11   TO PROVIDE THAT A PERSON MAY NOT OWN, POSSESS,
12   OR OPERATE USED FARM EQUIPMENT THAT WAS
13   IMPORTED FROM A COUNTRY DETERMINED TO BE A
14   THREAT FOR THE SPREAD OF HOOF AND MOUTH
15   DISEASE, TO PROVIDE THAT THE SOUTH CAROLINA
16   DEPARTMENT OF AGRICULTURE MUST SEIZE AND
17   DISPOSE OF ANY EQUIPMENT THAT VIOLATES THE
18   PROVISIONS OF THIS JOINT RESOLUTION, AND TO
19   PROVIDE THAT ONCE THE FEDERAL GOVERNMENT
20   DETERMINES A COUNTRY IS CLEAR OF A THREAT OF
21   THIS DISEASE, THEN THE STATE’S BAN ON THE
22   OWNERSHIP, POSSESSION, OR USE OF EQUIPMENT
23   IMPORTED FROM THAT COUNTRY IS RESCINDED.

25   Be it enacted by the General Assembly of the State of South
26   Carolina:

28   SECTION 1. A person may not own, possess, or operate used
29   farm equipment that was imported from a country determined to be
30   a threat for the spread of hoof and mouth disease by the United
31   States Department of State, the United States Department of
32   Agriculture, the United States Customs Service, or the South
33   Carolina Department of Agriculture. The South Carolina
34   Department of Agriculture must seize and dispose of any
35   equipment that violates the provisions contained in this section.
36   Once the federal government determines a country is clear of a
37   threat of the disease, then the state’s ban on the ownership,
38   possession, or use of equipment imported from that country is
39   rescinded.

41   SECTION 2. This joint resolution takes effect upon approval by
42   the Governor.
