Introduction to this form

This form is to be used for all applications for transfer, in whole or in part, of a greenhouse gas emissions trading
permit and/or Registry Account. Any such application must be made jointly by the Operator and the new, proposed
Operator /Transferee. This form (IRL ETS 013/03) comprises three parts: Part A is to be completed by the Operator
and Part B is to be completed by the new, proposed Operator/Transferee, Part C comprises a Joint Declaration
between the Operator and new, proposed Operator/Transferee. Once completed by the Operator and the Transferee,
the form must be jointly submitted to the Environmental Protection Agency. The application for transfer will not be
processed until all sections of the form are completed in sufficient detail and to a satisfactory standard with all
relevant attachments submitted.

Completion of the Form
This form has been designed in Microsoft Excel to allow it to be filled in electronically. The Form comprises three
parts: Part A to be completed by the Operator, Part B to be completed by the new, proposed Operator/Transferee,
Part C is a joint declaration of Operator and the new, proposed Operator/Transferee. Once all parts are completed,
you should e-mail the form to GHGpermit@epa.ie and send a signed original, to include Parts A, B and C
along with three copies by post to:

Emissions Trading Registry
Where the new, proposed Operator/Transferee does not currently hold an operator holding account in the National
Emissions Trading Registry, it will need to complete the relevant application forms in order to partake in emissions
trading. Please refer to the epa website (www.epa.ie) for further information regarding Emissions Trading and to

                 A partial transfer is required when part of a Schedule 1 activity within your installation is to be transferred to another Operator

                 transfer is required when all the Schedule 1 activities within your installation are transferred to another Operator.

Section 3 Partial Transfer Details

3.1              Schedule 1 Activities:
                 Please identify the Schedule 1 activity or part of the Schedule 1 activity to which the transfer applies (the transferred activity).
                 Your description should be consistent with that given in your permit application and permit and should detail relevant capacities
                 (e.g. thermal) of activities transferred.

3.3              Allocation of Allowances from New Entrant Set Aside:

                 If an application for an allocation of allowances from the New Entrant Set Aside (NESA) or CHP Set Aside (CHPSA) has been
                 made but has either not been determined or the full allocation has not been issued, please specify whether the application for
                 allowances from the NESA relates to the transferred unit. The application to the NESA or CHPSA should be identified by
                 reference to either the date of the application or the NESA or CHPSA number, if you have been notified of this.




Section 4 Emissions Trading Registry
                 A FULL transfer of a permit must be reflected in the National Emissions Trading Registry through an installation and account
                 transfer. An installation transfer within the Registry will result in that installation/account being associated with the new,
                 proposed operator.
                 Any allowances that the current operator does not wish to transfer to the new operator should be transferred out of
                 the registry account before the installation is transferred.

                 The account transaction history (see Account activity screen) can be transferred to the new operator allowing them to view ALL
                 previous transactions that were executed on this account.

          PART C - JOINT DECLARATION
          Section 10                        Transfer of Liabilities

          In applying for a transfer of the permit the new operator is taking on the liability and responsibility for all legal obligations as
          required under SI 437 of 2004 and amendments and as listed in the greenhouse gas emissions permit. This includes, but is not
          limited to:
          o The duty to submit a verified annual installation emissions report (AIER) by 31 March for emissions during the previous year in
          accordance with SI 437 of 2004, article 14 (2)
          o The duty to ensure that the AIER is verified in accordance with SI 437 of 2004, article 14 (3)
          o The duty to surrender, by 30 April each year, a number of allowances equal to the total emissions from that installation in the
          previous year in accordance with SI 437 of 2004, article 12(3).
          o Any reports or amendments to reports outstanding or required in respect of annual emissions for the previous calendar year.
          o Payment of any excess emissions penalties outstanding in accordance with SI 437 of 2004, article 16.
          o The obligation to surrender an amount of allowances equal to those excess emissions in the following calendar year


          Section 11                        Joint Declaration
          The Operator and new, proposed Operator/Transferee must jointly indicate when the transfer is to take effect and jointly complete,
          sign and seal this Part.

          The EPA will not process any application in the absence of a completed declaration.

          Application Instructions
          Once this Form is completed, signed and sealed, and together with all supporting documentation,
          please return by email to GHGPermit@epa.ie.

          Please also send one signed and sealed original and three copies to:

          We may request any further information needed by notice issued under the European Communities (Greenhouse Gas Emissions
          Trading) Regulations 2004 (S.I. 437 of 2004) and amendments.

          Upon receipt of the Application for Transfer of a GHG Emissions Permit and the supporting documentation, the EPA will verify the
          information provided.
          If the information provided is satisfactory, the EPA will update the GHG emissions permit and the Emissions Trading Registry to
          reflect the installation transfer.
