					    RESOLUTION OF THE PLANNING BOARD OF THE BOROUGH OF
    ROSELLE PARK, UNION COUNTY, NEW JERSEY, FINDING THAT
    THE AMENDMENT TO THE ROMEROVSKI SITE REDEVELOPMENT
    PLAN DATED SEPTEMBER 2007 IS SUBSTANTIVELY CONSISTENT
    WITH THE BOROUGH’S HOUSING ELEMENT, FAIR SHARE PLAN
    AND MASTER PLAN; ENDORSING THE AMENDMENT TO THE
    ROMEROVSKI SITE REDEVELOPMENT PLAN DATED SEPTEMBER
    2007 AND RECOMMENDING APPROVAL OF ORDINANCE NO. 2217
    TO THE BOROUGH COUNCIL


     WHEREAS, on April 20, 2006, the Borough Council authorized
the Planning Board of the Borough of Roselle Park to conduct a
preliminary investigation to determine if the Romerovski Site
qualifies as a “redevelopment area” as that term is defined in
the Local Redevelopment and Housing Law at N.J.S.A. 40A:12A-5;
and

     WHEREAS, Heyer, Gruel & Associates prepared a report
entitled “Romerovski Site Redevelopment Study,” dated August
2006 (the “Report”) and submitted the Report to the Planning
Board for its analysis; and

     WHEREAS, on September 18, 2006, the Planning Board of the
Borough of Roselle Park officially recommended the Romerovski
Site to the Borough Council as a “Redevelopment Area” as
provided for under the Local Redevelopment and Housing Law; and

     WHEREAS, after receiving the Planning Board’s September 18,
2006 Resolution recommending the Romerovski Site as an area in
need of redevelopment, the Borough Council adopted Resolution
158-06, which designated the Romerovski Site as an area in need
of redevelopment pursuant to the Local Redevelopment and Housing
Law; and

     WHEREAS, Heyer, Gruel & Associates prepared a proposed
redevelopment plan for the Borough Council entitled “Romerovski
Site Redevelopment Plan,” dated February 2007; and

     WHEREAS, on February 15, 2007, the Borough Council
introduced Ordinance No. 2201 entitled “AN ORDINANCE ADOPTING A
REDEVELOPMENT PLAN PURSUANT TO N.J.S.A. 40A:12A-7 FOR THE
ROMEROVSKI SITE LOCATED IN THE BOROUGH OF ROSELLE PARK;” and

     WHEREAS, on March 1, 2007, Ordinance No. 2201 and the
Romerovski Site Redevelopment Plan were adopted by the Borough
Council; and

     WHEREAS, in its continued commitment      to    satisfy its
affordable housing obligations, the Borough    of   Roselle Park
formed a Mount Laurel Subcommittee to complete the process of
(1) analyzing its affordable housing obligations; (2) evaluating
its entitlement to credits; (3) reviewing its land use
regulations; and (4) finalizing the preparation of an affordable
housing plan responsive to the Borough’s obligations for all
three housing cycles; and

     WHEREAS, in addition to the above, the Planning Board of
Borough of Roselle Park, State of New Jersey, adopted its
current Master Plan pursuant to N.J.S.A. 40:55D-28 on October
20, 1997, re-examined the Master Plan during 2003 and amended
the Master Plan in 2006; and

     WHEREAS, the Master Plan must include a Housing Element
pursuant to N.J.S.A. 40:55D-28b(3); and

     WHEREAS, Heyer, Gruel & Associates completed the Housing
Element and Fair Share Affordable Housing Plan, Borough of
Roselle Park, Union County, New Jersey, June 2007 and submitted
it to the Planning Board for consideration at the Board’s June
18, 2007 regular meeting; and

     WHEREAS, on June 18, 2007, the Planning Board adopted the
Housing Element and Fair Share Plan as an amendment to the
Roselle Park Master Plan in accordance with N.J.S.A. 40:55D-28;
and

     WHEREAS, the Housing Element and Fair Share       Plan   was
subsequently endorsed by the Borough Council; and

     WHEREAS, the Borough Council later determined that the
Romerovski Site Redevelopment Plan needed amendment to be
consistent with the Borough’s Housing Element and Fair Share
Plan; and

     WHEREAS, Heyer, Gruel & Associates prepared an amendment to
the Romerovski Site Redevelopment Plan dated September 2007; and

     WHEREAS, on September 6, 2007, the Borough Council
introduced Ordinance No. 2217 entitled “AN ORDINANCE AMENDING
THE REDEVELOPMENT PLAN PURSUANT TO N.J.S.A. 40A:12A-7 FOR THE
ROMEROVSKI SITE LOCATED IN THE BOROUGH OF ROSELLE PARK;” and

     WHEREAS, pursuant to Resolution No. 201-07 adopted by the
Borough Council on September 6, 2007, the Borough Council
referred Ordinance No. 2217 to the Planning Board for review and
recommendation pursuant to N.J.S.A. 40:55D-26a; and

     WHEREAS, the Planning Board considered Ordinance No. 2217
at its public meeting on September 17, 2007; and

     WHEREAS, the Planning Board heard evidence in connection
with Ordinance No. 2217 and the amendment to the Romerovski Site
Redevelopment Plan dated September 2007; and

     WHEREAS, the Planning Board provided the general public an
opportunity to comment on its review of Ordinance No. 2217 and
the amendment to the Romerovski Site Redevelopment Plan dated
September 2007; and

     WHEREAS, a motion to adopt a Resolution memorializing   the
Board’s action regarding its review of the amendment to      the
Romerovski Site Redevelopment Plan dated September 2007      and
Ordinance No. 2217 was made, seconded and voted upon by      the
members of the Planning Board.

     NOW THEREFORE BE IT RESOLVED that the Planning Board of the
Borough of Roselle Park, County of Union, State of New Jersey
hereby finds that the amendment to the Romerovski Site
Redevelopment Plan dated September 2007 is          substantively
consistent with the Borough’s Housing Element and Fair Share Plan
that was adopted by the Planning Board on June 18, 2007 and all
other elements of the Borough’s current Master Plan; and

     BE IT FURTHER RESOLVED, that the Planning Board endorses
the amendment to the Romerovski Site Redevelopment Plan dated
September 2007 and recommends adoption of Ordinance No. 2217 by
the Borough Council; and

     BE IT FURTHER RESOLVED that the Secretary of the Planning
Board is directed to forward a copy of this Resolution to the
Mayor and Council of the Borough of Roselle Park for further
consideration and action; and

     BE IT FURTHER RESOLVED that the Secretary of the Planning
Board is directed to publish notice of this action in the manner
prescribed by law.




     I hereby certify that the foregoing Resolution was adopted
by the Planning Board of Roselle Park at its meeting of
September 17, 2007 and memorializes the action of the Planning
Board finding that the amendment to the Romerovski Site
Redevelopment Plan dated September 2007 is substantively
consistent with the Borough’s Housing Element, Fair Share Plan

and Master Plan; endorsing the amendment to the Romerovski Site
Redevelopment Plan dated September 2007; and recommending
approval of Ordinance No. 2217 to the Borough Council, by a vote
of 6 in favor; 0 against and 0 abstentions.
