TEMPORARY/PERMANENT TRANSFER OF A LICENCE UNDER THE ABOVE ACT
Explanatory Note - The attention of all those applying for a licence is drawn to the
Board’s Regulations and to the attached policy statement of the Board. The purpose of
the policy is to set down standards against which the Board will assess, in general terms
and taking account of the particular circumstances of the application, whether an
applicant is a fit and proper person to be the holder of a liquor licence. It is stressed that
all applications are considered on their individual merits. If a person is applying for a
licence in his/her own name, then this questionnaire should be completed by that
person. If the applicant is a company or partnership, then the questionnaire should be
completed by the day-to-day manager responsible for the running of the premises.
Question 6(a) 7 and, if applicable, 8 and 9, together with Part 6 hereof, however, must
be completed by an authorised official of the company or partnership. That official
(preferably a director or partner) should also co-sign the Declaration at the end of this
questionnaire along with the day-to-day manager. If in the case of an application for the
provisional grant of a new licence, no day-to-day manager has been nominated when
the application is lodged, a further questionnaire will require to be completed and
submitted along with the application for finalisation when the day-to-day manager has
been nominated.

NOTE TO APPLICANTS: In relation to previous experience:-
The Board’s policy states that in general, an applicant for a public house, hotel or
entertainment licence should have either 1 year’s full-time experience in a
managerial position within licensed premises or 2 years’ part-time experience. (NB.
Full-time means working at least 35 hours per week and part-time means working at
least 20 hours per week).
Applicants for a restaurant, refreshment, restricted hotel or an off-sale licence
should generally have acquired either 6 months’ full-time experience within licensed
premises in a managerial position or 1 year’s part-time experience.
Any previous employment should generally have been acquired within the period of
2 YEARS prior to the date of this application.
PART 3 - TRAINING IN MANAGEMENT OF LICENSED PREMISES (SEE NOTE

NOTE TO APPLICANTS
In relation to management training:-
The Board’s policy states that applicants should have completed, or provide an undertaking
that they will complete within two months from the date of grant, renewal, transfer (including
substitution) or finalisation of the provisional grant of a licence, an approved course of
training in relation to the operation, management and control of licensed premises. This
policy applies to any individual applying for a licence and in the case of a non-natural person
(such as a Company or Partnership) to the nominated Director or Partner of the Company or
Partnership responsible for the operation of the premises which are the subject of the
application and also, the nominated day to day manager.
In addition, the policy states that staff engaged in management duties on behalf of the
licence holder, either on a full or part-time basis, should likewise have competed an
approved course of training or an undertaking should be provided that all such staff will have
completed training as described within one year of the licence being granted, renewed etc.

For details of the approved courses of training, including the provisions as to exemptions
and refresher/update training, reference should be made to the policy statement on Training
for Licensees.
Evidence of such training or a signed undertaking (provided at the end of this questionnaire)
to the effect that such training will be acquired within the requisite timescales should be
produced to the Clerk of the Board unless the applicant wishes to explain to the Board why
the policy should not be applied in their individual case.

APPLICATIONS FOR LICENCES
POLICY RELATIVE TO THE FITNESS OF APPLICANTS TO HOLD A LICENCE
The Licensing Board considers it appropriate to have in place a policy which would assist the
process of carrying out the requirement on the Board under the Licensing (Scotland) Act, 1976, as
amended to determine whether an applicant for a licence is a fit and proper person to be the holder
of a licence in terms of Section 17(1)(a) of said Act with specific regard to their ability to control and
manage licensed premises.
The Board took into account the following factors in determining the necessity for and the
substance of its policy in this regard, namely:-
1. The outcome of a consultative meeting held on 8 September 1994 between the Chairman
of the Licensing Board and representatives of the Scottish Licensed Trade Association and
Strathclyde Licensed Trade Association. It was the view of both these organisations that in
general terms standards had fallen with regard to the control and management of licensed
premises due at least in part to lack of experience on the part of persons applying for and
being granted licences. To address this both organisations were jointly engaged in
developing training courses for licenceholders and managers of licensed premises. At the
meeting on 8 September 1994, the appropriate levels of experience for licenceholders was
discussed;
2. Concern expressed by Strathclyde Police on the subject of controlling disorder and crime
within the city centre and beyond. In this context, the Board took account of recent
complaints submitted by the police with regard to the conduct and management of certain
licensed premises which had given rise to the Board deciding to hold suspension hearings
in terms of Section 31 of the said Act; and
3. The views expressed by the Chief Medical Officer of Health with the Scottish Office on the
subject of his Department's initiative to promote sensible drinking habits throughout
Scotland. The Board members had regard to the content of an address and video
presentation made in the course of a meeting held on 19 August 1994 with the Chief
Medical Officer. At that meeting it was indicated that there was conclusive evidence that
excessive drinking gave

rise to a considerable number of social problems including disorder and crime. It had been
explained that Licensing Boards in the context of their duties and responsibilities under the
said Act of 1976 could have an influence on the standards throughout the licensed trade as
a whole, particularly in the context of the management and control of licensed premises,
with regard to preventing excessive drinking and drunkenness on the part of persons
resorting to licensed premises and could have an impact on improving the situation giving
rise to alcohol abuse and all the adverse effects which stem from such abuse.
Taking account of the applicant’s fitness to be the holder of a licence in the context of their ability to
control and manage licensed premises, the Board, having consulted with representatives of the
licensed trade on the making of this policy, agreed that in future it would assess applicants for
licences under Section 17(1)(a) of the Licensing (Scotland) Act 1976 in terms of the following
criteria. The criteria applies to individuals who apply for licences (ie natural persons) and day to
day managers where application is made by a non-natural person such as a company or
partnership:-
(i) That the applicant in the case of an application for a public house, hotel or entertainment
licence has been employed in a managerial position within licensed premises for a
minimum of 1 year in a full-time capacity (full-time employment to be taken in the context of
this and the following paragraph as not less than 35 hours per week over the 1 year period)
or the applicant has been employed in a managerial position on a part-time basis within
licensed premises for a minimum of 2 years (part-time employment to be taken in the
context of this and the following paragraph as not less than 20 hours per week over the 2
year period) in either case without adverse comment or complaint.
(ii) In the case of an application for a restaurant, refreshment, restricted hotel or an off sale
licence, the Board considers that the relevant experience required should be 6 months in a
full-time capacity or one year in a part-time capacity in either case without adverse
comment or complaint.
(iii) In addition to the foregoing requirements in relation to experience, that the applicant has
acquired a reasonable working knowledge of licensing laws and (other than in the case of
an application for a restaurant, refreshment, restricted hotel or an off sale licence) has
received appropriate training on the management and control of licensed premises.

In all cases the previous duties undertaken and experience and training acquired by the applicant
should be the same or similar to those necessary to control and manage licensed premises of the
size and type which are the subject of the application before the Board. Further, in general, the
previous experience and training should have been acquired within the period of 2 years prior to
the date of the application
Where application for a licence is made by a non-natural person such as a company or
partnership, these applicants should be able to demonstrate to the Board that if the application is
granted and those in control of the company or partnership become the holders of a licence, they
are in a position to properly instruct and generally supervise the appointed day to day manager of
the premises on his or her full duties relative to the management and control of the premises
including the management and control of any entertainment provided on the premises.
The Board looks to existing and new licence holders ensuring that they and the staff employed by
them are appropriately trained in accordance with the requirements contained in the Health and
Safety at Work Etc Act 1974 and the Food Safety Act 1990.
The Board will look to the Director of Environmental Health, in appropriate circumstances, to
advise and report to the Board any material breach of these requirements. In the event of any
material breach of these requirements the Board may refuse to renew or may consider suspending
a licence as appropriate.
Reference shall be made to this policy as appropriate in the case of an application for the grant or
provisional grant of a new licence, renewal or permanent transfer of a licence and in the case of an
application for confirmation of transfer of a licence under Section 25(4) of the said Act of 1976 as
amended.
It is stressed that all such applications will be assessed on their individual merits and that the Board
as well as having regard to the foregoing policy will also have regard to the particular
circumstances pertaining to any application before reaching its decision on the fitness of an
applicant to be the holder of a licence.

ADDENDUM TO POLICY RELATIVE TO THE FITNESS OF APPLICANTS TO HOLD A
LICENCE
UNDER AGE DRINKING
The Board is concerned about the prevalence of under-age drinking and the purchase from
licensed premises for consumption on or off those premises of alcohol by or on behalf of persons
who are under the legal drinking age.
The Board understands that a proof of age scheme to counteract under-age drinking and the
purchase of alcohol by persons who are under the legal drinking age operated by the Portman
Group has widespread support amongst the licensed trade in Scotland.
The Board supports this and any similar schemes which seek to tackle this issue and will monitor
the success of this particular scheme.
Having regard to the Board’s policy for determining whether an applicant is a fit and proper person
to be the holder of a licence in terms of the Licensing (Scotland) Act 1976, the Board has agreed
that in considering applications it will take account of inter alia the applicant’s approach or
proposed approach to under-age drinking in relation to the sale or supply of alcohol and will require
the applicant to state what steps are already in place or are to be taken to minimise this problem.
It is stressed that all applications to the Board are assessed on their individual merits and that the
Board as well as having regard to the foregoing policy will also have regard to the particular
circumstances pertaining to any application before reaching its decision.
NB - IMPORTANT NOTE TO LICENCEHOLDERS
Licence holders are reminded of the following provisions of the Licensing (Scotland) Act 1976, as
amended:-
Section 68 of the Act provides that
(1) .....the holder of a licence or his employee or agent shall not in licensed premises sell
alcoholic liquor to a person under 18, or allow a person under 18 to consume alcoholic
liquor in a bar, nor shall the holder of the licence allow any person to sell alcoholic liquor to
a person under 18,
(2) A person under 18 shall not in licensed premises buy or attempt to buy alcoholic liquor nor
consume alcoholic liquor in a bar,
(3) A person shall not knowingly act as agent for a person under 18 in the purchase of alcoholic
liquor, nor shall any person knowingly buy or attempt to buy alcoholic liquor for
consumption in a bar in licensed premises by a person under 18, and ....
(7) If any person contravenes this section he shall be guilty of an offence.
Section 97A of the Act provides that a holder of a licence in respect of (a) any off-sale premises or
(b) the off-sale part of any other premises, or any employee or agent of his, who causes or permits
a person under 18 to sell on these premises alcoholic liquor without the sale having been
specifically approved by the licenceholder or by a person of or over 18 acting on his behalf shall be
guilty of an offence.

SECOND ADDENDUM TO POLICY RELATIVE
TO THE FITNESS OF APPLICANTS TO HOLD A LICENCE
TRAINING FOR LICENCEES
The Board’s policy dated 23 May and effective from 30 May 1995 relative to assessing the
fitness of applicants to hold a licence in terms of the Licensing (Scotland) Act 1976, as
amended, provides that applicants should have received appropriate training on the
management and control of licensed premises. The policy also provides that applicants, in
addition to training, should have acquired sufficient practical experience of the licensed
trade and the policy sets down the length of experience applicable for particular types of
licence.
In relation to the training aspect of the policy, the Board, having consulted with the Scottish
Licensed Trade Association, the Scottish Grocers Federation and the British
Entertainment and Discotheque Association, has determined that in order to fully achieve
the improvements in the licensed trade outlined in the policy statement of 23 May 1995
and to maintain high standards in relation to the operation and management of licensed
premises, in addition to considering the particular applicant’s practical experience of the
licensed trade, it will take into account the following general criteria with regard to training
when it is required to consider the fitness of an applicant to be the holder of a licence. It is
stressed however that every application will be considered and determined on its
individual merits and the Board will take into account the particular applicant’s previous
history as regards training and experience acquired in relation to the management and
control of licensed premises in reaching its decision on whether to grant or refuse the
application.

Formal Training for Licensees
In the case of all applications for the grant, provisional grant, renewal or transfer of a
licence (including substitution of the nominated day to day manager), unless the Section
herein dealing with Exemption from Training applies, the Board, in general terms, will look
to applicants having completed, or undertaking to complete, within two months from the
date of grant, renewal, transfer (including substitution) or finalisation of the provisional
grant of a licence and in either case, producing to the Clerk of the Board a valid Certificate
from the Course Provider confirming completion, the under noted Course of training at
foundation level which has been approved by the Licensing Board (See 1(a) below and the
associated Course outline attached at Annex 1(a) hereof).
In the case of applications relative to premises operating or to be operated in terms of an
off-sale licence, attendance will be at an appropriately adapted version of this Course of
training (See1(b) below and the associated Course outline attached at Annex 1(b) hereof).
Applicants will be entitled to an exemption from attendance at one or other of these
Courses, as appropriate, if a valid and current Certificate is produced to the Clerk of the
Board confirming attendance at (a) any of those Courses detailed in the Section herein
dealing with Exemption from Training or (b) one or other of the Refresher/Update Training
Courses, as appropriate, details of which are provided in the Section herein dealing with
Refresher/Update Training.

premises in respect of which the grant, renewal, transfer (including substitution) or
finalisation of the provisional grant of a licence has been made and also by the nominated
day to day manager.
In the case of an individual applying for a licence, that person should undergo the relevant
training.

Training for Staff in Licensed Premises
The Board, in general terms, will also look to licence holders, prior to or at the date
of grant, renewal, transfer (including substitution) or finalisation of the provisional
grant of a licence, producing to the Clerk of the Board, either valid and current
Certificates from the Course Provider confirming that all staff engaged or to be
engaged in management duties at the licensed premises by way of assisting or in
substitution for the licence holder, whether on a full or part-time basis, have
completed one or other of the above Courses of training at foundation level (See
1(a) and 1(b) above and the related Appendices) as appropriate, or an undertaking
that, within six months of the aforementioned date, (or in the case of any such staff
engaged beyond the six month period hereinbefore referred to, within six months
from the date of their engagement), all or any staff who have not completed the
relevant Course of training will do so and further that Certificates as previously
described will be produced to the Clerk of the Board.
Applicants will be entitled to an exemption from this requirement if valid and current
Certificates from the relevant Course Provider are produced to the Clerk of the
Board confirming attendance by all such staff at (a) any of those Courses detailed in
the Section herein dealing with Exemption from Training or (b) one or other of the
Refresher/Update Training Courses, as appropriate, details of which are provided
in the Section herein dealing with Refresher/Update Training.
The term “management duties” where it appears in this policy statement means
duties which, either in whole or in part, relate to the management, control and
conduct of persons on the licensed premises and any matter relating to or arising
from the use of the licensed premises by those persons.

Optional Further Training for Staff
Licence holders may voluntarily opt to encourage all such staff engaged in management
duties at the licensed premises, to undergo formal training beyond the aforementioned
foundation level Courses and the Board is pleased to approve the under noted Course
(See 3 below and the associated Course outline at Annex 3 hereof) as one which will
suitably build on the level of training achieved upon completion of the foundation level
Courses.

one or other, as appropriate, of the under noted Refresher/Update Training Courses at
foundation level, both of which have been approved by the Licensing Board (See 4(a) and
4(b) below and the associated Course outlines attached at Annexes 4(a) and 4(b) hereof).
Valid and current Certificates from the Course Provider should be produced to the Clerk of
the Board by the applicants at the time of lodging the application for renewal of any licence
confirming attendance at one or other of these Courses.

Purpose – Demonstrating the knowledge and skills required for all
types of bar work.

3. pour, serve, mix and present alcoholic and non-alcoholic
