                                  Day Care in Single Family Homes
                  For purposes of this document, the term day care is also referred to as child care home

Step 1. Contact the North Carolina Division of Child Development at 919-662-4499 for state
        and county requirements.
Step 2. Contact City of Raleigh Zoning Division at 919-516-2550 for zoning requirements.
Step 3. Review Appendix A for building code compliance information.

                     Family Child Care Home - For 5 or fewer children
Note: Approval must be obtained from the City of Raleigh for a family in-home child care.

Family Child Care Homes are permitted within all zoning districts which permit both residential
uses and day care facilities and shall meet all the following:

    1. The Family Child Care Home must be carried on by a resident of the structure as either a
       sole proprietorship or a corporation that is wholly owned by the residents of the structure
       or a partnership where all partners are resident of the structure.

    2. The use of any accessory building or accessory structure as a Family Child Care Home is
       prohibited. Any outdoor play equipment stored throughout the day or night shall not be
       permitted in the front yard nor shall it be situated closer than fifteen (15) feet from any
       adjoining lot containing a dwelling.

    3. One (1) off-street parking space shall be provided for each Family Child Care Home. The
       off-street parking space required for the Family Child Care Home shall be maintained in
       addition to the space or spaces required for the residence itself. No parking areas, other
       than driveways, may be located in the required front yard setback or in any protective
       yard.

    4. Only one (1) vehicle used in connection with Family Child Care Home shall be
       permitted.

    5. No person, other than members of the family residing on the premises, shall be engaged
       or employed. This shall not apply to a substitute non-resident person providing care on
       the premise while the owner/operator is sick or otherwise unable to provide such care.

    6. The structure housing the Family Child Care Home shall be similar in appearance to the
       neighborhood.

    7. No more than five (5) children shall be cared for at any given time. Shifts may not
       overlap (e.g. 1st shift-7:00 a.m. to 3:00 p.m. the 2nd shift would start @ 3:30 p.m. to
       11:00 p.m., etc.)

    8. There shall be no sign or advertisement visible from the exterior of the dwelling. The
       address of the property must be posted in accordance with Section §10-2083.1(c)(2) of
       the City Code.

    9. No excessive lighting will be generated at the facility and all the lighting shall be in
       accordance with §10-2089.

Note: Day care facility requires a Special Use Permit from the Board of Adjustment.

To permit a day care facility in any residential district except in an Airport Overlay District or
primary reservoir watershed protection area after the Board finds that the evidence presented at
the hearing establishes each of the following:

    1. The use will not be injurious to property or improvements in the affected area.

    2. The following minimum land areas per enrollee shall apply:
           a. Rural Residential, Residential-2, and Residential-4 Districts - one thousand three
                hundred (1,300) square feet.
           b. Residential-6, Manufactured Home, Special Residential-6 Districts - eight
                hundred (800) square feet.
           c. Residential-10 and districts of lower residential classification - three hundred
                (300) square feet.
       Notwithstanding the requirements in the preceding sentences, each facility may increase
       enrollment twenty (20) percent to provide for absenteeism of enrollees of a day care
       facility.

    3. In the case of a day care facility for children, there shall be a minimum of seventy-five
       (75) square feet of fenced outdoor play area per child older than eighteen (18) months of
       age.

    4. The structure housing the Family Child Care Home shall be similar in appearance to the
       area.

    5. Off-street parking shall be provided in accordance with §10-2081; one space for every
       eight (8) children, one (1) space for the home and one (1) space for each employee.

    6. Access to the facility from nearby streets will be adequate based upon the projected
       number of participants to attend the facility. (Cross reference: Residential street and
       collector streets, Street, Sidewalk and Driveway Access Handbook, on file with the City
       Clerk.)

    7. The landscaping of the facility will adequately blend it into the area, screen its purely
       functional aspects from the street or absorb and deflect any excessive noise.

    8. No excessive lighting will be generated at the facility in any manner which will annoy
       residents of the surrounding structures. All lighting shall be in accordance with
       §10-2089.

    9. The Board of Adjustment may allow in any residential district one (1) unlighted
       announcement sign not to exceed two (2) square feet in area and three and one-half (3
       1/2) feet in height and an equivalent-sized permanent vehicular sign.

    10. Only one (1) vehicle used in connection with the day care facility in residential zoning
        districts will be parked or stored on the premises, or residential street.

This special use permit shall not be required for the day care facility in a residential zoning
district if the facility is approved by the Planning Commission or City Council in accordance
with all the provisions of §10-2072, Residential Institution in a residential zoning district, and the
Planning Commission or City Council find that standards (2) through (10) above are met (this
would normally be a new structure where the preliminary site plan has to be approved by the
Planning Commission).



              Building Requirements for a Residential Day Care Facility

    1. Maximum number of children up to 12 (code allows up to 16, but the North Carolina day
       care limits this to12).
    2. Each exit door requires a manual pull station interconnected to the smoke detector and
       alarm.
    3. Install exit doors directly from each room or 1 hour fire rate the structure. One hour fire
       rating is achieved by removing all walls and ceiling of ½ inch sheetrock and replacing it
       with 5/8 inch fire rated sheetrock. Rated ceiling fixtures and fire dampers are required.

Step 4. Prepare full building plans sealed by a professional designer and submit for permitting
        to the City of Raleigh Development Services Customer Service Center. For additional
        information please call 919-516-2495.


                           Day care Commercial Project Submittal
If your day care project is for a new building, addition, or change of use, you must call for an
appointment to bring your project in for gatekeeping. During this appointment, a Customer
Service Center representative will look at your drawings and check to make sure your submittal
meets the minimum requirements to begin the commercial review process. If the minimum
requirements are met, you will be assigned a transaction number and a projected completion
review date. If the requirements are not met, your plans will be returned and you will be told the
reason for the rejection of your plans. You will only be able to resubmit your plans after
satisfying the stipulated gatekeeping requirements.

All submittals for day care must include 4 SETS of bound plans, a completed Permit Application
with original signature(s), as well as required information regarding food service if your project
will be serving food. Also, include a copy of your proposed menu and cut sheets for the
proposed equipment for food service. All day care facilities that will be serving food must adhere
to Wake County Environmental requirements. Please contact Wake County at 919-856-7437 or
