INVITATION TO BID
The City of Birmingham, Michigan is accepting sealed bids for a CCTV SECURITY
SYSTEM FOR THE DEPARTMENT OF PUBLIC SERVICES AND POLICE DEPARTMENT
until Friday, April 11, 2003 at 10:00 a.m. in the office of the city clerk, 151 Martin
Street, Birmingham, Michigan, 48012.

on the attached form(s). Failure to do so may disqualify your offer.
All information shall be entered in ink or typewritten. Mistakes may be crossed out

CCTV SECURITY SYSTEM FOR THE DEPARTMENT OF PUBLIC SERVICES
The City of Birmingham is accepting sealed proposals from qualified vendors for the
installation of a CCTV system for the Department of Public Services (DPS) and
Police Department. This system will incorporate eight cameras at the DPS facility,
and monitoring equipment will also be located at the police department. System
specifications may be obtained by contacting the Birmingham Police Department,
Services Division, at (248) 644-1800, ext. 345. Questions regarding the placement
of the cameras should be directed to (248) 644-1807.
It is the intent of the City of Birmingham, Michigan to procure the services of a
professional, established, and reliable vendor for this project. One component of
this project involves the transfer of the existing digital recorder (DVR) from the
police department to the DPS. A Pelco 3116 will be installed in the police
department, to provide for sufficient retention of archived video recordings. Access
to the police department communications center and equipment will only be
granted to contractors / installers who possess an extremely strong knowledge of
all of the existing systems in the communications center. Criminal record checks
may be conducted on individuals accessing secure areas within the police

3. Total bid amount must also include all miscellaneous wire, cable, hardware,
jumpers, cable BNC connectors, mounting equipment, power supplies,
conduits, router and labor.
Bid to include training costs associated with this system. Employees to be
trained include Department of Public Services administrative staff, and Police
Department administrative and dispatch staff.
Underground directional boring may be required at the DPS facility. Bid
amount must include these charges.
Interior and exterior cameras must provide excellent clarity in all lighting
conditions. 30 day post installation system acceptance period (prior to
payment) will include stringent review of live monitor and playback under all
conditions (light, dark, rain, etc.)
The contractor shall procure and maintain during the term of the contract the
insurance coverages outlined below. All coverages shall be with insurance
companies licensed and admitted to do business in the State of Michigan. All
coverages shall be with insurance carriers acceptable to the City of Birmingham.
a. Workers' Compensation Insurance: The contractor shall procure and
maintain during the life of the contract, Worker's Compensation
Insurance, including Employers Liability Coverage, in accordance with
all applicable statutes of the State of Michigan.
b. Commercial General Liability or Garage Liability Insurance: The
contractor shall procure and maintain during the life of the Contract,
Commercial General Liability or Garage Liability Insurance on an
"Occurrence Basis" with limits of liability not less than $1,000,000 per
occurrence combined single limit, Personal Injury, Bodily Injury, and
Property Damage. Coverage shall include the following extensions:
(A) Contractual Liability; (B) Products and Completed Operations; (C)
Independent Contractors Coverage; (D) Broad Form General Liability
Extensions or equivalent.
c. Motor Vehicle Liability Insurance: The contractor shall procure and
maintain during the life of the Contract, Motor Vehicle Liability
Insurance, including Michigan No-Fault Coverages, with limits of
liability not less than $1,000,000 per occurrence combined single limit
Bodily Injury and Property Damage. Coverage shall include all
owned, non-owned, and hired vehicles.
d. Additional Insured: Commercial General Liability, Garage Liability,
Garage Keeper's Liability, and Motor Vehicle Liability Insurance, as
described above, shall include an endorsement stating the following

the Additional Insureds, and not contributing with other insurance or

e. Cancellation Notice
Workers Compensation Insurance, Commercial General Liability
Insurance, Garage Liability Insurance, Garage Keeper's Liability, and
Motor Vehicle Liability Insurance, as described above, shall include an
endorsement stating the following: "It is understood and agreed that

g. Insurance Certificate to be Submitted with Bid
The contractor shall submit a copy of their standard insurance
certificate, included with their bid, to the City of Birmingham.
h. Proof of Insurance Coverage: The Contractor shall provide the City
of Birmingham at the time the contracts are returned for execution,
Certificates of Insurance and/or policies, acceptable to the City of
Birmingham, as listed below.
1. Two (2) copies of Certificate of Insurance for Workers'
2. Two (2) copies of Certificate of Insurance for Commercial
3. Two (2) copies of Certificate of Insurance for Vehicle Liability
4. If so requested, Certified Copies of all policies mentioned
above will be furnished.
i. If any of the above coverages expire during the term of this contract,
the contractor shall deliver renewal Certificates of Insurance to the
City of Birmingham at least ten (10) days prior to the expiration date
The contractor agrees to the fullest extent permitted by law to defend, pay on
behalf of, indemnify and hold harmless the City of Birmingham, its elected and
appointed officials, employees and volunteers and others working on behalf of the
City of Birmingham against any and all claims, demands, suits or loss, including all
costs connected therewith, and for any damages which may be asserted, claimed
or recovered against or from the City of Birmingham, its elected and appointed
officials, employees, volunteers or others working on behalf of the City of
Birmingham by reason of personal injury, including bodily injury and death and/or
property damage, including loss of use thereof, which arises out of or is in any way
connected or associated with the contract.
6. Settlement of Disputes
Any disputes arising under the contract shall be settled either by commencement of
a suit in Oakland County Circuit Court or by compulsory arbitration, at the election
of the city. If the contractor feels aggrieved, they shall advise the city of any
dispute they have arising out of the contract and shall demand that the city elect
whether the dispute is to be resolved by submitting it to compulsory arbitration or
by commencement of a suit in the Oakland County Circuit Court or any other court
having jurisdiction. The city shall make its election within thirty (30) days from the
receipt of such notice. If the city elects to have the dispute resolved by compulsory
arbitration, it shall be settled pursuant to Chapter 50 of the Revised Judicature Act
for the State of Michigan, with each of the parties appointing one arbitrator, and
the two thus appointing a third. The Oakland County Circuit Court or any court
having jurisdiction may render a judgement upon the award of the arbitrators. In
the event that the city elects not to have the matter in dispute arbitrated or fails to
make such an election, any dispute between the parties may be resolved by the
filing of a suit in the Oakland County Circuit Court. In the event that the city feels
aggrieved, it shall elect the method of resolving its dispute by either demanding
that the matter be arbitrated or by filing a suit in the Oakland County Circuit Court.
7. Conflict of Interest
The City of Birmingham will not enter into a contract to furnish materials or
services to the city from any city official, his spouse, child or parent, or from any
corporation, association or partnership in which any city official, his spouse, child or
parent, has any direct or indirect interest.
Ownership of less than one percent (1%) of the stock or other equity interest in a
corporation or unincorporated business shall not be deemed to be a disqualifying
Every contract entered into by the City of Birmingham shall contain a provision to
the effect that if subsequent to entering into the contract a city official, his spouse,
child or parent shall become directly or indirectly interested in the contract, the city
shall have the right to terminate the contract without further liability if the
disqualification has not been removed within thirty (30) days after the city has
given notification of the disqualifying interest.
8. Obligation to Execute Contract
The bidder whose proposal is accepted will be required to execute the contract
within ten (10) days after receiving notice of such acceptance; and in case of
refusal or failure to do so, shall be considered to have abandoned all their rights
and interests in the award.
The contractor shall, when applicable, comply with the requirements of all Federal,
State, and local laws and ordinances and regulations relating to minimum wages,
social security, unemployment compensation insurance, and Worker's
Compensation, and shall not discriminate against any employee or applicant for
employment because of race, sex, creed, color, or national origin.
There shall be no change, modification, or alteration of the agreement, except in
writing, signed by both of the parties. Neither party shall assign any of the rights
under the agreement without prior approval, in writing, of the other.
