LIEN INFORMATION:
The following information is provided as a courtesy through the Clerk of Court (hereafter referred to as Clerk) and
should not be considered as a substitute for legal advice or services.
1. WHERE A LIEN MAY BE FILED:
The Clerk files, records, and maintains lien and judgment records provided for by statute. The party seeking
to file the lien is responsible for deciding what county the lien should be filed in.
2. FEE: The statutory fee to file a lien with the Clerk is $5.00.
The statutory fee to file a satisfaction of the lien is $5.00.
3. FORMS:
The Clerk does not have or provide forms for lien processes. Certain lien forms are available
electronically through a website located at: http://www.wisbar.org/forms Forms may also be available
through a business that sells them, or drafted through an attorney or other legal source.
4. LEGAL PROCESS:
The party seeking to file the lien is responsible for compiling and submitting the lien in proper form to the
Clerk. The legal process for a variety of lien types is referenced in part under Wisconsin Statutes Chapter
779. Lien processes may include providing proper and timely "notice of intent to file a lien claim",
documented proof of how and whom that notice was given to, then timely submitting these documents with
the claim for lien and fee to the Clerk for filing.
5. LEGAL ADVICE
If you are proceeding on your own, you are responsible for roles and decisions an attorney would otherwise
handle. If you have legal questions, you are advised to consult an attorney or make a decision based on
your own study and conclusions of the law. Information on Wisconsin law is available electronically

6. VALIDITY OF LIEN:
It is not the Clerk's role to determine if the lien is proper or correctly done. If the lien filing is challenged, it
will become an issue for the Court to decide.
7. COMMUNITY RESOURCES INCLUDE:
There is a free legal clinic at the Eau Claire Public Library every 3rd Wednesday evening commencing at 6:30pm.
There is a self-help center available on-line through the Wisconsin Court System website which can be accessed
under http://www.wicourts.gov
There is an attorney referral site available on line through the Eau Claire County Bar Association website which can
be accessed under www.eauclairecountybar.org
A listing of area attorneys is available in the local phone book.
