Star Fund Applications
1. Williston Parks and Recreation – Master Plan
Rolfstad states the Williston Parks and Recreation is requesting a grant in the amount of up to $35,000 to
fund a master plan for the park district.
The Park District was going to use the funds from the sale of park property to pay for the master plan but
the Park Board decided not to sell the property.
Rolfstad states that it is the recommendation from the STAR Fund Board to grant up to $35,000 to the
Williston Park and Recreation for the master plan of the park district.

Klug asked how much money was given to the college, Rolfstad replied he thought it was $50,000 and
Bekkedahl commented that it was $42,500 or $45,000 and Bogar commented that he thought it was

2. Williston Area Development – Annual Budget Request
Rolfstad states the Williston Area Development Foundation has requested funds of $30,000 for the year
2011. This would provide 27% of the general budget requirements. This is the same amount requested
the previous year.
Rolfstad stated that the Williston Area Development Foundation is requesting an additional $35,000 to be
used to promote the continuation of marketing Williston along with using campaigns such as Rockin’ the
Bakken.
Rolfstad said the STAR Fund recommendation is to approve a grant to the Williston Area Development
Foundation $30,000 for the general budget and an additional $35,000 for promotional expenses for their
2011 fiscal year.

3. Theodore Roosevelt Expressway – Pledge Request
Rolfstad commented that the Williston City Commission became involved in the Great Plains
International Trade Corridor in 1998.
The TRE is a nonprofit corporation that has been established to represent the expansion of road from
Rapid City, South Dakota to the Port of Raymond, Montana.
Rolfstad states that in 2005, the TRE achieved Federal High Priority Status providing for the
reconstruction of US 85 of Grassy Butte to Long X Bridge near Theodore Roosevelt National park North
Unit to a super two-lane highway. In 2007, the TRE Association established a board of five members
from North Dakota, Montana and South Dakota and hired a permanent full-time Coordinator, Cal Klewin
who has been lobbying for funds needed for the project. The TRE is funded through memberships,
communities, counties, chamber of commerce offices, economic development corporations, private
businesses and grants. The funding is used to pay for the coordinator, needed to promote the trade
region, progress the development of the project and bring economic opportunities to the region.
Rolfstad states it is the STAR Funds recommendation to grant $25,000 to the TRE for 2011 and $25,000
for each additional year up to $125,000 subject to annual review by the STAR Fund Board.

Cal Klewin spoke to the Board on the history and progress of the TRE and Williston’s involvement in the
project.
Koeser commented that this year and next year the State is spending over $70 million on safety
improvements, Klewin replied it is $72 million now but was originally $60 million.

A. Board of Adjustments – Allowing a Mobile Home within the M-1: Light Industrial District
Jarcik stated the Planning and Zoning Commission heard an appeal on October 18, 2010 from Mr.
Herman on a mobile home residential unit on the property located on the west side of 2/85 North of 47 th
Street and adjacent to the WISCO property on the sough side. Mr. Herman states this mobile home is
for his daughter and grandson and there wasn’t anywhere else to place the mobile home. Mr. Herman is
asking for an emergency basis for a year or two.
Jarcik stated the Planning Commission did not feel comfortable designating a specific time frame for the
removal of the residential unit and felt it should be forwarded to the City Commission for consideration for
further decision.
President Koeser opened the hearing.
Richard Ryan’s property is west of the property in question. Ryan commented that the road has been
maintained by both him and Mr. Herman for the past 17 years and feel Mr. Herman deserves to have a
place for his daughter to live and commented that affordable housing is hard to find. Ryan commented
that he is in favor of the trailer to be in place for a minimum of two years and states he doesn’t feel that
six months is enough time to find another place for the mobile home.
December Herman, daughter of Mr. Herman, states that she had moved back to Williston in February
and when they talked about buying the mobile home Cimmaron Heights wasn’t open and although Sand
Creek was open they wouldn’t accept the trailer due to its age and she wasn’t able to afford what Sand
Creek had to purchase and there were no spaces available in the other trailer parks.
Herman states she is a single mother of two, five year old and a three-month old and repaying student
loans and she has found housing too expensive for her in her situation. Herman states she isn’t living in
the trailer yet.
Bekkedahl asked if the trailer is located near chemicals or storage tanks, Herman replied no but there
are propane tanks but they are empty and for sale.
Joe Bush commented owning the property across from the mobile home for 44 years and with all the
restructuring and rezoning that is going on he is concerned with. He states in 44 years he has never

received a letter from the Commission, City or County that the property has been rezoned M1. Bush
says as far as the mobile home in the area that is the least of his concerns and feels two years will not be
a problem.
Koeser asked for any public input.

Cymbaluk asked Richard Ryan what they are doing with the County in regards to this issue, Ryan replied
he is here as a resident not as a County Representative but states they do not allow housing in industrial
areas however they can get a conditional use permit to apply for temporary housing in an industrial area
that varies one to two years depending on the condition.
Koeser asked for a third and final time for public input. Hearing none the hearing was closed.
Koeser states the Commission has several options for this request to allow the housing for two years and
the Commission can allow it for a period of time or it can be denied. Koeser states if this is going to be
allowed there should be a time limit.
Bekkedahl commented that this isn’t in the City limits but it is within the one-mile jurisdiction of planning
and zoning, Koeser replied correct. Bekkedahl asked if the Commission accepts any responsibility or
liability by approving this request whether it being outside the City limits or would it be treated as if it were
within the City limits, Furuseth replied it would be treated as if it were within the City limits. Furuseth
commented if it is approved there is liability with it, Bekkedahl asked if there was a way to approve it with
a waiver of liability, Furuseth replied no.
Bekkedahl asked if there is a way to make sure the property does not have hazardous materials or
dangerous chemicals within a certain perimeter of the facility, Furuseth replied that would be a
reasonable request. Bekkedahl asked December Herman if she felt her father would have any issues
with the request, Herman replied no.
Klug commented that the Commission is going to have to make a decision on how long they are going to
allow trailers in construction areas and in other areas throughout the City.

not to exceed two years.
Bogar suggested amending the motion in that if Ms. Herman were to find other housing Mr. Herman is not
to rent out the trailer to another individual.

1. WWTP Alternatives
Meiers states there was an aerial drawing and cost estimate to construct additional stabilization ponds in
the area next to the WWTP. There was a meeting with Commissioner Bogar and Klug and thought the
alternative allows the ability to phase the development and still get over an additional 5,000 population
equivalent in treatment capacity.
Meiers stated that Phase I would be constructing all the ponds except for the east pond since it is
privately owned. This would cost approximately $11.5-$14.5 million depending upon if synthetic liners
are needed or not. The option would serve approximately 5,500 additional in population and could be
utilized to be phased into future aeration ponds if population growth increases substantially.
Meiers commented that if the Commission agrees to this alternative and approve the geotechnical survey
agreement with AE2S to start acquiring preliminary design dates and instructing them to submit an
engineering agreement based on this alternative design option.
Meiers said the City is at a 95% capacity and with the growth he expects by next year the City will be
exceeding the capacity and be non-compliant.
Koeser asked if this was to move forward could this be completed next fall, Meiers replied there are
environmental issues but the hope is that it could be done by then.

2. Engineering Amendment Agreement #1
Meiers states Schlumberger is requesting the City to consider providing sewer/water services to their
development area and be able to do them to meet their construction time table. If the City agrees then
amendment #1 will need to be approved for the engineering services so aerial topography and utility
services can be done prior to snow accumulation.
Kautzman suggested pursuing two possible annexations: 1) Schlumberger’s request to accommodate
them and 2) at the same time pursue a secondary annexation which could subject itself to a protest and
go in front of the administrative law issue which could delay the Schlumberger’s request.
Meiers suggest having an engineering consultant to provide the City with a more preliminary engineering
report of what the costs would be.
Meiers suggested tabling this issue at this time.

project manager for the projects and he recommends Wiedrich be appointed this year.

paid $102,600 for a new truck and hook plus a quote of approximately that same price for just the
truck/chasis for a 2011 freightliner next year. Meiers feels this would be a good cost savings and is
asking permission to purchase this refuse truck.

Marburger received a letter of intent from Glen Kroshus dba G & B Rentals to open a rental car agency
at the Williston airport and the interested party has placed a $500 deposit down on the space. Marburger
states the party is in negotiations to secure one of the nationally known franchises and expects to close
that negotiation in the next few weeks.
Marburger’s recommendation is to hold onto the check as a deposit for the use of the space contingent
upon that within 30 days he signs the agreement with the national franchise. At that point the lease can
be written and the Airport committee would have to look at it. The lease is $500 per month and 5% of the
gross revenue.
