include the approval date by its local
governing board.

Local Educational Agency Responsibilities:
The LEA must investigate complaints alleging a
violation by the LEA of a federal or state law or
regulation governing the programs listed in the
California Code of Regulations, Title 5, Section
4610(b), or discrimination complaints and seek
to resolve those complaints in accordance with
the complaint procedures adopted by the LEA.

The CDE reviewer will:

complaints in the last 12 months. If the
answer is yes, the FPM team lead or the
assigned consultant will review a random
selection of complaint files onsite.
• If no complaints have been received by the
LEA, the LEA will be asked to upload a
statement certifying that no complaints have
been received.

On-Site vs. Online Reviews
• For onsite reviews, the FPM team lead will
complete a random selection of UCP files and
check those files for the required elements.
• For online reviews, the CDE reviewer will ask
the LEA for information regarding the UCP
files received and a self certification process
will ensue. (See Handout)

random selection review of the UCP files:
– The six month timeline was met for filing
discrimination complaints
– The investigative process allowed the complainants
and/or representatives the opportunity to present
evidence
– The complaint was addressed within the 60 calendar
day timeline

• Revisions to board policies must be approved by the
local board. Revised administrative regulations must be
approved by the proper local authority
• All Williams Complaints documents (UCP 4, 5, and 6)
must use the wording of “pupils” and not “students.”
• The language in the policy/regulations must match
those on the complaint form. Districts often forget to
check its documents for consistency.

Williams Complaints Classroom Notice
A notice shall be posted in each classroom, in each school, in the
LEA, notifying parents, guardians, pupils, and teachers:
– There should be sufficient textbooks and instructional
materials.
– School facilities must be clean, safe and maintained in good
repair.
– There should be no teacher vacancies or misassignments.
– Where appropriate, intensive instruction and services are
provided to pupils who have not passed one or both parts of
the high school exit examination after the completion of
grade 12.
– The location at which to obtain a form to file a complaint in
case of shortage.

LEAs that do not receive intensive instruction funds pursuant
to EC 37254, would not have to include the following
statement on their Williams Complaint forms in schools with

provided pursuant to Ed. Code Section 37254 to
pupils who have not passed one or both parts of
the high school exit examination after the completion of
grade 12.“

• LEAs will upload their UCP documents into CAIS for
review by CPCM staff.
• If documents are found to be missing or in the wrong
UCP section, the analyst will contact the LEA staff to
make the discrepancies known and will require missing
documents to be uploaded and/or misplaced documents
to be relocated. The analyst will also ask that irrelevant
documents be removed.
• If areas of noncompliance are found, the consultant will
contact the LEA staff to provide assistance and to
request that revised/proper documents are uploaded
onto CAIS. This includes the Proposed Resolution of
Findings (PRF).
