Thank you for your interest in becoming Board Certified in Criminal Trial Law. The application filing period
opens September 1 of each year and applications must be completed and returned, along with the $250
application fee (postmarked no later than October 31).

Board certification was first introduced to members of The Florida Bar in 1982 in two practice fields. Since that
time, it has gradually expanded to include twenty-four defined areas of law. Each area has set standards that
have been approved by the Supreme Court of Florida and incorporated into the Rules Regulating The Florida
Bar. The standards include specific practice or experience criteria, passage of an examination, advanced
continuing legal education and supportive peer review sufficient to assess qualifications such as competence,
skill, experience, professionalism and ethics.

Certification was developed primarily to assist legal consumers in identi fying and evaluating the credentials of
lawyers at a time when lawyer advertising had become widespread, and often overwhelming and confusing. It
has also served as an excellent referral resource within the professional community. Lawyers who achieve
board certification are permitted to use the term “specialist”, “specializing in” and “expert” to distinguish
themselves.

The application process is fundamental to the evaluation of each candidate and you are encouraged to read the
instructions and to carefully prepare your application. Please be sure to carefully read through the area's rules,
policies and exam specifications, which can also be found on the website, prior to completing the application.
Please note that all requirements, including CLE must be accomplished by the October 31 deadline. If you have
not already done so, you will need to contact your staff liaison to obtain a current printout of your board
certification credit hours. You may be aware The Florida Bar's website will permit you to access your General
CLE hours, but at this time the certification credit hours cannot be obtained. Your staff liaison at The Florida Bar
will be happy to assist with your questions about the procedures, and your printout.

Your pursuit of board certification demonstrates your commitment to quality and professionalism in the delivery
of legal services and we wish you success.

Once your application is received, it will be several months before you are notified of its dispositio n. In the
interim, you may be asked to supplement your application as a result of committee review. Once your eligibility
to sit for the exam has been determined, you will be notified in writing.

       BOARD CERTIFICATION APPLICATION & INSTRUCTIONS

   Standards & Policies. Chapter 6, Rules Regulating The Florida Bar, sets forth the minimum standards for board
    certification and the specific requirements for each area of practice. The rules may be found on the Bar’s websit e
    at: www.floridabar.org/certification. Please be sure to carefully read the rules and policies before you begin
    your application.

   Application Filing. Please refer to the Bar's website for the postmark deadline for your area. All requirements for
    certification must be met by the postmark deadline, with one exception: The five year practice of law requirement
    may be completed after application filing, but no later than November 30 of the year in which the application is filed.

    Typed applications are preferred, but neatly handwritten applications will be accepted. Completed applications
    should be returned to the Legal Specialization & Education Department of The Florida Bar at the above addres s.

   Fees. The Certification Program is financially self-supporting and operates on revenue generated primarily from
    applicant fees. The initial filing fee is $250; the examination fee is $150; and, if certification is granted, a $1 50
    annual fee must be paid each year. You will receive an invoice for your annual fee each February via email to your
    record Bar email address. Recertification occurs every five years and you will automatically receive a reminder
    notice. The fee for recertification is $250.

    Your application must be accompanied by the $250 fee at the time of filing. Please make your payment by check,
    money order or bank cashier’s check payable to The Florida Bar. You will be notified at a later date when to pay
    the $150 examination/certification fee. All fees are non-refundable.

   Application Processing & Review. Upon our receipt of your completed application, you will (within 14 days)
    receive written notification and an assigned file number. Each question/blank must have a response. Incomplete
    applications will be returned. Only completed applications will be substantively reviewed and the accuracy of the
    information provided will be verified.

    A review and recommendation as to each applicant’s qualifications, based upon compliance with the standards
    adopted by the Supreme Court, and policies established by the certification committee (“Committee”), is the
    responsibility of the Committee, with final approval determined by the Board of Legal Specialization and Education
    (“BLSE”). This process usually takes five to six months. During this time, you may be requested to provide
    additional information. A prompt response is important to the continued progress of your application.

    Once your application has been submitted, please understand that you have a continuing obligation to notify the
    Legal Specialization & Education Department of The Florida Bar should there be any changes to any of your
    responses provided within your application.

   Professionalism and Ethics. The standards for certification include consideration of character, ethics and
    reputation for professionalism. Questions are included in the peer review statements, and the application also
    requires disclosure of disciplinary history. Should there be any changes in the information you provided on your
    application during the processing period, please advise our office in writing. Certification may be withheld pending
    the resolution of disciplinary matters.

   Examination. All applicants will be notified in writing as to examination eligibility and an exam number will be
    assigned. This number will identify you throughout the testing and grading process. Please do not call or e-mail to
    inquire about the status of your eligibility; staff is not authorized to advise you by telephone or e-mail. You will be
    notified in writing no later than March 31 of your eligibility to sit for the exam.

    Please refer to the Bar's website for information about the examination for your area. There are no make-up exam
    opportunities, although you may defer taking the exam until the following year if you wish to do so, pursuant to
    BLSE policy 2.11(e)(1). If you choose this option, an abbreviated application update w ill be required, along with
    the $150 reapplication filing fee.

    In some areas of certification, a program may be offered by a Bar Section and identified as an “Exam
    Preparation” or “Review” course. Please be advised that these courses will not necessaril y prepare you
    for the examination. The certification committees, and any other individuals involved in the preparation of
    the certification examinations, do not participate or contribute information to the steering committees for
    these programs.

   Peer Review. Each applicant shall submit names of lawyers and judges who can attest to the applicant’s special
    competence and substantial involvement in the practice of law in which certification is sought, as well as the
    applicant’s character, ethics, and reputation for professionalism, in accordance with the area standards and rule 6-
    3.5(c)(6). The BLSE or certification committee may solicit statements from additional lawyers and/or judges.

    Statements of reference concerning applicants shall be submitted on forms furnished by the BLSE. A sample copy
    of the Statement of Reference is provided for your information. Please do not send this statement to your
    references. Staff will solicit the statements on your behalf. Reference statements submitted by applican ts cannot
    be accepted.

    Please take care to provide correct addresses for each reference. Persons ineligible to file references on an
    applicant's behalf include: Florida Supreme Court Justices, members of The Florida Bar Board of Governors , the
    Appeals Committee, the BLSE and any certification committee, officers of The Florida Bar, and current partners
    and co-workers. If you have questions about whether a particular individual may be listed, please contact your
    staff liaison.

   Continuing Legal Education. The education requirements must be completed within the time frame specified in
    the application. Hours submitted must be approved for certification in the area in which you are applying. General
    CLER hours will not qualify. If you are unsure about credit for a program or individual activity, please attach
    detailed information on the program or activity, including an outline of the course content, a time schedule and
    speaker information. The Committee will review each submission and allocate credit as appropriate. CLE status
    reports from the website do not reflect credits for certification.

   Confidentiality. Rule 6-3.12, Rules Regulating The Florida Bar, provides for complete confidentiality in the
    certification process. The entire content of your file, including the statements of reference, will remain confidential.
    All communications you receive about your application and the examination will be marked “personal and
    confidential” and mailed to your official bar membership address. If you would prefer to have us correspond with
    you at a different address, you will need to complete a change of membership address form by accessing
    www.floridabar.org and clicking member profile located on the right side of the website, under member tools. You
    may also contact our Membership Records Department at (850) 561-5832.

   Staff Assistance. Your staff liaison is prepared to assist you with the application process and provide general
    information about the standards. Staff may not, however, advise you as to whether you qualify for certification, or
    discuss the status of your application. All communications as to the status of your application will be sent to you in
    writing on behalf of the committee.

                                     SUBSTANTIAL INVOLVEMENT
Rule 6-8.3(a), Rules Regulating The Florida Bar, requires:

       (a) Substantial Involvement. To become certified as a criminal trial lawyer, an applicant must
           demonstrate substantial involvement in criminal trial law. Substantial involvement shall
           include the following:
           (1) At least 5 years of the actual practice of law of which at least 30 percent has been spent
               in active participation in criminal trial law. At least 3 years of this practice shall be
               immediately preceding application or, during those 3 years, the applicant may hav e
               served as a judge of a court of general jurisdiction adjudicating criminal trial matters.
           (2) The trial of a minimum of 25 criminal cases. Of these 25 cases, at least 20 shall have
               been jury trials, tried to verdict and at least 15 shall have involved felony charges; and at
               least 10 shall have been conducted by the applicant as lead counsel. At least 5 of the 25
               cases shall have been tried during the 5 years immediately preceding application. On
               good cause shown, for satisfaction in part of the 25 criminal trials, the criminal law
               certification committee may consider involvement in protracted litigation. Protracted
               litigation is defined as litigation which proceeds on a long-term basis involving unusual
               and complicated legal or factual matters, extensive discovery, court hearings, or trial, and
               by its very nature is so time consuming it precludes the applicant from meeting the
               numerical requirement.
           (3) Submission of a criminal trial court memorandum or brief prepared and filed by the
               applicant within the 3 year period immediately preceding application. Such document
               shall be substantial in nature, state facts and argue various aspects of criminal law. The
               quality of this memorandum or brief will be considered in determining whether an
               applicant is qualified for certification.
           (4) Within the 3 years immediately preceding application, the applicant’s substantial
               involvement must be sufficient to demonstrate special competence as a criminal trial
               lawyer. Substantial involvement includes investigation, evaluation, pleading, discovery,
               taking of testimony, presentation of evidence, and argument of jury or nonjury cases. For
               good cause shown, the criminal law certification committee may waive 2 of the 3 years of
               substantial involvement for individuals who have served as judges. In no event may the
               year preceding application be waived.

III.   Criminal Trials

       Rule 6-8.3(a)(2) requires the trial of a minimum of 25 criminal cases. Of these 25 cases, at least 20 shall
       have been jury trials, tried to verdict, at least 15 shall have involved felony charges; and at least 10 shall
       have been conducted by the applicant as lead counsel. At least 5 of the 25 cases shall have been tried
       during the 5 years immediately preceding. Please list the 25 trials below, beginning with your 10 most
       recent trials in reverse chronological order. For example, case 1 should be your most recent, case 2
       your second most recent, etc. At case 11, you may list the trials from anytime during your legal career.

       Definition of a Trial.         A "trial" shall be defined as substantially preparing a case for court;
       offering testimony or evidence (or cross-examining the evidence presented by the prosecution) in an
       adversarial proceeding before a trier of fact; and submission of a case to the trier of fact for
       determination of the ultimate fact of guilt or innocence. Other cases shall be considered as follows:

               (1)      if the result is "dismissal of charges" by the court upon a motion for judgment of acquittal
       at the close of the prosecution's case or thereafter, the case shall be counted as a trial;

       Protracted Litigation.          Protracted litigation is defined as litigation which proceeds on a long-term
       basis involving unusual and complicated legal or factual matters, extensive discovery, court hearing s, or
       trial, and by its very nature is so time consuming it precludes the applicant from meeting the numerical
       requirement.
