anytime in recent memory. Banks are still making loans and deals are being financed but qualifying requirements imposed on prospective buyers/ borrowers are very challenging. As an alternative to traditional bank loans installment contracts or land contracts are becoming more prevalent in the marketplace. An installment contract facilitates a transfer of ownership in the form of a contract bestowing legal interest in the property to the buyer while the seller retains the deed until the terms of the contract are satisfied. Several benefits serve both parties, for the buyer there is limited out-of-pocket finance expenses and generally more flexible terms. Also, because the buyer has put some money into the project at the time of purchase and is building equity in the form of monthly installment payments the refinancing of the property to payoff the balance of the land contract is generally easier than a purchase loan. For the seller the biggest advantage in today’s market is being able to complete a sale transaction and begin the process of redeeming equity built up in the property. From a tax Perspective the seller is able to defer some of the capital gains by spreading the obligation out over the term of the installment contract. You should always consult an accountant to fully understand the tax treatment of any property sale. Another benefit comes from collecting interest on the unpaid balance of the sales amount on a monthly basis, this additional yield compensates the seller for having to wait for the balance of proceeds from the sale. In some cases this additional yield can be substantial and make up for reduced valuation pressures currently felt in today’s real estate market. Some drawbacks include restrictions on the property for the buyer, they generally need permission from the seller to make significant changes to the property, if they take a building down or cause a devaluation of the property by logging timber than they could be in default of the contract and jeopardize their equity, however, a well written contract can protect all parties in a fair and equitable way. A seller always faces the problem of default by the buyer and having to foreclose to regain control of the property but good risk management upfront can minimize this event.

Sealed-Bid Plus™ NAI is offering a unique twist to the sealed bid program to help sellers achieve the highest possible sale price for their assets. The process starts with submission of a sealed bid. Then the finalists are invited to participate in a brief open bidding process to secure the highest bid for that asset. This strategy has been proven to produce a winning bid that is typically 10-15% higher than the original sealed bid.
