Item: 01.    District - Environmental Clearance -Reg.

Noted. The decision of the SEIAA may be communicated to the proponent.

The SEIAA in its meeting held on 28.06.2011 observed as following:

After detailed discussions, since it is an independent activity located 5 km away from the mining
area and not exempted under any notification or guidelines it is necessary to have public hearing
apart from carefully assessing Environment Impact Assessment of the project in the locality such
as the impurities and the waste and its chemical composition and the treatment methodology etc.,

Keeping this in view, the SEAC discussed and observed as follows:

The project is considered under B1 category. The TORs proposed in the SEAC meeting held on
06.01.2011 are approved. The project proponent is advised to prepare draft EIA report with the
proposed TORs in addition to the following additional TOR; undergo the process of public
hearing in consultation with APPCB and submit the final EIA report duly incorporating the issues
emerged in the public hearing to the SEAC for appraisal. The TORs are valid for a period of
TWO years.

Addl. TOR:

    Study of the Impacts of impurities, waste generated, its chemical composition and the
     treatment methodology etc., generated out of the project on the locality and its
     surroundings.

Agenda       LPG Bottling Plant by M/s. Hindustan Petroleum Corporation Ltd., Bukkarai

Noted. The decision of the SEIAA may be communicated to the proponent and the SEAC
observed as follows:
The stone crusher does not come under the purview of EIA-2006 Notification and its amendments
thereof.

Since, the activity viz., stone crusher and batching plant, proposed is not covered under the
notification of the MoE&F, GOI. The issue of prior EC for such unit is not required . In view of
the above, amendment to the EC issued earlier does not arise.

However, the project proponent shall be informed to take such other necessary action in carrying
out such activity in the premises as required under various regulations in force.

Agenda       Projects coming up in 10 km radius of Osman Sagar and Himayat sagar-
Item: 07     Decision taken by the SEIAA –Reg.

The G.O. Ms. No. 111 dt. 08.03.1996 is mainly based on watershed / basin boundary but not the
political boundaries. Hence, each project can be evaluated based on the locality of the project. The
location in terms of latitude and longitude of the site can be known from the GPS data available at
APPCB, by which the project can be appraised.

Agenda      Integrated Municipal Solid Waste Management Project (proposed by GHMC),
Item: 08.   Jawaharnagar, (V), Shameerpet (M), Ranga Reddy District - Environmental
            Clearance -Reg.

The representative of the project proponent Sri. D. Sudhakar, EE, GHMC and the representative
of the consultants Smt. Padmaja & Sri Vijay Kumar of M/s. Ramky Enviro Engineers Ltd.,
attended and made a presentation before the SEAC.

The SEAC has discussed the issue in detail and a Sub-committee also visited the site and made
some observations. Based on the revised proposal of the proponent and the observations of the
Sub-committee, the SEAC is of the opinion to obtain a detailed technical report from APPCB, as
it is regulatory Authority, for taking final view on this project.
The decision on this proposal can be taken after receiving the report from APPCB.
This can be referred to SEIAA for its approval.

Agenda        M/s. Celon Organics Pvt. Ltd., IDA Kondapally, Ibrahimpatnam (M), Krishna
Item: 09.     District - Environmental Clearance -Reg.

The representative of the project proponent Sri. K. Ramana Mohan, Project Manager and the
representative of the consultants Sri Chandra Mohan of M/s. Right Source Industrial Solutions
Pvt. Ltd., Hyderabad attended and made a presentation before the SEAC.

The proponent informed that it is proposed to manufacture 54 products, out of which any 8
products will be manufactured at any given point of time on campaign basis. It is noted that the
area of the project is only 2340 sq.m., which may not be sufficient to provide all the utilities of the

bulk drug unit. Hence, the project proponent is advised to submit revised proposal incorporating
the following information:

   1. Detailed feasibility for manufacture of 54 products and storage of different type of raw
      materials including Hazardous chemicals/solvents, establishment of treatment systems and
      utilities in about Ac. 0.5.

   2. Copy of membership of CETP in IDA Kondapalli under establishment, if any.

   3. Layout plan of IDA indicating the location of the proposed project.

   4. Revised site layout plan drawn to scale showing various facilities to be provided in the
      project.

Agenda        M/s. Sravanthi Industries Pvt. Ltd., Sy.Nos. 1,2,3, 264, 266, of Kothagudem, and
Item: 10.     63 to 66, 73 to 78, 81 & 82, Chikkavaram, Krishna District - Environmental
              Clearance -Reg.

The representative of the project proponent Sri. D.V. Rao, G.M and the representative of the
consultants Sri G.V. Raghava Rao of M/s. Vimta Labs Ltd., attended and made a presentation
before the SEAC.

In the earlier meeting of the SEAC, the project proponent was requested

   (i) To explore the possibility to draw water from River Krishna.

   (ii) To furnish a commitment to achieve zero discharge from the proposed project by recycling
        the entire treated waste water with in the premises by installing RO Plant. Any type of
        discharge from the plant into the surplus course is not permitted.

The project proponent replied as following in response to the points mentioned above:

   (i) The proponent informed that their requisition to draw water from Eluru Canal from
       through river krishna was not considered vide lr.dt. 27.06.2011 by the irrigation and CAD
       Department. Further, river Krishna is located more than 40 km from the proposed site.
       Laying of water pipeline passing through agriculture lands, roads, railway track will be
       difficult and pumping water from such a long distance may not be viable option. It also
       requires substantial investment. Hence, the total water required for the proposed project
       will be met from Ground water (700 KLD) and Budameru drain (590 KLD).

  (ii) The proponent informed that they would also install RO plant to achieve Zero Liquid
       Discharge. Further, the proponent vide lr. dt. 28.07.2011 reiterated commitment to install
       RO plant and achieve Zero Discharge from the proposed project.
After detailed discussions, the project is recommended for issue of prior EC with the following
specific conditions:

    The RO plant of capacity 670 KLD shall be installed as committed by the proponent vide
     lr. 28.07.2011.
    Zero liquid discharge concepts shall be adopted. Any type of discharge from the plant into
     the surplus course is not permitted at any circumstances.

Agenda        M/s. India Coke & Power Pvt. Ltd., Manukuru (V), Nayudupeta (M), SPS
Item: 11.     Nellore District - Environmental Clearance -Reg.

The representative of the project proponent Sri. M. Chandra Sekhar and the representative of the
consultants Sri B.S.Chandra Murthy of M/s. B.S. Envi-Tech (P) Ltd., Hyderabad attended and
made a presentation before the SEAC.

The Public hearing was held on 07.06.2011 and the proponent submitted final EIA report. The
SEAC examined final EIA report, minutes of the public hearing and issues emerged during the
public hearing. After detailed discussions, the project proponent is advised to submit a copy of
coal linkage document on Rs. 100/- stamped paper for further necessary action.

Agenda       M/s. Berry Metals Ltd., Plot No.5, APIIC Ltd., Industrial Park, Peddapuram
Item: 12.    (Phase III), East Godavari District – Environmental Clearance – Reg.

The representative of the project proponent Sri. E.V. Prasad and the representative of the
consultants Sri Y.B.S. Murthy of M/s. B.S. Envi-Tech (P) Ltd., Hyderabad attended and before
the SEAC.

The proponent has submitted a copy of the letter issued by the Zonal Manager, APIIC, IDA,
Kakinada stating that site has been allotted to the proposed project in Sy. No: 912 (p) and 913 (p).
The plot numbers allotted to the proposed project were not mentioned in the above letter. Further,
the proponent informed that the plot no. allotted to the proposed project are Plot No. 5, 6 & 7 in
Sy. No: 912 (p) & 913 (p), APIIC Industrial Park, Peddapuram (Phase-III), E.G.District.

After detailed discussions, the SEAC observed that there is no clarity in the Plot numbers Survey.
numbers and extent of area of the proposed project. Hence, the proponent is advised to furnish
necessary supporting documents from competent authorities indicating the above information for
taking further necessary action.

Agenda       M/s. Kerneos India Aluminate Technologies Pvt. Ltd., Pudi (V), Atchutapuram
Item: 13.    Industrial Park (M), Visakhapatnam District - Environmental Clearance -Reg.

The representative of the project proponent Mr. Benoit Valdelievre & Sri Praveen Kumar and the
representative of the consultants Sri B.S.Chandra Murthy of M/s. B.S. Envi-Tech (P) Ltd.,
Hyderabad attended and made a presentation before the SEAC.

Earlier, M/s Magus Marketing Pvt. Ltd. has proposed to manufacture Calcium Aluminate Binders
at Atchutapuram, Visakhapatnam District and requested to issue clarification on applicability of
EIA-2006 Notification and its amendments thereof. The issue was examined by the SEAC and it
was noted that the manufacture of Calcium Aluminate Binders is involved in Primary
metallurgical process, which is category-A project. Hence, the proponent was advised vide lr. dt.
16.05.2011 to approach MoE&F, GOI, New Delhi for obtaining EC.

Now, the proponent vide lr. dt. 07.07.2011 (with new name M/s. Kerneos India Aluminate
Technologies Pvt. Ltd.) submitted an application seeking EC (if applicable) for the proposed
project to manufacture Calcium Aluminate Binders. The proponent furnished a copy of lr. dt.
27.07.2011 addressed to M/s Magus Marketing Pvt. Ltd., issued by the MoE&F, GOI furnishing
clarification. The Ministry clarified that the process of manufacturing Calcium Aluminate Binders
is neither primary nor secondary metallurgical process. Further, clarified that Calcium Aluminate

is refractory cement, specialized type of cement, which does not come under OPC. It is a special
binder for high temperature applications.

The SEAC noted that the proposed manufacturing process is similar to that of cement and also the
MoE&F, GOI clarified that it is a specialized type of cement. The proponent informed that the
proposed site is adjoining APSEZ, Atchutapuram. After detailed discussions, the project is
considered under B1 category. The proponent is directed to prepare draft EIA report with the
standard TORs applicable to cement industries, undergo the process of public hearing in
consultation with APPCB, submit final EIA report, minutes of public hearing and response of the
proponent to the issues emerged in the public hearing to the SEAC for appraisal. The terms of the
reference are valid for a period of TWO years.

Agenda          (28 KLD Grain based Distillery 4 MW) by M/s. Ind-Barath Biosciences Ltd.,
Item: 14.       Sy.No: 96/1F, 104/1D, 104/2A, 104/2B, and 92, Pattisam (V), Polavaram
                (M), West Godavari District -Environmental Clearance – Reg.

The representative of the project proponent Sri A.S.Y Narayana Murthy and the representative of
the consultants Sri B.S.Chandra Murthy of M/s. B.S. Envi-Tech (P) Ltd., Hyderabad attended and
made a presentation before the SEAC.

The Public hearing was held on 23.06.2011 and the proponent submitted final EIA report. The
SEAC examined final EIA report, minutes of the public hearing and issues emerged during the
public hearing.

After detailed discussions, the project proponent is advised to submit a copy of coal linkage
document on Rs. 100/- stamped paper and a commitment letter mentioning that “the ground
water shall not be used in the process under any circumstances” for further necessary action.

Agenda        M/s. RVR Power Projects (AP) Pvt. Ltd., Chandaparu (V), Palakolu (M), West
Item: 15.     Godavari District - Environmental Clearance - Reg.

The representative of the project proponent Sri C.V. Subba Raju and the representative of the
consultants Sri B.S.Chandra Murthy of M/s. B.S. Envi-Tech (P) Ltd., Hyderabad attended and
made a presentation before the SEAC.

It is noted that Chandaparru (V) is located at a distance of 0.2 km from the proposed site. After
detailed discussions the draft TORs proposed by the proponent are approved. In addition to
these, the following additional TORs shall be considered for preparing the draft EIA:

   (i)      All the coordinates of the plant site with topo sheet of Survey of India.

   (ii)      Land use and land cover map of the study area of 10km radius and a vicinity map of
            3km radius shall be prepared using high resolution satellite data. Location of any
            National Park, Sanctuary, Elephant / Tiger Reserve (existing as well as proposed),
            migratory routes, if any, within 10 km of the project site shall be specified and marked
            on the land use and land cover map.

   (iii)    Land requirement for the project to be optimized. Item wise break up of land
            requirement and its availability to be furnished. The norms prescribed by CEA should
            be kept in view. It should also include land to be acquired, if any, for fuel
            transportation system as well as for laying of pipeline including Right of Way (ROW).

   (iv)     Quantity of fuel required, its source and transportation.
   (v)      Examine the feasibility of zero discharge. In case of any proposed discharge, its
            quantity, quality and point of discharge, users downstream etc. should be provided.

   (vi)     Optimization of COC for water conservation. Other water conservation measures
            proposed in the project should also be given. Quantity of water requirement for the
            project should be optimized.
   (vii)    Risk assessment should be carried out. It should take into account the maximum
            inventory of storage at site at any point in time. The risk contours should be plotted on
            the plant layout map clearly showing which of the proposed activities would be
            affected in case of an accident taking place. Based on the same, proposed safeguard
            measures should be provided. Measures to guard against fire hazards should also be
            provided.

   (viii) All documents to be properly referenced with index, page numbers and continuous
          page numbering.

   (ix)     Where data is presented in the report especially in table, the period in which the data
            was collected and the source should invariably be indicated. In addition to that the
            standards prescribed by the MoE&F, GoI for the respective parameters shall be
            indicated.

The proponent shall prepare draft EIA report considering above mentioned TORs in addition to
the TORs submitted by them, undergo the process of public hearing in consultation with APPCB,
submit final EIA report, minutes of public hearing and response of the proponent to the issues
emerged in the public hearing to the SEAC for appraisal. The terms of the reference are valid for a
period of TWO years.

Agenda        M/s. Nekkanti Power Pvt. Ltd., Kothapatnam (V), Kota (M), SPS Nellore District -
Item: 16.     Environmental Clearance – Change of site- Reg.

The representative of the project proponent Sri G. Krishna Mohan and the representative of the
consultants Sri B.S.Chandra Murthy of M/s. B.S. Envi-Tech (P) Ltd., Consultants, Hyderabad
attended and made a presentation before the SEAC.

The proponent informed that the location of the project has been shifted to new site which is
located at about 0.8 km south of the earlier site. The proponent further informed that the earlier
proposal in the old site is dropped. Hence, the earlier application may be returned.

The proponent vide lr. dt. 18.07.2011 submitted a revised / fresh application for the new site. It is
noted that the water required for the proposed project will be supplied by M/s. Krishnapatnam
Water Company Ltd. Located at about 2.0 km from the proposed site. The proponent informed
that it is not proposed to draw water from the sea.

After detailed discussions the present proposal is considered under B1 category. The draft TORs
proposed by the proponent are approved. In addition to these, the following additional TORs shall
be considered for preparing the draft EIA:

   (i)      All the coordinates of the plant site with topo sheet of Survey of India.

   (ii)    Land use and land cover map of the study area of 10km radius and a vicinity map of
           3km radius shall be prepared using high resolution satellite data. Location of any
           National Park, Sanctuary, Elephant / Tiger Reserve (existing as well as proposed),
           migratory routes, if any, within 10 km of the project site shall be specified and marked
           on the land use and land cover map.

   (iii)   Land requirement for the project to be optimized. Item wise break up of land
           requirement and its availability to be furnished. The norms prescribed by CEA should
           be kept in view. It should also include land to be acquired, if any, for fuel
           transportation system.

   (iv)    Quantity of fuel required, its source and transportation. A confirmed fuel linkage
           (MOU) should be provided on Rs. 100/- Stamp paper under company seals of both the
           parties.
   (v)     The source of water, water balance report shall be submitted. The proponent shall
           examine the feasibility of zero discharge. In case of any proposed discharge, its
           quantity, quality and point of discharge, users downstream etc. should be provided.

   (vi)    Optimization of COC for water conservation. Other water conservation measures
           proposed in the project should also be given. Quantity of water requirement for the
           project should be optimized.
   (vii)    Risk assessment should be carried out. It should take into account the maximum

   (x)     Impact of the proposed project on Kottapatam Reserved Forest as it exists adjacent to
            the proposed site.

The proponent shall prepare draft EIA considering above mentioned TORs in addition to the
TORs submitted by them, undergo the process of public hearing in consultation with APPCB,
submit final EIA, minutes of public hearing and response of the proponent to the issues emerged
in the public hearing to the SEAC for appraisal. However, the final decision of SEAC is subject to
the orders of the Hon’ble High Court in W.P. No. 14305 of 2011 & W.P. No. 20114 of 2011 filed
against the thermal power plants in Nellore District. The terms of the reference are valid for a
period of TWO years.
