WHERE IS LEAD FOUND?
Old paint in homes built before 1978
– Paint chips
– Lead dust (sometimes invisible!)

MASSACHUSETTS LEAD LAW
A property owner must correct lead paint
hazards when there is:
a home built before 1978 AND
a child less than 6 years old living in the
home
within 90 days of taking the title.
The only way to know if there is lead in a
home is to have it tested by a licensed

WHAT IF MY HOME HAS LEAD?
Remember!
There are 2 ways to comply with the Lead Law:
1) Remove or cover all lead hazards LOC
2) Fix only urgent hazards Letter of Interim Control

OCCUPANT NOTIFCATION
An owner must notify tenants (and other agencies) TEN
calendar days before any deleading work can begin on the
home
During moderate and high risk deleading inside,
occupants MUST be relocated until a lead inspector
approves the work and clean up
– Property owners must provide alternative housing for tenants
during moderate & high risk deleading
– Tenants must pay rent unless staying with family or friends

LEAD PAINT NOTIFICATION
Your real estate agent must give you:
A Property Transfer Lead Paint Notification form
A signed Property Transfer Lead Paint Certification
form
Any information the owner has regarding lead in
the home

IMPORTANT POINTS:
Property owners must
comply with the Lead Law.
This includes:
– Owner occupied home owners
– Rental property owners

IMPORTANT POINTS:
If a child gets lead poisoning from his or her
home, the owner is strictly liable
(unless an LOC or Letter of Interim Control is in effect)
Strict liability means owners may be liable
EVEN IF THEY DID NOT KNOW lead paint
was in the home.

TENANT’S RIGHTS
You must give tenants the same information that
buyers are required to receive prior to
purchasing a house
– before they sign a rental agreement
– EVEN IF they do not have children:

TENANTS RIGHTS
Tenants have the right to ask you (their landlord)
to have a lead inspection done……it is your
responsibility to do this.
If a landlord refuses, tenants are advised to call
their local Board of Health or CLPPP to make a
“Parental Request” for a free lead determination.

DISCRIMINATION- it is illegal to….
Refuse to rent to a family because there is lead in
the house and they have a child under six.
Raising the rent or threaten eviction if they ask to
have a lead inspection.
Request results of a lead test from the family.
Sign away a child’s right to a lead safe home. DW

NEW RRP RULE: Renovate Right!
Enacted April 22, 2010
Federal law requires contractors working in or on
pre-1978 homes to be certified in lead safe work
practices
BOTTOM LINE:
Ask to see your contractor’s certification.
