                 Basel Convention noted with appreciation the Government of Indonesia’s interest in hosting
                 the ninth meeting of the Conference of the Parties to the Convention (“COP 9”). The
                 Conference of the Parties requested the Executive Secretary to enter into consultations with the
                 Government of Indonesia with a view to agreeing on satisfactory arrangements and concluding
                 a host country agreement for hosting COP 9.

        II.      Implementation
                 2.       In November 2007, following consultations with the President, the Executive
                 Secretary initiated a dialogue with the Government of Indonesia, as the host country of COP 9,
                 on the possible theme, which could address linkages between waste management and human
                 health.
                 3.       Having received the approval of the host country, the Executive Secretary transmitted
                 a request for guidance to the members of the Expanded Bureau on the proposed theme, as well
                 as on possible milestone activities related to the Basel Convention, which could be linked to

               the forthcoming meetings of the COP. The text of the letter transmitted to the members of the
               Expanded Bureau is attached in Annex I for ease of reference.
               4.      The Executive Secretary also initiated consultations with the Government of
               Indonesia on the possible organization of the meeting. Annex II to the present note contains
               proposals for the organisation of COP 9. The Secretariat will provide an oral presentation to
               the Expanded Bureau on the format in which the theme could be addressed at a special event
               during COP 9.
               5.       The Secretariat will report orally on progress made with respect to the conclusion of a
               host country agreement.

       III.    Proposed action
               6.       The Expanded Bureau is invited to provide guidance to the Secretariat on the theme
               of the meeting and on the proposed milestone activities. The Expanded Bureau is also
               requested to provide guidance to the Secretariat on the organisation of COP 9, in particular on
               whether a technical level working group or a Committee of the Whole should be convened to
               undertake the technical level negotiations at the meeting.

Annex I
Extract from request for guidance transmitted by the Executive
Secretary to Members of the Expanded Bureau in January 2008

     “Dear Members of the Expanded Bureau,
     Proposed theme of the ninth meeting of the Conference of the Parties to the Basel
     Convention
     I write with reference to the Conference of the Parties to the Basel Convention (“COP 9”),
     scheduled to be held from 23 to 27 June 2008, and which the Government of Indonesia has
     kindly offered to host. The purpose of this letter is initiate consultations on the proposed theme
     of COP 9, “Waste Management for Human Health”.
     I have consulted the Government of Kenya, the current Presidency, and the Government of
     Indonesia as the host of COP 9, on the proposed theme of COP 9, and have received
     preliminary approval of the theme. Thus, I now seek the guidance and views of the members
     of the Expanded Bureau on the proposed theme, having regard to the role of the Expanded
     Bureau, as described in decision VI/36, to, among other things, “provide guidance and advice
     to the secretariat on the preparation of agendas and other requirements for the organization of
     meetings and on any other matters brought to it by the secretariat in the exercise of its
     functions”.
     The proposed theme was identified by the Secretariat because it is considered that this will
     highlight the fact that the failure to ensure environmentally sound management of waste has a
     clear causal relationship with disease and death. This relationship might be best illustrated in
     considering the implications on the health of persons with no other means but to live in the
     vicinity of uncontrolled waste deposits. It is evident that this is a serious problem affecting all
     regions of the world, to which insufficient attention has been paid. Such a theme would also
     serve to establish a nexus with wider high-level discussions within the United Nations system
     and in other fora on the interlinkages between health and the environment, and would lay the
     ground for new avenues for resource mobilization to be explored.
     I am writing to seek your views on the proposed theme, and to invite you to initiate
     consultations amongst your regional groups on these ideas. I would very much appreciate it if
     you could provide me with any preliminary comments and suggestions that you may wish to
     make in advance of the Expanded Bureau by e-mail (katharina.kummer@unep.ch) or by
     telephone (+ 41 22 917 8213). Should there be support for the proposed theme, there will be a
     need to investigate concrete ways in which the Conference of the Parties could address the
     theme. Your views on this will also be very much appreciated.
     I also take this opportunity to advise you of proposals for possible milestone activities related
     to the Basel Convention which have also been submitted to the President, and to the
     Government of Indonesia. I shall be seeking your comments and guidance on these proposals
     during the forthcoming meeting of the Expanded Bureau. The proposed milestone activities are
     as follows:
          As you are aware, March 2009 will mark the 20th anniversary of the adoption of the              Formatted: Bullets and Numbering
           Convention. It might be appropriate, therefore, to commemorate this important occasion
           with an event which would heighten the visibility of issues related to waste management.
           Such an event could also provide an opportunity to consider past successes and future
           challenges of the Convention, in an informal setting, and serve to heighten public
           awareness of the Convention. The Secretariat has initiated informal consultations with
           the Swiss Government on the possibility of holding this event in Basel.
          As the Strategic Plan for the Implementation of the Basel Convention covers the period
           to 2010, it has been suggested that the tenth meeting of the Conference of the Parties
           might focus on a follow-up strategy which would set the direction and priorities of work
           for the next decade.

                    Furthermore, it has been suggested that, as 2012 will mark the 20th anniversary of entry
                     into force of the Convention, this might be an opportune moment to convene a review
                     conference. If this is considered an appropriate occasion, a mandate to commence a
                     review process might be initiated at COP 9, which would conclude at the eleventh
                     meeting of the Conference of the Parties in 2012.
                    In order to mark the 20th anniversary of entry into force of the Convention, 2012 might
                     be set as a target to resolve the issues surrounding the Ban Amendment, which have long
                     been on the Convention’s agenda. Should there be support for this approach, there would
                     be a need for careful preparation and intensive consultations in the coming years. It has
                     been suggested that such consultations could be initiated at an informal Ministerial lunch
                     during COP 9. This could be chaired by the Executive Director of UNEP, who has
                     confirmed his intention to be present at COP 9.
               I would be grateful to receive views on the foregoing and, in particular, on the proposed theme.
               I look forward to meeting you all at the next meeting of the Expanded Bureau.”
