Dear Sir(s),

1.     A set of tender documents for the above work is forwarded herewith. Please note that the
tender will be received by The Chief Engineer, Project Udayak, PIN –931 715, C/O 99 APO
upto 1200 Hrs 05 Dec 2011.Tender received after the due date and time will not be considered.

2.     Tenderer or their duly authorised representative who have submitted tender and who wish to be
present at the time of opening of tenders may visit the office of Chief Engineer (P) Udayak, PIN-
931715, C/O 99 APO at the above mentioned time.

3.   Please note that tender documents are to be prepared in two stages containing the following
documents:-

3.1    Stage-I:- QUALIFICATION DETAILS             :

3.1.1 Under this stage, in the envelop, clearly labeled as “STAGE-I- QUALIFICATION DETAILS”
particulars about the following shall be furnished as per the format specified at Appendix ‘A’ and
annexure thereto. No indication of the price bid shall be given at this stage and only the details as
sought as per the given format be submitted alongwith EMD.

       (a) Particulars of firm and resources held
       (b) Work completed during last three years and work in hand during current year.
       (c) Verification statement.
       (d) EMD in original in case of unenlisted bidders or bidders registered with department other
           than BRO.
       (e) Power of attorney to submit tender (where applicable).

       (Where the bid has been invited in parts, the particular part being participated be clearly
highlighted in the verification statement to facilitate proper evaluation thereof).

3.1.2. Stage-II:-FINANCIAL BID (Price Bid)

3.1.2.1. For this stage in the involved clearly labeled as “STAGE-II’-FINANCIAL BID”. Complete tender
document duly signed each page thereof with price bid as per the schedule ‘A’ shall be submitted.
3.1.2.2.       The financial proposal shall include the costs associated with the work. These shall
normally cover, complete cost associated with arranging supply of materials as required including
labour charges, loading, unloading, transportation and all taxes as applicable. The financial proposal
shall clearly indicate the amount asked for without any assumptions of conditions attached to such
amount. Conditional offer or the proposal not furnished in the format specified shall be considered non-
responsive and is liable to be rejected.

3.1.2.3.      The financial proposal shall take into account all types of tax liabilities and cost of
insurance.
3.1.2.4.      Costs shall be expressed in Indian Rupees only both in figure and words.
3.1.2.5.     All payments shall be subjected to deduction of Income tax at source in accordance with
the Income tax act as applicable.

4.     Tender documents shall be submitted in two stages as listed above and each stage shall be kept
in a separate sealed envelope marked name of work and Stage-I and Stage-II appropriately. Both the
envelope containing Stage-I (Qualification Details) and Stage-II (Financial Bid) duly sealed shall be put
in one large size envelope (cloth lined outer cover). This outer cover shall indicate name of work, name
of bidder, last date and time of receipt of tender prominently.

5.      The tender documents ( in full) either duly downloaded from BRO website or issued by BRO
alongwith various documents required to be submitted shall be dropped in Tender Box kept at HQ CE
(P) Udayak, PIN- 931715, C/O 99 APO before the date and time fixed for receipt of tender. The tender
received after due date and time shall not be considered and shall be returned to the tenderer
unopened. Chief Engineer, Project Udayak, shall not be responsible for any postal or other delay and
shall not take care to ensure the submission of tender at place and time fixed for receipt of tender.

6.     The tenderer are requested to submit the complete details about their firm, such as year wise
work executed in last three years, cost of work in hand to be executed and resources as per the format
given at Appendix ‘A’ and annexure thereto, to examine their resource and financial capability. It shall
be ensured that details are provided correctly. Furnishing incomplete or incorrect details shall make the
tender liable for rejection at any stage.

7.      STAGE-I of tender shall be opened immediately after the time indicated in Para-1 herein before
in the presence of tenderers or their authorized representative. However price bid of tenderer shall be
put in one envelope and sealed by the opening officer. Stage-I (Qualification Details) shall be opened
and evaluated as per eligibility criteria/listed hereunder. The STAGE –II (financial bid) in respect of
qualified tenderer only, shall however be opened on 10 Dec 2011 at 1200 Hrs. Priced bid in respect
of unsuccessful tenderer shall be returned unopened. Please note that:-

       (a)     The tender shall be based on details and data given in tender documents, Particular
       specifications, General Conditions of contracts, drawings, general information and lump sum
       contract form with schedule ‘A’ (list of works) to be priced by tenderers.

     (b) The Chief Engineer Project Udayak, PIN- 931715, C/O 99 APO shall be Accepting Officer here
         in after referred to as such for the purpose of this contract.

       (c)     The tender shall be accompanied with Earnest Money amounting to ` 1,50,000.00
       (Rupees one lac fifty thousand only) in the form of Deposit at Call Receipt/Term Deposit
       Receipt/Special Term Deposit Receipt issued in favour of Chief Engineer (P) Udayak, PIN-
       931715, C/O 99 APO by scheduled Bank. A tenderer may however participate in particular part
       or parts or for complete work as per their eligibility/qualification and submit EMD accordingly.
       Tenders in respect of bidders enlisted with any Govt Deptt other than BRO and not accompanied
       with earnest money shall not be considered for acceptance. The amount of this receipt shall be
       basic amount and not their maturity value. Any deposit lying with the department in any form
       against any tender and/or contract shall not be considered for adjustment as the earnest money
       against this tender. Any tender not accompanied with earnest money in the form as indicated
       here-in-before or accompanied with any letter/communication containing any request for
       adjustment of any other deposit as earnest money shall be treated as non bonafide tender. If an
       unregistered/un-enlisted firm revokes his offer (tender) after opening of bids within the validity
       period of his offer, the earnest money deposited by the firm alongwith his tender shall be
       forfeited. The Chief Engineer (P) Udayak, PIN- 931715, C/O 99 APO shall return the Earnest
       Money wherever applicable to all unsuccessful tenderers by endorsing the authority on the
       deposit for its refund.

       (d)    The security deposit amount for this work shall be 25% more than the amount of earnest
       money based on the value of contract ( i.e. 1.25 times of the earnest money) subject to the
       provision that in no case the individual Security Deposit shall exceed `11,25,000.00 (Rupees
       Eleven lacs twenty five thousand only).

       (e)   The tenderer shall be deemed to have full knowledge of all relevant drawings documents,
       samples, site, etc, whether he had inspected it or not.

       (f)    Tenderers are requested to quote rates both in figure and words in column 5 against
       each item of schedule ‘A’ and extend the amount to column 6 of Schedule ‘A’.

       (g)   Any tender which stipulates any alternations to any of the conditions laid down or which
       proposes any other conditions of any description whatsoever is liable to be rejected.

       (h)    Tenderers are requested to submit their tender strictly complying with the various
       provision given in the tender documents.

        (i)  Accepting Officer reserves the right to accept the tender submitted by a Public Sector
       Undertaking, giving a price/purchase preference over other tender(s), which may be lower, as
       admissible under the Govt. Policy. No claim for any compensation or otherwise shall be
       admissible from those, whose tenders may be rejected on account of the said Policy.

        (k)    The submission of tender by a person implies that he has read this tender forwarding
        letter, the conditions of contract and has made himself aware of the scope and specifications of
        the work to be done and of the conditions, and other factors, site conditions, taxes and levies
        prevailing, etc which may affect the quotation and execution of the work.

        (l)    Tenderer must be very careful to deliver a bonafide tender; failing which the tender shall
        be out rightly rejected. Tenderers are, therefore, advised to ensure that their tender must
        satisfy each and every condition laid down in the notice.

8.     Tenderer must ensure that the tender is unambiguous and is complete in all respects. Your
particular attention is drawn to the following requirements, which must be complied with:-

       (a)    Tender documents are to be signed, dated and witnessed at all the pages provided for
       the purpose. Each page and all corrections are to be initialed.

       (b)    All corrections should be signed or initialed by indelible ink. Use of correcting fluid is not
       allowed.

       (c)    Cloth lined envelope shall be used for returning the tender documents.

       (d)     In case you are submitting a BLANK TENDER word ‘ BLANK’ must be prominently
       endorsed on the envelope, the forwarding letter and general summary duly signed by the
       tenderer. The tender documents complete including drawings (s) are required to be returned to
       this office.

       (e)    If a tender is submitted on behalf of a firm, it may be signed either by all partners or a
       persons or a person holding a valid power of attorney from all the partners constituting the firm.
       The person signing the tender on behalf of another or on behalf of a firm shall attach with
       tender a proper power of attorney duly executed in his favour by such other person(s) or by all
       the partners stating specifically that he has authority to bind such other person (s) or the firm
       as the case may be in all matters pertaining to the contract including the arbitration clause. The
       power of attorney shall be executed as indicated below:-

              (i)     In case of individual, a suitable affidavit shall be submitted.
              (ii)    In case of partnership concern, power of attorney shall be executed by all
                      partners.
              (iii)   In case of company, power of attorney shall be executed in accordance with
                      constitution of company.
9.   Attention of Tenderers is drawn to the Indian Official Secret Act – 1923 ( XIX of 1923) as
amended upto date particularly Section 5 thereof.

10.     In view of postal and other delays, it is suggested that your tender be posted sufficiently in
advance of the last date fixed for receipt of tenders or sent through a special messenger, if necessary,
Tender received late shall not be considered. Telegraphic communications received in connection with
this tender will also be not considered.

11.    The tender shall remain open for acceptance for a period of Ninety days (90 Days) from the
date of opening of the tender (excluding the date of opening).
12.    The tender shall be signed and returned alongwith the tender documents and shall form part of
the tender documents.

13.     Tenderers are required to quote for complete scope of work as per Schedule ‘A’, particular
specification, special conditions and other provisions of the tender documents, falling which the tender
shall be considered as “non bonafide” and shall be liable for rejection. Tenderers rate shall be inclusive
of all statutory levies, duties, surcharges, taxes, octroi, service tax, etc and including VAT/State Sale
tax on Works contract, tax payable under the respective statutory pursuant to the Constitution 46th
Amendment Act 1982. Any other conditions stipulated by the tenderer regarding Sale Tax on Works
contract shall not be considerable and such tender shall be liable for rejection.

14.    The tenderers are advised to visit the work site to acquaint themselves of working and site
conditions, before submitting their tender.

15.    The applicant tenderer who has downloaded the tender documents from BRO website are
requested to collect the standard drawings of related structures where applicable from the HQ CE (P)
Udayak, PIN- 931715, C/O 99 APO.

16.    On acceptance of tender, the name of authorised representative (s) of the contractors who shall
be responsible for taking instructions from Engineer-in-Charge or its authorised representative shall be
intimated by the contractor within 7 days of issue of acceptance letters.

17.    DRAWINGS : The related drawings of structures (where applicable) are available in the office HQ
Chief Engineer, Project Udayak, Pin-931715, C/o 99 APO.
18.    Evaluation of Bid
18.1. A two stage procedure shall be adopted in evaluation of the bids with qualification details
(STAGE-I) being completed prior to opening of financial bid.

       (a)     The qualification details (STAGE-I) shall be evaluated by a board of officers to be
       appointed by the Accepting Officer. The following criteria shall be applied for evaluation of the
       details.
              (i)    Whether EMD as required has been submitted or otherwise. The tender shall be
              considered non-bonafied , if EMD as applicable is not found enclosed in the form sought
              for.

              (ii)   Enlistment class of the tenderer.

              (iii)   If tenderer belongs to appropriate enlisted class, i.e. have upper tender limit at
              par with the value of work, the tenderer will be treated qualified for participation in the
              bid i.e. Class ‘B’ for this bid.

              (iv)    In case a tenderer is enlisted/registered with any Govt Deptt other than any
              formation of BRO or have enlistment in a class lower than the one specified as above as
              per the value of work, in that case only those tenderer who meet the following criteria
              shall be treated as qualified. The Accepting Officer however, reserves the right to review
              the criteria depending upon the extent of competition and other aspect including security
              considerations.
                     (aa)     Twice the maximum value of work executed/completed in a year, over last
                     three years less the value of balance works in hand shall exceeds the value of NIT
                     for the particular part/parts being participated or whole the work, if participating
                     in all the parts.
      (b)     After the Evaluation of STAGE-I (qualification details) is completed, the STAGE –II
      (Financial bid) of qualified bidders shall be opened separately on 10 Dec 2011 at 1200 Hrs. The
      STAGE -II (financial bid) shall be return unopened by registered post, to all the bidders who shall
      not be qualify for the participation in the STAGE -II (financial bid).

      (c)     The STAGE -II (Financial bid) shall be opened on the date and time as indicated above in
      the presence of the representatives of the qualified bidders who choose to attend. The prices as
      quoted by each bidder shall be read aloud and recorded while opening the bid.

      (d)      The lowest financial bid as whole or in a part (if so defined) and if found complete in all
      respect shall generally be invited for execution of contract agreement. However, Accepting Officer
      is not bound to accept the lowest or any bid received or to give any reason for doing so.

19. After opening of the bid, information related to the examination, clarification, evaluation,
comparison of bids and recommendation concerning the award of the contract shall not be disclosed to
the bidders or any other person not connected with the process until the award of the contractor is
finalised. Any effort by a bidder or his representative to influence the department in the process of
examination, clarification, evaluation of bids and in decision concerning award of contract may result in
the rejection of the bid.

1.     The quantities shown under Column 4 of Schedule-A at Page No. 11 are approximate and are
inserted as a guide for departmental purpose only. It do not constitute any guarantee for the ultimate
quantities that shall be ordered under the contract. It shall, however, not be varied beyond the limit
laid down in Condition 5 of General condition of Contract, IAFW 1815 (Z).

2.    The tender shall be accepted as a whole and contractor shall not have any claim on this
account. The Accepting Officer does not bind himself to accept the lowest or any tender.

3.   The items are to be delivered AT Km 678.700 ON ROAD PAYA-DIGARU (NH-52) FOR
WMM, DBM AND BC WORKS BETWEEN ON BOTH SIDE APPROACHES OF DIGARU BRIDGE OF
PAYA-DIGARU-TEZU ROAD UNDER 1444 BCCSECTOR/48 BRTF/PROJECT UDAYAK IN
ARUNACHAL PRADESH


4.    Total period of completion shall be as under from the date of commencement mentioned in the
Work Order by the OC Contract.

               100% quantity                      - 180 days

5.     The Work Order shall be placed within 15 days from the date of acceptance of tender.

6.     No item of stores will be issued by the department. The contractor has to make his own
arrangements for procurement of all items which are required to be incorporated in the supply and
stacking of item/material as per schedule `A’.

7.     Contractor shall submit time and progress chart to OC contract on acceptance of tender. Time
and progress chart shall be prepared in consultation with OC Contract to ensure smooth supply of
materials at uniform rate.

8.     The contractor shall quote his rates and amount for all items in column No 5 and 6 respectively
in Schedule-‘A’ at Page No. 11.

9.      Tendered rates shall be deemed to include the provisions of all materials, processes, operations
and requirements detailed in the particular specifications, irrespective of whether those appear as
specific items, or are mentioned in the description of Schedule “A” items or not and the contractor shall
not be paid extra for the same. It is an express condition of this contract that, the rates quoted by the
contractor in the tender for various items of works shall be deemed to include all taxes, viz. excise,
sales tax and royalties, etc and for entire completion of the work in accordance with the provisions
given elsewhere in the contract.

10.    Income Tax at source at the rate notified by the Government of India from time to time along

                     GENERAL CONDITIONS OF CONTRACT, IAFW-1815 (Z)
                          FOR SUPPLY OF STORES AND MATERIALS
                                     (Revised 1953)

1.     A copy of the General Conditions of Contract, IAFW – 1815(Z), Revised 1953 with errata 1 to 28
and amendments 1 to 34 has been supplied to me/us and or is in my/our possession. I/We have read
and understood the provisions contained in the aforesaid GENERAL CONDITIONS OF CONTRACT before
submission of this tender and I/We agree that I/We shall abide by the terms and conditions thereof, as
modified, if any else where in these tender documents.

2.      It is hereby further agreed and declared by me/us, that the General Conditions of Contracts
including Condition 37 thereof pertaining to the settlement of disputes by arbitration containing 19
pages (Serial page No 09 to 27 ) including errata 1 to 28 and amendments 1 to 34 form part of these
tender documents.

3.     Wherever the phrases Commander Works Engineer (CWE) and Garrison Engineer (GE) have
been used in the General Conditions of Contract, IAFW 1815(Z), the same are considered as Task
Force Commander (TFC) and OC Contract respectively as applicable in the Border Roads Organization.

                                          SPECIAL CONDITIONS

1.     GENERAL
1.1    Following Special Conditions shall be read in-conjunction with General Conditions of Contract
based on IAFW-1815 (z) including up to date amendments and errata thereto. Any provisions of
Special Conditions if at variance with the General Conditions mentioned above, provisions of these
Special Conditions, shall take precedence over the General conditions of contract, IAFW 1815 (Z).

2.     SCOPE OF WORK

2.1    The scope of work under this contract is only for “ Supply of the items of materials shown in
the Schedule “A” at the locations given in Schedule “A” and as per Particular Specifications, including
conveyance, loading and unloading and stacking charges, etc complete in all respects as directed by
Engineer-in-charge (EIC)

2.2       The contractor’s rate shall be deemed to be inclusive of royalty, other charges including Sales
Tax and any other taxes, etc as per existing central Govt/State Govt order to be paid by the
contractor. No extra claim shall be admissible on account of fluctuation of market rates directly and/or
indirectly and/or implied on any account. No claim on account of misunderstanding, whatsoever, shall
be entertained on any account in this respect.

3.     VISIT TO SITE

3.1     The contractor is advised to visit the site of work by making prior appointment with the
Commander, 48 BRTF (GREF), C/O 99 APO or Officer Commanding, 1444 BCC (GREF), C/O 99
APO so as to acquaint himself with regard to nature and conditions of the site, nature and means of
local communications, conditions of access and all other cognate matters concerning the execution and
completion of the work.

3.2    The contractor   shall be deemed to have fully inspected and made himself familiar with
various factors which may effect his quotation whether he actually inspects the site or not. No extra
charges consequent on any misunderstanding or other otherwise shall be allowed.

3.3    The contractor shall be deemed to have fully become conversant with local conditions prevailing
in the Arunachal Pradesh where the contract is operative e.g. restrictions on plying of the vehicles
imposed by the Security Forces and/or local administration and/or law enforcing agencies and also
the liabilities for the security checks, etc. The department shall not be responsible for the eventualities
due to security risks/ security requirements as may be required and/or imposed by the security forces
and/or by the local administrative and /or law enforcing agencies. No claim whatsoever on this account
shall be admissible.

4.     WORKING HOURS

4.1     Contractor’s materials, transport, etc, shall normally be permitted to enter/leave the site
between 7 AM to 5 PM only. Dumping outside the timings mentioned above can be permitted by the OC
Contract, if he so desires in the interest of the work.

5.    WORK ON HOLIDAYS
5.1     The contractor shall not carry out on weekly and paid holidays except when he is specially
authorized in writing to do so by the OC Contract on his request in writing. Copy of request letter from
contractor and permission so accorded by the OC Contract for the work on holidays shall be forwarded
by the OC Contract to Accepting Officer for record.

6.     SECURITY AND PASSES

6.1    The contractor shall employ only Indian Nationals after verifying their antecedents and loyalty.
The contractor shall, on demand by the Engineer-in-Charge, submit list of his agents, employees
and work people concerned and shall satisfy the Engineer-in-Charge as to the bonafide of such people.
The Contractor and his workmen shall observe all the rules promulgated by the authorities controlling
the area in which supplies under the contract are to be delivered, e.g. Prohibition of smoking, lighting,
fire precautions, search of Persons on entry and exit, keeping specified routes, restricted hours of
work, etc. Thorough search of all persons and transports may be conducted by the departmental
authorities, Military Authorities or by any other authorities as approved/authorized by the OC Contract
at the site of delivery of materials at any time and any number of the times for security reasons.
Permits are to be obtained from the civil authorities, by the contractor for himself, his staff and labour.
Nothing shall be paid extra on this account.

6.2    The work is to be executed in Arunachal Pradesh and contractor shall obtain all passess/permits
as per the rules at his own expense and risk and nothing extra on this account shall be paid. Necessary
assistance shall be sought by the contractor from the Department for obtaining passes to the firm or
his representatives and workmen to enter in Arunachal Pradesh

7.     UNLOADING AT SITE

7.1      Unloading of materials shall be done by the contractor at the places shown/ marked by the
Engineer-in-charge. If the contractor’s labour unloads materials at places other than shown/ordered,
the same shall have to be to be removed and taken to the places at contractor’s own cost. If not lifted
and delivered at the requisite place as directed by Engineer-in-Charge within the reasonable time, the
same can be done by department and cost/charges on this account shall be recovered from his
RAR(s)/Final bill. The amount of recovery levied by OC Contract on his account shall be final and
binding.

8.     PRICE ADJUSTMENT
8.1    Rates in Schedule ‘A’ shall not be subjected to any adjustment whatsoever due to fluctuations in
the local rates of material, POL, etc and rates of dearness allowances, wages, etc, for labour during the
contract period and/or any other cause whatsoever except as allowed vide clause 32 of General
Condition of Contract of IAFW 1815 (Z) applicable only to finished items of supply.

8.2      Contractor’s rate quoted in the schedule ‘A’ shall be deemed to be inclusive of all such
arrangement as may be involved in satisfactory execution of the work order under the contract. No
claim whatsoever on account of any misunderstanding or otherwise shall be admitted.

8.3       All the local taxes viz VAT, Excise, Income tax, Sale Tax, etc, as per the existing order of the
Govt shall be borne by the contractor and rates quoted by the tenderer shall be deemed to be inclusive
of all such taxes.

9.     PHASE-WISE SUPPLY

9.1    The contractor shall commence the supplies immediately as per the phasing given in schedule
“A” of the tender or in absence of this , supplies shall be made in a phased manner as fixed and
directed by the Engineer-in-Charge. Any change in quantities of materials to be supplied shall be
decided by Accepting Officer in conformity to Clause 5 of General Condition of Contract, IAFW 1815
(z) based on recommendation of OC Contract and Commander Contract on merits of the case.

10.    SOURCE OF MATERIALS AND ITS INSPECTION

10.1    No Stone quarry shall be made available by the Department for this work. The arrangements
for the source of materials as well as compliance to the different environmental requirements as
stipulated, from time to time, by the Ministry of Environmental and Forest, Government of India and
local bodies, as applicable shall be the sole responsibility of the contractor. The materials to be
supplied under this contract shall be       strictly in accordance with the requirements/specifications
mentioned in the Particular Specifications.

11.    LAND FOR OFFICE

11.1 The contractor shall have to make his own arrangements for land as may be required by him/
firm for housing of staff and workmen and for erection of store sheds, offices, godowns, etc. The
contractor must ensure that the staff, labour, plant, equipment, stores, etc employed or collected in
connections with the work are so located that there is no hindrances to the free flow of the traffic on
the road. Suitable warning boards, lights and other measures are to be provided by the contractor at
his own cost, for the safety of the traffic as directed by the Engineer-in-Charge.

12.    PERMIT FROM LOCAL AUTHORITIES FOR PLAYING VEHICLES

12.1      The contractor shall make arrangements for obtaining necessary permit from local authorities
for plying his vehicles for the work in accordance with rules and regulations of the land. Assistance, if
any, in obtaining permits can however be extended by the OC Contract/Engg-in-Charge.

13.    REJECTION

13.1 Materials after being brought to site and dumped and having been rejected in laboratory tests
shall have to be removed by the contractor immediately within 07 days of rejection. If the contractor
fails in doing so, the Engineer-in-Charge shall have the right to get these rejected materials removed
and thrown out side the road land, under departmental arrangements and no compensation on account
of damage/loss shall be payable to contractor. The cost of such removals as worked out by the OC
Contract, in consultation with Engineer-in-Charge shall be recovered from RAR(s)/ Final bill. The
decision of the OC Contract for the amount to be deducted shall be final and binding on the contractor.

14.    EMPLOYMENT OF LOCAL LABOUR

14.1 Attention of the contractor is invited to the Condition 18 of the General Conditions of Contract ,
IAFW 1815 (z) and the Contractor shall as far as possible employ local labour under this contract. All
facilities as per provisions in Labour Acts in force shall be provided to the labour by the Contractor. The
Contractor shall pay wages not less than the fair wages fixed from time to time by the Arunachal
Pradesh or minimum wages fixed under the Minimum Wages Act by the Central Govt., whichever is
higher. The department shall have the right to call for any documents related with employment of
labour being principal employer.

15.    PROCUREMENT OF OTHER STORES/MATERIALS

15.1 Contractor shall remain responsible for procurement of all stores/materials including all
tools/equipments required for procurement and supply of the items listed at Sch ‘A’ under this
contract. The rates shall be deemed to be inclusive of all such eventualities.

16.    INSPECTION (REFER CLAUSE 20 OF IAFW –1815 (Z)

16.1    Inspection of work at different stages shall be carried out by Engineer-in-Charge, OC Contract,
Task Force Commander or any officer of the Department concerned with this work. The contractor
shall provide all facilities for such inspection and examination of any part of the work and no special
claim on this account shall be admissible and/or accepted by the department.

17.    ROYALTIES

17.1       The contractor shall make arrangements for procurement/supply of materials mention in
Schedule “A” and elsewhere. Royalties are payable by the contractor to the concern Department of
Arunachal Pradesh      Government .The contractor shall attach with his Final Bill, the royalty clearance
certificate for the quantity which has been supplied under the contract issued by the concerned
department of Arunachal Pradesh or the Primary License Holder as per below, failing which full amount
of royalty charges for the quantities supplied under the contract shall be recovered from contractor’s
Final Bill and remitted to concern Department of Arunachal Pradesh Government.

18.    PAYMENT OF WORK
18.1 The payment shall be released through E-Payment mode, for which the contractor is required to
submit the NEFT/RTGS Mandate Form (enclosed at Appx ‘B’) duly filled in specified details. Otherwise,
it shall be released through A/c Payee Cheque.
18.2      In case where the payment is released through cheque it shall be sent by post to the
Contractor for which the postage charges shall be deducted from the net amount due to the
Contractor.

19.    ARBITRATION (REFER CLASUE 37 OF CONDITION OF CONTRACT OF IAFW-1815(Z)

19.1 All disputes or difference arising as aforementioned, other than those for which the decision of
the Accepting Officer or any other person is by the contract expressed to be final and binding shall be
referred to sole arbitration under condition No 37. of General condition of contract IAFW-1815(Z) after
written notice by either party of the contract to the other of them, in accordance with the rules
specified hereunder :-

       Rules for Arbitration
       (a)   Matter to be arbitrated shall be referred to the sole arbitration of an Engineer Officer to
       be appointed by Director General Border Roads, or in his absence the Officer officiating as the
       DGBR whose decision shall be final and binding.

       (b)     The venue of arbitration be such a place or places as may be fixed by the arbitrator at is
       his sole discretion.

       (c)   The arbitration proceedings shall be governed by the Arbitration and Reconciliation Act,
       1996.

       (d)    The arbitrator shall give reasons for the award in each and every case irrespective of the
       value of claims or counter claims.

       (e)    The award of the arbitrator shall be final and binding on both the parties.

       (f)    The appropriate Court at Tinsukia/Dibrugarh shall alone have jurisdiction to decide any
       dispute arising out of or in respect of this contract.

       (g)     The expenses incurred by each party in connection with preparation, presentation, etc.
       of its proceedings as also fees and expenses paid to the arbitrator shall be borne by each party.

20.    MINIMUM FAIR WAGES PAYABLE TO LABOUR
20.1     The Contractor shall pay wages not less than the minimum fair wages fixed from time to
time by Central Govt/ State Govt/Local Authority. He shall have no claim whatsoever, if on account of
any local regulations and/or otherwise, he has to pay wages in excess of the wages so fixed.

20.2 The contractor shall observe the laws/regulations applicable in Arunachal Pradesh regarding the
employment of labour, payment of wages and other cognate matters relating to the conditions.

20.3 Labour Regulation and Abolition Act 1970, Worksman Compensation Act-1923, Child Labour
Act-1986 and minimum wages Act-1948 are applicable to the contractors working under this
department. Rates quoted by the tenderer shall be deemed to have taken into account the cost, etc
required to comply with the provisions contend in said Acts and rules framed under said Acts.

21.    TESTING OF MATERIALS AND PRODUCTION OF TEST CERTIFICATES
21.1. Testing of material shall be carried out by the contractor at his expenses from recognized
laboratory located in the near vicinity of area as decided by Engineer-in-Charge. The random samples
shall be collected by Engineer- In-Charge in presence of contractor or his accredited representative,
properly packed sealed and forwarded to laboratory for carrying out necessary test. The test certificate
shall be produced before the payment of RARs/final bill. All charges on account of tests carried out
shall be borne by the contractor.

22.    ACCEPTANCE       OF SUPPLIES
22.1.     The Accepting Officer shall have the over riding powers in all the decisions of officers detailed
in this contract for various purpose from time to time and his decision shall be final and binding under
this contract.

23.    DEDUCTION OF TAXES AT SOURCE

23.1.    Income Tax at source at the rate notified by the Government of India from time to time along
with surcharge as applicable shall be deducted from the gross amount of payment of RAR(s)/Final Bill.
Similarly, Sales tax at source, if applicable at the rate notified by the Government of Arunachal Pradesh
from time to time along with surcharge as applicable shall be deducted from the gross amount of
payment of RAR(s)/Final Bill. The contractor may ascertain full details in this respect from the concern
Department(s).

24.    ATTENDANCE OF DEPARTMENTAL WORKMEN AND OTHER AGENCIES

24.1 The contractor shall permit free access and generally afford all facilities and usual conveniences
to other agencies and / or departmental workmen to carry out works, if any, under separate
arrangements. The contractor shall not be allowed any extra payment on this account.

25.    RATES QUOTED

25.1 Tendered rates shall be deemed to include the provisions of all materials, processes, operations
and requirements detailed in the particular specifications, irrespective of whether those appear as
specific items, or are mentioned in the description of Schedule “A” items or not and the contractor shall
not be paid extra for the same. It is an express condition of this contract that the rates quoted by the
contractor in the tender for various items of works shall be deemed to include all taxes, VAT, excise,
sales tax, entry tax and royalties, etc and for entire completion of the work in accordance with the
provisions given elsewhere in the contract.

25.2 The rates quoted in Schedule ‘A’ shall be deemed to be inclusive of all such arrangements as
may be involved in satisfactory delivery of supplies under this contract.

26.    DISCREPANCIES /DOUBTS

26.1 In case of any disputes or discrepancies or any doubt or obscurity as to the interpretation of
any of the tender documents ie General conditions of Contract, Special Conditions, Particular
Specifications, etc, the matter shall be referred to the Accepting Officer, whose decision in this regard
shall be final and binding.

27.    ROAD ENTRY PERMIT
27.1     The Govt deptts are exempted from the levies of local bodies viz octroi, municipal tax, etc.
A road permit to this effect will be issued by the OC, Contract to facilitate transportation of stores.

28.    IMPLEMENTATION OF SECTION 113 OF MOTOR VEHICLE ACT 1988

28.1 Hon’ble Apex Court verdict on the WP (C) No. 136 of 2003 in the matter of Paramjit Bhasin and
Ors Vs Union of India and Ors regarding implementation of Section 113 of MV Act 1988 shall be strictly
adhered to during execution of this contract. No overloading of the vehicles beyond permissible limit
shall be carried out by the contractor during transportation.

1.       GENERAL

1.1     The materials to be supplied under this contract shall be in accordance with schedule “A” and
the Particular Specifications referred to herein and Ministry of Road Transport & Highways
Specifications for Road and Bridge works (Fourth Revision).
2.      SPECIFICATIONS
2.1     The contractor shall ensure that, the material supplied are as per the stipulations given at
Schedule ‘A’ and meets the specifications listed hereunder.
3.     DELIVERY SCHEDULE
3.1      All the material as listed in Schedule ‘A’ shall be delivered at specified locations within the
period as specified therein.

3.2      The responsibility for any loss/damage during transit, loading and unloading of material shall
rest with the contractor.
4       CRUSHED STONE AGGREGATE 40 mm GRADED DOWNWARD FOR WMM WORKS
4.1     GENERAL SPECIFICATIONS
4.1.1 Coarse aggregates shall be crushed stone. If crushed gavel/shingle is used, not less than 90
percent by weight of the gravel/shingle pieces retained on 4.75 mm sieve shall have at least two
fractured faces. The aggregates shall conform to the physical requirements set forth as below

** To determine this combined proportion, the flaky stone from a representative sample should first be
separated out. Flakiness index is weight of flaky stone metal divided by weight of stone sample. Only
the elongated particles be separated out from the remaining (non-flaky) stone metal. Elongation index
is weight to elongated particles divided by total non- flaky particles. The value of flakiness index and
elongation index so found are added up.
*** - If the water absorption value of the coarse aggregate is greater than 2 per cent, the soundness
    test shall be carried out on the material delivered to site as per IS: 2386(Part-5).

8.     RIVER/COARSE SAND
8.1    GENERAL SPECIFICATIONS

8.1.1 River/Coarse sand shall be clean, hard, durable, uncoated, coarse dry particles free from dust,
soft or flaky particles or organic matter or other deleterious substances.
8.2    GRADING REQUIREMENT
8.2.1 The grading of the sand shall conform to Grading-II (Fineness modulus neither be less than 2
      nor greater than 3.5) passing 4.75 mm sieve and retained on 150 micron sieve.
8.3    PHYSICAL REQUIREMENTS

8.3.1 The bulk density of sand shall conform to minimum 1120 kg per cum in accordance with IRC:
       14-1977.
9.     PERIODICITY OF TESTS
9.1    The test shall be carried out as per the frequency mentioned against each. However Engineer-
in-Charge/OC Contract reserve the right to carry out more test at any intervals at their sole discretion.
The contractor shall not have any claim on account of additional tests, if any ordered by Engineer-in-
Charge/OC Contract
9.2    The stone crushed chips and sand not conforming to the above specifications shall be rejected
by the Engineer-in-Charge. Such rejected materials shall be removed from the site by the contractor at
his own expenditure failing which the Engineer-in-Charge shall do the same at the risk and cost of the
contractor.
9.3     The cost of all tests stated above shall be borne by the contractor and his rates quoted in the
Schedule ‘A’ shall be deemed to include these testing charges and nothing extra shall be admissible on
this account. Testing shall be done from the Government laboratories or from the laboratory approved
by the OC, Contract.

10.     MEASUREMENTS
10.1 All measurement will be done at work site where materials have been ordered to be delivered
by the Engineer-in-Charge. The measurement shall be taken jointly by the Engineer-in Charge and the
contractor or any person authorized by the contractor. All measurements shall be properly recorded in
the measurement book IAFW-2261 in term of accounting unit specified at Sch ‘A’, as per IS-1200
(Part-VII) of 1972, and signed by both the parties immediately after completion of each set of
measurement. The Contractors signature in the measurement book shall be taken as a token of his
acceptance of the measurements. If the contractor or his representative fails to attend at the
appointed time of recording measurement, then, the Engineer-in-Charge will have the power to
proceed himself to take measurement ex-parte and in that case measurements shall have to be
accepted by the contractor and no dispute/claims on this account shall be admissible.
10.2 All the materials shall be procured from approved sources and shall conform to the physical
requirements, specified in the respective Specifications Clause for the individual items given elsewhere
in this Specification.

10.3 Only the aggregate satisfying the Specification requirement shall be conveyed to the roadside
and stacked. Each size of aggregate shall be stacked separately. Likewise, materials obtained from
different quarry sources shall be stacked separately and in such a manner that there is no
contamination of one source with another.

10.4 The aggregates shall be stacked entirely clear of the roadway on even clear hard ground, or on
a platform prepared in advance for the purpose by the Contractor at his own cost and in a manner that
allows correct and ready measurement. If the stockpile is placed on ground where the scraping action
of the loader can contaminate the materials with underlying soil, then the stockpile shall be rejected by
the Engineer. Materials shall not be stacked in locations liable to inundation or flooding.
10.5 The dimensions of the stockpiles and their location shall be approved by the Engineer. Where
the material is improperly stacked, the engineer shall direct complete re-stacking of the materials in an
approved manner at the Contractor’s cost.
11.     PERCENTAGE REDUCTION IN VOLUME TO ALLOW FOR VOID AND SAND BULKING :-
11.1 The actual volume of aggregate/materials to be paid for to the contractor under this contract
shall be computed after deducting the specified percentages as listed hereunder from the volumes
computed by stack measurements to allow for voids and bulking.

12.    MEASUREMENT FOR PAYMENT

12.1 Coarse and fine aggregate supplied to the site shall be paid for in cubic meter. The actual
volume of the aggregates to be paid for shall be computed after deducting the specified percentages as
per the clause 10 above of particular specification of the contract from the volume computed by stack
measurements, to allow for voids and bulking.
12.2 Unless otherwise directed by the Engineer, measurement shall not be taken until sufficient
materials for use on the road have been collected and stacked. Immediately after measurement, the
stacks shall be marked by white wash or other means as directed by the Engineer.
13.    RATES
13.1 The contract unit rates for different sizes of coarse aggregate, fine aggregate and other
materials shall be payment in full for collecting, conveying and stacking or storing at the site including
full compensation for :
        i)    All royalties, fees, rents where necessary;
        ii)   All leads and lifts; and
        iii)  All labour, tools equipment and incidentals to complete the work to the Specifications.
        vi)   All necessary testing of material, both initial, to approve and source, and regular control
              testing thereafter.

                                    NOTICE INVTING TENDERS

1. A sealed tender is invited for “SUPPLY AND STACKING OF STONE METAL OF NOMINAL SIZE
40 mm GRADED DOWNWARD, STONE CHIPS OF NOMINAL SIZE 22.40 mm GRADE
DOWNWARD, STONE CHIPS OF NOMINAL SIZE 13.20 mm GRADED DOWNWARD, STONE
CHIPS OF NOMINAL SIZE 11.20 mm GRADE DOWNWARD AND SAND AS PER MORT&H
SPECIFICATION AT Km 678.700 (AT PAYA HMP SITE)            FOR WMM, DBM AND BC WORK
BETWEEN Km 687.056 TO Km 689.802 ON BOTH SIDE APPROACHES OF DIGARU BRIDGE OF
PAYA-DIGARU-TEZU ROAD UNDER 1444 BCC SECTOR / 48 BRTF/ PROJECT UDAYAK IN
ARUNACHAL PRADESH”.
2.      The work is estimated to cost ` 100.00 Lac approximately. This estimate, however, is not a
guarantee and is merely given as rough guide and if it costs more or less to any extent, the tenderer
shall have no claim on that account.
3      The tender shall be based on IAFW – 1815 (R) used in conjunction with General Conditions of
Contract, IAFW 1815 (Z) and Special Conditions, where the tenderer is required to quote their rates for
the item of supplies listed in the Schedule ‘A’ both in figures and words.
4.     The contract is to run for a period of 180 days with reference to the total cost of the work from
the date of acceptance of the tender/issue of work order.

5.     Not more than one tender shall be submitted by one contractor or one firm of contractors.
Under no circumstance will a father and son(s) or other close relations, who have business dealing with
one another be allowed to tender for the same contract as separate competitors. A breach of this
condition shall render the tenders of both parties liable to be rejected.

6.    The Chief Engineer (Project) Udayak, C/O 99 APO shall be the Accepting Officer, hereinafter
referred to as such for the purpose of this contract.
7.    Application for tender documents must be submitted to The Chief Engineer, Project Udayak, C/O
99 APO so as to reach this office by 08 Nov 2011 onwards. The tender document may however be
downloaded directly from the web site as mentioned hereunder.
8.      The applicants must attach with their application, cost of the tender documents in the form of
Bank Draft for ` 1,000.00 (Rupees One Thousand only) issued by the State Bank of India drawn
in favour of the Chief Engineer, Project Udayak payable at Tinsukia, Code No - 0196 (Assam
State). Please note that the application received without Bank Draft towards cost of the tender
documents shall not be entertained. An advance copy of the application with photocopy of demand
draft for Cost of tender may also be sent through Fax at No 03759-249522.

9.      In addition to the above, the tender document shall also be available in downloadable form in
website www.bro.nic.in or www.bro.gov.in. An applicant may download it directly from the website
and participate in the process. However, in such case cost of document shall be payable in the above
form at the time of submission of the document. Intimation to this effect may however be given to this
office so that subsequent changes, if any, can be intimated.
10.     Applicants enlisted with a class having tendering limit lower than that of the value of work listed
hereabove, shall attach details about the registration/enlistment letter / certificate with BRO / MES /
State PWDs / CPWD / Railway or other Govt organization, particulars of the similar works executed
during last three years and works in hand and details about resource and financial capability to
undertake the work, as per the format enclosed with the tender. Tender not accompanying with these
details may be rejected without assigning any reasons thereto.

11.     The cost of tender documents in the form of Bank Demand Draft shall be non-refundable, if the
tender documents are issued to the applicants. The contractor/applicants shall bear the cost of bank
charges for drawing and encashing the Bank Draft and they shall not have any claims whatsoever on
this account on the Government..

12.  Tender forms and conditions of contract and other necessary documents shall be issued from
12 Nov 2011 onward or could be downloaded directly from the website www.bro.nic.in or
www.bro.gov.in.

13.     The tender shall be accompanied by earnest money deposit of ` 1,50,000.00 (Rupees One
Lac Fifty Thousand only) in the form of Call Deposit Receipt (CDR) issued in favour of Chief Engineer
(Project) Udayak, C/O 99 APO by any scheduled Bank, payable at State Bank of India, Tinsukia,
Code No - 0196 (Assam State) by those contractors who are either                       un-enlisted or
enlisted/registered with Govt Deptt other than BRO.
14.    In case the tenderer is enlisted/registered with Govt Deptt other than any formation of BRO and
his tender is not accompanied with the requisite earnest money deposit, such tender shall be
considered as non-bonafide tender and shall be rejected.
15.    Earnest money deposit of all unsuccessful tenderer shall be returned immediately by endorsing
an authority on the CDR for its refund.
16.    The security deposit amount for this work shall be 25% more than the amount of earnest
money deposit calculated as per scale laid down based on the contract amount. The amount of
security deposit shall, however, not exceed `11,25,000.00

17.    The earnest money deposit of the successful tenderer shall be returned on receipt of the full
security deposit or shall retain it as a part of security deposit.
18.    Tenderers are advised to visit the site by making prior appointment with Commander 48
BRTF (Phone No 03786-223431) C/O 99 APO/ Officer Commanding 1444 BCC (Phone No.
03803 -222273) C/O 99 APO well in advance before quoting the rate in the tender form. The
tenderer shall be deemed to have full knowledge of all relevant documents, sites, etc. whether he has
inspected in person or not. However the cost of visiting the sites shall be at the expense of tenderer.

19.    Tender duly sealed shall be received by Chief Engineer (Project) Udayak, C/O 99 APO up to
1200 Hrs on 05 Dec 2011. Tender shall be opened immediately after the time indicated
hereinbefore.

20.    Tender shall be opened in two stages i.e. Stage-I (Qualification bid) and Stage-II (price bid).
Under Stage-I, (Qualification bid), the documents as sought about the qualification shall be opened on
the date specified above. The Stage-II (price bid) containing price bid and complete tender document
shall however be opened separately on 10 Dec 2011 at 1200 Hrs after evaluation of Stage-I. The
Stage-II shall be opened only in respect of those bidders who qualify the stipulated criteria about their
resourcefulness. Stage-II (price bid) of non-qualified tenderer shall be return back unopened.
21.     The tender shall remain open for acceptance for a period of 90 days from the stipulated date of
its receipt.
22.    The tender which propose any alternation to any of the conditions laid down or which proposes
any other conditions described whatsoever is liable to be rejected.

23.    The submission of tender by a tenderer implies that he has read this notice and conditions of
contract and has made himself aware of the scope and specifications of the work to be done and of the
conditions and other cognate factors having bearing on the execution of the work.
24.    The Accepting Officer reserves his right to accept a tender submitted by a public undertaking
giving a price preference over other tender(s) which may be lower, as are admissible under the Govt.
policy. No claim for any compensation or otherwise shall be admissible for such tenderer whose
tenders may please be rejected on account of the said policy.
25.     A bonafide tenderer must satisfy each and every condition laid down in this notice. Tenderer
must be very careful to deliver a bonafide tender or alternatively to return the blank tender complete
with all documents forming part of the tender duly signed.

26.    The earnest money as submitted with the tender document shall be forfeited :-
       (a) If the tenderer withdraws the tender after tender opening during the validity period.
      (b) If the successful bidder fails within the specified time limit to sign the agreement or furnish
      the required security deposit.
27.   The Accepting Officer does not bind himself to accept the lowest or any tender or to give any
reasons for not doing so.

28.    Information relating to examination, evaluation and comparison of tender and recommendation
for the award of contract shall not be disclosed to the bidders or any other person not officially
concerned with such process until the award to the successful bidder has been announced. Any efforts
by a tenderer to influence the processing of tender or award decision may result in rejection of his
tender. This notice of tender shall form part of the Contract Agreement.

29.    Tenderer who have downloaded the tender documents from BRO website shall submit
declaration along with tender document that I/we have downloaded the tender from BRO website
www.bro.gov.in or www.bro.nic.in (link tender-link-Udayak) and I/we have not tempered/ modified the
tender form in any manner. In case if the same is found to be tempered/ modified in any manner, I/we
understand that my/our tender will be summarily rejected and I/we are liable to be banned from doing
business with BRO.
