1 Bid responses for purchase of services (Memoranda of Understanding) do not need to address cash discounts,
product identification, warranties on manufactured items, federal excise tax or Georgia sales/use tax, or titles to equipment
as these items are not applicable to purchase of services bids.
2 Bid responses containing provision for late or interest charges will not be considered for an award. Bidders are instructed to
remove or strike through any reference to this provision in or on vendor printed forms and to initial changes prior to submitting
a bid response to the State of Georgia.
3 All bid responses received will be considered F.O.B. destination. Vendor may, however, charge back freight and insurance.
In such event, Vendor shall state the exact amount of freight and insurance charges for a "shall not exceed" amount.
4 Bidder shall place the following information on the outside, lower left corner of the envelope containing the bid.
Bid Opening Date:
Bid Opening Time:
Invitation of Bid #:
The information can be found on the face of the Invitation to Bid. If you are quoting on more than one bid, a separate envelope must be used
for each bid. Failure to include the above information may delay opening of the bid past the designated time. In such cases,
the bid would not be considered for award.
CONDITIONS OF BID
The offer conveyed by this bid shall remain open for a period of thirty (30) days from the date of opening.
All discounts offered will be taken if earned. In the event that the State is entitled to a cash discount, the period of computation will
commence on the date of delivery, or receipt of a correctly completed invoice indicating the discount, whichever occurs later. If the State is
entitled to a discount under the contract, but the invoice does not reflect the existence of a case discount and the State pays the invoice,
it shall be entitled, upon demand, to credit in the amount of such discount. Payment of invoices owned by the State shall be made whenever
possible within 30 days of the receipt of a correct invoice or goods, whichever is later, unless otherwise provided for in terms and
conditions attached to this Invitation to Bid or in the resulting contract.
Unless otherwise specified, any reference to brand names, trade names, model numbers or other descriptions peculiar to specific brand
products is made to establish a required level of quality and functional capabilities. It is not intended to exclude other products of that level.
Comparable products of other manufacturers will be considered if proof of comparability is contained in the bid. It shall be the responsibility
of the bidder(s), including the bidder whose product is referenced, to indicate the brand name and model or series number of the product
offered and to furnish with their bid such specification, catalog pages, brochures or other data that will provide an adequate basis for
determining the quality and functional capabilities of the product offered. The State reserves the right to request samples of any
bidders prior to bid award. FAILURE TO PROVIDE THIS DATA MAY BE CONSIDERED VALID JUSTIFICATION FOR REJECTION OF BID.
The State reserves the right to:
1 Award bids received on the basis of individual items or groups of items by the User Agency, and reject any or all bids or any
part thereof; and waive any minor irregularity in the bid; and accept the bid that is in the best interest of the State.
2 Request a performance bond.
3 Request that bidder furnish proof that he/she is the manufacturer or one of the manufacturer's authorized dealer's or
distributors and is capable of providing warranty services on all items delivered. When a manufacturer's certificate or
evidence of authorized distributorship is required, it shall be dated not older than thirty (30) days to the date of the bid opening.
