11   TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA,
12   1976, BY ADDING SECTION 11-5-290 SO AS TO DIRECT
13   THE STATE TREASURER TO ESTABLISH AND MAINTAIN
14   AN ONLINE REGISTER OF EACH STATE PAYMENT IN THE
15   AMOUNT OF ONE THOUSAND DOLLARS OR MORE IN A
16   FISCAL YEAR, TO PROVIDE THE PAYMENTS WHICH
17   MUST BE INCLUDED ON THIS REGISTER AND THOSE
18   PAYMENTS THAT ARE EXEMPT, AND TO PROVIDE FOR
19   THE ORGANIZATION AND INDEXING OF THIS REGISTER.

21   Be it enacted by the General Assembly of the State of South
22   Carolina:

24   SECTION 1. Chapter 5, Title 11 of the 1976 Code is amended by
25   adding:
26
27      “Section 11-5-290. (A) The State Treasurer shall establish and
28   maintain an online register of each state payment made in the
29   amount of one thousand dollars or more in a fiscal year to:
30        (1) vendors of goods, services, and professional services
31   procured by the State; and
32        (2) payments to state officers and employees as
33   reimbursements of expenses.
34      (B) The register must be indexed by agency and payee with an
35   appropriate code indicating the general nature of the payment.
36      (C) The State Treasurer, in consultation with affected agencies,
37   may exclude payee information from the register with respect to a
38   payment that could adversely impact on law enforcement sources
39   and methods and in other instances where the payee is information
40   exempt from disclosure pursuant to Chapter 4, Title 30, the
41   Freedom of Information Act.”

1 SECTION 2. This act takes effect July 1, 2009, and applies for
2 state payments made after June 30, 2009.
