 FINAL ADOPTION OF ORDINANCE NO. 29-2007, A BOND ORDINANCE
PROVIDING FOR IMPROVEMENTS TO VREELAND AVENUE IN AND BY THE
CITY OF HACKENSACK, IN THE COUNTY OF BERGEN, NEW JERSEY,
APPROPRIATING $125,000 THEREFORE AND AUTHORIZING THE
ISSUANCE OF $125,000 IN BONDS OR NOTES OF THE CITY TO FINANCE
PART OF THE COST THEREOF.

        “This ordinance has been advertised pursuant to law and now calls for a

      Motion offered by Melfi and seconded by Sasso that there be a public
hearing.

      PUBLIC HEARING

       Motion offered by Melfi and seconded by McAuliffe that the public hearing
be closed.

        BE IT RESOLVED by the City Council of the City of Hackensack, County
of Bergen and State of New Jersey, that Ordinance No.29-2007 entitled: “A
BOND ORDINANCE PROVIDING FOR IMPROVEMENTS TO VREELAND
AVENUE IN AND BY THE CITY OF HACKENSACK, IN THE COUNTY OF
BERGEN, NEW JERSEY, APPROPRIATING $125,000 THEREFORE AND
AUTHORIZING THE ISSUANCE OF $125,000 IN BONDS OR NOTES OF THE
CITY TO FINANCE PART OF THE COST THEREOF has passed its second and
final reading and is hereby adopted.

PROVIDING FOR THE JOHNSON PUBLIC LIBRARY ROOF REPLACEMENT
IN AND BY THE CITY OF HACKENSACK, IN THE COUNTY OF BERGEN,
NEW    JERSEY,   APPROPRIATING  $168,000   THEREFORE   AND
AUTHORIZING THE ISSUANCE OF $159,600 IN BONDS OR NOTES OF THE
CITY TO FINANCE PART OF THE COST THEREOF.

of Bergen and State of New Jersey, that Ordinance No. 30-2007 entitled: “A
BOND ORDINANCE PROVIDING FOR THE JOHNSON PUBLIC LIBRARY
ROOF REPLACEMENT IN AND BY THE CITY OF HACKENSACK, IN THE
COUNTY OF BERGEN, NEW JERSEY, APPROPRIATING $168,000
THEREFORE AND AUTHORIZING THE ISSUANCE OF $159,600 IN BONDS
OR NOTES OF THE CITY TO FINANCE PART OF THE COST THEREOF has
passed its second and final reading and is hereby adopted.

      INTRODUCTION OF AN ORDINANCE AMENDING CITY ORDINANCE
NO. 24-74, CHAPTER 170-50 “SECTION I, NO PARKING,” TO REMOVE
WINCHESTER PLACE FROM THE DESCRIBED STREETS OR PARTS OF
STREETS AS LISTED IN THE ORDINANCE.

       BE IT RESOLVED that the above ordinance, being Ordinance 31-2007 as
introduced, as amended, does now pass on first reading and that said Ordinance
shall be considered for final passage at a meeting to be held on November 20,
2007 at 7:00 p.m. or as soon thereafter as the matter can be reached at the
regular meeting place of the City Council and at such time and place all persons
interested be given an opportunity to be heard concerning said Ordinance and
that the City Clerk be and she is hereby authorized and directed to publish said
ordinance according to law with a notice of its introduction and passage on first
reading and of the time and place when and where said ordinance will be further
considered for final passage.

      RE-INTRODUCTION OF ORDINANCE NO. 21-2002 ENTITLED: "AN
ORDINANCE OF THE CITY OF HACKENSACK, IN THE COUNTY OF
BERGEN, NEW JERSEY, PROVIDING A SUPPLEMENTAL APPROPRIATION
OF $682,500 FOR IMPROVEMENTS TO HUDSON STREET IN AND FOR THE
CITY OF HACKENSACK AND APPROPRIATING $682,500 THEREFOR,
INCLUDING $100,000 IN COMMUNITY DEVELOPMENT BLOCK GRANTS,
$40,000 IN A BERGEN COUNTY OPEN SPACE GRANT AND $300,000
EXPECTED TO BE RECEIVED FROM THE STATE OF NEW JERSEY,
DEPARTMENT OF TRANSPORTATION AND PROVIDING FOR THE
ISSUANCE OF $650,000 IN BONDS OR NOTES OF THE CITY OF
HACKENSACK TO FINANCE THE SAME.

       BE IT RESOLVED that the above ordinance, being Ordinance No. 21-
2002 as introduced, does now pass on first reading and that said Ordinance shall
be considered for final passage at a meeting to be held on November 20, 2007 at
7:00 P.M., or as soon thereafter as the matter can be reached at the regular
meeting place of the City Council and at such time and place all persons
interested be given an opportunity to be heard concerning said Ordinance and

WATERFRONT PEDESTRIAN/BIKEWAY CORRIDOR IN AND BY THE CITY
OF HACKENSACK, IN THE COUNTY OF BERGEN, NEW JERSEY,
APPROPRIATING $2,101,201.00 AND AUTHORIZING THE ISSUANCE OF
$675,000.00 BONDS AND NOTES OF THE CITY TO FINANCE PART OF THE
COST THEREOF.
       BE IT RESOLVED that the above ordinance, being Ordinance 22-2007 as
introduced does now pass on first reading and that said Ordinance shall be
considered for final passage at a meeting to be held on November 20, 2007 at
7:00 pm or as soon thereafter as the matter can be reached at the regular

       WHEREAS, the United States Department of Transportation, Federal
Highway Administration regulations requires that all City employees required to
possess a Commercial Driver’s License to operated City vehicles shall be subject
to periodic and random alcohol and controlled substance testing effective 1995;
and

       WHEREAS, these regulations stipulate that a City employee testing
positive shall receive professional counseling by a Substance Abuse
Professional at the direction of a Medical Review Officer; and

      WHEREAS, HealthWise at Hackensack University Medical Center offers
an Employee Assistance program specifically designed to address substance
abuse problems at a fixed annual fee not to exceed $9,309.00 per annum; and

       WHEREAS, the Local Public Contracts Law (N.J.S.A. 40A:11-1, et seq.)
requires that the resolution authorizing the award of contracts for “professional
services” without competitive bidding, and the contract itself must be available for
public inspection.

       NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of
the City of Hackensack as follows:

       1. That the Mayor and City Clerk be and are hereby authorized and
          directed to execute an agreement with HealthWise at HUMC to
          perform services for the period effective October 1, 2007 through
          September 30, 2008.

       2. That this contract is awarded without competitive bidding as a
          “professional service” in accordance with N.J.S.A. 40A11-5-(1) of the
          Local Public Contracts Law because same is expressly excluded from
          competitive bidding and without public advertising for bids as an
          authorized exception.
             3. That a notice of this resolution be published once in The Record; and

             BE IT FURTHER RESOLVED that the Chief Financial Officer has certified
      that funds are available from Account #7-01-23-210-210-284 in an amount not to
      exceed $9,309.00 of the Current Fund. Purchase Order #158482

              WHEREAS, Aldo Cammalleri, Traffic Maintenance Worker, has
       requested a Leave of Absence, without pay, for twelve weeks for personal
       medical reasons under the Family Leave Act, and

             WHEREAS, Stephen Lo Iacono, City Manager, has determined that this
       employee be granted this Leave of Absence for twelve weeks, commencing on
       November 1, 2007 and terminating January 27, 2008.

              NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the
       City of Hackensack, that Aldo Cammalleri, Traffic Maintenance, be granted a
       Leave of Absence for twelve weeks, without pay, as requested; and

             BE IT FURTHER RESOLVED that a certified copy of the Resolution is
       forwarded to the employee’s pension system by the Chief Financial Officer, if
       deemed necessary.

       Reverend Wilcox of the Second Reformed Church, Reverend Jerry Caterino of
       the Bread of Life, Church of the Nazarene and Father Brian H. Laffler, SSC,
       Church of St. Anthony of Padua be hereby appointed to serve as the Chaplains
       of the Hackensack Fire Department.
