similar articles carried into the

courthouse must clear the electronic security scan devic2

installed in the courthouse.    ?ersons carrying said articles may

carry the articles with them as they walk through the security

device or may have such articles outwardly scanned by a hand-held

metal detector device by the courthouse bailiff designated to use

such device.

     Section 4.   Procedures on Activation of ..$..~curity Device.   In

the event of an activation of the security scan device l1pon a per­

son walking through the device, the person shall be requested by

the bailiff to remove any items from his person which may be caus­

ing the activation of the device and to walk through the device

again.   If a person is unable to walk through the security device

without activating the metal detector, the person may be subject

to search by the bailiff or may be required to leave the court­

house, at the direction of the bailiff6

     In the event any backpack, briefcase, package, or similar

article causes an activation of the security device, the person

carrying such article shall be requested by the bailiff to open

the article and remove any item from the article which may be

causing the device to activate.    In the event the backpack, brief­

case, package, or similar article cannot clear the security device

without causing an activation of the security scan device, the

article shall be subject to search by the bailiff, or the person

carrying such article may be required, at the direction of the

courthouse bailiff, to remove the article from the courtho:lse

building and grounds before '.:.he person may be permitted entry to

the cou ["thouse.

     Section 5.     P:?"::?__~L':.g of Notice.     The County Administrator is

hereby directed and authorized to prepare and post proper and ade­

quate notice signs at the entrance to the Courthouse building not­

ifying persons of the electronic security scan device and the pro­

hibition regarding the carrying of firearms, weapons, explosives,

or destructive devices into the courthouse.

     Section 6.     General Penalty.             Anyone convicted of a violation

of, or failure to comply with, any of the provisions of this ord­

inance shall be punished as provided by law.

     Section 7.     Se~~rability.         If any portion of this ordinance

is declared by a court of competent jurisdiction to be invalid or

unenforceable, such declaration shall not be deemed to affect the

remaining portions of this        ordinance~


     Section 8.     Repealing     Clause~         All ordinances Qr parts of

ordinances in conflict herewith are, to the extent of such con­

flict, hereby repealed.

     Section 9.     Effective Date.          This ordinance shall take effect

upon receipt of official acknowledgment from the Offlce of the

Secretary of the State of Florida that this ordinance has be-en

filed with said office.
