Vendors are required to have a Texas State Sales and Use Tax permit clearly showing their tax ID posted in the booth at all times. Food
vendors are required to obtain a Tarrant County Health Permit and post in booth at all times.

                                     Rules and Regulations

                     Vendor fees are paid in advance and are non refundable.
                                Booths may not be sub-leased

   Settlers' Day Festival is an outdoor Western Heritage themed event.
   Inclement weather cancellation will be determined by staff on a day by day basis.
   Tents, tables and chairs will not be provided, however some vendor locations will have shade provided
    by trees or already standing awnings
   Vendors manning the booth must be 18 years of age or older.
   All booths will be outdoors.
   Vendor parking is limited to a designated area. This information will be sent to you in a vendor packet
    prior to the festival.
   Vendor vehicles must be moved from the vendor area during the festival times.
   Vendor tents must have fire retardant tag or fire retardant certification from manufacture.
   Fire inspections will be done throughout the festival.
   Vendors are responsible for cleanup of their area.
   Restrooms will be available for vendors and public.
   Deadline for vendor fee payment is October 1, 2009.
   Vendor shall conform to all statues, ordinances, rules, orders, regulations and directions issued by any
    authorized authority of the federal, state or city government.
   Event management reserves the right to remove or stop any vendor or vendor representative,
    performing any act or practice which the event management finds objectionable or detracts from the
    purpose of the festival.
   Vendor property brought to the festival by the vendor is at the sole risk of the vendor and is to be
    removed for the premises at specified move out time.
   Vendor assumes all responsibility and risks of loss and/or damages on site on in connection with
    transportation, display, storage and sale of merchandise.
   Security will be provided from 10 pm Friday until 7am Saturday.
   Painting, mixing of chemicals or explosive materials is not allowed at any time.
   The displaying and / or carrying of firearms are strictly prohibited except for contracted gunfighters
    and uniformed officers of the White Settlement Police Department and other local police agencies.
   Vendors wishing to display firearms must first receive approval from the City Marshall and Police
    Chief.
                                    Agreement of Liability Waiver
I hereby release, waive, discharge, covenant not to sue and agree to hold harmless for any and all purposes,
The City of White Settlement, Texas, its officers, employees, successors, assigns, sponsors and volunteers (
collectively "the City") from any and all liabilities, claims, demands, personal injury including death, or
property damage that may be sustained by me while participating in the First Annual Settlers' Day Festival,
including injuries or damages sustained as a result of the negligence of the City.
                                                   Venue
The Parties agree that if legal action is brought under this contract, exclusive venue shall lie in the Courts
of Tarrant County, Texas, and its terms or provisions, as well as the rights and duties of the Parties
hereunder, shall be governed by the laws of the State of Texas.
                                          Contract Agreement
I have read the General information regarding the 2009 Second Annual Settlers' Day Festival. By paying
the vendor fee, I have agreed to the conditions and terms of this contract. I understand payment must be
received with a completed agreement by October 1, 2009. I also understand that after October 1, 2009 a late
fee of $20 will be assessed. The late fee should be included with application if Vendor Agreement and
payment are not received by due date.

It is understood and agreed by applicant that this entire document constitutes a contract between Vendor
and the Second Annual Settlers' Day Festival only when festival management confirms this contract.
Confirmations may be mailed, faxed or emailed. Acceptance of money by Settlers' Day Festival is not
binding if fee is returned before acceptance and confirmation of this contract. Verbal agreements or
promises made verbally and not specifically stated and confirmed in writing, as part of this contract, will
not be binding.
