                         (REGULATED PARKING)

To be read with Local Law No 2 (Regulated Parking)

Application

2.     In line with Council’s powers of regulation under the above Local law, the following
       Local Law Policy will apply, for the effective regulation of activities within the
       objectives of that Local Law.

Traffic Area

3.     Pursuant to the Traffic Act, 1949 and Local Law (Regulated Parking), the whole of the
       Council Area is herby declared to be a Traffic Area.

       Unless otherwise signposted parking on roads and off-street regulated parking areas
       shall be limited to a maximum period of two (2) hours at any one location within the
       Traffic Area at all times.

Definitions

4.     (1)     In this Local Law Policy, the terms used shall, unless the context otherwise
       indicates or requires, have the meanings assigned to them by the Traffic Act, 1949 and
       Regulations thereunder.

       (2)     In this Local Law Policy the following shall have the meaning shown:-

       “Authorised Person” - means an officer or agent of the Council authorised either by
       Council resolution or by an officer or agent with appropriate delegated authority, to
       exercise the powers of an Authorised Person under the Local Law (Regulated Parking)
       or Local Law policies made thereunder.

       “Chief Executive Officer” (CEO) - means the Chief Executive Officer of the
       Council or the person for the time being acting in that position.

       “Commercial Vehicle” - means as defined in the Traffic Act, 1949, and approved as
       such pursuant to this Local Law Policy. For the purposes of this Local Law Policy,
       the term includes a station sedan or station wagon.

       “Council” - means the Council of the City of Gold Coast.

       “Industrial Vehicle” - means a motor truck, articulated vehicle, articulated motor
       vehicle, prime mover, semi-trailer, motor omnibus, specially constructed vehicle,
       tractor, traction engineer or other motor vehicle constructed, fitted, equipped or used
       principally for industrial or commercial purposes but does not include a motor car.

      “Recreational Vehicle” - means a motor home, caravan, caravan trailer and any
      similar vehicle used wholly or substantially for recreational purposes and includes a
      boat trailer, whether or not carrying a boat and any other trailer.

       “Tourist Bus” - means any vehicle constructed, fitted, equipped or used principally
      for the carriage of eight (8) or more adult persons and used or intended to be used for
      plying or standing for hire for the carriage of passengers, or of charter parties: the term
      does not include a vehicle approved for use in the carriage of passengers and so
      licensed under the relevant Queensland Statute, while vehicle is being used for the
      purpose of carrying on that usage subject however that the term does not include a
      vehicle licensed for airport passenger service.

      “Tourist Bus Zone” - means a section of the Traffic Area defined as such by an
      official traffic sign and set aside for the standing of tourist buses.

      “Works Zone” - means a regulated parking area, adjacent to a work site, wherein the
      normal regulatory signage or metering has been respectively temporarily amended or
      hooded and wherein, for period of the hooding or amendment, the area is to be utilised
      only for the standing of construction vehicles directly associated with the adjacent
      work site activity and only whilst engaged in the loading or unloading of goods or
      materials at the work site.

Off Street Regulated Parking Areas

5.    The areas of land (including any structure thereon) described in the Schedule 1
      appended to this Local Law Policy are hereby prescribed to be Off-street Regulated
      Parking Areas.

Regulated Parking

6.    (1)    Metered parking shall apply to each and every metered space in accordance
      with the locations and the details set out in Schedule 2 appended to this Local Law.

      (2)     In relation to regulated parking in the off-street regulated parking areas within
      the Traffic Area and as specified in Schedule 1 the hours and days upon which
      regulated parking shall apply are:-

             (a)     On Council owned, or Council controlled Crown land:
                     9.00am - 5.00pm Monday to Friday inclusive
                     9.00am - 12 noon Saturday
                     Statutory holidays excepted
             (b)     On Council controlled, commercially owned land:
                     8.30am - 9.00pm Monday to Friday inclusive
                     8.30am - 5.30pm Saturday
                     10.30am - 4.00pm Sunday
             (c)     Parking bays for Disabled Persons’ vehicles on Council controlled,
                     commercially owned land:
                     8:30am - 9:00pm Monday to Friday incl
                     8:30am - 5:30pm Saturday
                     10:30am - 4:pm Sunday

       (3)     Where meters, boom gate control or ticket dispensing machines (parkatarea)
       are provided in an off-street regulated parking area, the parking fee and authorised,
       regulatory system shall be as prescribed in Schedule 1 appended to this Local Law
       Policy.

Hooding of Meters

7.     In relation to regulated parking an Authorised Person may, for good reason, approve
       the hooding of a meter upon payment of the prescribed fee and whilst ever the hood
       remains in place metered regulated parking on that parking site shall not apply.


Resident Parking Schemes

8.     (1)     The Chief Executive Officer may under the Local Law Policy proclaim
       specific areas as Resident Parking Areas - Schedule 4 attached - and issue Resident
       Parking Permits in accordance with this Local Law Policy.

       (2)      A Resident Parking Scheme Area shall only be proclaimed and permits issued
       where the location is suitable and where such parking would not unduly impede the
       traffic flow in the Area or in the vicinity of same.

       (3)     Subject to Subsection (2), Residential Parking Permits will only be issued to
       the owners or tenants of single unit dwellings within the scheme area where adequate
       offstreet parking could not reasonably be provided on that property.

       (4)    A maximum of two (2) parking spaces per dwelling may be granted, subject to
       the provisions of Subsection (2) of this Section.

       (5)     Any person who desires to obtain a Resident Parking Permit shall make
       application to the Chief Executive Officer on the prescribed form and pay the
       prescribed fee.

       (6)     If an Authorised Person approves the application a permit label will be issued
       which must be affixed, facing outwards, to the subject vehicle as near as practicable
       to the vehicle registration label.

       (7)    Replacement permit labels may only be issued upon the completion by the
       Applicant of a sworn statement advising that the original label has been lost,
       destroyed, damaged or defaced.

       (8)     The fees for a Residents Parking Permit and replacement labels shall be as
       prescribed in the Schedule 4 appended to this Local Law Policy. Resident Parking
       Permits must be renewed annually.

Parking contrary to an official traffic sign

9.     A vehicle may be parked, without penalty, contrary to the requirements for a
       designated parking space as defined in the Traffic Act 1949 if the vehicle displays:

      (a)    a disabled person parking permit issued under the Traffic Act, 1949 by the
             Queensland Department of Transport, or

      (b)    a residents parking permit issued by the Council but only when the vehicle is
             parked in the area to which that resident’s parking permit applies.

      and the vehicle is parked in accordance with the conditions that apply to such permit.


Commercial Vehicle Loading Zones

10.   (1)     A vehicle may be parked in a commercial vehicle loading zone only if the
      vehicle conforms with the definition of “commercial vehicle” in this Local Law
      Policy.

      (2)     The fees for a commercial vehicle identification label and replacement labels
      shall be as prescribed in the Schedule 5 appended to this Local Law Policy.

      (3)    Applications for approval of a vehicle as a commercial vehicle under this part
      must be in writing on the approved form together with the appropriate fee as set out in
      the Schedule 5 appended to this Local Law Policy and must be accompanied by the
      relevant information and supporting documentation to allow for consideration of the
      application.

      (4)    Approval of a vehicle as a commercial vehicle shall expire:

             (a)     on 31 August of each year; or
             (b)     on sale of the vehicle; or
             (c)     on revocation of the approval by an Authorised Person,

             whichever is the sooner

      (5)    (a)     The owner of the commercial vehicle shall, within one day after the
             issue of the identification label affix it securely to the inside of:-

                     (1)    the windscreen, or

                     (2)    the pivoted or hinged ventilation window,

             of the commercial vehicle in respect of which it has been issued as near as
             practicable to and immediately above the vehicle registration label issued by
             the Department of Transport and so that the identification label faces outwards
             and is clearly visible (to a person outside the commercial vehicle, facing that
             part of the commercial vehicle to which it is attached).

             (b)     If the commercial vehicle has no windscreen or is a motor cycle the
             identification label shall be displayed and kept displayed in a holder clearly
             visible and similar to that in which is displayed the vehicle registration label
             issued by the Department of Transport and shall be affixed to clear glass in the

         holder and in such manner that all the particulars on the identification label are
         clearly visible through the glass.

 (6)     The owner of a commercial vehicle shall keep the identification label affixed
 as required hereof at all times during the currency of approval.

 (7)    Where an identification label is lost, destroyed, damaged, or in any way
 defaced during the currency of the approval, an Authorised Person may upon -

         (a)   application on the form required by the Chief Executive Officer by the
         owner of the commercial vehicle; and

         (b)     payment of the prescribed fee,

         issue a duplicate of the identification label.

(8)      Upon the transfer of the ownership of a commercial vehicle the approval shall
expire and the owner upon whose application the motor vehicle was approved as a
commercial vehicle shall before making delivery of a commercial vehicle to the
transferee destroy the identification label issued in respect thereto. In all other cases the
owner of a commercial vehicle shall destroy the identification label issued in respect
thereof within three (3) days after the expiration or revocation of the approval.


(9)     It shall be a condition of any approval that it may at the discretion of an
Authorised Person be revoked -

         (a)    If the owner of the commercial vehicle fails to comply with any of the
         conditions of the approval; or

         (b)     If the owner or the driver of the commercial vehicle, consequent upon
         the fixing or giving of a notice pursuant to the provisions of section 44F of the
         Traffic Act 1949 in respect of an offence committed in relation to the parking
         of the commercial vehicle in a loading zone -

                 (i)    pays the prescribed sum by way of penalty as provided under
                 the Traffic Act 1949 and this Local Law Policy; or

                 (ii)    is convicted of the offence; or

         (c)    If an Authorised Person determines that the approval should be
         revoked.

         Upon revocation of an approval such approval shall cease to have any force or
         effect.

 (10)    Any person who -

         (a)     Prints or manufacturers or has in his possession a label other than an
         identification label issued by the Chief Executive Officer pursuant this Local

             law Policy which resembles an identification label issued by the Chief
             Executive Officer pursuant to this Local law Policy or which is calculated or
             likely to deceive; or

             (b)    Uses or causes or allows to be used, or is in charge of any motor
             vehicle upon which is affixed any identification label which has been altered,
             mutilated, or defaced in any manner whatsoever, or upon which any writing,
             mark, or colour thereof is not clearly legible or visible; or

             (c)    Uses or caused or allows to be used, or is in charge of, any motor
             vehicle having affixed thereto an identification label which was issued by the
             Chief Executive Officer pursuant to this Local Law Policy in respect of any
             other motor vehicle; or

             (d)     Uses or causes or allows to be used, or is in charge of any motor
             vehicle to which is affixed an identification label containing any incorrect
             particulars or which is not in force; or

             (e)     Alters or defaces any identification label; or

             (f)     Buys or sell any label which resembles or is intended to resemble an
             identification label or which is calculated or likely to deceive; or

             (g)    Being the owner of a commercial vehicle fails to affix within the time
             hereinbefore provided and keep affixed during the period prescribed and in the
             manner hereinbefore provided the identification label issued in respect of the
             said commercial vehicle; or

             (h)   Makes any false statement in any application made under this Local
             Law Policy; or

             (i)     Contravenes any of the provisions of this Local Law Policy

             shall be guilty of an offence.

             Maximum Penalty - 20 Penalty Units

Tourist Bus Zones

11.   (1)     A person shall not, upon a road, park, stop or leave stand, a vehicle in a tourist
      bus zone provided that this paragraph shall not apply to a person driving a tourist bus
      whilst parking, stopping or standing such tourist bus for the purpose of picking up or
      setting down passengers for a period not exceeding ten (10) minutes and in accordance
      with the directions or indications given by any official traffic sign.

      (2)     A driver of a tourist bus shall not, upon a road park, stop or leave stand, such
      tourist bus for the purpose of picking up or setting down passengers whilst within
      eight hundred (800) metres of a tourist bus zone other than in a tourist bus zone.

      (3)     Any person who contravenes or fails to comply with a provision of this Section
      shall be deemed to have committed a regulated parking offence against Regulation 55
      (1) of the Traffic Regulation 1962, under the Traffic Act 1949, and shall be penalised
      accordingly.

Works Zone

12.   (1)     Council may under this Local Law Policy proclaim specific areas adjacent to
      work sites as Works Zones as defined in this Local Law Policy and regulate standing
      or parking accordingly.

      (2)     All applications for approval of Works Zones and associated fees are to be
      submitted to the Chief Executive Officer for processing not later than four (4) weeks
      prior to the commencement of work.

      (3)     Provided the application complies with Council’s Local Laws and Local Laws
      Policies and conforms with any parking or construction requirements to the reasonable
      satisfaction of an Authorised Person and the Divisional Councillor the necessary signs
      and markings will be installed and all work site activity shall take place within the
      Zone so defined.

      (4)    If is the responsibility of the contractor to see that the Works Zone is used for
      the intended purpose. Vehicles other than those actually unlading or loading
      construction materials shall not, on any account, use the Works Zone. Vehicles
      operating within the zone shall comply with all provisions of the Traffic Act and
      Council Local Laws and Policies.

      (5)    Construction material shall not be placed on the roadway at any time.

      (6)    The contractor shall not allow construction materials or vehicles operating
      form the Works Zone to block or restrict pedestrian movement along the footpath.

      (7)     The Council reserves the right to amend the hours of operation, location and
      size of the zone as required.

      (8)    The approved time period of a Works Zone may be extended provided Council
      receives details of the extension period and associated fees not later than two (2)
      weeks prior to commencement of the new period and that this extension has the
      approval of the Authorised Person.

      (9)      The Works Zone will be removed as soon as possible after the expiry date or
      may be removed without warning in the case where the contractor repeatedly fails to
      comply with Council’s conditions of usage to the reasonable satisfaction of the
      Authorised Person. Once removed, the previous parking regulations will be reinstated
      with any modifications that are considered by the Authorised Person to be necessary
      to suit new access arrangements.

      (10) All costs as prescribed in Schedule 6 appended to this Local Law Policy and
      associated with the above actions shall be met by the applicant.

Industrial and Recreational Vehicle

13.   A person shall not upon any road, park an industrial or recreational vehicle for a
      period in excess of one (1) hour.
