POSSESSION NOTICE
Whereas,
The Authorised Officer of IFCI Limited under the Securitisation & Reconstruction of Financial
Assets and Enforcement of Security Interest Act 2002 (the Act) and in exercise of powers
conferred under Section 13(12) read with Rule 3 of the Security Interest (Enforcement) Rules,
2002( Rules), issued Demand Notice dated 22.9.2006 under Section 13(2) of the said Act
calling upon the Borrower Company, M/s. Sun Polytron Industries Ltd. at Feltham House,
10, J.N. Heredia Marg, Ballard Estate, Mumbai – 400 001 through its Managing Director to
pay the amount mentioned in the said Notice being Rs.96,64,34,747/- (Rupees Ninety Six
Crore Sixty Four Lakh Thirty Four Thousand Seven Hundred Forty Seven only) as on
30.6.2006 together with further interest thereon, costs, charges and other monies until
payment or realization, within 60 days from the date of the said notice.
The Borrower Company mentioned hereinabove having failed to pay the amount, notice is
hereby given to the Borrower Company mentioned hereinabove in particular and to the public
in general that the Hon’ble Mamlatdar, Dadra & Nagar Haveli, Silvassa took on 29.7.2009
actual & physical possession of the properties described hereinbelow in exercise of powers
conferred on him by Order No. ADM/ RD/ RECOVERY/43/2008/3829 dated 7.7.2009 of the
Hon’ble District Magistrate, Silvassa issued under Section 14 of the Act and handed over
the same to the undersigned in her capacity as the Authorised Officer of IFCI Ltd. on the
same day i.e. 29.7.2009. Accordingly, the undersigned has taken possession of the said
properties in exercise of powers conferred on her under Section 13 (4) of the said Act
read with the Rule 8 of the said Rules on 29.7.2009.
The Borrower Company mentioned hereinabove in particular and the public in general is
hereby cautioned not to deal with the subject properties and any dealings with the said
properties will be subject to the charge of IFCI Ltd. for an amount of Rs.96,64,34,747/-
(Rupees Ninety Six Crore Sixty Four Lakh Thirty Four Thousand Seven Hundred Forty
Seven only) as on 30.6.2006 together with further interest thereon, costs, charges and other
monies.
DESCRIPTION OF THE PROPERTIES
All that piece and parcel of non-agricultural land Bearing Survey Nos. 13/2 and 18/P admg. in
the aggregate 1 Hectare 92 Ares situate at village Kharadpada in the Union Territory of Dadra
and Nagar Haveli and bounded as under
On or towards the North by : Survey No.10
On or towards the South by : Public Road
On or towards the East by : Survey No.14 / 5
On or towards the West by : Survey Nos.14/3 & 14/6, 13/1 & 16
together with all buildings & structures constructed thereon.
