DePuy Patients to Go on Bellwether Trial Later This Year
Callaway, Florida – There are many patients who have been part of the controversial DePuy recall who
has decided to take legal actions on the matter and file the necessary DePuy hip recall class action.
According to a Bloomberg report, patients who were part of the said recall are set to go on trial later this
year, where more than 6000 lawsuits would be assessed to determine the liabilities and damages that
the defective device caused.
The hip recall, which has affected about 93000
people all over the world, 37,000 of those in the
United States was due to the reported high
failure rate of the two ASR products, namely the
DePuy ASR XL acetabular system and the DePuy
ASR hip resurfacing system. Records show that
12 to 13 percent or one out of every eight
patient who have received the implant are
subject to a five year revision rate, not to
mention the risk of experiencing symptoms like
pain and swelling in the hip area, difficulty in
walking and even elevation of metal levels in the bloodstream.
Hip lawyer representing the patients who were part of the recall met with Johnson and Johnson, the
second largest health care company and the mother company of DePuy orthopaedics Inc. met on the
hearing of the multi-district litigation of more than 4,000 lawsuits filed against the company. The
remaining 2000 lawsuits were filed in state courts. Both parties are seeking to get the best possible deal
and how much would the company be responsible of paying with each lawsuit that were filed.
The lawyers and the company both agreed that the process would follow a bellwether trial.
While the patients claim that there had been irresponsible actions that have caused all the trouble on
the part of the manufacturing company of the product. Johnson and Johnsons insist that their company
has acted responsibly and on the best way they could, regarding the matter. They believe that they have
made the appropriate actions and handled their responsibilities to the patients who were part of the

on later this year, they would be able to get the proper compensation that they deserve from the
