Dear Sirs,

I am writing to you today to request that you pay back all default charges applied to my account during
the previous six years from the date of this letter. I believe that the charges applied to my account do
not truly reflect the cost, to [NAME OF YOUR BANK], of going into an unauthorised overdraft.

It has been calculated that the default charges applied to my account amount to £[TOTAL CHARGES].

Additionally, because I believe that I have been unlawfully deprived of this money, interest has been
calculated on the above amount at the statutory rate (the amount the court will award) to a value of
£[TOTAL INTEREST].

I am therefore requesting that you repay to me the full amount of the total sum £[TOTAL CHARGES +
TOTAL INTEREST]. Please find attached details of these charges and the interest applied to them for
your reference. [Details should include when each charge was made and interest calculated from date
of payment to date of this letter at 8% per year (without compounding). Keep a copy of this for your
records]

[Keep this section in if you are reliant upon income based benefits (such as Jobseeker’s
Allowance/Income Support etc.) as your income or DELETE if this doesn’t apply]
I ask that you deal with my case immediately, rather than at the end of the ongoing test case, because I
rely on means tested benefits for my income. The Social Security Administration Act 1992 states that
charges should not be recovered from means tested benefits because the amount of benefit awarded
has been determined, by the government, to be the minimum amount of money the benefit claimant
needs to live on.

[Keep this section in if you are currently experiencing financial difficulties or DELETE if this doesn’t
apply. NOTE: If you tell the bank that you are in financial difficulty they may ask you to provide proof
of this]
I ask that you deal with my case immediately, rather than at the end of the ongoing test case, because I
am currently experiencing financial difficulties as a result of [SELECT FROM: disability / serious illness / a
loss of employment / a relationship breakdown / imprisonment / starting work in a lower paid job /
starting full-time education / needing to take parental care leave / etc.] and the FSA waiver stipulates
that you must continue to deal with hardship cases.

I look forward to a full response to this letter within the next 14 days.

Yours Faithfully,
