2.2   Local Government Elections 2009

In January 2009 the State Government announced plans to return to First-Past-the-
Post (FPTP) voting in time for the next local government elections in October 2009.

The Local Government (Elections) Bill 2009 was intended to progress the necessary
legislative changes, and whilst the Bill has been introduced into the Parliament,
whether it will be passed in time for the election is unclear at this time.

WALGA has been approached by some local governments to ascertain whether it was
taking a position in relation to this matter and in particular whether it was planning on
taking a lead with regard lobbying for the amendment to proceed at the earliest
opportunity or to encourage Elected Members and Councils to approach and/or lobby
their local members.

WALGA advised it has been in daily contact with the Department of Local Government
regarding the FPTP legislative amendment, but as of 16 July 2009 no formal position
had been made.

It’s fairly certain that lobbying will not have any effect; the question being examined is
whether the amendment, even if given clear passage through Parliament once the
spring session commences, can take effect in time for the election.

Elected Members will be informed of any further updates as they become known.

The table below shows the number and value of outstanding Library debts that were

The use of debt collectors to pursue outstanding Library loans continues to realise a
financial benefit to the Town, as well as an improvement in customer service to Library
members with more stock available for selection on the shelves and improved
efficiency in satisfying customer requests.

2.4     Investment, Reserves and Rates Debtors Report – 31 July 2009

Investment Summary:
Total investments at 31 July 2009 were $9,816,543 which is made up of $5,828,529 in
Reserve Investments (59% of funds invested) and $3,988,014 of Municipal Funds (41%
of funds invested). This compares to total investments at 30 June 2009 of $9,809,896.
Municipal Funds and Reserve Funds have increased due to the investment of Rates
Income and interest on the funds. The split of investment is 100% in Term Deposits and
0% in Commercial Bills.

Investment Spread:
The greatest proportion of investments is with National Australia Bank (16.54%). The
investment spread is in accordance with the Investment Policy.

Reserves:
As at 31 July 2009 there was $1,400,777 budgeted to be transferred from reserves that
did not occur due to funds not being expended. These items are itemised below:

Rates Debtors:
From the Rates Debtors Report as at 31 July 2009 the total rates debtors were
$19,974,770 (88% of collectable rates). This compares to total rates debtors at 31 July
2009 of $18,830,787 (90% of collectable rates). The total rates collected for the year
are $2,634,271 compared to $1,993,574 at the same time last year. Total new rates
charges for the month totalled $22,360,398 while $2,634,271 was collected for the
month.

DETAILS:

Council has received an application dated 26 March 2009 for alterations and additions
to the abovementioned property.

The alterations and additions comprise of the following:

     •   Construction of a double carport to the front of the dwelling;
     •   Removal of existing enclosed verandah from rear elevation and construction of a
         single storey rear extension;
     •   Construction of a timber deck beyond the proposed rear extension;
     •   Replacement of sliding doors on existing side elevation with a high level window;
     •   Repair of existing verandah and front windows of dwelling; and
     •   Installation of lattice below floor joists for vermin control.

The existing dwelling has a pitched roof at approximately 28 degrees, with an open
front verandah and rear enclosed verandah at approximately 20 degrees. The proposal
seeks a variation to Council’s Local Planning Policy - Streetscape with regard to the
requirement of additions to match the existing dwelling which includes roof pitch. The
proposed rear extension will have a pitched of approximately 5 degrees, significantly
less than the main roof and verandah roofs on the existing dwelling.

In addition to the above it should be noted that the proposed carport eaves will be sited
within 375mm from the north western boundary, in lieu of 450mm as per the Residential
Design Codes, that the carport wall height will exceed an average height of 3.1 metres
in lieu of 3 metres as per the Residential Design Codes, and that the kitchen window on
the proposed rear elevation will lie within 3.5 metres of the north eastern boundary and
over 500mm above natural ground level in lieu of 6 metres as per the Residential
Design Codes. The impact of these non-compliances have been assessed by Officers
and it is not considered that they will have a significant impact upon the amenities of
adjoining neighbours having regard to the presence of a driveway and carport structure
immediately adjacent to the common boundary and having regard to the fact that the
proposed kitchen window on the rear elevation will not have a significantly greater
impact than existing windows on the rear elevation.

In response to the above non-compliances, and in accordance with Council Policy
GEN3 ‘Community Consultation’, the proposal was the subject of community
consultation for a period of 14 days with letters being sent to owners and occupiers of
affected properties. During the consultation period no submissions were received.

As justification for the proposed development, the applicant has submitted a letter
stating the following:

“Following on from our most recent telephone discussion dated 25th June I will
endeavour to outline the sequence of events and the reasoning behind the logic
associated with the second draft of plans currently lodged with your office.

OBJECTIVE
To acquire an inner-city parcel of land that had subdivision potential, with an existing
dwelling suitable for rental, within budget.

PRE-PURCHASE
Prior to the initial purchase of 72 Carnarvon on April 17, 2008 the Office for the Town of
Victoria Park was contacted in an attempt to ascertain the options available for the
property, from this series of dialogue two options emerged. A) Apply for demolition,
sub-divide and then build, or. B) Renovate and sub-divide. It soon became apparent
that the then Town Planning Officer was in favour of renovating the existing structure in
keeping with the Weather Board Precinct Guidelines. Having promoted this option the
Town Planner was also in acknowledgement of the current status of the dwelling and
mindful of the possible outcome for a demolition order. At this point a financial
schedule was compiled for renovation.

72 Carnarvon Street prior to purchase had been uninhabited for a number of years
during which time extensive white ant damage had occurred, as time would reveal, to
such an extent the structural integrity of the building had been compromised, the

dwelling had in essence been abandoned. Further to this, it is our understanding the
Town of Victoria Park was in receipt of complaints from surrounding property owners
relating to the derelict condition of the property. Testament to the above can be found in
the months it stayed on the market `For Sale` in what was then a buoyant property
market.

To conclude the pre-purchase discussions with the Planning Officer for the Town of
Victoria Park, incorporating clearly our intentions to renovate and extend, it was
indicated, without prejudice, that the undertaking would be considered with merit as it
was in keeping with planning intent.

PROPERTY SETTLEMENT
On completion of settlement the first priority was to address the white ant problem. To
do so required the removal of plaster board sheeting from the walls and ceiling which
unfortunately revealed even more damage than we originally assessed. We were able
to determine that the primary access for the white ants was the concrete verandah that
had encased the stumps at the front of the house. To rectify the problem the front
roofing had to be supported and the concrete porch demolished and removed which
was a considerable undertaking in itself. On completion of that task, re-stumping was
required as the stumps too had perished due to white ants. The front room on the
southern side, including the weather boards, had all been eaten to a shell. At this point
replacement options were considered, it was then that a pair of French doors were
seen as an enhancement, as with the three pain window in the adjoining front room. As
it was, the existing windows were not of the period of the house and had been modified
to fit post original construction; this is also the case for the aluminium sliding door in the
centre room and the third utility room.

Meanwhile, at the rear of the house white ant damage and wood rot had claimed most
of the wooden structure that enclosed the original washroom and ablution area which
had at some stage been converted to the kitchen. This area was gutted in an attempt
to halt the white ant invasion.

REBUILDING
So, having arrested and quarantined the damage we are now faced with the job of
rebuilding. To date we have engaged the services of a surveyor, registered builder,
draftsman, carpenter, plumber, tree lopper, and bobcat operator.

From the most recent official communication dated 25th June, and our phone
conversations, it would appear that the point of contention is the proposed extension of
1 meter to the proposed living area at the rear of the building. Our second submission
to the renovation plan incorporates that the extension only affect a two thirds portion of
the width at the rear as opposed to the initial full width which incorporated the kitchen
side of the building.

CONCLUSION
In all our activities thus far, over 14 months since purchase, we have endeavoured to
work with council direction. We have acted mindful of the Council’s streetscape
guidelines at all times and believe we have continued to do so to this point. We propose
to renew a derelict and uninhabitable dwelling and believe our application to be a
workable compromise for all parties. Whilst we are grateful for the Council’s

concessions, the request to alter the roof pitch will make this project, which is already
under financial hardship, quite simply, not feasible. Whilst not requesting that the
Council re-write policy guidelines, we respectfully suggest that when viewing a project
of this nature, whereby an area eyesore is being renewed and enhanced, more
pragmatic and practical concessions are granted to assist the third party enhance the
essence of Town of Victoria Park.

Beyond this letter and our current application we will be left with few other options than
to perhaps seek advice directly from a broader spectrum of authorities on this matter.”

Legal Compliance:

Non- compliance with Town of Victoria Park Local Planning Policy – Streetscape

A3.2 Weatherboard Precincts and Weatherboard Streetscapes

“i) Development within the Streetscape Zone of a Weatherboard Precinct or
Streetscape shall be consistent with the street and side setback, building heights and
roof shapes and pitches general to the weatherboard houses within that Precinct or
Streetscape and shall incorporate the following design guidelines:

a)       Form, Mass and Proportion

Roof shapes, heights, pitches and material matching with housing predominating in the
street, with a minimum roof pitch of 30 degrees in any instance or where the roof pitch
of the proposed additions reflect the roof pitch of the existing dwelling. A skillion roof as
an extension of an original roof form is acceptable.”

The performance criteria relating to the above clause reads:

“P3 Design of new development in the Residential Character Study Area,
Weatherboard Precincts, Weatherboard Streetscapes to be consistent with the
following criteria:

     •   Retains and restores as many weatherboard houses as possible, to conserve
         the stock.
     •   Ensures that modifications to existing weatherboard houses are designed in
         sympathy with them, to enhance the streetscape…”

COMMENT:

The property in question lies within a Weatherboard Precinct, as defined by the Town of
Victoria Park Local Planning Policy – Streetscape. Council’s planning policies relating
to Weatherboard Precincts require additions to ‘Original Dwellings’ to be sympathetic in
form to the original dwelling, and to have pitched roofs to match the main roof.

The proposed rear extension will have a pitch lower than that of the existing skillion roof
which it is proposed to replace. The pitch of the roof will bear no resemblance to the
existing dwelling, and is not considered to represent an addition of the high quality
which is normally expected within the Weatherboard Precincts.

In the determination of other similar applications, Council has consistently required rear
extensions to be incorporated into the main roof of the dwelling with a pitch to match.
Whilst this is a more costly approach, it has enabled the quality of weatherboard
houses within the Town to be maintained.

A verandah roof, similar to that which the proposed extension will replace, is normally
considered to represent a skillion roof, i.e. an extension of the original roof form. The
proposed rear extension does not represent a skillion roof and it is considered that it
will detract from the existing character and appearance of the existing dwelling.
Approval of an extension of this form will set an undesirable precedent within the
Weatherboard Precinct, the cumulative effect of which will reduce the quality of the
existing traditional housing stock.

Whilst the applicant’s comments are noted in relation to cost, this is not considered to
be relevant to the determination of this application.

In view of the above, it is recommended that the application be approved subject to
conditions, including a condition which requires the rear addition to have a pitched roof
of a form to match the existing dwelling.

RESPONSIBLE OFFICER RECOMMENDATION:

In accordance with the provisions of the Town of Victoria Park Town Planning
Scheme No. 1 and the Metropolitan Region Scheme, the application submitted by
J. Harrington on behalf of M. L. Harrington and J. J. Harrington (DA Ref: 09/0171)
for Additions and Alterations to Single House at No. 72 (Lot 375) Carnarvon
Street, East Victoria Park, as indicated on the plans dated 3 May 2009 be
Approved subject to:

1.     The roof form and pitch of the rear extension hereby approved is to match
       the main roof of the existing dwelling and is to be integrated into the
       existing roof of the dwelling. Revised elevations of the amended roof form
       shall be submitted to and approved in writing by the Manager Planning
       Services prior to the submission of a Building Licence.

2.     Details of the profile and colour of the weatherboards shall be submitted to
       and approved in writing by the Manager Planning Services prior to the
       submission of a Building Licence.

3.     Open eaves with exposed rafter ends to be provided to all elevations.

4.     All driveways and car parking bays to be brick paved.

5.     Any letterbox, structure, wall or fence located within a 1.5 metre x 1.5
       metre visual truncation at the intersection of any driveway and the front
       property boundary, is not to exceed a height of 750mm with the exception
       of:
       i) one brick pier (maximum dimensions 350mm by 350mm); and/or
       ii) wrought iron infill fencing.

6.    Existing crossovers that are not used as part of the development or
      redevelopment shall be removed and the verge shall be reinstated to the
      satisfaction of the Director Technical Services.

7.    The carport is not to be enclosed and no rolladoor or similar carport door
      will be permitted on the carport structure in the future.

8.    External colours, finishes and materials to be used in the construction of
      the building are to be in accordance with the colour schedule date
      stamped approved 20 July 2009, attached with the approved plans.

9.    All windows visible from the street to be of a timber frame construction to
      match the original shape and form of windows within the dwelling.

10.   External fixtures, including but not restricted to airconditioning units,
      satellite dishes and non-standard television aerials, but excluding solar
      collectors, are to be located such that they are not visible from the primary
      street, secondary street or right-of-way.

11.   Compliance with Council’s Building, Environmental Health and Technical
      Services requirements.

12.   The owner or occupier is required to display the street number allocated to
      the property in a prominent location clearly visible from the street and/or
      right-of-way that the building faces.

Advice:

1.    With regards to Condition No. 4 the following are minimum requirements

3.3   Final Approval Of Amendment No.44 To Town of Victoria Park
      Town Planning Scheme No.1 (PLA0003/44)


Amendment No. 44 was based on the Causeway Precinct Review Final Report dated
May 2008. Following the advertising period, Council sought final approval of
Amendment No.44 with two minor modifications. The Amendment documentation was
then forwarded to the Western Australian Planning Commission (WAPC) for
consideration.

A letter from the WAPC dated 11 March 2009 advised that the Minister for Planning
upheld the submissions of support and those objecting to the reduction in proposed
building height limits, dismissed the submissions of objection, and decided not to
approve the amendment until such time as Council further modified the amendment to
effectively allow the 18 storey height limit on the six sites identified in the Causeway
Precinct Review Draft Report July 2007.

The Minister also directed the Council to modify the Causeway Precinct Review Final
Report to be consistent with the findings of the original Draft Report. As a consequence
the Causeway Precinct Review Final Report (Modified) March 2009 was prepared.

Amendment No. 44 was modified in accordance with the directions of the Minister for
Planning, and subsequently granted final approval and gazetted on 29 July 2009.

The Amendment included modifications to the version that was advertised for public
comment.  A     summary      of    those     modifications    is    as    follows:

1. provisions to allow an 18 storey height limit on six sites in the Causeway Precinct;
2. provisions to allow some discretion to permit reductions in parking requirements for
   visitor parking for residential uses, where there is reciprocal parking available on
   site with non-residential uses. In addition discretion is provided, where the small
   size of sites or site characteristics makes the separation of parking and/or
   pedestrian separation for residential and commercial activities unviable within
   basement areas; and
3. provisions for Area 8 permitting exclusion of ground floor commercial floor space
   from plot ratio calculations.

An Information Sheet detailing the background and finalisation of this matter is now
posted on the Town Website and anyone that lodged a submission on Amendment
No.44 has been advised in writing accordingly.

4.2   Inauguration of Swan Canning Rivers Local Government Policy
      Forum


Inauguration of Swan Canning Rivers Local Government Policy Forum

A recommendation will be placed to the upcoming WALGA State Council meeting, that
a local government policy forum on issues related to the management of the Swan and
Canning Rivers be endorsed. This forum is seen as an important mechanism by which
member Local Governments can identify, consider and respond to commonly shared
issues involving planning for and maintenance of river edge land.

A diverse range of issues including land use planning, infrastructure and environmental
services for the Swan and Canning Rivers will be covered. Executive support for the
forum will be provided by WALGA Environment and Waste.

An elected member taskforce has set out Terms of Reference, and an inception
meeting will be held on Thursday 6 August 2009. Elected Members from our area
having input to the Terms were Mayor Best of the City of South Perth and the EMRC.
