you consider the below prior to signing any petition in support of this bill.
HR3501, although appearing to be very appealing and beneficial to breeders and animal owners, should be opposed.
It is of our opinion that this bill does exactly what it was intended to do. To draw in unsuspecting breeders who believe they are getting a
"break" and it is being done exactly in the style to which we who work legislation are accustomed to seeing, or should be accustomed to seeing,

by now.
Those who believe this is a 'good thing' should stop and reconsider how bills are amended as they make their way through Congress. Alt-
hough some feel it worthy of support as currently written, consideration needs to be given regarding the amendments that HSUS could/would add
that most likely will end up not benefiting breeders at all, rather, it could/would be more detrimental to your rights to own animals in the
end. This is not an unfamiliar tactic in politics, as many of you more experienced in the legislative arena are aware - gain the support of the
opposition with some "feel good" legislation, amend, amend, amend - and then advise Congress that it was "what everybody wanted." If you sign
on to it in the beginning, you have no defense - you signed up to support it and your signature on any petition will be proof positive.
Everybody should be aware by now that the HSUS is looking at taxes that are not being collected from breeders, as evidenced in the not so
long ago Indiana confiscation in which back taxes surpassed $130,000. No better way could possibly exist in tracking hobby breeders than to claim
they were avoiding paying income taxes on their dogs. In order to claim deductions, you must first claim a profit, and in doing so, hobby breeders
will no longer be considered as such and would then fall under other more stringent regulations, possibly causing the hobbyist to be reconsidered as
a "business." In addition, there are many rural and urban areas that are not zoned for "business" and many hobby breeders will then be in the target
scope and in jeopardy of losing their animals because of "zoning regulations and restrictions" in those particular areas that are not zoned for busi-
ness. Professional, licensed breeders already deduct expenses. Hobbyists, by signing any petitions, would be voluntarily setting themselves up to
lose their hobbyist status and would then be required to prove all expenses for their animals once they are considered as "professional breeders."
While you, as a hobbyist, may gain on one level, you will surely lose on several others once your status is changed.
As "Happy" as this bill may sound, there are far too many unanswered questions when reading in between the lines and while this bill, as is
currently written, appears to only entail "health care for animals", can you possibly conceive in your own mind that HSUS or any other anti
animal group will leave it as is when it gives them the perfect opportunity to add to it as it makes its way through the legislation process?
Additionally, allowing (up to) a $3500. deduction also increases the potential of a dog's value. Animal rights attorneys are constantly testing
the courts in this currently gray area for purposes of malpractice and emotional damages. Permitting deductions for dogs is one more step up the
"they are family and should be in an elevated property status" ladder.
We fully realize that the "Happy Act", HR3501, is a "feel good" piece of nationwide legislation to unsuspecting supporters but we also realize
that this bill has the potential of putting animals on the same level as humans and sets a very dangerous precedent in equating animals with the
seniors, the elderly and children, who currently are permitted to have deductions taken by their caregivers. This bill creates the perfect backdrop for
"guardianship."
As such, the Monthly National Legislation Report, and the organizations listed below, oppose this bill and asks that you take the time to
consider all possible ramifications prior to making any decision other than opposition.

6a. Marion County: “ Last Sunday, 2 Collies and an Aussie were accused of killing a cat. A Marion County Animal Control officer came to the
dog owner's home and without a warrant took a 70 year old handicapped widow's dogs from her, to be held on a "dangerous dog" charge, based on
a complaint filed by a neighbor. This woman lives on Social Security and has few if any financial resources to fight for her beloved animals.
Was the cat killed by these 3 well mannered, friendly, obedience trained dogs? Highly unlikely, as no Veterinarian had the opportunity to ex-
amine the cat to determine the cause of death...we will never know. But here in Marion County, Florida, you can be bullied by rude and arrogant
Animal Control officers and your animal is guilty until proved innocent. How can the dogs be proved innocent when there is no proof that they were
responsible for the cat's death?? NO MATTER...in this county they can confiscate your dogs and hold them for up to 21 days, during which time you
can choose from the following actions...euthanize the dogs...agree to pay a "dangerous dog" fee of $500 per dog annually, or request a hearing
which is not conducted in front of a judge and abide by their decision as to the disposition of your dogs.
There should be laws to protect people from dangerous animals, but in this county and the state the laws are worded so that anyone, a disgrun-
tled neighbor, perhaps, or someone who just doesn't like dogs, can file a complaint without proof and the burden is on the accused to defend against
the accusation. The State of Florida and Marion County need to review the current law and not treat an animal who may or may not have attacked
another animal in the same manner as one who has attacked and injured or killed a human being. Also, our Marion County Animal control officers
may need some sensitivity training, so as not to treat the citizens of the county as though we were residing in a fascist society.
The owner of the dogs would like to get them out of the pound and have them taken to a boarding facility so that she can visit them as Animal
Control will not allow her any access to her dogs until the situation is resolved. She does not have the money to pay for this or the lawyer to fight for
her beloved dogs.

9/30/09: HEARING: on SUB124 House Agriculture and Natural Resources Committee RESULTS from HEARING: “The
hearing lasted nearly 3 hours with at least 7 people speaking in favor of the bill and at least 6 opposed. The committee members gave the same
attention to both sides (as usual), so it was difficult to tell if they leaned one way or the other. A few of them asked questions that showed they might
be thinking of alternatives, but it was really hard to tell how serious they were.
The proponents had a slick video projected from a laptop onto two big screens, one facing the committee and one facing the audience. Kellie

did her usual spiel peppered with lies about the participation of breeders in drafting bill language and using a picture of a large Amish farmhouse to
illustrate her contention that commercial breeders make enough money selling puppies that they can afford big houses so they shouldn't quibble
about spending money to bring their kennels up to the standards in the bill. Never mind that the Amish have large families living together or that they
take pride in their homes. A woman who identified herself as a tax expert told the committee that she did a chart about the loss of revenue from
commercial breeders who take only cash to avoid paying taxes, but she based her work on the assumption that there are 9000 commercial kennels
in Ohio. In answer to a question from a committee member, she stated that the vast majority of commercial breeders are tax cheats.
Other proponents included a couple of women who do rescue, a dog warden involved in a substandard kennel case, a humane agent from
Perry County who has testified before, and Bob Baker, a roving kennel 'investigator' who now works for ASPCA but has also worked for HSUS and
an anti-farm animal rights group.
Opponents were OVDO, the Ohio Association of Animal Owners, the Ohio Professional Dog Breeders Assoc., the dog wardens assoc., collie

I wanted to make you aware of proposed new regulations in King County, WA (Seattle-area) that could affect your ability to feed raw diets to
your animals. The Seattle and King County Boards of Health are updating their regulations and permit requirements for pet-related businesses
such as groomers, pet stores, kennels, shelters, and daycare facilities. They have defined “Risk” categories for pet stores that sell live animals. But
they have also included pet stores that sell raw pet food in those “risk” categories. And they have created a separate, but matching, permit classifi-
cation for any other type of business (veterinary hospital, grocery store, training facility, raw diet manufacturers who sell direct to the public, etc.) that
sells raw diets. Any business falling into the above categories will be subject to yearly inspections and a yearly permit fee. In addition, any new
construction, or even a remodel of an existing building, for a business that sells raw diets will require that architectural plans be submitted to the
Board of Health and hourly fees will be charged to the business in order for the Board to review them. If the Board requires changes, the revised
plans will have to be submitted again for review and the hourly fees will again be charged. It is important to note that these burdensome fees,
inspections and construction requirements are being applied *only* to businesses that sell raw pet food. If a business does not sell live animals and
doesn’t sell raw diets (though they sell other types of pet food), they are exempt from all these regulations.
By singling out raw diets, the County government is implying danger that is not proven and creating burdens not reasonably related to the
problems they are trying to prevent. Kibble and canned pet foods have extensive, documented histories of pathogen contamination. By not includ-
ing these types of foods within their regulations, the County is creating an uneven commercial playing field and placing an undue competitive burden
on the sellers of raw pet foods. Please be aware that technically, sellers of freeze-dried raw pet food and treats, if the products were raw at the time
of manufacture, can be considered subject to these regulations. Even meat wholesalers – if they know they are selling to persons or groups using
the goods for pet food – would be subject to all these regulations. We recognize the right and duty of the County to protect the health and safety of
its citizens. Requiring safe handling instructions on all raw pet food labels would be a reasonable way to address their concerns. The regulations
they are currently requiring are not reasonable at all. The point of these regulations seems to be aimed at discouraging the feeding of raw pet
food. In fact, we have already heard from some raw diet retailers, including a veterinarian, who have indicated that they will stop selling raw diets if
these regulations are adopted. That means that consumers will end up with fewer choices in where to buy raw diets, and that could affect your abil-
ity to continue feeding raw diets. Perhaps more important, if these regulations are enacted, it also sets the stage for even more restrictive regula-
tions for raw diets in King County and could become a model for elsewhere in the nation. This could be the first step on a slippery slope to prohibit
the feeding of raw diets.
I strongly encourage residents of WA to submit your concerns about these regulations to the Board. If they do not hear vigorous opposition to
their unfair requirements for unproven concerns, the sellers of raw diets in King County will be singled out with financial and bureaucratic burdens,
and your raw diet choices could become limited. Make your voice heard. Don’t allow King County to unfairly begin to legislate how you choose to
feed your animals.
