               Research Assignment


• Plaintiff passenger gets a ride home from Defendant
  driver after leaving an after hours office party. While
  getting into Defendant’s car, plaintiff notices the
  distinctive scent of 151 proof Lemon Hart rum on the
  Defendant’s breath. Notwithstanding this observation,
  Plaintiff gets in the car. Unsurprisingly, Defendant causes
  an accident which injures Plaintiff. What is the likelihood
  of a court dismissing a summary judgment motion filed
  by defendant based on assumption of risk? Also
  research how to prepare such an opposition.
