INSTRUCTIONS TO COMPLETE POWERS OF ATTORNEY FOR USE ON INTELLECTUAL
PROPERTY CASES IN MEXICO
1.-) When granted by individuals:
The signature of the person who grants the power attorney, together whit the name, address and signature of two witnesses,
is sufficient to make the document valid in Mexico. This type of power of attorney will meet all representation requirements to
act on behalf of an individual, regardless of his/her nationality, before the Mexican patent and Trademark office, before the
Copyright Office and even before all related Administrative Courts.
2.-) When granted by foreign companies, corporations or any other type of legal entity, solely for prosecution and registration
purposes.
a) The power of attorney form is to be executed by a legal representative of the company.
b) Two witnesses are lo execute the document as well, showing full name and complete address
Finally, the date of the Board of Directors´ Meeting during which authority was officially given to the person who executes the
power of attorney, is to be inserted at the bottom of the power of attorney form.
Please bear in mind that this type of power of attorney, without notarization, legalization or Apostille, will only be valid to
represent the company, on the prosecution of patent and trademark applications and on the recordal of mergers, changes of
name assignments, etc., before the Mexican Patent and Trademark Office.
3.-) When granted by foreign companies, corporations or any other type of legal entity, to represent them on any kind of
litigation for Intellectual Property rights:
The power of attorney form is to be completed as indicated above. Then it must be notarized and affixed with legalization
before the Mexican Counsel. As an alternative to legalization, please note that Mexico is a member State of the Hague
Convention and, therefore, Apostille is also acceptable.
