Planning Board Minutes
July 19, 2007

MEMBERS PRESENT: Sandra Scott, Planning Board Chairperson, William Ruther, Vice Chairman, Carl
Wiedemann, Patrick Barnes, Walter Miller, and Anthony Galea, Alternate Board Member. Also Attending:
Todd Mathes, Board Attorney, and Maryann Murphy, Secretary.

INTRODUCTION: Sandra Scott, Planning Board Chairperson opened the meeting at 7:30pm. Sandra
Stated that starting in August, Planning Board meetings will begin at 7PM to accommodate the extended
length of meetings. The Planning and Zoning Clerk has posted notices around the Town Hall and a notice
will be placed in the Community notes of the Gazette as well as will be changed on the Duanesburg.net
website.
Chairperson Scott noted that questions were raised of adequate water supply for the Lake and Liddle Rd.
application. The project Engineer has submitted information showing adequate water supply.
Sandra also noted that the Board members may wish to wait until the Thursday prior to each meeting to
come and pick up their folders as some information may not be in the folders earlier than that.

OPEN FORUM:
Charles Parker of 483 Esperance Station Rd. had two questions, one for Board Member Miller, and the
second to the complete Board. He asked about the Jacobson project which was approved in May.

Sandra Scott Chair, asked that Board member Miller not answer that question. The application is currently
under litigation and this question is out of order.
Todd Mathes advised the entire Board not respond to any questions as the application is currently under
and Article 78 proceeding and Town Attorney Siegel is handling it.

Dellene Rowlison of 1546 Thousand Acre Rd. asked when it was that the requirement for a building lot in
the Town of Duanesburg was passed.
Sandra Scott answered in 2001 the Zoning Ordinance was amended. In the Subdivision Ordinance a
building lot is 100,000 sq. ft. or 2.3 acres for an (R-2) Residential zone.
Board Member Silva added that the 2.3 acre minimum building lot has been in effect since the 1985 Zoning
Ordinance.

PUBLIC HEARINGS:

BASTIANI, RAUL L. and JANET C.: SBL#: 64.00-1-9, (C-1) located at 2908 State Highway 30, is
seeking approval for a special use permit under section(s) 11.2.3, 11.2.19 and 11.2.15 of the Zoning
Ordinance of the Town of Duanesburg. Charles Johnson representing the Applicant.

Charles Parker of 483 Esperance Station Rd. questioned the distance from the well to the septic system
and the capacity of the septic system to hold additional occupants.
Public Hearing Closed.
Engineer Johnson must provide documentation that the septic system is adequate to accommodate the
proposed application. This information must be provided to the Planning and Zoning Dept. no later than

4:00pm on August 6, 2007.
Miller/ Deleva made a motion to continue the application for BASTIANI, RAUL L. and JANET C.
Barnes, yes, Miller, yes, Silva, yes, Wiedemann, yes, Ruther, yes, Scott, yes, Deleva, yes. Unanimously
Approved.

VANWORMER, EDWARD C.: SBL#:65.00-1-31.4, (R-2) located at Gage Rd. is seeking approval for a
special use permit under section(s) 8.2.1 and 6.2.6 of the Zoning Ordinance of the Town of Duanesburg to
construct a two-family dwelling.

Dellene Rowlison of 1546 Thousand Acre Rd. was concerned with the septic system capacity and ground
water runoff, she also had concerns with lot size minimums.

John Chappell of 1280 Gage Rd. had concerns with the amount of stormwater runoff and the need for a
culvert at the end of the existing driveway.
Public Hearing Closed.
The Applicant must provide written documentation on the following issues:
    1) When the subdivision was approved as well as a map showing the number of lots approved.
    2) Application completed indicating the Applicant’s phone number
    3) Duanesburg’s Highway Superintendent and the County Public Works Department both consulted
          for drainage problem resolution which effects neighboring properties.
This information must be provided to the Planning and Zoning Dept. no later than 4:00pm on August 6,
2007.
Silva/ Ruther made a motion to continue the application for VANWORMER, EDWARD C.:

CONTINUATION OF PUBLIC HEARING:

MORGAN, KEITH: SBL#: 35.05-1-1.2, located at 280 Batter Street (R-2), is seeking approval a special
use permit to construct a garage on a vacant parcel of land under section 8.2.16 of the Zoning Ordinance of
the Town of Duanesburg.
Sandra will write the Applicant and inform him that in order for the Planning Board to continue reviews
Mr. Morgan’s Application the Planning and Zoning Dept. must be in receipt of 12 copies of the Applicant’s
land survey no later than 4:00pm August 6, 2007.
Wiedemann/ Miller made a motion to continue the public hearing for MORGAN, KEITH.
Barnes, yes, Miller, yes, Silva, yes, Wiedemann, yes, Ruther, yes, Scott, yes, Deleva, yes. Unanimously
Approved.

Approval of June 21, 2007 Planning Board minutes:
Barnes/ Wiedemann made a motion to approve the Planning Board minutes for April 19, 2007 with
corrections.
Barnes, yes, Miller, yes, Galea, yes, Wiedemann, yes, Ruther, yes, Scott, yes, Silva, abstain, Deleva,
abstain. Approved.

OLD BUSINESS:

FROST, ROBERT: SBL#: 35.00-3-1.1, (R-2) located at Route 159 Mariaville Rd. is seeking approval for
a major subdivision to divide 35.53± acres into 14 lots.

The Planning Board requires the Applicant provide the DEC wetlands determination letter which must be
to the Planning and Zoning Dept. no later than 4:00pm August 6, 2007. The Board would also like to know
the determination of the Zoning Board of Appeals for the Applicant’s variance application regarding lot 14.
The project Engineer agreed to look at the subdivision exit in terms of diminishing light glare on abutting
properties.

FROST, ROBERT: SBL#: 44.00-2-9.1, (R-2) located at the corner of Lake Rd. and Liddle Rd. is seeking
approval for a major subdivision to divide 98.16± acres into 17 lots ranging from 2.86± acres to 9.04±
acres.
Further review by the Board hinges on receiving notification of the NYS DEC’s stormwater control
specialist’ report.
The Planning Board will determine a mutual time for members to walk the project site.

Silva/ Wiedemann made a motion to continue the public hearing.

Approved.

NEW BUSINESS:

CROWN ATLANTIC COMPANY, LLC.: SBL# 44.00-1-10.12, (R-2) located at 2837 Duanesburg
Churches Rd. is seeking an amendment to existing special use permit under section 14.6.2.5 of the Zoning
Ordinance of the Town of Duanesburg.

The Board requested that the Applicant provide the name and address of the contact person who will
receive notification for the annual fee as well as maintenance reports, information on structural capacity of
the existing lattice tower in terms of antennas, what percentage of structured capacity are the three new
antennas, and the name (type) of the requested antennas and rationale for their addition. This information
(12 copies) must be received by our Planning Dept. no later than 4:00pm August 6, 2007.

O’CLARE, MICHAEL: SBL#: 53.00-1-44, located at 7 Courtney Drive (R-2), is seeking approval for a
minor subdivision to divide 5.05± acres into two lots, lot 9A being 2.752± acres and lot 9B being 2.298±
acres with an existing single family residence.

The Planning Board requires that the Applicant provide the forthcoming letter from National Grid’s
Planners regarding effect of 1 more house on the existing subdivision for adequate electric supply,
designation of well location on plat for proposed dwelling, and documentation of adequate water supply.
This information (12 copies) must be received by our Planning Dept. no later than 4:00pm August 6, 2007.

PATINO, EDGAR: SBL# 67.05-3-3.2, (H) located at 6777 Duanesburg Rd. is seeking approval for a
special use permit under section 9.2.5 of the Zoning Ordinance of the Town of Duanesburg to convert a
single family residence into a two family residence.

The Planning Board requires that the Applicant provide twelve (12) copies of the DEC permit letter for the
discharge from the sewer system as well as a letter from the Schenectady County Department of Health
indicating approval of the septic system design.
This information (12 copies) must be received by our Planning Dept. no later than 10 days prior to the next
regularly scheduled Planning Board meeting in order to be on that agenda.

WILLIAMS, MARTIN & KATHERINE: SBL#: 67.00-3-1.111, (C-2) located at 5256 Duanesburg Rd.
is seeking approval for a major subdivision to divide 30.99+- acres into 3 lots.
The Planning Board requests the Applicant show on the Final Plat that Lot 2 was previously subdivided in
2006. No new information needs to be submitted prior to the next regularly scheduled meeting.

Barnes/ Miller made a motion to declare the Town of Duanesburg Planning Board as Lead Agency for
the WILLIAMS, MARTIN & KATHERINE application.

Approved.

Wiedemann/ Miller made a motion that no adverse environmental impact has been found for the
WILLIAMS, MARTIN & KATHERINE application.

Ruther/ Miller made a motion to hold a Public Hearing for WILLIAMS, MARTIN & KATHERINE
on August 16, 2007.

Approved.

SKETCH PLAN REVIEW:

HURLEY AND VICE DEVELOPMENT CORP: SBL#:52.00-1-29, (R-2) located at lot 5A Eaton
Corners Rd. is seeking approval for a minor subdivision under section 3.3 of the Subdivision Ordinance of
the Town of Duanesburg.
The Planning Board requests the Applicant fill out an Application and submit all other needed materials no
later than 10 days prior to the next regularly scheduled Planning Board meeting in order to be on that
agenda.
