The Fairness in Procurement Alliance (FPA) is respectfully requesting for the Army OIG to conduct an
investigation into the alleged Army abusive contracting practices detailed on the attached documentation
and on this link, http://bit.ly/vwW6Zp. Please acknowledge this communication and advise what action
might be expected and by when.

The original FPA communication had been addressed to Ashton Carter on December 4th, 2011 with copies
to various Army and DoD officials, however, the communication was, regrettably, ignored.

For your information, the Office of Advocacy has issued a formal letter to OFPP addressing the allegations

The mission of FPA is to bring fairness to public procurements so that small and disadvantaged businesses (SDB) can receive
"maximum practicable utilization" (MPU) as prescribed by P.L. 95-507 and thus compete and prosper at the federal, state and local
levels. FPA operates a Think Tank and Legal Center whose purpose is to involve university and Law School professors and students
in sustainable projects that bring transparency to public procurement and create jobs. FPA also manages ‘The Umbrella Initiative'
whose goal is "to double the number of small businesses contracting with the government by the year 2020."

Mr. Carter:

Our Dec. 4th requests for an investigation into the Army and the Air Force procurement practices (copies
attached) addressing specific abusive procurement practices were never acknowledged. Please, again,
advise how your Office intends to handle these requests.

The procurement practices in questions were also the subject of a key GAO protest (B-406075) I brought
up when other efforts for solutions were exhausted. A decision is expected at any moment. SBA and a
host of small business organizations submitted ‘amicus briefs’ in support of my case. Additionally, the
Office of Advocacy has just released a formal letter to OFPP in support of our allegations as well. You can

The GAO decision will most likely lead to Billions in contracts for small businesses. (refer to the attached
Set-Aside Alert lead article.) The Florida Hispanic Chamber addressed the subject on a major

likely, be asked to go on record explaining the steps both the Army and the Air Force intend to take to
eliminate the endemic practices described on the Petitions.

The Fairness in Procurement Alliance (FPA) coalition is respectfully requesting the U.S.
Army and the U.S. Air Force to address the allegations of contracting abuse raised on
the attached Petitions which have been sent to Members of Congress, government
officials, small business advocates and the media.

Please acknowledge and advice what actions will be taken to improve “the level of
participation by small and disadvantaged businesses” which, frankly, is just as important
if not more than the DoD outreach efforts that are currently being undertaken.
