MANDATE TO LEASE
Made and entered into by and between: (hereinafter “the Owner”) and (hereinafter “the agent”)

The Owner hereby appoints the agent as the sole agent to find a Lessee for his/her/its property which is more fully described as: ________________________________________________________________________________________________________________________ ________________________________________________________________________________________________________________________ ________________________________________________________________________________________________________________________ ___________________________________________________________________ 2 The agent's appointment will endure for a period of _________________ from the date of signature hereof. 3 The Owner undertakes that for as long as the agent's mandate endures: 3.1 He/she/it will not hire the property to any person other than a Tenant introduced by the agent; 3.2 He/she/it will not hire the property to any person who negotiates directly with the owner. 3.3 If the owner contravenes the terms of clause 3.1 above, the agent will nevertheless be deemed to have earned his/her/its commission at the rate specified in clause 4 below. 4 If the agent fulfils his/her/its mandate, the agent will be entitled to a commission at the appropriate rate fixed by the Estate Agents Board from time to time. 5 5.1 The agent will earn his/her/its commission if a Tenant introduced by the agent is willing and able to hire the property and signs a written offer for the hire of the property upon terms and conditions substantially corresponding with the specific terms and conditions set out below, alternatively upon such terms and conditions which would ordinarily be applicable to the hiring of industrial/commercial/residential property. 5.2 The terms and conditions of this mandate are: RATE OF RENTAL: COMMENCEMENT OF MONTHLY RENTAL: RATE OF ESCALATION: PERIOD OF HIRE: DATE OF COMMENCEMENT OF LEASE: 6 The agent will have earned his/her/its commission immediately upon the delivery to the owner of a written offer to hire the property signed by a willing and able Tenant. However, if any offer (or agreement arising upon the acceptance of any offer) is subject to any specific condition, then the agent will only have earned his/her/its commission upon the fulfilment of such condition/s.
