11   TO AMEND SECTION 2-7-30 OF THE 1976 CODE,
12   RELATING TO THE CONSTRUCTION OF THE WORDS
13   “PERSON” AND “PARTY” AS THOSE WORDS APPEAR IN
14   THE LAWS OF THIS STATE, TO PROVIDE THAT THE
15   CONSTRUCTION OF “PERSON”, “HUMAN BEING”,
16   “CHILD”, AND “INDIVIDUAL” INCLUDES INFANT
17   MEMBERS OF THE SPECIES HOMO SAPIENS WHO ARE
18   BORN ALIVE, AND TO DEFINE “BORN ALIVE”.

20   Be it enacted by the General Assembly of the State of South
21   Carolina:

23   SECTION 1. Section 2-7-30 of the 1976 Code is amended to
24   read:

26      “Section 2-7-30. (A) The words ‘person’ and ‘party’ and any
27   other word importing the singular number used in any act or joint
28   resolution shall be held to include the plural and to include firms,
29   companies, associations and corporations and all words in the
30   plural shall apply also to the singular in all cases in which the spirit
31   and intent of the act or joint resolution may require it. All words in
32   an act or joint resolution importing the masculine gender shall
33   apply to females also and words in the feminine gender shall apply
34   to males. And all words importing the present tense shall apply to
35   the future also.
36      (B)(1) In determining the meaning of any act or joint resolution
37   of the General Assembly or in a regulation promulgated pursuant
38   to Article 1, Chapter 23, Title 1, the words ‘person’, ‘human
39   being’, ‘child’, and ‘individual’, must include infant members of
40   the species homo sapiens who are born alive at any stage of
41   development.

 1        (2) As used in this subsection, the term ‘born alive’, with
 2   respect to a member of the species homo sapiens, means the
 3   complete expulsion or extraction from the mother of that member,
 4   at any stage of development, who after the expulsion or extraction
 5   breathes or has a beating heart, pulsation of the umbilical cord, or
 6   definite movement of voluntary muscles, regardless of whether the
 7   umbilical cord has been cut, and regardless of whether the
 8   expulsion or extraction occurs as a result of natural or induced
 9   labor, cesarean section, or induced abortion.
10        (3) Nothing in this subsection may be construed to affirm,
11   deny, expand, or contract any legal status or legal right applicable
12   to any member of the species homo sapiens at any point before
13   being born alive as defined in this subsection.”

15   SECTION 2. This act takes effect upon approval by the Governor.
