I. BY THE COMMISSION:
Statement, Findings and Conclusions
1. On June 9, 2000, Maxine A. Shaw, doing business as
In God's Hand Homecare and Companion Services ("Applicant"),
filed an application for permanent authority to conduct
operations as a common carrier by motor vehicle for hire.
2. The Commission noticed this application to all
interested persons, firms, and corporations pursuant to § 40-6-
108(2), C.R.S., on June 19, 2000.
3. No petition to intervene or otherwise participate
in the proceeding was filed. Being noncontested, the application
was granted without a hearing. Decision No. C00-845. The grant
of the application was conditioned on, inter alia, the filing of
certificates of insurance as required by Commission rules.
4. The granting decision became effective on August
7, 2000. However, by its own terms the decision became void
because the Applicant failed to comply with the decision’s
requirements within 60 days.
5. On November 8, 2000, the Applicant filed its
request asking the Commission to grant an extension of time of at
least 30 days to file the certificates of insurance. We further
construe the request as one to reinstate the docket. As
justification for the request, the Applicant stated that it is
“seeking affordable commercial auto insurance.”
6. Being duly advised, the Commission will grant the
instant request. The Applicant is reminded that future requests
for extension of time may not be granted.
II. ORDER
A. The Commission Orders That:
1. Docket No. 00A-330CP is reinstated.
2. Maxine A. Shaw, doing business as In God's Hand
Homecare and Companion Services, is granted a 60-day extension of
time to comply with the insurance requirements of Decision No.
C00-845. If Maxine A. Shaw, doing business as In God's Hand
Homecare and Companion Services, does not comply with this Order
within 60 days of its effective date, then the authority granted
to Maxine A. Shaw, doing business as In God's Hand Homecare and
Companion Services, in Decision No. C00-845, shall be void.
3. This Order is effective on its Mailed Date.
