RESIDENTIAL MORTGAGE FORECLOSURE MEDIATION PROGRAM
RECOMMENDATION FOR BORROWERS
It is a good idea to contact your lender and submit your documents at least 4 – 6 weeks prior to
mediation in order that enough time is given for review. If you are unsure of who your representative is,
refer to your Notice of Foreclosure and you will find the firm and attorney’s information on the front of
the document. Contact the firm and ask who is attending to your file. Send all your documents via
recordable means such as certified mail, fax confirmation or e-mail confirmation. These documents are
often misplaced and you will need proof of receipt.
PLEASE NOTE THAT IF THERE ARE OTHER PARTIES THAT SIGNED THE NOTE BUT ARE NOT NAMED IN
YOUR FORECLOSURE OR THEY ARE NAMED BUT ARE NOT AVAILABLE YOU MUST BRING IT TO THE
LENDER’S ATTENTION BEFORE MEDIATION AND THESE PEOPLE MUST ATTEND MEDIATION.
You must show proof that you reside in the property.
IF YOU HAVE AN ATTORNEY OR HAVE EVER HAD ANY DOCUMENTS FILED ON YOUR BEHALF FOR THIS
CASE BY AN ATTORNEY, THIS ATTORNEY MUST ATTEND MEDIATION WITH YOU OR PRESENT A
WRITTEN WAIVER OF HIS PRESENCE TO OPPOSING COUNSEL WHICH MAY OR MAY NOT BE APPROVED
BY OPPOSING COUNSEL.
Ask your attorney or your lender’s attorney about financial counseling prior to mediation. This is usually

You may request from your lender information related to the loan including proof they hold the note,
history of payments, etc. There is a form for this on our website that you or your attorney can use to file
with the Court.
Documents to Provide Lender Prior to Mediation
Following is a list of documents that lender may require. This is not intended to be a complete list.
Please contact your lender’s representative and the lender’s attorney that will appear at mediation in
order to determine what other documents you will need.
Last two years federal tax return
Proof of income (e.g., one or two current pay stubs, contribution letters signed and dated,
notarized if possible, child support, etc. Pay stubs must have year to date earnings.
Past two bank statements
IF self-employed, attach a copy of the past six month’s profit and loss statement
Hardship Affidavit Letter
4506 T Form
RMA form (Request for Modification Affidavit)
Proof of all expenses (child support, utility bills, auto loans, auto insurance, cable, etc.)
Current real estate tax bill
If the mediation is for income property, copy of any lease agreement
A photo ID
Bring all documents to mediation as well.
