WORLD MASTERS GAMES – SYDNEY 11TH TO 18TH OCTOBER 2009 PRELIMINARY INFORMATION

Information has been published on the WMG website and has been circulating from the World Masters Games office regarding
the event next year in Sydney in October 2009. Although it is some time off we have noted that the Early Bird Offer for 15%
off the Games Competitor Registration Fee actually closes on Thursday, 31 July 2008 – yes that’s correct less than 3 weeks
time.

If you register as a competitor before 31 July 2008 you can take advantage of the Early Bird Offer of 15% off the Games
Competitor Registration Fee of AUD$220 – this is a saving of AUD$33 so you only pay AUD$187. Competitor registrations
made after 31 July 2008 up to close of entries on 31 July 2009 will cost AUD$220. There is no discount for the Accompanying
Person Fee of $110 so this can be paid at a later date – we are waiting for clarification from the Games Office on which
category non-playing officials and umpires fall into and will advise those affected separately if needed.

Please note we are advising our Redbacks members as a courtesy so that you can take advantage of the Early Bird discount if
you know you are going to be attending the 2009 WMG. This offer in no way guarantees how many teams we will field or
what the make up of teams will be as we are only in very early stages of organisation for the 2009 WMG. Participants will
have until 31 July 2009 to process their standard Registration Entry if they don’t want to worry about the Early Bird Discount.
More details regarding accommodation, umpire contributions and other info will be provided in newsletters later in the year
and, as with past events, we will endeavour to place all participants. In the event that we aren’t able to field enough teams,
participants will be able to transfer to alternate teams. Please note that there are rules regarding refunds if you change your
mind and decide not to attend are paying your registration and these rules can be found on the Games Website
www.2009worldmasters.com

SYDNEY WORLD MASTERS GAMES ORGANISING COMMITTEE
PRIVACY POLICY

INTRODUCTION
1. The Sydney 2009 World Masters Games Organising Committee (“SWMGOC”) was established by the
Sydney 2009 World Masters Games Organising Committee Act 2005 (NSW). The objective of SWMGOC as
set out in section 6 of this Act is “to plan, organise and stage the Sydney 2009 World Masters Games
(“Games”) in accordance with the obligations imposed, and the rights conferred, under the Host City
Contract (“HCC”).”

2. The protection of personal information is important to SWMGOC. SWMGOC is committed to respecting
the right to privacy and the protection of personal information.

3. SWMGOC’s privacy obligations are regulated by New South Wales legislation, including the Privacy and
Personal Information Protection Act 1998 (NSW) (“PPIP Act”) and the Health Records and Information
Privacy Act 2002 (NSW) (“HRIP Act”).

4. Personal information is information or an opinion (including information or an opinion forming part of a
database) from which it is possible to determine a person’s identity. Examples of personal information
include a person’s name, postal address, telephone number, email address, date of birth, fingerprints, body
samples or genetic information.

5. This Privacy Policy explains in general terms how SWMGOC manages personal information. It also
describes, generally the types of personal information held, purposes for which it is held, together with how
the information is collected, held, used and disclosed.

COLLECTION OF INFORMATION

When information is collected
6. Information will be collected by SWMGOC about a person in a number of ways, including, but not limited
to, when a person:
(a) views the SWMGOC website at www.2009worldmasters.com (“Website”);
(b) subscribes to any newsletter or publication produced by SWMGOC;
(c) subscribes to any SWMGOC electronic publication or mailing list;
(d) registers his or her interest to participate in the Games;
(e) registers, or is registered, as a participant in the Games;
(f) participates in the Games in any capacity (including as an official), and
(g) voluntarily provides their details in order to receive information from SWMGOC.

7. As well as collecting information directly from individuals, there may be occasions when SWMGOC will
collect information from third parties, such as other Games participants, team managers or national masters
sports federation representatives.

What information is collected
8. SWMGOC collect a range of information depending on the circumstances. Examples of the type of
information which may be collected are set out below. The primary purposes of collection of all information
are to:
(a) allow SWMGOC to conduct the Games; and
(b) assist SWMGOC in carrying out its obligations under the HCC.

9. SWMGOC requires the information to conduct the Games and provide its services, manage its relationship
with people and to communicate with people effectively.

10. In conducting the Games and carrying out its obligations under the HCC, SWMGOC must ensure that the
Games are organised and conducted “in the best possible manner which promotes and enhances the long
term interests of the masters sports movement”. In carrying out this obligation, SWMGOC must provide

information on all Games participants to the International Masters Games Association (“IMGA”), which is the
organisation that owns the Games. At the conclusion of the Games, SWMGOC will forward information on
all its participants to IMGA.

11. The information collected by SWMGOC about a particular person will vary depending on the
circumstances of collection. It may include, but is not limited to:
(a) a person’s name;
(b) email and/or postal address;
(c) telephone number;
(d) date of birth;
(e) home country;
(f) sporting organisation affiliations;
(g) gender;
(h) credit card details;
(i) communication history with SWMGOC;
(j) transactional information in respect of the use of SWMGOC services;
(k) health information;
(l) relevant qualifications;
(m) automatically recorded computer information;
(n) roles performed, or events entered, at previous masters games events.

12. SWMGOC will, before or as soon as possible after, collecting the information, take reasonable steps to
ensure that the persons concerned are aware of:
(a) the fact that the information has been collected;
(b) the purpose for which the information is collected;
(c) the intended recipients of the information, including the organisations or types of organisations to which
SWMGOC usually discloses information of that kind;
(d) whether the supply of information is required by law and any consequences if it is not provided;
(e) the existence of any right to access, or correct, the information, and
(f) SWMGOC’s details.

13. SWMGOC will take reasonable steps to ensure that the information collected is relevant to the purpose
for which it was collected, accurate, complete and up to date and that it does not intrude unreasonably into
the personal affairs of the person concerned.

SWMGOC WEBSITE VISITS
14. When people visit the Website, information technology systems may record certain information about
the person’s use of the site. This information may include, but is not limited to, Internet Protocol addresses,
server addresses, previous sites visited, date and time of visit and browser/operating system type.
SWMGOC aggregates this information to help analyse and improve the performance of the Website.

15. In addition, SWMGOC may use “cookies” on the Website. Cookies are small text files that help a
website to remember the preferences of visitors to improve the experience of using that website. Using
cookies is standard practice for most large websites. In some cases, cookies may collect some personal
information. SWMGOC will treat this information in the same way as other personal information.

16. Websites linked to the Website are not subject to SWMGOC’s privacy standards, policies or procedures.
These websites would need to be contacted or reviewed directly to determine their privacy standards,
policies and procedures.

17. SWMGOC can not take any responsibility for the collection, use, disclosure or security of any personal
information that individuals provide to a third party.

RETENTION AND SECURITY OF PERSONAL INFORMATION
18. SWMGOC stores information in different ways, including by paper and in electronic form. SWMGOC will
do everything reasonably within its power to ensure that information is kept securely. It will ensure that
information is retained for no longer than is necessary for the purposes for which it was obtained. Some of
the security measures SWMGOC may use include:

(a) confidentiality requirements of SWMGOC employees and service providers; and
(b) security measures for system access.

19. Where it is necessary for a person’s information to be given to a third party in connection with any of
SWMGOC’s activities, SWMGOC will do everything reasonably within its power to ensure the information is
disclosed or not used in an unauthorised fashion.

USING AND DISCLOSING PERSONAL INFORMATION
20. All personal information collected by SWMGOC is only available to those authorised individuals who need
to handle that information for the purpose for which it was collected.

21. In some circumstances, personal information may also be disclosed outside SWMGOC and outside
Australia. In such circumstances, SWMGOC will use its best endeavours to ensure such parties keep the
information confidential and do not use the information other than the purpose for which it is disclosed to
them.

22. For example, SWMGOC may disclose personal information to a range of third party organisations which
include, but are not limited to:
(a) IMGA;
(b) organisations involved in Games programs and initiatives in Australia;
(c) companies engaged by SWMGOC to provide services and carry out functions and activities on its behalf,
including uniform suppliers, sponsors, medical providers, mailing houses and other service providers;
(d) the sporting organisations engaged by SWMGOC to operate the various sports events staged during the
Games;
(e) professional advisers, including our accountants, auditors and lawyers;
(f) our insurers; and
(g) other organisations as required or authorised by law.

23. In addition to the circumstances described above, SWMGOC may also disclose personal information:
(a) when required by law;
(b) to an enforcement body when reasonably necessary; or
(c) to lessen or prevent a threat to an individual or public health or safety.

24. A person whose data is collected by SWMGOC will have the option to withdraw their consent to
SWMGOC’s use of this information by notifying SWMGOC in writing.

25. SWMGOC will not use information for a purpose other than that for which it is collected, unless:
(a) consent has been provided by the individual concerned; or
(b) the alternate use of the information is for a purpose that is directly related to the purpose for which the
information was collected; or
(c) SWMGOC believes that alternate use of the information is necessary to prevent or lessen a serious and
imminent threat to the life or health of the individual concerned.

26. SWMGOC will not disclose information to third parties unless:
(a) the disclosure is directly related to the purpose for which the information was collected, and SWMGOC
has no reason to believe that the person concerned would object to the disclosure; or
(b) the individual concerned is aware, or reasonably likely to have been aware, that information of that
particular kind is usually disclosed to that other person or body; or
(c) SWMGOC believes that the disclosure of the information is necessary to prevent or lessen a serious and
imminent threat to the life or health of the individual concerned.

ACCESS & CORRECTION
27. Access to an individual's own personal information held by SWMGOC is permitted, except as otherwise
provided under law, and will be afforded by SWMGOC without excessive delay or expense to the person
concerned.

28. If an individual wishes to access information held by SWMGOC, they should make a request in writing to
SWMGOC.

29. SWMGOC will take all reasonable steps to ensure that the personal information it collects, uses or
discloses is accurate, complete and up-to-date.

30. Personal information can be corrected, completed or updated by contacting SWMGOC. Note that in the
interest of protecting the privacy of all our customers, SWMGOC must properly identify the individual and as
such, SWMGOC may telephone the person or require current name and address and a form of identification
(such as a driver’s licence or passport) before access to information is provided.

31. In some limited circumstances, SWMGOC will allow a third party to access and correct information held
about an individual. For example, this may occur when a person (Person A) allows a third party (Person B)
to register them as a Games participant. SWMGOC will allow Person B (also being a Games participant) to
continue to have access to, and to update, the information provided about Person A. In these
circumstances, Person A will be informed of any access and updates provided by Person B and can notify
SWMGOC if they withdraw their consent to this access.

32. SWMGOC will assume, unless told otherwise, that any request for access to information relates to
current records. This will include the personal information which is held on database and files.

HEALTH INFORMATION
33. The HRIP Act defines “Health information”. This definition includes, but is not limited to:
(a) information or an opinion about the physical or mental health of a person, a health service provided to a
person, or an individual’s express wishes about the future provision of health services to him or her;
(b) information collected in providing a health service; and
(c) information collected in connection with the donation of an individual’s body parts, organs or body
substances.

34. SWMGOC may collect and use health information from time to time to ensure that the Games are
operated safely and in accordance with any special health needs our participants may have, and for
insurance purposes. SWMGOC will only collect health information that is relevant to the running of the
Games.

35. SWMGOC will treat the health information it is provided with in accordance with the “Health Privacy
Principles” set out in Schedule 1 of the HRIP Act.

36. SWMGOC may use health information to carry out research, to prepare submissions to government or
IMGA, or to plan events and activities, provided such health information has been aggregated or otherwise
de-identified so that it cannot be used to identify any individual.

RESOLVING PRIVACY ISSUES AND COMPLAINTS
37. Any issues or complaints in relation to the collection, use, disclosure, quality, security and access of
personal information, may be made to SWMGOC at the address below:

38. Any person who does not want SWMGOC use their personal information should put this request in

Terms and Conditions of Entry
I acknowledge and agree that for my application to participate in the Games to be accepted by SWMGOC, I
must agree to the following terms and conditions of entry. I acknowledge and agree that these terms and
conditions can not be amended. I acknowledge and agree that if my application to participate in the Games
is successful, I shall participate in the Games and Games Activities at my own risk and that SWMGOC
reserves the right to vary any aspect of the Games or Games Activities at any time and for any purpose.
Such variation may include, but is not limited to, varying the sports, events or applicable age groups that
comprise the Games Activities and/or rescheduling or cancelling any of the Games Activities. I acknowledge
and agree that I shall have no Claim against SWMGOC, IMGA or NSW Government for any loss suffered by
me due to such variation.

1. INTERPRETATION
In these terms and conditions:
"Claim" means and includes any action, suit, proceeding, claim, demand, damage, cost or expense however
arising including but not limited to negligence.
"Games" means the Sydney 2009 World Masters Games.
"Games Activities" means performing or participating in any capacity in any authorised or recognised Games
sport, event or activity.
"Images" means any photographs or electronic images and/or recordings
"IMGA" means the International Masters Games Association.
"NSW Government" means the Crown in right of the State of New South Wales.
"Rules" means the rules, regulations and policies of SWMGOC and the sport body organising any Games
Activities in which I participate as varied from time to time.
"SWMGOC" means the Sydney 2009 World Masters Games Organising Committee and its, committee
members, officers, employees, agents and volunteers.
"Third Party" means, where there is a transaction between two or more people or entities, any other person
or entity who does not have a direct connection with the transaction but who might be affected by it.
"WADA" means the World Anti-Doping Agency.

2. ENTRY
My application to participate in the Games may be accepted at the discretion of SWMGOC. In particular:
(a) I acknowledge that the closing date for entries into the Games is 31 July 2009 and if my entry is
received after this date I am unlikely to be eligible to compete; and
(b) I am aware that some sports may have a limit on the number of participants they can cater for and
SWMGOC reserves the right to accept entries in order of receipt, until the maximum number of entries is
obtained. I also acknowledge if insufficient entries are obtained age groups may be combined or events
cancelled.

3. FITNESS TO ENTER
I declare that I am medically and physically fit and able to participate in the Games and Games Activities. I
understand and accept that SWMGOC will continue to rely upon this declaration as evidence of my fitness
and ability to participate.

4. INJURY PROCEDURES
I acknowledge and agree that if I sustain any injury or illness while participating in the Games Activities, I
authorise SWMGOC to perform, administer or obtain any medical attention as deemed necessary by
SWMGOC. I acknowledge and agree that I am personally responsible for any expenses incurred as a result
of any such injury or illness, including expenses relating to transportation, hospitalisation, medical treatment
and any other related services or treatments performed or administered.

5. RULES
I agree to abide by the Rules and all written and verbal instructions as may from time to time be issued or
given by SWMGOC. I acknowledge and agree that if I fail to comply with the Rules or other instructions
issued by SWMGOC, I may be disqualified from the Games or any Games Activity. I agree, at all times, to
participate in the Games with fair play, sportsmanship and I will not engage in conduct prejudicial to the
good order, reputation, safety, security or discipline of the Games or SWMGOC.

6. WARNING
Games Activities can be inherently dangerous. I acknowledge that I am exposed to certain risks during
Games Activities including but not limited to:
(a) I may be physically or mentally injured, impaired, maimed or killed;
(b) other participants may act dangerously or with lack of skill;
(c) conditions may be hazardous and may vary without warning or predictability;
(d) organisers, officials, venue owners/operators and any agents or representatives of any of them, in
charge of an event may be obliged to make decisions under pressure of time and/or events;
(e) any policy of insurance in respect of my health or life may be voided;
(f) my property may be damaged, lost or destroyed.
I acknowledge that accidents can and often do happen which may result in me being injured or even killed,
or my property being damaged. I have read and understood this warning and accept and assume the
inherent risks in participating in the Games Activities.

7. EXCLUSION OF IMPLIED TERMS
I acknowledge that where I am a consumer of recreational services, as defined by any relevant law, certain
terms and rights usually implied into a contract for the supply of goods or services may be excluded. I
acknowledge that these implied terms and rights and any liability of SWMGOC, IMGA and/or NSW
Government flowing from them, are expressly excluded to the extent possible by law, by these terms and
conditions. To the extent of any liability arising, the liability of SWMGOC, IMGA and/or NSW Government
will, at the discretion of SWMGOC, IMGA and/or NSW Government, be limited to the re-supply of the
services or payment of the cost of having the services supplied again.

8. RELEASE AND INDEMNITY
In consideration of my entry to the Games being accepted, I, to the extent permitted by law:
(a) release and will release SWMGOC, the State Sporting Associations, IMGA and NSW Government from all
Claims that I may have or may have had but for this release arising from or in connection with my
participation in any Games Activities; and
(b) indemnify and will keep indemnified SWMGOC, the State Sporting Associations, IMGA and NSW
Government in respect of any Claim by any person arising as a result of or in connection with my
participation in any Games Activities.

9. INSURANCE
I acknowledge that any fees paid by me to SWMGOC do not include any personal accident insurance. I
acknowledge that SWMGOC, IMGA, NSW Government or any sporting organisation (whether state, national
or international) that is assisting SWMGOC with the conduct of the Event have not taken any responsibility
for approving, nor provided any advice about, the scope or adequacy of any insurance policy I may take
out.

10. AGE POLICY
I agree to comply with the stipulated age as outlined in the registration forms. I agree to provide
photographic proof of age when requested to do so by SWMGOC or its agents.

11. ANTI-DOPING POLICY
The use of WADA banned substances and methods by a competitor is prohibited during the Games. I
acknowledge and agree that SWMGOC (and its appointed agents) reserves the right to subject any
registered competitor, at any time, during the period of the Games to a test for the purpose of testing for
banned substances or methods as prescribed by WADA. SWMGOC recognises that some substances which
are banned by the WADA may be permitted on the provision of suitable medical evidence. Details regarding
the modified process to be implemented by SWMGOC shall be provided on SWMGOC's website on or about
1 January 2009.

12. MEDAL POLICY
I acknowledge that Gold, Silver and Bronze coloured non-precious metal medals will be awarded in all sports
events and age categories regardless of numbers of entrants, but subject to the competitor completing the
event within the Rules which, for the avoidance of doubt, includes all anti-doping rules. In the absence of
any rule set by the relevant International Sports Federation, SWMGOC will award medals for team sports up
to a number equal to double the total number 'on the field of play'. If SWMGOC determines it necessary to
collapse age categories in order to present viable competition, the awarding of medals will not be affected.

Placegetters in each age category will be presented with medals regardless of his/her placing within a
collapsed competition, unless the competition is determined by an elimination process.

13. USE OF IMAGES AND LOGO
I acknowledge and consent to images being taken of me during my participation in any Games Activities. I
acknowledge and agree that such Images are owned by SWMGOC and that SWMGOC may publish,
reproduce, edit and otherwise use (including authorising third parties, including but not limited to NSW
Government, to do the same) the Images for promotional or other purposes (including, but not limited to,
art, advertising, trade, visual documentary, merchandise or film coverage) without my further consent being
necessary. Further, I consent to SWMGOC using my name, image, likeness and also my performance in the
Games Activities, at any time, by any form of media, to promote SWMGOC or the Games. I also
acknowledge and agree to not make any unauthorised reproductions of the Games’ logo or use the
words "Sydney 2009 World Masters Games" or any variation thereof, on any form of merchandise,
promotional material, personal or team clothing, stationery, or other product.

14. REFUND POLICY
I acknowledge and agree that any application for refund of any fees paid to SWMGOC by me will only be
considered if it has been received prior to the closing date of entries noted above. All refund applications
must be in writing. An AUD50 administration fee will be deducted from any refund. I acknowledge and
agree that any refund granted to me will be at the sole discretion of SWMGOC.

15. PRIVACY POLICY
I understand that the information I have provided to SWMGOC is necessary for the objects of SWMGOC. I
acknowledge and agree that the information will only be used under the terms of the SWMGOC Privacy
Policy which can be viewed at the SWMGOC website www.2009worldmasters.com or a copy can be
requested by contacting SWMGOC.

16. GOVERNING LAW
These terms and conditions shall be construed in accordance with and governed by the laws of New South
Wales, Australia. Its form, execution, validity construction and effect shall be determined in accordance
with the laws of New South Wales and the parties submit themselves to the jurisdiction of the courts in that
state.

17. SEVERANCE
If any provision of these terms and conditions is invalid or unenforceable in any jurisdiction, the phrase or
clause is to be read down for the purpose of that jurisdiction, if possible, so as to be valid and enforceable.
If the phrase or clause cannot be so read down it will be severed to the extent of the invalidity or
unenforceability. Such severance does not affect the remaining provisions of these terms and conditions or
affect the validity or enforceability of it in any other jurisdiction.

I warrant that all information provided to SWMGOC is true and correct. I have read, understood,
acknowledge and agree to these terms and conditions including the warning, exclusion of implied terms,
release and indemnity.

18. THIRD PARTY REGISTRATION
Where I am nominating a Third Party to be a participant in the Games, I warrant that I am expressly
authorised to complete this entry on behalf of the Third Party that I am nominating. I also warrant that:

(a) the Third Party has authorised me to accept the SWMGOC terms and conditions of entry, including the
application of all Rules and SWMGOC's Privacy Policy as amended from time to time, on their behalf;
(b) I will provide the Third Party with a copy of these terms and conditions upon completion of this
registration process; and
(c) I will inform the Third Party that they will be deemed to have accepted these terms and conditions upon
participation in the Games Activities.
