PART ONE: Introduction


What the Publication Scheme is
This Publication Scheme is a complete guide to the information routinely published by East Lancashire
Hospitals NHS Trust. It is a description of the information about our Trust which we make publicly available.
We shall review the Scheme at regular intervals and monitor how it is operating.


It is important to us that this Scheme meets your needs and we have designed it to be a route map so that
you can find information about East Lancashire Hospitals NHS Trust easily. Under Section 19 of the
Freedom of Information Act 2000 (there is a link to the Act in Part Three below), the Trust has a legal duty to
adopt and maintain a Publication Scheme for the publication of Trust information. The purpose of the Act is
to promote greater openness by public authorities.


The Publication Scheme will help you to find all the information which the Trust publishes. The Freedom of
Information Act does not change the right of patients to protection of their patient confidentiality in
accordance with Article 8 of the Human Rights Convention, the Data Protection Act and at common law.
Maintaining the legal right to patient confidentiality continues to be an important commitment on our part. To
help with this, we have appointed a Caldicott Guardian, who has responsibility to ensure the protection of
patient confidentiality throughout the Trust in accordance with your legal rights. The Trust Caldicott Guardian

Rights of Access to Information


       At the present time, in addition to accessing the information identified in this Publication Scheme,
        you are entitled to request information about East Lancashire Hospitals NHS Trust under the NHS
        Openness Code 1995. A link to this is available in Part 3 of the Scheme and hard copies are
        available free of charge from the Department of Health. Sometimes, some or all of the information
        cannot be provided and we will explain the reasons why not when this happens.
       The Freedom of Information Act recognises that as a member of the public, you have the right to
        know how public services such as the NHS are operated, how much they cost and how you can
        make complaints if you need to. You have the right to know which services are being provided, the
        targets that are being set, the standards of services that are expected and the results achieved.

We will state how you can obtain the information outlined within each class. This will be either via the website
or as a hard copy or other media as stated within each class. The publications are all free unless otherwise
indicated. Where information is provided at a cost the charges will be calculated as set out in class 15.


The Trust’s commitment to publish information excludes any information which can legitimately be withheld
under the exemptions set out in the NHS Openness Code or the Freedom of Information Act. Where

About the Trust           East Lancashire Hospital Trust was established on 1 April 2003 by the merger of
                          Blackburn, Hyndburn and Ribble Valley Health Care NHS Trust and Burnley Health
                          Care NHS Trust

                          The Trust is responsible for providing acute hospital services to over half a million
                          people living in East Lancashire. Our hospitals provide over 1,350 inpatient beds.
                          The Trust has an annual operating budget of £270 millions, and is one of the areas
                          largest employers with over 6,500 staff.

                       The Trust Board oversees the work of the organisation. Our Trust Board has Non
                       Executive Directors, including the Chair, Executive Directors and the Chief
                       Executive. Members of the Board can be found on our website under Management

                       These members of the Trust Board have voting rights and legal responsibility for the
                       oversight of the work of the Trust.

Partnerships           The Trust also works in partnership with a number of NHS and non NHS
                       organisations, which emphasises the need for health and social care agencies to
                       work closely to deliver more responsive patient services. This development is in
                       accordance     with   national   guidance   and   local   needs.     These   partnership
                       organisations include local authorities and PCT’s and charities.
                       Some partnerships will involve information sharing, with agreed information sharing
                       protocols between organisations about how this information is shared.

Class description: Funding details, charging policies and financial accounts


Overview               The Trust’s financial plans are based on the requirement to achieve statutory
                       targets, improve value for money and achieve efficiency savings. Information
                       relating to our financial plans can be found in the Annual Report, the current
                       Business Plan and Trust Board papers.
Responsibility         The Finance Director has corporate responsibility for the oversight of the Trust’s
                       finances. Please go to class 2 for details of the Finance Director.

Financial Position      The Trust Board receives regular updates on the financial position for the
                        organisation and makes decisions about resources and the Trust’s budget.
Annual Accounts         A set of accounts is developed for each year and presented to the Trust Board. The
                        current annual accounts are provided in our Annual Report which can be found on
                        our website.
Finance/Funding         The revenue position represents the income received and expenditure incurred on
                        the day to day activities within the Trust in the provision of services.
How We Purchase our Equipment and Supplies
                        The Trust follows guidance established by the NHS Purchasing and Supply Agency
                        (PASA). This website can be found at http://www.pasa.doh.gov.uk. The PASA
                        guidance sets out the standard terms and conditions that NHS organisations should
                        follow with regard to purchasing our equipment and supplies. The overall aim is to
                        achieve best value for money for the NHS. This is referred to as ‘procurement’ in the
                        NHS.
Tendering               The Trust will advertise relevant tenders for goods or services through the “Official
                        Journal of the European Communities” (OJEC). Their website can be found at

                        The Trust will ensure that competitive tenders are invited for the supply of goods,
                        materials and manufactured articles and for the rendering of services including all
                        forms of management consultancy services (other than specialised services sought
                        from or provided by the Department of Health) in accordance with the limits set out

                        Delegated arrangements are in place so that invitations to tender are sent to a
                        sufficient number of firms/individuals to provide fair and adequate competition as
                        appropriate.

    4. Aims, Targets and Achievements

Class Description: Financial targets, aims and objectives and key performance indicators
Performance Reports Information including finance and activity can be found in our monthly Trust Board `
                        reports which are available on our website.
Governance              At East Lancashire Hospitals NHS Trust established procedures are in place for the
                        management of governance issues. These are lead by the Governance Unit and the
                        Governance Committee which oversees all governance arrangements within the
                        Trust.
Caldicott               The Caldicott Committee, commissioned by the Chief Medical Officer of England
                        was set up to review all patient identifiable information which passes from NHS
                        organisations to other NHS or non NHS bodies for purposes other than direct care.
                        Medical research or where there is a statutory requirement for information. Each

                         NHS organisation has a person responsible for ensuring the Committee’s
                         recommendations are observed called the Caldicott Guardian. Our Medical Director
                         is the Caldicott Guardian for East Lancashire Hospitals NHS Trust and is
                         responsible for ensuring the protection of patient confidentiality throughout the Trust.
Risk Management          East Lancashire Hospitals NHS Trust is fully committed to ensuring a safe place and
                         systems of work for its staff, visitors and patients. Risk management plays a pivotal
                         role in achieving safety through its risk management policy and strategy and the
                         Trust’s Health and Safety Policy. These documents are reviewed and where
                         necessary revised annually.
Who Monitors Us          The Trust is monitored and scrutinised by a number of external bodies in regard to
                         our performance in a variety of areas. These areas may relate to specific service
                         areas, professional conduct, adverse events or to overall management of the Trust.
                         Some of the bodies that monitor us are listed in Part Three of this Publication
                         Scheme.
Although the Trust aims to make as much information available as possible, some information shared with
other organisations may not be in the public domain. Some information that is of a personal and confidential
nature or otherwise exempt under the Freedom of Information Act will be excluded as will any other
confidential material. This includes material relating to the health and safety of specific individuals, as to law
enforcement or criminal or regulatory enforcement or audit issues may also be excluded from publication.

As one of the largest and busiest hospital trusts in the North West each year we treat approximately 456,000
outpatients and 97,000 inpatient and day case patients. We employ over six and a half thousand staff
including many clinical staff with a national and in some cases international reputation.
We have recently invested over £143 million in our hospitals, in state of the art buildings and equipment
including the Phase 5 development at the Burnley General Hospital and the new Royal Blackburn Hospital.
We provide a broad range of adult and children’s services including: orthopaedics, general surgery, special
surgery (e.g. ear, nose and throat surgery), urology, acute medicine such as cardiology, diabetes, respiratory
medicine and elderly care, and an Accident and Emergency service.
East Lancashire Hospitals NHS Trust operates from four main sites:
       Royal Blackburn Hospital
       Burnley General Hospital
       Rossendale Hospital
       Pendle Hospital
We also provide some services at Accrington Victoria and Clitheroe hospitals and in a range of health centre
settings.
General and specialist medical, surgical, women and children’s and diagnostic services are provided at
Royal Blackburn Hospital and Burnley General Hospital. Rossendale Hospital provides out patient, x-ray and

rehabilitation services. Pendle Hospital provides inpatient intermediate care and medical services. It also
provides an outpatient and day hospital service for the elderly. In Accrington Victoria Hospital we provide
outpatient, x-ray and mammography services. In Clitheroe we provide a range of outpatient services.
A public consultation on exciting new plans to change the way we deliver services across East
Lancashire was completed during July 006. See Meeting Patients’ Needs.
Royal Blackburn Hospital        The hospital provides a full range of hospital services to adults and children
                                and opened in July 2006. In addition to the modern facilities within the first
                                stage of the hospital the new building includes state of the art inpatient

Burnley General Hospital        Burnley General Hospital provides a full range of hospital services to adults
                                and children. In May 2006 the Trust opened the Phase 5 development a £33
                                million investment in state of the art new facilities including new inpatient
                                and outpatient areas.
Rossendale Hospital             The hospital provides a local facility for the population of Rossendale. The
                                recently established Rossendale Development Committee, which includes
                                representatives from the local community, was formed to agree exciting new
                                plans for health care provision in the Rossendale area.
Pendle Hospital                 A    modern    community     hospital   Pendle   Hospital   provides   inpatient
                                intermediate care and medical beds. There is also an outpatient and day
                                hospital for the elderly.

HR Strategy             The Trust is currently developing a formal HR strategy. The Trust recognises that in
                        order to deliver the aims and vision for the people and communities it serves, the
                        staff who are employed to provide theses services must be appropriately selected,

Health and Safety     The Trust recognises its responsibility as an employer to provide a safe and healthy
                      working environment for staff to work in and has established a number of policies
                      and procedures to ensure this responsibility is met. The Trust will ensure every
                      reasonable step is taken to protect the health, safety and welfare of all its
                      employees and others.
Diversity and Equality The Trust ensures all employment policies and procedures reflect equality of
                      treatment and opportunity towards staff and prospective employees regardless of
                      race, gender, marital status, disability or sexual orientation. Positive action is
                      encouraged to ensure that the workforce as far as possible represents the patients
                      and communities we serve. A dedicated Diversity and Equality Unit operates within
                      the Trust.
Harassment & Bullying
                      Harassment and bullying of staff by patients, their relatives or other staff will not be
                      tolerated ad formal action will be taken against those who commit such offences.
                      Our policy sets out acceptable standards of behaviour and applies to all workers and
                      contractors employed in the Trust. It also sets out the processes to be followed
                      where there is concern about harassment.
Staff Involvement /Communication
                      The Trust recognises that staff involvement matters to the entire workforce. Efforts
                      will continue to be made to provide staff with opportunities to be involved. In order to
                      achieve staff involvement mechanisms are being developed to ensure all staff have
                      opportunities to receive information about issues which affect services and their role
                      in delivery from Board level downwards.
                      The involvement of staff at all levels within the organisation is encouraged using
                      different methods of communication such as newsletters, Intranet, meetings, Team
                      Brief and surveys.

                         The Trust recognises the vital part that training education and development plays in
                         allowing the organisation to meet its business objectives and in ensuring the further
