APPLICANT REQUESTS THAT:

His Air Education and Training Command (AETC) Form 126A, Record of
Commanders Review Action, dated 16 April 2001, be changed to
reflect “BE CONSIDERED FOR REINSTATEMENT IN THIS COURSE AT A LATER
DATE.”

STATEMENT OF FACTS:

On 20 May 2003, the applicant's original request was considered
and denied by the Board. For an accounting of the facts and
circumstances surrounding the applicant’s request and the
rationale of the earlier decision by the Board, see the Record of
Proceedings at Exhibit F.

On 4 September 2004, he requested reconsideration based on new
evidence.   On 22 April 2005, the Board considered and again
denied his request.       For an accounting of the facts and
circumstances surrounding the applicant’s request and the
rationale of the earlier decision by the Board, see the Record of
Proceedings at Exhibit J.

On 7 May 2006, the applicant again requested reconsideration of
his appeal and provided a copy of a similar case considered by
the AFBCMR wherein the applicant had been granted similar relief
to what he was asking for and several letters of support.

Applicant’s submission, with attachments, is at Exhibit K.

THE BOARD CONCLUDES THAT:

After again reviewing the evidence of record to include a letter
from his SUPT deputy commander recommending he have the
opportunity to be reinstated to SUPT, a majority of the Board is
of the opinion sufficient relevant evidence has been presented to
demonstrate the existence of an error or an injustice warranting
a change to the applicant’s AETC 126A. While we considered his
request to be reinstated directly into SUPT training; we believe
that because of the period of time since his elimination from
training and the rigorous nature of military flight training
programs, it would be in the best interest of the Air Force and
the applicant that he should be provided another opportunity to
compete, and if accepted, be granted an age and total active
service federal commissioned service waiver. Therefore, a
majority of the Board recommends his record be corrected as
indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air Force
relating to applicant be corrected to show that:

     a. AETC Form 126A, Record of Commanders Review Action,
Section III, reflects “BE CONSIDERED FOR REINSTATEMENT IN THIS
COURSE AT A LATER DATE.”

     b. If accepted by a sponsoring flying unit and selected for
JSUPT, he be granted age and total active federal commissioned
service waiver.

The following members of the Board considered this application in
Executive Session on 11 December 2006, under the provisions of
AFI 36-2603:

By a majority vote, the Board voted to partially grant the
request. Ms. Boockholdt voted to deny the request but does not

        MEMORANDUM FOR THE CHIEF OF STAFF

               Having received and considered the recommendation of the Air Force Board for
        Correction of Military Records and under the authority of Section 1552, Title 10, United States
        Code (70A Stat 116), it is directed that:

             The pertinent military records of the Department of the Air Force relating to
        APPLICANT, be corrected to show that:

                  a. AETC Form 126A, Record of Commanders Review Action, Section III, reflects
        “BE CONSIDERED FOR REINSTATEMENT IN THIS COURSE AT A LATER DATE.”

                       b. If accepted by a sponsoring flying unit and selected for JSUPT, he be granted an
        age and a total active federal commissioned service waiver.
