STORAGE CONTRACT-2011-2012







1. Insurance: The boat owner agrees to provide a current Certificate of Insurance to Davis & Tripp, Inc. that states:

the boat is fully insured with complete marine insurance, including adequate hull coverage and property and

indemnity or liability insurance. The minimum amount of P&I is $300,000.00. Fuel Spill liability minimum is

$800,000.00. Davis and Tripp, Inc. does not carry insurance covering the property of the boat owner. Davis and

Tripp, Inc. will not be responsible for any injuries or property damage resulting, caused by, or stemming from the

use of the dock or facilities. The boat owner releases and discharges Davis and Tripp, Inc. from any and all liability

from loss, injury (including death) or damages to person or property sustained in or at the facilities of Davis & Tripp,

Inc., including fire, theft, vandalism, wind, high or low water, hail, rain, ice, snow, accident or any other act of God,

whether or not the boat is parked or hauled by an Agent of Davis & Tripp, Inc.

2. Removal of electronics is the sole responsibility of the boat owner. Davis & Tripp, Inc. is not responsible for any

electronics that are left on the boat.

3. Per NFPA (National Fire Protection Agency) we are no longer able to store batteries in our buildings. All

batteries will be left in the boat unless other arrangements have been made. The NFPA has also ruled that no

portable fuel tanks of any size, (this includes but is not limited to alcohol, butane, propane, gasoline or diesel fuel),

heaters and flammable materials maybe stored on boats while they are in dry dock. Also, if at all possible the NFPA

recommends that the boats fuel tank be stored mostly full, but not totally full. If any portable fuel tanks, such as

mentioned previously, are found onboard, they will be removed and discarded at the customer’s expense.

4. Any and all outside contractors that you wish to engage for your boat must be retained by Davis & Tripp, Inc.

through our Service Department. Outside contractors could consist of, but are not limited to the following types of

businesses: mechanical or fiberglass repair, electronic and canvas contractors, boat brokers and surveyors.

5. Davis and Tripp, Inc. will not be responsible for bailing any boat stored outside.

6. Holding tanks must be emptied prior to hauling for storage.

7. Customers may have access to their boat stored inside during business hours, however due to insurance

restrictions and our policy owners are not allowed to work on their boats.

8. Davis and Tripp, Inc. will perform the work as outlined in the Winter Storage Policy for boats stored inside and

those who have chosen outside storage Plan A. Our Service Department will contact you to go over the work that we

will be performing and to discuss any other work you might want done. We will not be able to guarantee spring work

requested after January 1, 2012.

9. Customers (Plan B and Plan C) who perform some or all of their own work must abide by Davis& Tripp, Inc.

work procedures. Those who do not concur will forfeit their storage spot and possible future dockage.

10. The only boats who will be allowed to remain at the Bridge Street location: boats that are too large to move over

the road and Plan A boats that are requesting a launch prior to May 01, 2012. All boats must be moved from the

Bridge Street location by May 01, 2012. Boats not launched by that date will be moved at the owner’s expense to

our Smith Neck Road storage facility. A summer storage charge will be assessed as of July 1st for all boats that

remain in storage. Please refer to the Rate Sheet for pricing.

11. Boats will not be launched until all outstanding balances have been paid. Our due dates are clearly marked on

each invoice. If your boat launch is canceled for nonpayment and we need to move your boat to reach another, you

will be charged for the move.

12. Davis and Tripp, Inc. is not responsible for antennas, wind indicators, electronics, standing and running rigging

that are left on the boat during the hauling process, the storage period and/or launching process.

13. Due to insurance regulations, Davis and Tripp, Inc. can not permit customers to use our ladders, staging or

other lifting apparatus. Ladders that belong to the customer must be chained to the boat stand. Do not leave

unattended.

14. Customers may not enter the crane area during the hauling or launching process.

15. Davis & Tripp, Inc. is not responsible for items left on the boat.

16. A non-refundable deposit of $500.00 must be included with this contract, or this contract will not be valid.

Canceling your storage contract may affect your opportunity for dockage.

17. Unless we are notified in writing of any discrepancy within 30 days of the statement date, we will assume all

attached invoices to be correct. Owner shall pay upon demand all costs, damages, charges and expenses, including

legal expenses and attorney’s fee incurred by Davis and Tripp, Inc. in collecting any unpaid balances.

18. Delivery date range quoted is given in good faith, but not guaranteed. Please be reminded that sometimes it may

be necessary to perform more work on the boat once it is in the water.

19. The deadline for guaranteed storage is October 15, 2011.

*20. Any requests for changes made to this contract by the boat owner must be done in writing. Requests do not

guarantee acceptance on behalf of Davis & Tripp. Inc.

21. You may be charged for a boat move if you change your launch date and it becomes necessary to move your

boat.

22. Customers whose boats are brought in or leave by an outside contractor will be responsible for that transport

bill. This includes boats that stored in the Davis & Tripp, Inc. lot and are too heavy for us to handle.

23. Davis & Tripp, Inc. reserves the right to enter any boat for reasons of inspection. This does not however,

obligate Davis & Tripp, Inc to inspect each boat.

24. If a boat does not launch in the spring of 2012, there will be a summer storage charge assessed beginning July 1,

2012.
