                  The implementation of the Water Framework Directive raises a number of

                     Member States face several common challenges when implementing the
                     WFD:

    1          TS 1. an extremely demanding timetable (as we have seen in learning unit 2_3.1)
                  2. the complexity of the text and the diversity of solutions to scientific,
                  technical and practical questions
                  3. the problem of capacity building and an incomplete technical and scientific
                  basis
                  4. a severe limitation of human and financial resources in Member States

                     Member States need clear and harmonised guidance to overcome above
                     challenges. More over, the large number of actors and issues involved in
                     implementing the WFD brings the necessity of defining a clear strategy on
                     how to implement the Directive in a comparable way throughout Europe.

                     The necessity of a common understanding and a common strategy is
                     recognised as a crucial factor to successful and effective implementation of
                     the WFD at the time when the Directive was adopted. There was a broad
                     consensus that the Common Implementation Strategy (CIS) is necessary in
                     order to:

                  1. Develop a common understanding and approaches
                  2. Elaborate informal technical guidance including best practice examples
                  3. Share experiences and resources

                  4. Avoid duplication of efforts
                  5. Limit the risk of bad application


                  Nevertheless, it is important to remember that the individual Member States
                  are fully responsible for the implementation. Therefore, the Common
                  Implementation Strategy can be interpreted as an implementation guidance.

                  The CIS cannot give answers to all questions since Member States will not
                  only face common challenges that are addressed within the CIS, but also
                  specific questions and problems which are specific to their local conditions.

                  Figure 1, on the next page, visualises the overall structure of the CIS in
                  implementing the above first 4 activities. As shown in the diagram, each key
                  activity may be subdivided into one or more specific projects. There is no

                  hierarchy to be placed among the activities. The structure is flexible, and
                  allows inclusion of any further key activities and projects as the process
                  develops.

                  In parallel with the activities under the Common Implementation Strategy, the
                  Commission established multi-stakeholder consultative fora which are the 5th
                  activity of the CIS. The consultative fora are usually called expert advisory
                  group and deal with below issues:

                     - Flood protection

                  Expert advisory groups are meant to develop specific Daughter Directives or
                  Community Law which is intended to complement and specify the WFD on
                  some issues as described above. For example, on 12 December 2006, the
     7         TS European Parliament and the Council adopted the new Groundwater
                  Daughter Directive (2006/118/EC). In July 2006, the Commission adopted a
                  proposal for a Daughter Directive on environmental quality standards for the
                  priority substances which is currently undergoing the co-decision procedure.
                  Another parallel activity is DG Environment’s attempt to pursue a further
                  integration of WFD into other Community Policies. Suitable policy areas for
                  integration are identified in the Strategic Document (2001) as;
                  - Regional Policy
                  - Cohesion Policy
                  - Agricultural Policy
                  - Fisheries Policy

                    III. Organisational structure

                  The common implementation process does not seek to establish another
                  formal decision making forum but it seeks to keep it as a forum for informal
                  co-operation. The organisational structure of the Common Implementation
     1         TS Strategy is reviewed and adjusted every couple of years . Different types of

                   The first three priorities
                   1. Information sharing,
                   2. Develop guidance on technical issues,
                   3. Information and data management
                    have a more horizontal character. They are the key activities for developing
                   a common understanding of the implementation of the Water Framework
      4         QE Directive. All these horizontal activities need to be integrated and made
                   operational in the River Basin Management Plans. Therefore, the necessary
                   link between the issues treated under horizontal priorities needs to be
                   established from the beginning.
                   Activity 4 has a more vertical character and includes the key activities
                   intended for the practical integration of the outcome of the horizontal priorities

                  Within the frame of the common strategy, the focus is therefore on
                  methodological questions related to a common understanding of the
                  technical and scientific implications of the WFD. It aims to clarify and
                  develop supporting technical and scientific information to assist the practical

                  Water Directors should function as an initiator and driver of the process. The
                  joint group of Water Directors plays a key role in implementation process,
                  steering the process and consolidating the results of the working groups. It is
                  important to remember that it has no formal competence. The Chair of
     2         QE
                  meetings of Water Directors is the presidency and the Commission is the co-
                  chair.
                  The Water Directors are the representatives of the Member States and other
                  countries administrators with overall responsibility on water policy.

                  The Strategic Co-ordination Group coordinates the work of the different
                  working groups and activities under the CIS. The group also evaluates the
                  outcome of the different working groups. Another task is to prepare
                  documents and reports for the Water Directors’ meetings and give guidance
     3         QE to the key activities. More over, the group is charged to further develop the
                  Strategic Document. The Strategic Co-ordination Group is chaired by the
                  Commission and formed by participants of all Member States. Candidate
                  countries participate as observers and other stakeholders can be invited as
                  observers or be consulted. The Chairmen from working groups will participate
                  in meetings of the Strategic Co-ordination Group.
                  Working Groups are chaired by a lead country or Commission. Working
                  Groups consist of interested representatives from Member States, Candidate
                  Countries, stakeholders and NGOs. Participants from NGOs stakeholders

                  must be invited to join when they are considered possessing specific
                  expertise. Working Groups are created for different issues and their main
                  work is to develop Guidance Documents.
