                                          Important Tasks Following a Death
Although this is a difficult time, there are several important tasks that should not be overlooked. Taking the
proper steps now can help ease the transition process as you go forward.

The checklists that follow are a helpful way to organize the steps for survivors to take following the death of a
loved one. Some of the details requiring attention are more immediate than others, and thus we have segregated
items that need to be dealt with right away from those that aren’t as urgent.


Immediate Steps to Be Taken
      Contact someone who can assist you – relative, executor, etc.

      Review wishes of deceased regarding burial outlined in Letter to Family.

      Make funeral and burial arrangements.

      Notify friends and relatives.

Secondary Steps
~ You should meet with an attorney to review the steps necessary to administer the estate (the probate process).
Bring as much information as possible about finances, taxes and debts. The attorney will organize the
documents and help you understand the complex financial statements. Documents you should bring include:

      Certified death certificates: you can generally get the paperwork from the funeral director, and it’s a
       good idea to request at least ten copies of the death certificate

      A copy of the deceased’s birth certificate (and marriage license if applicable)
     Financial statements, including those from banks, brokerage firms and insurance agencies

      Other financial documents, including tax forms from prior years, unpaid credit card and utility bills, and
       mortgage statements

      Social Security number and Veteran’s Affairs identification number, if applicable

~ Be sure to contact the following parties to notify them of the death, make necessary changes and gather
detailed information regarding existing assets, liabilities, death benefits, etc.:

      Creditors: this includes credit card, installment loans, real estate loans, service contracts and other
       accounts

      Insurance companies: verify coverage of homeowner or auto insurance policies during the probate
       process, revise any homeowner, casualty or life insurance policies and file any insurance claims, as
       necessary

      Financial institutions, financial advisors and brokerage firms: determine the process for either closing or
       changing ownership information on accounts, investments and safe deposit boxes as appropriate

      Employee benefits department of employer: obtain a list of death benefits and provide any requested
       documentation

      Social Security office: check to see if you are eligible for death benefits

      Veteran’s Affairs: if applicable, you may be entitled to death benefits

      Organizations: if applicable, you may be entitled to benefits from unions, professional, fraternal or
       services organizations

~ Review your own estate plan including insurance policies, investment plans and legal documents such as
wills, real estate deeds and contracts. Revise beneficiary designations or other information as necessary.

Duties of an Executor
An executor is the person named in the will to handle the property of a deceased person. Essentially, the executor’s job
is to protect the property until all debts and taxes have been paid, and to see that what’s left is transferred to those who
are entitled to it. The executor has a number of duties, depending on the complexity of the estate. Typically, an executor
must determine:

         Whether or not probate court proceedings are needed. If the property is worth less than a certain amount (it
          depends on state law), formal probate may not be required.

         Who inherits the property. If there is a will, the executor will read it and distribute accordingly. If there is no
          will, a court-appointed administrator will have to look at state law (called “intestate succession” statutes) to
          determine the heirs.

         Whether or not it is legally permissible to transfer certain items immediately to the heirs, even if probate is
          required for other property.

The executor is also generally expected to do the following:

         If probate is required, file the will (if any) and all required legal papers in the local probate court.

         File an inventory and appraisal of the assets with the probate court within 90 days following the death.

         Locate the assets and manage them during the probate process, which may take a year or longer. This may
          involve deciding whether to sell real estate or securities owned by the deceased.

         Handle day-to–day details, such as terminating leases and credit cards, and notifying financial institutions and
          government agencies of the death. This may include Social Security, the Post Office, Medicare and the
          Veteran’s Administration.

         Establish an account for the estate to hold money that is owed to the deceased such as paychecks, pension
          benefits or stock dividends.

         Pay continuing expenses such as mortgage payments, utility bills and homeowner’s insurance premiums.

         Pay debts. As part of this process, the executor must officially notify creditors of the probate proceeding,
          following the procedure set out by state law.

         Pay taxes. A final income tax return must be filed, covering the period from the beginning of the tax year to the
          date of death. State and federal estate tax returns may also be required, depending on how much property was
          owned at the time of death and to whom the property was left. The estate may also need to file an income tax
          return.

         Supervise the distribution of the deceased’s property to the people or organizations named in the will. While the
          main reason for serving as an executor is to honor the deceased’s request, the executor is entitled to a payment
          for managing the estate. The exact amount is regulated by state law and is affected by factors such as the value
          of the property and what the probate court decides is reasonable under the circumstances.

funeral director will gather this information and file the Death Certificate with the proper authorities:

The Funeral or Memorial Services
You will want to consider the following points when determining the proper type of ceremony in remembrance
of your loved one:

         Determine whether they had wishes regarding funeral or memorial services with their friends, family
          members and attorney regarding any verbal or written wishes or instructions.

         Contact a funeral home or memorial society. Veterans, service members, and their dependents can be
          buried in a national cemetery for free. If buried elsewhere, veterans receiving VA disability payments at
          the time of death, can receive an allowance towards burial and funeral expenses.

         Let family and friends know what the plans are and ask them to help you contact others.

         Determine if all or part of the funeral costs have been prepaid. (You can refer to agreement documents
          that may have been kept, or ask the funeral home. Also, check with the cemetery to see if there is a
          prepaid plot and/or burial insurance.)

         Submit an obituary to the local paper(s). Make sure to include a charitable organization for donations if
          that is preferred over flowers.

         Keep track of all donations, flowers and cards received so that you may acknowledge the senders.
          Sympathy acknowledgement cards may be purchased, or possibly obtained from the funeral home.

About Probate
Probate is a legal process that includes:

         Proving in court that the will is valid

         Identifying and inventorying the property of the deceased

         Having the property appraised

         Paying debts and taxes

         Distributing the remaining property as the will or state law directs

Estate attorneys usually handle the probate process because it involves a court hearing. Probate typically takes
place in the city or county where the deceased person lived, but keep in mind, if real estate was owned in
additional states, those states may require a separate probate enforcing that state’s laws. The entire process can
be lengthy, sometimes stretching two or three years, depending on the settlement of the estate. Property covered
by the will cannot be distributed to beneficiaries until the probate process is complete.

Property That Avoids Probate

Not all property has to go through probate. Most states allow estates below a certain dollar amount to pass free
of probate, or through a simplified probate procedure. In addition, property that passes outside of the will, such
as through joint tenancy, a beneficiary designation or a living trust, is not subject to probate.

Who is Responsible for handling probate?

In most circumstances, the executor named in the will takes this job. If there is not a will, or the will fails to
name an executor, the probate court names someone (called an administrator) to handle the process – most often
the closest capable relative, or the person who inherits the bulk of the assets.

Taxes after Death
Because taxes due after death can be complicated, it is important that you consult and attorney or accountant
familiar with both federal and state taxation.


Federal Estate Tax

A federal estate tax return may need to be filed within 9 months after the death depending on whether the
decedent is survived by a spouse and/or if the estate exceeds the allowable estate tax credit.

Once you have assembled all assets included in the estate and determined its value, consult with an attorney to
determine if estate tax is applicable. Payment and federal estate tax returns are due in cash, nine months after a
person’s death. If you need more time, you can request an extension before that date. You will not be charged a
penalty for the extra time, but you will be charged interest.

State Tax

Many states impose an inheritance or estate tax. Therefore, it is imperative that you consult a professional
accountant or attorney for guidance. States with estate tax systems tax the deceased person’s estate before assets
are distributed to his or her heirs. Those states with an inheritance tax system will tax the heirs on the property
they receive.

Income Tax

Federal income tax returns and state income tax returns for the deceased are due on April 15 of the year
following the death. If the estate generates income over a certain amount during that time, the estate itself may
have to file an income tax return. It is the responsibility of the executor to ensure that returns are filed on time.

                                            The Letter to Family and Friends

Inevitably, we all must deal with the passing of a close family member or loved one at some point in our life. A
well organized and complete “financial organizer” can save grieving family members from a time consuming
and stressful “treasure hunt”. The financial organizer can readily identify the assets, accounts, estate documents,
beneficiaries, and other critical financial pieces requiring attention after someone’s death.

Beyond the facts and details, many people miss the opportunity to leave important sentiments and preferences in
a final written message, which we call the “Letter to Family and Friends”.

The Letter to Family and Friends is more than a will. It deals with the important sentiments you would like
close ones to know in the event of your untimely demise or incapacity.

A will most often contains our instructions about who receives specific assets from our estate. There is much
more your survivors might like to know that can be spelled out in the Family Letter. It is not a legally binding
document, and thus can be changed as desired. Some people send copies out to family members. At a
minimum, we advise that you give a copy to your attorney or named executor, place one in your financial
organizer, and one in an obvious place your family might look for such documents.

The start of your letter might contain a general paragraph providing a broad overview of your estate and what
beneficiaries can expect. Don’t get bogged down in details here, your binder will have a copy of your will and
specifics about accounts, properties, debt, and benefits.

Next, what sentiments are important to convey? Here is a partial list:

     (1) Desired funeral arrangements and gatherings, note burial info in binder if applicable
     (2) What would you like to see for your children, grandchildren? (a good education, experience abroad, a
         summer of reading, community service, simple words of encouragement).
     (3) How should a pet be cared for?
     (4) How should personal items be distributed? (jewelry, paintings, clothing, favorite objects, photo albums,
         family memorabilia, collections)
     (5) Perhaps your will does not specifically list charities as a beneficiary – but if you have favorite charities
         also list them here in the event the family would like to direct remembrances in your name.

                                          Organizing your Financial Records
Many people struggle with the mounting level of paper they receive in the mail. What is really important to keep
and what can be thrown away? Here are suggestions on how to organize your financial records, as well as some
general guidelines for how long you should keep them.

Record keeping becomes easier if you think in terms of separating papers by your need to use them, keeping
short-term items together, long-term items together and permanent -items together. You’ll want to start with 3
file boxes, labeling them “Immediate”, “Long Term”, and “Permanent”.

The “Immediate” file box will contain items that you are currently working with such as bills and bank
statements, as well as items that you will need for year-end taxes. This box should be cleaned out frequently,
placing documents in either the long term box, permanent box, or destroyed.

In the “Long Term” box think 3 – 7 years. In general, this box will contain tax-related documents as well as
supporting documents needed for major and minor purchases. This box should be cleaned out annually, either
placing items in the “permanent” box or destroying them.

Your “Permanent” box will contain items that should be held indefinitely. Consider keeping permanent records
in a fire-proof locked box. Files not needing ready access can be held in a bank safety deposit box (always keep
a copy of your wills/trusts at home).

Remember to shred any sensitive documents and anything with your account numbers, social security numbers
and/or date of birth.

Tax Records. There are basically two types of tax information that you need to be concerned about:
information you need in case of an audit and information to support your claims to income. Why the seven-year
rule category? The IRS can audit you for up to three years from the date you file your return and can pursue
under reported income for up to six years.

Monthly Investment Statements. The primary reason for keeping investment statements and confirmations of
security purchases and sales (other than to view trades and changes in value) is to track the original cost basis,
additional purchases, plus all reinvested distributions during the holding period. Check to see if this information
is listed on your year-end statement or available from the brokerage firm. If so, we recommend keeping the
year-end statement plus the most recent twelve months. If not, you should keep all statements showing any
activity during the year.

In rare cases, there could be a class action lawsuit relating to an investment holding applicable to the time you
held it. Participating in the recovery process involves providing documentation of purchase dates, holding period
and sale date. We can provide this information for you as needed if a position was purchased within an
FNIC/Pershing brokerage account.

                                                 How to Avoid Identity Theft
Identity theft is one of the fastest growing crimes, with almost 10 million victims afflicted last year. It is
unfortunate that we have to worry about identity theft, but taking some important steps can reduce your risk.

Identity theft occurs when someone uses your personal identifying information, like your name, Social Security
number, or credit card number, without your permission, to commit fraud or other crimes.

The Federal Trade Commission estimates that as many as 9 million Americans have their identities stolen each
year. In fact, you or someone you know may have experienced some form of identity theft.

The crime takes many forms. Identity thieves may rent an apartment, obtain a credit card, or establish a
telephone account in your name. You may not find out about the theft until you review your credit report or a
credit card statement and notice charges you didn’t make—or until you’re contacted by a debt collector.


How do thieves steal an identity?

Identity theft starts with the misuse of your personally identifying information such as your name and Social
Security number, credit card numbers, or other financial account information. For identity thieves, this
information is as good as gold.
Skilled identity thieves may use a variety of methods to get hold of your information, including:

     1. Dumpster Diving. They rummage through trash looking for bills or other paper with your personal
        information on it.
     2. Skimming. They steal credit/debit card numbers by using a special storage device when processing
        your card.
     3. Phishing. They pretend to be financial institutions or companies and send spam or pop-up messages to
        get you to reveal your personal information.
     4. Changing Your Address. They divert your billing statements to another location by completing a
        change of address form.
     5. Old-Fashioned Stealing. They steal wallets and purses; mail, including bank and credit card
        statements; pre-approved credit offers; and new checks or tax information. They steal personnel records,
        or bribe employees who have access.
     6. Pretexting. They use false pretenses to obtain your personal information from financial institutions,
        telephone companies, and other sources.
     7. Obituaries. Scammers look at obituaries for names and addresses, then buy social security numbers and
        other personal data for the deceased individual.

     1.       Deter identity thieves by safeguarding your information
                 Shred financial documents and paperwork with personal information before you discard them
                 Protect your social security number. Don’t carry your SS card in your wallet or write on a
                     check.
                 Don’t give out personal information over the phone, internet or mail. Never email your personal
                     information. Don’t respond to emails directing you to a site to confirm your user name or
                     password, even if it looks legitimate.
                 Use firewalls, anti-spyware and anti-virus software to protect your home computer and keep
                     them up-to-date.
     2.       Detect suspicious activity by routinely monitoring your financial accounts and billing statements. Be
              alert to signs that require immediate attention
                 Bills that do not arrive as expected
                 Unexpected bills or account numbers
                 Denials of credit for no apparent reason
                 Calls or letters about purchases you did not make
                 Inspect your credit report.

          The law requires the major nationwide consumer reporting companies—Equifax, Experian, and
          TransUnion—to give you a free copy of your credit report each year if you ask for it.
          Visit www.AnnualCreditReport.com or call 1-877-322-8228, a service created by these three
          companies, to order your free credit reports each year. You also can write: Annual Credit Report

     3.       Defend against ID theft as soon as you suspect a problem

          a) Place a free "Fraud Alert" on your credit reports, and review the reports carefully. The alert tells
             creditors to follow certain procedures before they open new accounts in your name or make changes
             to your existing accounts. The three nationwide consumer reporting companies have toll-free
             numbers for placing an initial 90-day fraud alert; a call to one company is sufficient:

     Placing a fraud alert entitles you to free copies of your credit reports. Look for inquiries from companies
     you haven't contacted, accounts you didn't open, and debts on your accounts that you can't explain. An
     initial alert stays on your reports for at least 90 days. An extended alert is available if you have been a
     victim of credit theft and submit an Identity Theft Report.
          b) Close accounts. Close any accounts that have been tampered with or established fraudulently.
                         Call the security or fraud departments of each company where an account was opened or
                          changed without your okay. Follow up in writing, with copies of supporting documents.
                         Use the ID Theft Affidavit at ftc.gov/idtheft to support your written statement.
                         Ask for verification that the disputed account has been closed and the fraudulent debts
                          discharged.
                         Keep copies of documents and records of your conversations about the theft
          c) File a police report. File a report with law enforcement officials to help you with creditors who may
             want proof of the crime.
          d) Report the theft to the Federal Trade Commission. Your report helps law enforcement officials
             across the country in their investigations.

Monitoring your credit report periodically can help you identify errors, avoid delays in obtaining a mortgage,
and spot activity due to identity theft.
The law requires the major nationwide consumer reporting companies—Equifax, Experian, and TransUnion—to
give you a free copy of your credit report each year if you ask for it. The information is provided within about
15 days.

order your free credit reports each year. You also can write: Annual Credit Report Request Service, P.O. Box

You are entitled to receive one free credit report every 12 months from each of the nationwide consumer credit
reporting companies through the Central Source. It is entirely your choice whether you order all three credit
reports at the same time or order one now and others later. The advantage of ordering all three at the same time
is that you can compare them. (However, you will not be eligible for another free credit report from the Central
Source for 12 months.) On the other hand, the advantage of ordering one now and others later (for example, one
credit report every four months) is that you can keep track of any changes or new information that may appear
on your credit report. Remember, you are entitled to receive one free credit report every 12 months from each of
the nationwide consumer credit reporting companies – Equifax, Experian and TransUnion – so if you order from
only one company today you can still order from the other two companies at a later date.

It isn’t necessary to pay a fee for this information, unless you want it immediately. It is generally not
recommended that you pay a fee for “monitoring” your report. If you suspect identity theft, you may place a
fraud alert at no charge.
