                          REGULAR MEETING
                             JUNE 26, 2007


PRE-COUNCIL WORK SESSION

The Pre-Council Worksession was called to order by Mayor David L. Ragan at 6:30
p.m. in the Council Chambers of the Richland Hills City Hall to review items on the
agenda prior to the regular meeting.

Mayor Ragan called the meeting to order at 7:00 p.m., in the Council Chambers of
the Richland Hills City Hall, 3200 Diana Drive, Richland Hills, Texas.

1.   Call to Order

2.    INVOCATION/PLEDGES OF ALLEGIANCE

      The invocation was given by Councilmember Doug Bell

      Councilmember Phil Heinze led the Pledge of Allegiance to the United States and
      Texas flags.

3.    PRESENTATIONS/RECOGNITIONS -- Consider recognizing and presenting
      awards to the following:

      A) Mayor David Ragan to present five-year service award to Mr. Joseph
         Oujesky, Municipal Court Judge, Municipal Court.


4.   COUNCIL APPOINTED BOARDS

       At this time, the City Council considered resignations and appointments to the
       City’s boards, commissions and committees.

       MOTION:         A motion was made by Mayor Pro Tem Jeff Ritter for the
                       following:

                       Community Redevelopment Advisory Board, Place 1
                       -Kenny Davis

                       Public Transportation Advisory Board, Place 1
                       -Edward Lopez

       MOTION:         A motion was made by Councilmember Phil Heinze for the
                       following:

                       Animal Shelter Advisory Board, Place 5B
                       -Lynda Kelley

                       Parks and Beautification Advisory Board, Place 4
                       -J. Eric James

       MOTION:         A motion was made by Councilmember Don Acker for the
                       following:

                       Accept the resignation from Pat Jermyn from the Parks and
                       Beautification Advisory Board

                       -Tommy Miller

                       Baker Blvd. Task Force, Citizen Position
                       -Ed Schwarz

       MOTION:         A motion was made by Councilmember Larry Marrs for the
                       following:

                       Economic Development Advisory Board, Place 5

                       -Re-appoint Reta Boyle

       Mayor Ragan advised there being no objections, the individuals were duly
       appointed/re-appointed from said boards.

5.     HEAR STATUS REPORT PRESENTATION REGARDING RICHLAND
       HILLS ROCKS SPECIAL EVENT

       City Manager James Quin advised this item was for consideration of hearing a
       presentation of Ms. Judy Allen, and Alicia St. Cyr, Richland Hills Rocks
       members, regarding fund raising and progress toward holding the special event
       scheduled for Saturday, September 29, 2007.

       Ms. Judy Allen, Richland Hills Rocks committee member, reported that the
       committee has not secured enough sponsorship to cover the budget of the event.
       She advised that as of the June 14, 2006, committee meeting, the projected budget
       shortfall is $2,605.00.

       City Manager James Quin advised that City Council policy states that 90 days
       prior to the event, the City Manager shall stop all activities, if revenue is not in
       place for the event. Mr. Quin also stated that Council may want to waive the
       policy.

       Mayor Pro Tem Jeff Ritter, stated that he attended the Richland Hills Rocks
       meeting of June 14, 2007. Mr. Ritter stated that he had several corporations that
       he contacted about sponsorship, with corporate approval the amounts of
       $8,500.00 and $9,600.00, may be donated toward the event.

       Mayor Pro Tem Ritter moved to postpone the deadline to the July 10, 2007
       meeting. At that time, the Richland Hills Rocks Committee should know if there
       is enough sponsorship to proceed with the Rocks event.


6.     CONSIDER APPROVING AN ORDINANCE AMENDING CHAPTER 90
       OF THE CITY CODE REGARDING MASONRY EQUIPMENT IN
       VARIOUS ZONING DISTRICTS

       City Manager James Quin advised that this item was for consideration of the
       following:

       (A) Conducting public hearing regarding amending Chapter 90 of the City Code,
           as amended, the Comprehensive Zoning Ordinance of the City of Richland
           Hills, regarding masonry requirements in various zoning districts; and

       (B) Approving amending Chapter 90 of the City Code, as amended, the
           Comprehensive Zoning Ordinance of the City of Richland Hills, regarding
           masonry requirements in various zoning districts.

       Mayor Ragan opened the public hearing at this time.

       The Planning and Zoning Commission conducted a public hearing regarding
       amending Chapter 90 of the Comprehensive Zoning Ordinance concerning
       requirements for masonry construction in all districts, screening fences between
       residential and non-residential properties and definition or required masonry
       components of construction. The amended ordinance will allow tilt wall
       construction in commercial districts.

       OPPOSITION:           None

       Mayor Ragan closed the Public Hearing.

       Motion: A motion was made by Councilmember Phil Heinze, and seconded by
               Mayor Pro Tem Jeff Ritter to approve. Motion carried by a vote of 5-0.


7.     DISCUSS BROADCASTING PRE-COUNCIL MEETING

       City Manager James Quin advised that this item was for consideration to discuss
       the broadcasting of the Pre-Council Meeting.

       Councilmember Doug Bell advised that there is discussion before the regular
       meeting that the audience is not hearing because the pre-council is not televised
       on cable, and therefore he would like to see the Pre-Council broadcast to the
       public.

       Councilmember Phil Heinze stated that he would like to continue the meetings
       with the current procedure.

       Mayor Pro Tem Jeff Ritter stated the Council could eliminate the Pre-Council
       meetings all together.

       Councilmember Don Acker advised that he concurs, there is no need for Pre-
       Council and would see no problem with eliminating that meeting.

       The item will be moved to July 10, 2007 to eliminate the Pre-Council Meeting.


8.     EVALUATE GSBS ECONOMIC DEVELOPMENT CONTRACT

       City Manager James Quin advised this item was for consideration of making mid-
       term evaluation of GSBS Economic Development Contract as required by the
       agreement.

      Motion:     A motion was made by Councilmember Heinze, and seconded by
                  Councilmember Marrs to move this item to the end of the agenda items.
                  Motion carried by a vote of 5-0.


9.     APPROVE FY 2007-08 CRIME CONTROL AND PREVENTION
       DISTRICT BUDGET

       City Manager James Quin advised this item is for consideration to approve Fiscal
       Year 2007-08 Crime Control and Prevention Budget as recommended by the
       CCPD Board of Directors.

       City Manager James Quin advised this item needs to be tabled to the July 10,
       2007 meeting.

      Motion:     A motion was made by Councilmember Heinze, and seconded by
                  Mayor Pro Tem Ritter to table this item to the July 10, 2007 meeting.
                  Motion carried by a vote of 5-0.


10.   DIRECT THE CITY ATTORNEY TO PREPARE AN ORDINANCE
      IMPLEMENTING HOTEL OCCUPANCY TAX OF SEVEN PERCENT

      City Manager James Quin advised this item is for consideration to direct the City
      Attorney to prepare an ordinance implementing a hotel occupancy tax rate of seven
      percent.

      Motion:     A motion was made by Mayor Pro Tem Ritter and seconded by
                  Councilmember Heinze to approve. Motion carried by a vote of 5-0.

      Councilmember Heinze asked if the tax use is restricted.

      City Manager James Quin, advised that the revenue collected from hotel tax is used
      for a building that would promote tourism, to attract tourist to occupy the hotel. It’s
      defined in the state law.


11.    CONSIDER APPROVING REQUEST OF MR. OLIVER PETTIT TO
       PLACE DIORAMA ON DISPLAY IN PUBLIC BUILDING

      City Manager James Quin advised the following was for consideration to approve a
      request by Mr. Oliver Pettit to place a diorama on display in a public building.

      David Lankford, Lankford Construction, gave a presentation regarding log homes/
      buildings. Mr. Lankford reviewed the various construction materials used for a log
      building and answered Councilmembers questions.

      Oliver Pettit, stated he is here to answer any questions regarding his diorama that
      he would like displayed in the lobby of City Hall. Mr. Pettit went over the scheme
      of the building, materials, and grounds around the building.

      Mayor Pro Tem Ritter suggested the Board Room for the display, stating that the
      lobby is too crowded, especially with Court held on Thursdays of each week, and
      the diorama could be damaged if placed there.

      Councilmember Phil Heinze stated that a log cabin is not a type of building he
      would approve for the city. Mr. Heinze stated that displaying the diorama in the
      lobby, gives the impression that the city is giving their approval of the building,
      and suggested putting the display in the Library.

      Raymond Parr, 3716 Granada, spoke in support of Oliver Pettit’s request.

      Gerrit Spieker, 3401 Jonette, spoke in support of Oliver Pettit’s request.

      Councilmember Marrs stated that there was a lot of work that went into the making
      of the diorama.

      Gerald Page, 2915 Scruggs Park, spoke in opposition to this type of building in
      Richland Hills, and displaying the diorama in the lobby.

      Councilmember Acker stated he would like to see the diorama displayed at the
      Richland Hills Public Library

      Motion:     A motion was made by Mayor Pro Tem Jeff Ritter, and seconded by
                  Councilmember Don Acker, to put this before the Library Advisory
                  Board, and to request Mr. Pettit’s diorama to be on display in the
                  Library for a two- week period. Motion carried by a vote of 5-0.


12.    APPROVE AD VALOREM ASSESSMENT                              AND      COLLECTION
       AGREEMENT WITH TARRANT COUNTY

       City Manager James Quin advised this item was for consideration to approve an
       agreement with the Tarrant County Tax Assessor-Collector to collect taxes due
       and owing on taxable property upon which the City has imposed said taxes.

      Motion:     A motion was made by Councilmember Heinze, and seconded by
                  Mayor Pro Tem Ritter to approve. Motion carried by a vote of 5-0.

13.    APPROVE RESOLUTION SUSPENDING ATMOS INTERIM GRIP RATE
       ADJUSTMENT

       City Manager James Quin advised this item was for consideration approving
       resolution suspending the July 30, 2007 effective date of the proposal by Atmos
       Energy Corp., Mid-Tex Division to implement interim GRIP rate adjustments for
       gas utility investment for 2006 and authorizing participation with the Atmos
       Cities Steering Committee in a review and inquiry into the sufficiency of the rate
       filing.

      Motion:     A motion was made by Mayor Pro Tem Ritter, and seconded by
                  Councilmember Phil Heinze to approve. Motion carried by a vote of 5-
                  0.


14.    APPROVE CONTRACT AWARD FOR BAKER BOULEVARD TRAFFIC
       ANALYSIS

       City Manager James Quin advised this item was for consideration to approve an
       award of contract for the amount of $7,900 to Lee Engineering Co. to conduct a
       traffic analysis study in conjunction with CDA application for proposed Baker
       Boulevard construction project.

       Motion: A motion was made by Councilmember Phil Heinze, and seconded by
               Mayor Pro Tem Ritter to approve. Motion carried by a vote of 5-0.

15.    REMOVAL OF CONSENT AGENDA ITEMS

       There were no items removed from the Consent Agenda individual consideration.

16.    CONSENT AGENDA --

       City Manager James Quin presented the consent agenda as follows:

       A) Approval of Tuesday, June 12, 2007 Regular Meeting Minutes.

       Motion: A motion was made by Mayor Pro Tem Ritter to approve, and
               seconded by Councilmember Don Acker. The motion carried by a vote
               of 4-0 with Councilmember Heinze abstaining, due to his absence from
               the June 12, 2007 meeting.


17.    REPORTS/COMMENTS – Public and Council.

       Oliver Pettit asked that his diorama display be advertised in the next city
       newsletter.

       Mayor Pro Tem Ritter stated he would give a report at the next City Council
       meeting regarding the mosquito issue in the City.

       Councilmember Bell thanked everyone for coming to the meeting, in spite of the
       heavy rain.

       Councilmember Heinze stated this is a great opportunity for the library to have
       the diorama on display, and this gives young people a chance to see how a
       diorama is made.

       Councilmember Acker said he was happy to see all the young people interested in
       the Boards and Commissions and appreciated all the interest.

       Councilmember Marrs had no comment.

       Mayor Ragan thanked everyone for attending the meeting.

15.    EXECUTIVE SESSION

       Mayor Ragan recessed the Regular Session of the Richland Hills City Council at
       8:20 P.M. in order to enter into Executive Session.

       Section 551.071: Consultation with attorney

       The City Council may conduct a private consultation with its attorney when the
       City Council seeks the advice of its attorney concerning any item on this agenda,
       about pending and contemplated litigation, or a settlement offer, or on a matter in
       which the duty of the attorney to the City Council under the Texas Disciplinary
       Rules of Professional Conduct of the State Board of Texas clearly conflicts with
       Chapter 551. This includes the following pending and/or contemplated litigation
       subjects.


8.      EVALUATE GSBS ECONOMIC DEVELOPMENT CONTRACT

       City Manager James Quin advised this item was for consideration of making mid-
       term evaluation of GSBS Economic Development Contract as required by the
       agreement.

       Mayor David Ragan reconvened the regular meeting at 8:32 P.M.

       Jerry Plowman, 2733 Ash Park Drive, asked Councilmember’s to review the
       contract with GSBS with diligence.

       Gerrit Spieker, 3401 Jonette, advised Councilmember’s to be aware of integrity
       issues when reviewing the GSBS contract.

       Kenny Davis, 2701 Willow Park, stated he has worked with Marty Weider on
       various projects. He stated that Mr. Weider is passionate about the work that he
       does for the city, and is proud that he is representing the City of Richland Hills.


27.   ADJOURNMENT

      There being no further business to come before the City Council, Mayor David
      Ragan declared the meeting adjourned at 8: 43 P.M.
