LAKE ARROWHEAD VILLAGE EXCLUSIVE USE CLAUSES FOOD BUSINESSES ESPRESSO DEL LAGO So long as tenant continues to operate in accordance with its use clause, Landlord agrees not to lease after the date of this Lease to another business whose primary use (more than 50% of gross sales) is the retail sale of coffee and/or the operation of an internet café. GNC Landlord covenants and agrees that, subsequent to the execution of this Lease, Landlord shall not enter into any leases with other tenants of the Shopping Center which contains a use clause permitting the tenant to conduct a business for the primary purpose of the sale of health foods, vitamins or mineral supplements. GREEN BURRITO Landlord agrees not to lease to another Tenant primarily engaged in a Mexican take-out business, excluding existing tenants. LAKE ARROWHHEAD DELI AND FAMILY FUN CENTER Landlord hereby agrees not to lease space in the Lake Arrowhead Village to a pizza type restaurant where pizza is a primary menu item. Assuming Lessee maintains at least twelve (12) games in good working condition on an ongoing basis, Lessor agrees not to lease to another business primarily engaged as an arcade in Lake Arrowhead Village. STATER BROS. SUPERMARKET Landlord agrees not to lease, rent or promote the use of any other portion of the Shopping Center owned by Landlord for the operation or conduct of a grocery store or grocery store business in direct competition of Tenant, which restriction includes, but is not limited to, a business engaged in the sale of meat, produce or other grocery items to be consumed off premises. Tenant recognizes that other tenants, such as a liquor store, a bakery, a delicatessen and a restaurant may or will be located in the Shopping Center, and that such tenants are not in direct competition to Tenant. SUBWAY Operation of sandwich and salad shop with minimum 24 seats. Landlord agrees not to lease to another business whose main source of income is sub-sandwiches. Tenant acknowledges that this clause does not apply to any existing businesses in Lake Arrowhead Village. Tenant may sell any and all items that tenant sells nationally. WOODY’S BOATHOUSE RESTAURANT Steak, seafood and salad restaurant with bar. Landlord agrees not to lease to another restaurant operation primarily engaged as a steak and seafood restaurant so long as tenant is not in default of this lease.
