 AN ORDINANCE GRANTING A VARIATION TO ALLOW AN ELECTRONIC MESSAGE BOARD
       SIGN AND A VARIATION TO ALLOW AN ADDITIONAL MENU BOARD SIGN
                 FOR CHICK-FIL-A LOCATED AT 935 E. GOLF ROAD
                              CASE NO. Z1106-03

        WHEREAS, the Zoning Board of Appeals of the Village of Schaumburg conducted a public
hearing on June 29, 2011 to consider a request for granting a, Case No. Z1106-03; and

        WHEREAS, the Zoning Board of Appeals has recommended the approval of a Variation to Allow
an Electronic Message Board Sign and a Variation to Allow an Additional Menu Board Sign For Chick-fil-
A Located at 935 E. Golf Road; and

         WHEREAS, the President and Board of Trustees of the Village of Schaumburg have determined
that the granting of a Variation to Allow an Electronic Message Board Sign and a Variation to Allow an
Additional Menu Board Sign For Chick-fil-A Located at 935 E. Golf Road, is desirable to provide a service
or a facility which is in the interest of public convenience, and is in the best interest of the Village;

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF SCHAUMBURG:

        SECTION ONE: That said Variation to Allow an Electronic Message Board Sign in accordance
with Title 15, Chapter 155.50(E) of the Sign Ordinance and Variation to Allow an Additional Menu Board
Sign in accordance with Title 15, Chapter 155.95(B)(1)(b) of the Sign Ordinance, be and is hereby granted
on the property legally described as:

       Parcel 1:
       Lot 1 in American Commons Subdivision, a Resubdivision of Lots 1 and 2 in Anderson’s
       Woodfield Commons West, being a Subdivision of part of the Northeast ¼ of Section 14,
       Township 41 North, Range 10, East of the Third Principal Meridian, in Cook County
       Illinois.

       Parcel 2:
       Non-exclusive easement for ingress and egress and parking for the benefit of Parcel 1
       created and granted by reciprocal parking easement by and between Chi-Chi’s, Inc., a
       Minnesota Corporation, and Bob Evans Farm Inc., an Ohio Corporation, dated May 10, 1983
       and recorded May 13, 1983 as document 26604303 over the access drives and parking areas
       described as follows: Lot 2 in American Commons Subdivision, a resubdivision of Lots 1
       and 2 in Anderson’s Woodfield Commons West, being a Subdivision of part of the Northeast
       ¼ of Section 14, Township 41 North, Range 10, East of the Third Principal Meridian, in
       Cook County, Illinois.

       Parcel 3:
       Easement for the benefit of Parcel 1 created and granted by easement in favor of Bob Evans
       Farms, Inc., for underground storm sewer purposes and the provisions relating thereto
       contained in the Document recorded as Document no. 26626383, affecting the 10 foot wide
       portion of lot 2 shown on exhibit A. First Amendment to easement agreement recorded
       March 24, 1999 as Document 99282673.

        SECTION TWO: That said Variation to Allow an Electronic Message Board Sign and a Variation
to Allow an Additional Menu Board Sign For Chick-fil-A Located at 935 E. Golf Road, be and it is hereby
granted subject to compliance with the following conditions:

1. The electronic message board sign shall not move, flicker or flash.
2. The gross surface area of both menu boards shall not exceed 30 square feet.
3. The following plans/exhibits for the sign shall be adopted as part of the governing ordinance:
   a. Site Plan, Internally Illuminated Menu Canopy Plans, and Internally Illuminated Drive-Thru Menu,
      prepared by Clayton Signs, dated March 31, 2010, and received by the Community Development
      Department on June 10, 2011.

       SECTION THREE: This ordinance shall be in full force and effect from and after its passage,
approval, and publication in pamphlet form and posting in the manner provided by law.
