 Section 17 Inspection Report:

3.            1045          National Teacher Training Institute has been recognized by SRC, NCTE
               TTC          for TTC course on 09.12.2004.
            National
        Teacher Training    A complaint has been received from Prof. P.C. Krishnan, Secretary,
        Institute, Kerala   Educational Reforms Forum, Thiruvananthapuram, Kerala on 5.5.2009.
                KL          The complainant made complaints against 21 institutions, which are
                            functioning in the State of Kerala. All the institutions were granted
                            recognitions during 2002-2006. The complainant has stated that the
                            B.Ed. and M.Ed. un-aided institutions in Kerala noticed serious defects
                            like infrastructural and instructional facilities available in these institutions.
                            The complainant is requesting SRC-NCTE to conduct a surprise
                            inspection to confirm the authenticity of the complaints made.

                            The matter was placed before SRC in its 175th meeting held on 13th and
                            14th May, 2009. The Committee decided to issue showcause notice under
                            section 17 of NCTE Act. Accordingly notice was issued to the above
                            institutions on 4.6.2009 for the following reasons:-
                              The institution does not possess qualified Professor, Reader and
                               Lecturer for conducting the M.Ed. course.
                              The infrastructural facilities have not been provided for PG course in
                               education.

                            The institution has replied to the Notice on 16.9.2009. The matter was
                            considered by SRC and it has decided to cause inspection under Section
                            17 and ask the institution to submit the reply to the Questionnaire (for all
                            courses including TTC). As per direction of Regional Committee a letter
                            was issued to the institution on 03.12.2009. In response to this letter the
                            institution has submitted Questionnaire for TTC course. Inspection under
                            Section 17 was conducted to the institution on 22.3.2010.

                            SRC in its 190th meeting held on 29-30 March, 2010 considered the
                            matter original files of the different programmes run by the
                            institution and other related documents, Act of NCTE, 1993,
                            Regulations and guidelines from time to time laid on the table,
                            visiting team reports under section 17 of NCTE Act and decided to
                            withdraw recognition of B.Ed.(APS0628), M.Ed. course (APS05798)
                            and B.Ed.-Addl. unit(APS06290) and to continue recognition for the
                            TTC course, on the following grounds:

                            infrastructural data(built-up area etc.) and also duly countersigned
                            by the Management of the institution, states the following:-

                            The built-up area available and earmarked for Teacher education
                            programmes were as follows:

                            Since the Regional Committee had already decided to withdraw
                            recognition of B.Ed.(APS0628), M.Ed. course (APS05798) and
                            B.Ed.-Addl. unit(APS06290) in its 190th SRC meeting and to
                            continue recognition for the TTC course only, the built-up area
                            available for the remaining TTC programme is 20, 886 sq.ft. which
                            is adequate as per NCTE norms.

                            In view of the fact that the available space will be adequate for the
                            TTC course(as already decided in the 190th SRC Meeting), the
                            Committee decided that approval for the TTC programme alone be
                            continued.



 Court Cases/Notice/Complaint Cases/Shifting/Miscellaneous Cases:

4.             8254         M.E.S. College of Education, Khammam District, Andhra Pradesh has made an
                            application for B.Ed course to Southern Regional Committee, NCTE,
               B.Ed         Bangalore. The application was processed and after considering the report of
                            the Visiting Team as well as other relevant materials granted recognition to the
         M.E.S College of   institution for offering B.Ed course with an intake of 100 students from the
                            session 2007 -2008 vide order No.15514 dated 03.12.2007.
           Education,
           Khammam          The Registrar, Kakatiya University, Warangal vide letter dt.14.03.2008 drew the
               AP           attention of Regional Director, SRC and informed that in the process of granting
                            temporary affiliation to the institutions the university conducted inspection and
                            observed that the building shown was meant for B.Pharma. This fact was
                            noticed by visiting team when visited for affiliation. The letter was placed before

                            the SRC in its 157 meeting held on 23 -24 April 2008. The SRC after careful
                            consideration of all aspects decided to issue show cause notice. Accordingly, a
                            show cause notice was issued on 28.05.2008 to the institution.

                            In response to the notice the applicant institution replied on 23.06.2008. The

                            reply was placed before SRC in its 161 meeting held on 6 -7 August 2008
                            and it was decided to cause inspection under Section 17 to verify the facilities.
                            Inspection team visited the institution on 17.9.2008 and have informed that the
                            management was not ready to face the inspection on 17.09.2008 because of
                            various factors and asked for postponement of the inspection by three more

                    months. Since the institution had not cooperated for carrying out inspection of

                    institution as per the provisions of NCTE Act, the SRC-NCTE in its 165
                                         th   th
                    meeting held on 27 -28 September, 2008 decided to withdraw the recognition
                    for the following reasons:-
                     The institution was granted recognition in a rented premises on the basis of
                         land document submitted in the form of sale deed bearing Sy.No.92 & 93
                         with Ac.1-02 & 3-38 guntas at Barugudem Revenue Village, Arempula
                         Gram Panchayat, Khammam District along with an affidavit
                         dated.04.08.2007 swearing that the land is exclusively meant for running
                         the educational institution and the same shall not be used for any purpose
                         other than teacher education programme.
                     As per the visiting team report of Kakatiya University, Warangal the
                         institution had shown the same land for B.Pharma. The same land
                         document have been submitted to other Regulatory Bodies. The institution
                         misled NCTE and other regulatory bodies, which is a serious lapse..
                     The institution breached oath taken by it in the affidavit dated.04.08.2007
                         swearing that the land is exclusively meant for running the educational
                         institution and the same shall not be used for any purpose other than
                         teacher education programme.
                     As per NCTE Norms and Standards, Rules and Regulations issued from
                         time to time the institutions are required to have exclusive provision for land
                         and building for teacher education course whereas the institution has
                         sought recognition of B.Ed course and in the same premises it started
                         B.Pharma course. The information submitted by it is concealed and is
                         misleading.
                     The institution itself accepted in writing to have accommodated B.Ed and
                         B.Pharma in the same building.
                     The institution did not cooperate with the visiting team in carrying out
                         inspection under section 17 on 17.09.2008. This is considered as an act of
                         defiance and unbecoming of an educational institution.
                     The institution violated the provisions contained under various sections of
                         NCTE Act and regulations there under.
                    Accordingly, a withdrawal order was issued to the institution on 06.10.2008.

                    Thereafter, the institution has approached Appeal Authority, New Delhi where in
                    the appellate authority has confirmed the order of SRC dated 6.10.2008 and
                    has decided that the withdrawal of recognition shall come into effect from the
                    academic session 2010-11.

                    As per direction of Appellate Authority Withdrawal order was modified and
                    another Withdrawal order was issued on 08.01.2010.

                    After that institution has approached Hon’ble High Court of Andhra Pradesh at
                    Hyderabad in W.P.No.28922 of 2009, Wherein Hon’ble High Court has passed
                    an order dated 31.12.2009 as under:-
                    “In the meanwhile, there shall be interim suspension in proceedings

                    dt.6.11.2009 confirming the order dated 06.10.2008 in proceedings

                    However, it is made clear that the petitioner shall not be entitled to run the B.Ed
                    College in the next academic year, in the same premises”.

                    Accordingly, Brief History of the case and the proceedings taken to file Counter

                    was placed before 188 meeting of SRC held on 28-29 January, 2010 wherein
                    the Regional Committee decided to pursue the case and has also decided to
                    await the disposal of the case. Accordingly, as per the decision of SRC, the

                           status of the case was informed to Head Quarters on 04.02.2010.

                           After that the institution has submitted the following documents:-
                           1. D.D of 40,000/- vide no 440095 dated 20,10,2009 issued by Indian Bank in
                           the favour of        Member Secretary, NCTE          New Delhi vide letter No.
                           MES/B.ED/2010/34 dated 31.03.2010.
                           2. Court order in the matter of M.E.S College of Education, Barugudem,
                           Khammam Mandal and District (writ Petition no 28922/2009)

                            In this order the Hon’ble High court has passed an order as under:-
                           “ This is an application to direct the respondents to inspect the petitioner’s
                              premises on payment of Rs. 40,000/- towards inspections fees.

                           No counter Affidavit is filed on behalf of the respondents

                           The recognition to the petitioner’s college was cancelled by the respondents on
                           the ground that the petitioner is running two courses in the same building. The
                           petitioner has taken the plea that it is running only one course i.e B.Ed in the
                           building in question and that the respondents can resolve the controversy by
                           undertaking a fresh inspection.

                           In as much as this court has suspended the proceedings of the respondents
                           canceling the recognition of the petitioner’s college and in view of the offer
                           made by the applicant for a fresh inspection, I do not find any justifiable reason
                           not to accept the request of the applicant.

                           In view of the same, the application is allowed. The respondents are directed to
                           undertake an inspection, take a decision afresh and communicate the same to
                           the petitioner within a period of eight weeks from the date of receipt of a copy of
                           this order.”

                           The matter was considered by the Committee and SRC decided to
                           cause inspection for which the following documents were to be
                           called from the institution. They are required to be submitted
                           within ten days of receipt of the letter:-
                             Land and building details with necessary original documents to
                              be submitted.
                             Filled-in Questionnaire with all the relevant information to be
                              submitted.
                             Building plan approved by the competent Govt. authority is to be
                              submitted.
                             Building Completion Certificate from the competent Government
                              authority in the prescribed format is to be submitted.

5.             0598        DBHPS Rajiv Gandhi College of Education, D.C. Compound, Dharwad –
                           580001, Karnataka was granted recognition by SRC for offering B.Ed.
               B.Ed        course with an intake of 60 students from the session 2000-2001 vide
                           order dated 10.07.2000.

          Gandhi College   A Complaint was received on 18.11.2009 from the Secretary, Hindi
           of Education,   Prachar Mandali, Bijapur, Karnataka addressed to the Chairperson,
             Dharwad       NCTE, New Delhi regarding misappropriation of funds and Mal-
                KA         administration of DBHPS institutions in Karnataka. The Complaint was
                           forwarded to SRC from NCTE, Delhi on 10.12.2009. The complainant

                            has requested NCTE to make investigation and to punish the real
                            culprits and the officials concerned.

                            SRC in its 188th meeting held on 28-29 January 2010 considered the
                            complaint and decided to call for the remarks from the institution on the
                            allegations made against DBHPS in Karnataka. Accordingly, letter was
                            issued to the institution on 08.03.2010. The institution submitted its
                            written representation on 30.03.2010.

                            The matter was considered by the Committee and it was decided to
                            cause inspection of the institution under Section 17 of NCTE Act to
                            verify the facts, within four weeks from the date of confirmation of
                            the Minutes.
6.            0156          DBHPS Lal Bahadur Shastri College of Education, 113/114, S.C. Road,
              B.Ed          Sheshadripuram, Bangalore – 560 020, Karnataka was granted
            DBHPS Lal       recognition by SRC for offering B.Ed. course with an intake of 60
          Bahadur Shastri   students from the session 2000-2001 vide order dated 10.07.2000.
            College of
            Education,      A Complaint was received on 18.11.2009 from the Secretary, Hindi
            Bangalore       Prachar Mandali, Bijapur, Karnataka addressed to the Chairperson,
               KA           NCTE, New Delhi regarding misappropriation of funds and Mal-
                            administration of DBHPS institutions in Karnataka. The Complaint was
                            forwarded to SRC from NCTE, Delhi on 10.12.2009. The complainant
                            has requested NCTE to make investigation and to punish the real
                            culprits and the officials concerned.

                            allegations made against DBHPS in Karnataka. Accordingly, letter was

7.             0602         DBHPS Dr.B.D. Jatti College of Education, Civil Hospital Road, Ayodhya
               B.Ed         Nagar, Belgaum – 590 001, Karnataka was granted recognition by SRC
             DBHPS          for offering B.Ed. course with an intake of 60 students from the session
            Dr.B.D.Jatti    2000-2001 vide order dated 10.07.2000.
            College of
            Education,      A Complaint was received on 18.11.2009 from the Secretary, Hindi
             Belgaum        Prachar Mandali, Bijapur, Karnataka addressed to the Chairperson,
                KA          NCTE, New Delhi regarding misappropriation of funds and Mal-
                            administration of DBHPS institutions in Karnataka. The Complaint was
                            forwarded to SRC from NCTE, Delhi on 10.12.2009 wherein the

                         complainant had requested to make an investigation and to punish the
                         real culprits and also the officials concerned.

                         Further, this office is in receipt of another letter dated 19.08.2009 from
                         Sri.Om Narain, Lecturer of Hari Bawa Inter College Gawan, Badaun
                         District, Uttar Pradesh regarding malpractices in B.Ed College of
                         Dakshin Bharath Hindi Prachar Sabha, Karnataka. The above letter was
                         forwarded by NCTE, Hqrs on 16.11.2009 wherin the complainant states
                         that the annual intake in B.Ed classes has been fixed at 100 students
                         and the following Colleges are admitting more than 100 students and
                         adjusting these excess students against the leftover vacant seats for the
                         preceeding years i.e.2007-2008 & 2008-2009:-
                           DBHPS Dr.B.D.Jatti Siksha College, Afzalpur, Takke Athani Road,
                            Bijapur – 586101, Karnataka
                           DBHPS Dr.B.D. Jatti Siksha College, Jila Hasptal Rasta (District
                            Hospital Road), Belgaum – 590001.
                           Vishveshwara Siksha College, K.R. Mohalla, Bani Vilas Road, Mysore
                            – 570 004.

                         Further, the Complainant has also stated that these students neither
                         attend the classes nor go to teaching schools, even then they get more
                         than 80% marks and has requested to investigate into the matter and
                         punish the defaulters.

                         SRC in its 188th meeting held on 28-29 January 2010 considered the
                         above two Complaints and decided to call remarks from the institution
                         on the allegations made against DBHPS in Karnataka. Accordingly,
                         letter was issued to the institution on 08.03.2010. The institution
                         submitted its reply on 30.03.2010.

                         The Committee considered the reply to the letter and it was
                         decided to cause inspection of the institution under Section 17 of
                         NCTE Act to in order to verify the facts, within four weeks from the

8.             0600      DBHPS Basaveswara College of Education, ‘Hindi Bhavan’ V.V. Road,
                         K.R.Mohalla, Mysore – 570 004, Karnataka was granted recognition by
               B.Ed      SRC for offering B.Ed. course with an intake of 60 students from the
                         session 2000-2001 vide order dated 10.07.2000.
             DBHPS
           Basaveswara   A Complaint was received on 18.11.2009 from the Secretary, Hindi
            College of   Prachar Mandali, Bijapur, Karnataka addressed to the Chairperson,
            Education,   NCTE, New Delhi regarding misappropriation of funds and Mal-
             Mysore      administration of DBHPS institutions in Karnataka. The Complaint was
               KA        forwarded to SRC from NCTE, Delhi on 10.12.2009 wherein the
                         complainant had requested to make an investigation and to punish the
                         real culprits and also the officials concerned.

                         Further, this office is in receipt of another letter dated 19.08.2009 from

                             Sri.Om Narain, Lecturer of Hari Bawa Inter College Gawan, Badaun
                             District, Uttar Pradesh regarding malpractices in B.Ed College of
                             Dakshin Bharath Hindi Prachar Sabha, Karnataka. The above letter was
                             forwarded by NCTE, Hqrs on 16.11.2009 wherin the complainant states
                             that the annual intake in B.Ed classes has been fixed at 100 students
                             and the following Colleges are admitting more than 100 students and
                             adjusting these excess students against the leftover vacant seats for the
                             preceeding years i.e.2007-2008 & 2008-2009:-

                                Bijapur – 586101, Karnataka

                             506102, Karnataka was granted recognition by SRC for offering B.Ed.
               B.Ed          course with an intake of 60 students from the session 2000-2001 vide
                             order dated 10.07.2000.

10.        7396       Shobha Memorial Educational Society, Vizianagaram District, Andhra
                      Pradesh had submitted an application for grant of recognition for B.Ed
           B.Ed       course on 25.07.2006. The application was processed and was
                      considered by the Committee in its various meetings and the institution
          Shobha      was refused recognition due to lack of infrastructural and instructional
         Memorial     facilities. Accordingly, a refusal order was issued to the institution on
        Educational   29.11.2007.
          Society,
       Vizianagaram   Aggrieved by the refusal order, the institution preferred an appeal to
            AP        NCTE-Hqrs. The Appellate Authority vide its order dated 20.6.2008
                      reverses the order appealed against. In obedience to the Appellate
                      Authority order, a Conditional Recognition letter was issued to the
                      institution on 30.7.2008.

                      A Complaint was received by the SRC against the institution alleging the
                      lack of infrastructural facilities, which was placed before SRC. The
                      Southern Regional Committee considered the complaint, inspection
                      reports of Section 17 of NCTE Act, Notice was issued and a reply was
                      received from institution.

                      The Committee after considering various aspects in respect of

                    deficiencies, location of College closer to quary mining and disturbances
                    to the academic ambience of the College, arrived at the conclusion that
                    the Conditional Recognition /LOI issued to the institution be withdrawn
                    for the following reasons:-
                    1. The quary mining is located adjacent to the College premises. It is a
                         disturbance to the academic ambience of the institution. The
                         Management’s written representation to the showcause Notice is not
                         convincing.
                    2. The built up space as per showcause Notice and Section 17
                         inspection report is less than the requirement as per norms and
                         standards of B.Ed. course. The Management in its representation
                         simply stated that 17,813 sq.ft. built up space available but failed to
                         submit the approved building plan and building completion certificate
                         issued by the Government authority as an evidence.
                    3. No proof is given in respect of modification of two rooms and to
                         provide more space to Seminar Hall.

                    Accordingly, a Withdrawal Order was issued to the institution on
                    09.04.2009. Aggrieved by the withdrawal order, the institution preferred
                    an appeal to NCTE-Hqrs. The Appellate Authority vide order dated
                    07.08.2009 reversed the order appealed against.

                    In obedience to the Appellate Authority order, a Conditional Recognition
                    letter was issued to the institution on 01.09.2009. The institution
                    submitted its written representation on 15.09.2009 which was
                    considered by SRC in its meeting held on 22nd September 2009 and a
                    formal recognition was issued to the institution on 14.10.2009.

                    Meanwhile, another Complaint was received from Ippaka
                    Ramachandrudu, Vizianagaram, Andhra Pradesh which was considered
                    by the Committee and a letter was issued to the institution on
                    22.02.2010 to give comments on the compliant. The reply is awaited
                    from the institution.

                    Again, the same Complainant has submitted another complaint on
                    6.4.2010 stating that the Management is collecting amounts from the
                    Private Colleges for getting admissions in their College and that there
                    are no materials in the labs. of the College.

                    The Committee considered the brief note about the College and
                    also the complaints received against the institution and has
                    decided to issue Final Notice to the institution based on the
                    complaint, on the following grounds:-
                      There is no approval for construction of the building. The Gram
                       Panchayat, Jami Village and Mandal has rejected the building
                       plan for the construction of the building to run the College.
                      The Society under which the College is running is not renewed
                       by the State Government.
                      Shobha Memorial Intermediate College was sanctioned during
                       1994-95 located in Survey No. 394 of Jami Village and Mandal to
                       run the intermediate College and the building was constructed in

                            1997-98. By showing the same building in the same survey No.,
                            the said management has obtained permission for running
                            Degree College. Again, by showing the same building on the
                            same survey No., the Management has obtained permission for
                            B.Ed. College.     Presently, the Management is running an
                            intermediate College, a degree College and a B.Ed. College in the
                            same premises and without making any additional construction.
                           There is no faculty as per NCTE norms.
                           Adjacent to the above said College, mining activity and quary
                            operations are being carried out, there is an amount of life risk
                            involved to the students and others.
                           The building shown is being used to run various courses and
                            was constructed unauthorizedly, without approval from the
                            competent authority.

                          The institution did not reply to the earlier notice of SRC, NCTE
                          dated 22.2.2010, on similar grounds.

                          If no reply is received from the institution within 21 days from the
                          date of issue of     this Final Notice, it will be construed that the
                          institution has no replies to offer and that action will be initiated for
                          withdrawal of approval without further notice,                 based on the
                          available records and evidences in the office.
11.        0824           Seethi Sahib Charitable Trust, Kozhikode, Kerala was granted
                          recognition on 31.12.2002. A complaint has been received from Shri
            TTC           Ananth, Educationist, Kerala on 08.07.2009 and it was placed before
                          SRC in its 178th meeting held on 13-14 July, 2009. The Committee
       Seethi Sahib       decided to issue Notice. Accordingly, a notice was served to the
      Charitable Trust,   institution under Section 17 of NCTE Act on 02.07.2009. The institution
        Kozhikode         has submitted the reply to the Notice on 16.9.2009. The reply was
             KL           considered by SRC in its 184th meeting held on 26-27 October, 2009
                          and it was decided to cause inspection under Section 17. As per the
                          decision of SRC, the inspection of the institution was carried out on
                          14.12.2009. The Committee considered the Visiting Team Report in its
                          188th Meeting held on 28-29 January, 2010 and decided to call for
                          clarification from the Institution. Accordingly, a clarification letter was
                          issued to the institution on 02.03.2010. The institution has submitted its
                          reply on 08.04.2009.

                          On careful perusal of the reply of the institution along with the
                          original file of the institution and other related documents, Act of
                          NCTE, 1993, Regulations and guidelines from time to time laid on
                          the table, visiting team report under section 17 of NCTE Act, the
                          Regional Committee decided to continue recognition to the TTC
                          course, as there are no valid/proven grounds for any decision

12.        1592           D.V.Gundappa Teacher Training Institute, Savitha Samaja,
                          Boosalakunte, M.C. Road, Near Veerabadra Nagar, Mulbagal – 563131,
           D.Ed           Kolar District, Karnataka submitted an application for grant of recognition
                          on 26.12.2003. The institution was granted recognition for D.Ed course
       D.V. Gundappa      with an intake of 50 students on 29.11.2004.
      Teacher Training
       Institute, Kolar   The institution vide its letter received on 01.04.2010 has stated that the
              KA          Trust has passed a resolution to close down the institution, since there
                          are no new admissions. Hence, as per the decision of the Trust, the
                          institution has requested to withdraw the recognition granted to the
                          institution and also requested to cancel the FDR bearing No.127758
                          dated 04.04.2005 for Rs.5.00 lakhs kept in joint account.

                          The Committee considered the request of the institution/Trust and
                          decided to withdraw recognition accorded to the institution for the
                          D.Ed. course, as requested by the institution. It was also decided
                          to return    the Fixed Deposit Receipts which were kept in joint
                          account towards Endowment fund and Reserve fund, after due
                          process of scrutiny and as per other norms.

13.        1794           M.S. Ramaiah College of Education, Opp. Art of Living, Udayapura,
                          Kanakapura Road, Bangalore – 560 062, Karnataka submitted an
            B.Ed          application for grant of recognition on 30.12.2003. The institution was
                          granted recognition for B.Ed course with an intake of 100 students on
       M.S Ramaiah        10.12.2004.
        College of
        Education,        The institution vide its letter received on 12.04.2010 has stated that the
        Bangalore         Management has taken a decision to close down the institution from the
           KA             academic session 2009-2010. Hence, as per the decision of the
                          Management, the institution has requested to withdraw the recognition
                          granted to the institution.

                          The Committee considered the request of the institution/Trust and
                          decided to withdraw recognition accorded to the institution for the
                          B.Ed. course, as requested by the institution. It was also decided
                          to return    the Fixed Deposit Receipts which were kept in joint
                          account towards Endowment fund and Reserve fund, after due
                          process of scrutiny and as per other norms.

14.        1795           M.S. Ramaiah Teacher Training Institute, Opp.Art of Living, Udayapura,
                          Kanakapura Road, Bangalore – 560 062, Karnataka submitted an
           D.Ed           application for grant of recognition on 30.12.2003. The institution was
                          granted recognition for D.Ed course with an intake of 100 students on

         Institute,       The institution in its letter received on 12.04.2010 has stated that the
         Banglore         Management has taken a decision to close down the institution from the

                          The Committee considered the request of the institution/Trust and

15.        0797           Fathima Memorial Training College, Thalachira, Kottarakara, Kollam
                          District, Pin – 691546, Kerala submitted an application for grant of
            B.Ed          recognition on 29.12.2004. The institution was granted recognition for
                          B.Ed course with an intake of 100 students on 21.05.2008.
          Fathima
          Memorial        The institution vide its letter received on 09.04.2010 has stated that the
      Training College,   University of Kerala had not issued affiliation to the college. The
           Kollam         institution has also stated that, in view of the University decision to reject
             KL           the application for affiliation, the institution is unable to start the B.Ed
                          course. Hence, it has requested to withdraw the recognition granted to
                          the institution and to permit for withdrawal of FDRs kept in joint account
                          towards the Endowment and Reserve fund.

                          The Committee considered the request of the institution/Trust and
                          decided to withdraw recognition accorded to the institution for the
                          B.Ed. course, as requested by the institution. It was also decided
                          to return    the Fixed Deposit Receipts which were kept in joint
                          account towards Endowment fund and Reserve fund, after due
                          process of scrutiny and as per other norms.

16.         B.Ed          The institution was granted recognition for B.Ed on 22.8.2002 with an
                          intake of 90 students from academic session 2002-2003.
      Sree Narayana
        College of        In the meantime, a complaint has been received from Smt. R. Sreelatha,
         Teacher          Raranmadathil, 5/3380, Mavoor Road, Calicut, Kerala on 3.9.2009. The
        Education,        matter was considered by SRC in its 184th meeting held on 26-27th
        Kozhikode         October 2009 and the Committee decided to obtain affidavit from the
            KL            complainant and to call for remarks from the institution on the
                          allegations. Accordingly, a letter was issued to the institution on
                          02.12.2009 and complainant on 02.12.2009.

                        The institution submitted its reply on 14.12.2009, which was placed
                        before SRC in its 188th meeting held on 28-29th January 2010 and the
                        committee decided to call for clarification from the institution on the
                        following points. Accordingly, a clarification letter was issued to the
                        institution on 01.03.2010 on the following:-
                             1. The institution to submit the details of built-up area of the building
                                 mentioned in the Building Completion Certificate and approved
                                 building plan.
                             2. The institution has not submitted filled-in Questionnaire.

                        The institution has submitted its written representation on 13.04.2010.

                        The Committee considered the reply of the institution and has
                        noticed that as per the Building Completion Certificate, the built-up
                        space available is 16,802.50 sq.ft. for B.Ed. course and has decided
                        to continue recognition for B.Ed. course.

                        The Committee also noticed that the College is offering M.Ed.
                        course in the same building and the built-up area available as per
                        the statement of the institution is not sufficient for both B.Ed. and
                        M.Ed. courses as per NCTE norms. Hence, the Committee decided
                        to withdraw the recognition for M.Ed. course due to shortage of
                        built-up area w.e.f. 2010-11. The affiliating University and the State
                        Government be informed accordingly.

17.        0823         Christ Academy, Thanjavur District, Tamilnadu was granted recognition
                        for D.T.Ed course with an intake of 50 students under clause 7(12) of
           D.Ed         Regulation dated 13.1.2006 vide order No.9191 dated 13.11.2006.

      Christ Academy,   Meanwhile, a complaint was received from Shri. S. Jayachandran,
        Thanjavur       Advocate regarding property disputes between client Mr. S.
             TN         Arocikiasamy, Son of Soosai Udayar (I) and Mrs. Alice Marcy, daughtetr
                        of Soosai Udayar and Mr. Gerad Phingnora Raj & Y. Arul. It was stated
                        that the academy has been running by a “Christ Academy” under the
                        management of Gerard Phingnora Raj & Arul.

                        Accordingly, a letter seeking clarification on the following points was
                        issued to the institution on 15.02.2010:-
                          The Christ Academy has been running by a trust under the
                           management of Gerard Phingnora Raj & Y. Arul, stating that the
                           property situated at Thanjavur, Neelagiri, Therkku Thottam in R.S.
                           No.193/1 belongs to the trust and it has lawful possession of the
                           same.
                          The said property not all belongs to any trust Mr.S.Arockiasamy, son
                           of Social Udayar and Mrs. Alice Mary, daughter of Soosai Udayar
                           these members having right, share, interest over the said property.
                           Infact, a suit for partition is already pending with reference to the
                           property mentioned above before the Fast Track Court no.1,
                           Thanjavur in O.S. No. 109/2004. In the said suit the above referred
                           Y.Arul and his son Gerand Phingnora Raj made a false representation
                           and gained recognition. The act of false representation and

                        suppression of material facts will show their malafide intention.
                        Further, while the litigation is pending they made superstructure in the
                        property.
                       With the intention to grab the properties they have created certain
                        records in the name of the trust in which they themselves are the
                        trustees. It is an act of land grabbing and falsification of documents,
                        by placing those false details they have obtained the loan facilities
                        from the bank. They have trespassed into the property and
                        constructed the superstructure.

                      The institution has submitted its written representation on 26.03.2010.

                      The Committee considered the written representation and has
                      noticed that the matter is pertaining to a civil dispute and the NCTE
                      cannot take any stand in this regard and hence decided that the
                      matter is to be decided by the Court of Law.

18.       M.Ed        The University of Mysore was granted recognition for offering M.Ed.
                      course for an intake of 50 students.
      Department of
       Studies in     Based on the note of Chairperson, NCTE stating that the University is
       Education,     offering M.Ed. face-to-face programme in number of outreach centres in
        Mysore        different parts of the Country including Andhra Pradesh, Rajasthan and
          KA          Jammu and Kashmir without having obtained any recognition/permission
                      from NCTE. Letters were issued to the Registrar and the Dean seeking
                      clarification on 7.1.2009. The Registrar has submitted a clarification on
                      21.1.2009 which was placed before 170th meeting of SRC held during
                      16-17 February, 2009 and a Notice was served to the institution on
                      22.4.2009. The reply to the Notice was considered in 175th meeting of
                      SRC which has decided to seek clarification and letter was sent on
                      5.6.2009 for the following:-
                       No outreach Centres should be allowed by the University including
                           Jammu and Kashmir as Universities cannot directly affiliate any
                           programme in Teacher Education without recognition from NCTE.
                           The exemption to J&K is applicable to the Universities in J&K and
                           not for those outside J&K.
                       University shall admit students only to the sanctioned intake of 50
                           from the academic session 2009-10 onwards. Excess admissions
                           be not made beyond the sanctioned intake which will attract Section
                           17 of NCTE Act for withdrawal of recognition.

                      The clarification letter was submitted by the University on 21.7.2009
                      wherein it was requested to approve all admissions made during 2007-
                      08 and 2008-09 to M.Ed. course under the University of Mysore
                      including admissions made in Out Reach centres in order to avoid any
                      hardship to students.

                      The Committee considered the request in its 180th meeting held on 29th
                      July 2009 and decided that as the NCTE regulations do not permit any

                        programme through outreach Centres and the request of the
                        University cannot be complied with. Accordingly, a letter was issued to
                        the University on 10.09.2009.

                        In reply, a letter dated 21.10.2009 has been received from the Registrar,
                        University of Mysore who stated that in future the University will strictly
                        adhere to the norms of NCTE while approving the M.Ed course through
                        Out-reach centres. Further, the University has requested NCTE to
                        approve all admissions made though the Out-reach centres during the
                        academic year 2007-2008 & 2008-2009 to M.Ed course under University
                        of Mysore in order to avoid hardship to the students.

                        SRC in its 187th meeting held on 29-30 December 2009 considered the
                        matter and decided that the University be informed that request of
                        University of Mysore for retrospective approval of all admissions made
                        during 2007-2008 and 2008-2009 cannot be considered as per the
                        NCTE Act, rules and regulations. Accordingly, a letter was issued to the
                        institution on 04.02.2010.

                        Now, the University of Mysore vide its letter received on 12.04.2010 has
                        requested SRC to reconsider the decision taken by the Committee.

                        The Committee has considered the request and has decided that it
                        is beyond the powers of the NCTE, SRC to accord retrospective
                        approval of any admission made during the previous years of 2007-
                        08 and 2008-09.

19.        9755         Sri.Rudreshwara D.Ed College, Sri.Rudreshwara Vidya Samsthe,
                        Hebbal, Davanagere – 5888527, Karnataka had submitted an
           D.Ed         application for grant of recognition on 31.10.2008. The institution was
                        refused recognition for D.Ed course on 28.07.2009.
      Sri Rudreshwara
       D.Ed College,    The institution preferred appeal to NCTE, Hqrs and the Appellate
        Davanagere      Authority vide order dated 06.11.2009 has remanded the case to SRC
            KA          for causing inspection on payment of Rs.40,000/- towards inspection
                        fee. The matter was placed before SRC in its 185th meeting held on 26-
                        27 November 2009 and SRC decided to cause re-inspection on
                        payment of Rs.40,000/- and call for necessary documents.

                        Accordingly, Re-inspection of the institution has been carried out on
                        17.02.2010. SRC in its 189th meeting held on 25-26 February 2010
                        considered the re-inspection report and decided to issue Letter of Intent
                        prior to grant of recognition.

                        Accordingly, Letter of Intent to the institution under clause 7(a) of
                        Regulations 2007 was issued to the institution on 01.03.2010.

                        Since the institution had not submitted its reply on the Letter of

                        Intent, the Committee has decided to instruct the institution to
                        submit the reply to the Letter of Intent within 30.5.2010, failing
                        which Letter of Intent stands cancelled without any further notice.

20.        6041         S.G.Balekundri D.Ed College, Chikkapadasalagi, Jamakhandi, Bagalkot-
                        597301, Karnataka submitted application to SRC on 02.01.2006. The
           D.Ed         application was considered for the session 2009-2010 after conducting
                        inspection and other procedures, recognition to the institution was
      S.G. Balekundri   refused by SRC. The refusal order was issued to the institution on
       D.Ed College,    14.06.2007.
         Bagalkot
            KA          The institution had preferred an appeal on 20.08.2007. Their appeal has
                        also been rejected by Appellate Authority on 07.11.2007.

                        The institution has filed W.P.896 of 2008 before the Hon'ble High Court
                        of Karnataka. The Hon’ble court after hearing the matter has passed a
                        direction to Respondent No.2 i.e. SRC, NCTE, Bangalore to consider
                        the request made by the petitioner afresh as expeditiously as possible.
                        The refusal order of SRC and the order of the Appellate Authority was
                        set aside.

                        In obedience to the directions of Hon'ble High Court of Karnataka in
                        W.P.896/2008 and judgment dated.26.06.2008, the SRC re-considered
                        the application of S.G.Balekundri D.Ed College, Jamkhandi, Bagalkot
                        District, Karnataka for D.Ed course in its 163rd Meeting held on 29-30
                        August, 2008 and it was decided to refuse recognition. Accordingly,
                        order of refusal was issued to the institution vide order dated
                        11.06.2009.

                        The institution preferred an appeal to NCTE, Hqrs and the Appellate
                        Authority vide order dated 06.11.2009 remanded the case to SRC for
                        causing inspection on payment of Rs.40,000/- towards inspection fee.
                        The matter was placed before SRC in its 185th meeting held on 26-27
                        November 2009 and SRC decided to cause re-inspection on payment of
                        Rs.40,000/- and call for necessary document.              Accordingly, Re-
                        inspection to the institution was conducted on 16.02.2010. SRC in its
                        189th meeting held on 25-26 February 2010 considered the re-inspection
                        report and decided to issue Letter of Intent prior to grant of recognition.

                        Accordingly, Letter of Intent to the institution under clause 7(a) of
                        Regulations 2007 was issued to the institution on 01.03.2010.

                        The institution replied to the Letter of Intent on 19.4.2010.                 The
                        matter is considered by the Committee and Formal recognition is
                        granted to the institution.

21.        9494         Mahamuth Ammal Educational Trust, Pudukkottai District, Tamilnadu

          M.Ed       was refused recognition in its 178th meeting held on 13th-14th July 2009.
                     Accordingly, order of refusal was issued to the institution on 31.07.2009.
        Mahatma
        College of
        Education,   Aggrieved by the refusal order, the institution filed an appeal under
        Pudukottai   section 18 of NCTE Act, before the Appellate Authority, NCTE, New
           TN        Delhi. The Appellate Authority vide order dated 06.11.2009 remanded
                     the case to SRC for examining the reply of the applicant institution and
                     for taking necessary action thereon.

                     The matter was considered by SRC in its 185th meeting held on 26th-27th
                     November 2009 and it was decided to issue Notice for submission of
                     reply on the grounds of refusal with documentary evidence.
                     Accordingly, as per the decision of SRC, a Notice was issued to the
                     institution on 02.12.2009 for the following:-

                      The built-up space is not earmarked for existing D.T.Ed.(100 intake)
                       course , B.Ed. course and proposed M.Ed course. The built-up space
                       of 14262 sq.ft is available as per building completion certificate
                       submitted by the management
                      The books in the Library numbering 3362 are not adequate for
                       existing D.T.Ed (100 intake), B.Ed course and proposed M.Ed Course.
                      The lab. equipment in science lab. is not adequate.
                      The reading space in the library is not sufficient to run all the courses.
                      The Management has to submit the filled Questionnaire with all
                       Infrastructural & Instructional facilities for verification.
                      The Management has to submit a certificate from Tamilnadu Teacher
                       Education University stating that no other course/College being run in
                       the same building, for verification. The Management has to submit a
                       building plan and building completion Certificate with details of built-up
                       space and that it is constructed for B.Ed. and M.Ed. courses from
                       PWD/Government Engineer.

                     The institution submitted its reply on 18.12.2009.

                     The SRC considered the reply in its 188th meeting held on 28th-29th
                     January 2010 and decided to cause re-inspection of the institution after
                     payment of Rs.40000/- within four weeks. Accordingly, a letter was
                     issued to the institution on 02.03.2010. The institution has not submitted
                     its reply even after completion of stipulated period.

                     The Committee considered the matter and it was decided to refuse
                     recognition for M.Ed. course on the following grounds:-
                       The institution has not submitted reply for the letter dated
                       2.3.2010 and also not submitted Rs.40,000/- fees for causing re-
                       inspection within the stipulated period of 4 weeks.


22.        5980      J.S.J.V Teacher Training Institute, Cuddalore, Tamilnadu had submitted
                     an application for grant of recognition to D.T.Ed course. Recognition to
          D.T.Ed     the institution was granted to the institution on 23.12.2006.

          Training       2009, the office of SRC has reviewed the files of the institutions which

                         held on 20th-21st August 2009 wherein, it was decided that the institution

                         further action. Accordingly, a Notice was issued to the institution on
                         16.09.2009.

                         The institution has not submitted reply to the above Notice so far.

                         Instead the institution has submitted letter dated 12.04.2010 requesting
                         for change of name from J.S.J.V. Teacher Training Institute to C.K.
                         Teacher Training Institute. The institution has submitted a copy of
                         resolution regarding change of Trustees and a copy of extract of
                         resolution.

                         The Committee considered the brief note about the College and
                         also the complaints received against the institution and has
                         decided to issue Final Notice to the institution on the following
                         grounds:-

                          To explain as to why the institution has not shifted to its own
                           premises, even after the expiry of three years (i.e., on
                           22.12.2009).

                                If no reply is received from your end within 21 days from the
                                date of issue of Final Notice, action will be initiated for
                                withdrawal of approval without further notice, based on the
                                available records and evidences in the office.

                          The Committee also decided that the change of Name from
                           J.S.J.V. Teacher Training Institute to C.K. Teacher Training
                           Institute cannot be considered as the institution is still in
                           temporary accommodation and any change of Name and
                           character of the institution is not permitted, at this stage.

23.        8652          J.S.J.V College of Education, Cuddalore, Tamilnadu has been granted
                         recognition for B.Ed course on 5.8.2008 with an intake of 100 students
           B.Ed          from session 2008-09.

                          The Committee considered the letter of the institution for change of
                          Name and decided that their request for change of name from
                          J.S.J.V. College of Education to C.K. College of Education cannot
                          be complied with as the institution is in Leased accommodation
                          and any change of name and character of the institution is not
                          permitted, at this stage.

24.        4417           Umaiyal TTI, Theni, Tamilnadu is recognized by SRC vide order No.
                          F.SRO/NCTE/D.T.Ed/2006-2007/10147 dated 12th January 2007 for
           D.T.Ed         D.T.Ed course with annual intake of 50 students.

      Umaiyal Teacher     The State Govt of Tamilnadu vide its letter No. Rc. No.6794/C2/2009 dtd
          Training        19.06.2009 had forwarded a complaint against the institution on the
       Institute, Theni   basis of the report of the Affiliation. Inspection Committee has stated
              TN          that the application for affiliation in respect of above TTI is deferred until
                          a reply is received from SRC as to the compliance of the defects as
                          indicated above on the following points:-
                           Total Plinth area consisting of ground floor and first floor of the
                              building is 403.68 sq.mts only.
                           Asbestos roofed building accounts for 149.84 sq.mts. As per NCTE
                              norms 1000 sq.mts RCC building is required and no asbestos sheet
                              roofing is allowed.
                           All the class rooms, workshops, laboratories are not as per NCTE
                              norms.
                           First floor is partially A.C. sheet and RCC roof with more leakage in
                              roof and poor maintenance.
                           The institute is housed in a rental building. As per NCTE regulations
                              norms and standards clause 8(7) no building could be taken on
                              lease for running any Teacher Training Institute.
                           Proposed building plan not produced to the inspection team for
                              perusal.
                           Building stability certificate, building license and sanitary certificate
                              not produced.

                          The institution preferred a W.P. in the Hon’ble High Court of Madras at
                          Madurai vide W.P. No. 6422 of 2009 wherein the Hon’ble Court had
                          directed the petitioner to comply with the deficiencies pointed out by
                          DTERT and submit the same to SRC-NCTE within a period of one week
                          from the date of receipt of the order and also directed SRC-NCTE on
                          receipt of the same from the petitioner to consider the same on merits
                          and in accordance with law within a period of two weeks thereafter.

                          The institution vide its letter dated 29th July 2009 had submitted a
                          representation to SRC-NCTE on the basis of the directions of the
                          Hon'ble Court. The matter was placed before SRC in its 181st meeting
                          held on 20th and 21st August, 2009.

                      its W.P. No. 6422 of 2009 and decided to cause inspection under
                      Section 17 of NCTE Act after payment of Rs. 40,000/- and submission of
                      filled in Questionnaire with documents. Accordingly, a letter was issued
                      to the institution on 28.8.2009. The institution has not submitted filled in
                      Questionnaire and fees instead they have filed a W.P. no. 9393 of 2009
                      in the Hon’ble High Court of Madras against the decision of SRC.

                      SRC in its 185th meeting held on 26-27th November 2009 decided to
                      constitute visiting teams for visiting all the section 17 cases before 31 st
                      December 2009. A reminder letter was issued to the institution on
                      11.02.2010 intimating to be ready for inspection which is to be held
                      shortly.

                      The matter was considered again by the Committee and it was
                      decided to cause inspection of the institution under Section 17 of
                      NCTE Act to verify the facts, in anticipation of the payment of
                      inspection fees by the institution, within four weeks from the date
                      of confirmation of the Minutes.

25.    SRCAPP110      SR Educational and Rural Development Society submitted an
                      application to SRC-NCTE for grant of recognition to Aazad College of
           B.Ed       Education, Kandukur, Prakasam District, Andhra Pradesh for B.Ed
                      course on 03.11.2009.
      Aazad College
      of Education,   The application was scrutinized and a copy of application was sent to
        Prakasam      State Government for recommendation on 20.11.2009. A deficiency
           AP         letter was issued to the institution on 22.12.2009 for the following
                      points:-
                      1. Certified copy of the registered land documents issued by the
                           competent authority:- The land does not seem to be registered with
                           the Govt. authority (competent authority) hence land document duly
                           registered with competent authority to be submitted.
                      2. Notarized copy of change of land use certificate issued by the
                           competent authority:- The institution has not submitted notarized
                           copy of land use certificate issued by the Competent Authority.
                           Hence the institution is required to submit notarized copy of CLU
                           (Agricultural lands-conversion to Non-Agricultural purpose) issued by
                           Competent Authority.
                      3. Minority Certificate:- The institution is claimed as minority institution
                           as per application form, however the institution has not submitted
                           minority certificate in this regard. Hence the institution is required to
                           submit minority certificate issued by Competent Authority.

                      The State Government has made negative recommendation vide letter
                      no. 22042/Gen.II/A2/2009 dated 05.01.2010. The institution submitted
                      its written representation on 22.02.2009.

                      The SRC considered the written representation in its 190th meeting held
                      on 29-30th March 2010 and the committee decided to reject the

                             application for want of valid Minority Certificate from the Competent
                             Authority.

                             After the decision to reject the application, the institution has submitted
                             letter dated 05.04.2010 and submitted Muslim Religious Status
                             Certificate dated 1.4.2010 and has stated that “after receiving the
                             deficiency letter from SRC, NCTE, Bangalore, we approached the
                             government of AP for issuing the Muslim Religious Minority Status
                             Certificate to the above institution. The Government of Andhra Pradesh
                             Minorities Welfare (Wakf-II) Department called for remarks and
                             inspection report to the Director of School Education, AP to take further
                             action. The DSE, AP sent Regional Joint Director of School Education
                             for inspection report, after completion of inspection, he sent favourable
                             remarks to the DSE, AP to take further action. The Director of School
                             Education, AP submitted their report to the Govt. of AP Minorities
                             Welfare (Wakf-II) Department to take necessary action. Principal
                             Secretary, Minorities Welfare (Wakf-II) Department sent to the Ministry
                             of Mniorirty Welfare for approval and finally Government of Andhra
                             Pradesh Minorities Welfare (Wakf-II) Department issue Muslim Religious
                             Minority Status Certificate of our Azad College of Education, Oguru (vill),
                             Kandukur, Prakasam (dist). Due to this procedure we submit the order
                             copy of Minority Status Certificate on this date”.

                             The Committee considered the matter and decided that their
                             explanation cannot be considered as the institution should have
                             applied to SRC, NCTE along with the Minority Certificate as per
                             regulations, 2009 and the notification of NCTE in this regard.



 26.      Consideration of Notices issued under section 17 in the state of Tamilnadu (Total 35

     The following institutions were issued notices under section 17 on the basis of
     complaints received from State Government and as per Sathyam Committee’s
     recommendation in the State of Tamilnadu, but replies have not been received so far.

                D.Ed.          recognition by SRC on 06.10.1996 for D.Ed course with an intake of 30
                               students.

           Dt., Karnataka      DSERT, Bangalore has not allotted any seat to the institution as there

                               institution has requested to withdraw the recognition granted to the
                               institution and to release the FDR of Rs.5.00 lakhs dt.17.04.2009.


                               The Committee considered the request of the institution/Trust and
                               decided to withdraw recognition accorded to the institution for the
                               D.Ed. course, as requested by the institution. It was also decided
                               to return   the Fixed Deposit Receipts which were kept in joint
                               account towards Endowment fund and Reserve fund, after due
                               process of scrutiny and as per other norms.

                              decided to issue Letter of intent to the institution under clause 7(9) of
              D.T.Ed.         NCTE Regulations as per the orders of the appellate authority dated
                              12.2.2010 which was remanded to SRC for issuance of letter of
        R.R. TTI, Chennai     intent prior to grant of recognition under clause 7(9) of NCTE
                TN            Regulation, 2007. Letter of Intent was issued to the institution on
                              2.3.2010 and the institution replied to the LOI on 30.3.2010.

                              The Committee considered the written representation and
                              decided to serve Notice for the following reasons:-
                                Principal is not possessing 5 years experience in Elementary
                                 Teacher Education institution as required under NCTE
                                 Regulation.
                                The list of staff shown in DTERT letter dated 9.9.2005 is not
                                 tallying with list submitted by institution.
                                The proceedings of selection committee is not submitted so
                                 as to ascertain whether the selection committee is constituted
                                 as per NCTE norms/State Govt Norms.
                                Website details are not submitted (the institution is required to
                                 submit downloaded copies of their website contents)

                              In view of the above, the Committee decided to issue Notice to
                              the institution and thereby providing an opportunity to the
                              institution to make a written representation within 21 days from
                              the date of receipt of the Notice along with necessary
                              certificates/documents in order to take a final decision in the
                              matter, failing which action will be initiated based on the records
                              available in the file.
