Mr. Yurkie explained how the public hearing will be conducted, with the petitioner
making comments, the public hearing being opened and anyone in the audience interested
will be given an opportunity to state their name and address and any comments they wish
to make, the public hearing will be closed, and the Planning Commission will have an
opportunity to discuss the matter and ask any questions they wish before they make their
decision.
Benny Sorrentino, 35520 Forton Court, Clinton Township, Michigan 48035, explained
that they would like to develop a strip shopping center and are seeking a rezoning of the
property to allow this use.
Motion by Mr. Pearl, supported by Mr. Truax, to open the public hearing. Roll Call
Vote: Aye – Pearl, Truax, Gibson, Matway, Moseley, Weiss, Yurkie, Trombley. Nay –
None. Absent – Tomlinson. Motion carried.
There were no comments from the audience.
Motion by Mr. Pearl, supported by Mr. Truax, to close the public hearing. Roll Call
Vote: Aye – Pearl, Truax, Gibson, Matway, Moseley, Weiss, Yurkie, Trombley. Nay –
None. Absent – Tomlinson. Motion carried.
Mr. Santia replied to inquiry that a B-3 zoning district allows uses including general
retail, automotive sales, offices, banquet facilities, and allows the broadest use of
commercial developments.
Mr. Gibson felt that a B-3 use would be less intense than an I-1 Light Industrial use.
Ms. Weiss commented that there is currently an abundance of vacant property zoned I-1
Light Industrial so she felt that a commercial parcel that is developed will be better for
the Township’s tax base than a vacant industrial parcel.
Mr. Yurkie felt that the rezoning and subsequent development of a commercial strip
center will be a boost to the area.
Motion by Mr. Yurkie, supported by Mr. Pearl, with reference to File #6068 and
application from Melvin and Beatrice Rasch, 23141 Petersburg, Eastpointe, Michigan, as
represented by Peter Beer and Benny Sorrentino, 18700 West Ten Mile Road, 2nd Floor,
Southfield, Michigan 48075, concerning the proposed rezoning of Lot 13, Supervisor’s
Plat #2 Subdivision (Section 35), generally located at the northwest corner of 14 Mile
Road and Harper Avenue, from I-1 Light Industrial to B-3 General Business, that
recommendation be submitted to the Clinton Township Board for approval of the

Pertinent correspondence was read and entered into the record. Ms. Trombley advised
that notice of this public hearing was issued by regular mail to 43 owners and/or
occupants of property located within 300 feet of the land in question, with none returned
as undeliverable.
Mr. Yurkie explained how the public hearing will be conducted, with the petitioner
making comments, the public hearing being opened and anyone in the audience interested
will be given an opportunity to state their name and address and any comments they wish
to make, the public hearing will be closed, and the Planning Commission will have an
opportunity to discuss the matter and ask any questions they wish before they make their
decision.
John Mill, Vice-President of Operations for Mt. Clemens General Hospital, explained
that ITT is interested in leasing space in their building at the subject location to hold
evening classes; however, in order to allow this, they need a B-3 zoning. He added that
the remaining four floors will continue to be used for office.
Motion by Mr. Truax, supported by Mr. Pearl, to open the public hearing. Roll Call
Vote: Aye – Truax, Pearl, Gibson, Matway, Moseley, Weiss, Yurkie, Trombley. Nay –
None. Absent – Tomlinson. Motion carried.
Sherry Jackson, 22769 Shiell, Clinton Township, Michigan 48035, explained that
she lives on the corner of Shiell and Gratiot, and she is opposed to the rezoning
because she felt that any retail use would be allowed if the property is rezoned to
B-3 General Business.
Mr. Santia noted that there is an existing multi-story office building on the site and he
anticipated that it will be there for a long time. He added that while there could be room
for additional development on the site, he did not feel the hospital will develop a gas
station or other business use in front of their attractive office building. He assured that,
based upon his conversations with the hospital staff and their realtor, the only reason for
the rezoning request is that they want to lease to a school-for-profit, which requires a B-3

zoning. He admitted that Ms. Jackson was right in that if the property is rezoned to B-3
and the petitioner wishes to tear down the existing building, the site could be redeveloped
with a commercial use.
Ms. Jackson reiterated her opposition to the rezoning for that reason. She
expressed her concern that if the property is rezoned, any type of retail use would
be permitted on the property. She stated she is opposed to anything other than
office zoning.
Motion by Mr. Pearl, supported by Mr. Matway, to close the public hearing. Roll Call
Vote: Aye – Pearl, Matway, Gibson, Moseley, Truax, Weiss, Yurkie, Trombley. Nay –
None. Absent – Tomlinson. Motion carried.
Mr. Matway inquired as to whether there is a way to restrict the zoning for this site while
still allowing the school to lease space in the building.
Mr. Santia replied that there are a number of options available in this instance: 1) The
Ordinance Update Committee could look at amending the text of the ordinance to allow
schools-for-profit to be allowed in the OS Office/Service Districts; 2) The rezoning to B-
3 could be limited to the building only, while the remainder of the site would either retain
the current OS-1 Office/Service zoning designation or could be rezoned to P Parking; or
3) The rezoning request could be denied, and the petitioner could look into a “contract
zoning” to allow this particular use. Mr. Santia felt the most reasonable option would be
to modify the zoning ordinance to allow schools-for-profit in the OS Office/Service
Districts.
Mr. Truax did not have an objection to a B-3 zoning because he indicated that both sides
of Gratiot are currently zoned B-3 with the exception of the subject parcel.
Mr. Santia noted that the subject parcel extends much deeper into the abutting residential
area than the other commercial parcels along Gratiot, with a number of residential rear lot
lines abutting this parcel.
Mr. Pearl inquired as to whether the petitioner would be willing to limit the rezoning to
the existing building only, with the remainder of the property to remain zoned OS-1
Office/Service (Low-Rise).
Mr. Mill assured that would be acceptable to them.
Ms. Weiss felt that while rezoning the building only to B-3 would generate a “quick-fix”
for this particular site, she felt the Ordinance Update Committee should look further into
a possible text amendment to allow schools-for-profit to be allowed in the OS Districts.
Mr. Mill explained that they would like to have approval for this rezoning by the end of
the year so they can move forward with their plans. He replied to inquiry that if it would

be quicker to rezone the building only as opposed to revising the text of the ordinance,
they would prefer to seek the rezoning.
Motion by Mr. Pearl, supported by Mr. Truax, with reference to File #6069 and
application from Joseph Scallon, Mt. Clemens General Hospital, 1000 Harrington, Mt.
Clemens, Michigan 48043, as represented by Jennifer Kufta and Laney Cavazos, NAI
Farbman, 28400 Northwestern Highway, 4th Floor, Southfield, Michigan 48034, for
rezoning of part of Lots 21 through 26, all of Lots 27 and 28, and part of Lots 29 through
31, Ingleside Farms Subdivision, and part of Lot 291 and all of Lot 292, Ingleside Farms
Subdivision #2 (Private Claim 138, Sections 22/23/26/27), all as being 6.037 acres of
land located at the southeast corner of Metropolitan Parkway and Gratiot Avenue (M-3)
from OS-1 Office/Service (Low-Rise) to B-3 General Business, that recommendation be
submitted to the Township Board for rezoning of the existing building only to B-3, with
the remainder of the parcel to remain zoned as OS-1. Roll Call Vote: Aye – Pearl,

Ron Schurman, Smith & Schurman Associates, 43252 Woodward Avenue, Suite 208,
Bloomfield Hills, Michigan 48302, explained that they are requesting a waiver of the
wall along the easterly and northerly property lines. He acknowledged that although
there is an abutting residence, the plans for that property are for another use other than
residential.
Ms. Trombley read a letter from Caesar Building Company, indicating their support of
the request for wall waiver.

Mr. Schurman explained that the easterly property line is 165 feet away from their
parking lot and there is a heavily treed area so they did not feel the wall would do
anything in terms of shielding headlights from shining on the neighboring property. He
did not feel the wall to the north would serve any worthwhile purpose.
Mr. Santia explained that the wall to the north would shield any garage doors and
loading/unloading area for the hearses. He replied to inquiry that wall waivers are
granted by the Township Board, and the Planning Commission is a recommending body.
Gregory Schultz, 21705 Gratiot Avenue, Eastpointe, Michigan 48021, stressed that they
have a four-car garage design so their hearses would load and unload inside the building,
with no visibility of this from the outside of the building.
Mr. Schurman indicated that the property owners to the north and east have submitted
their letters of support for the proposed wall waiver. He stressed that the garage is very
deep to accommodate the loading and unloading.
Motion by Ms. Trombley, supported by Mr. Truax, with reference to File #0406 and

Chris Holsbeke, 325 North Avenue, Mt. Clemens, Michigan 48043, owner of the subject
parcel, explained that the building is designed for cold storage. He stressed that they do
not need any variances at this time because the plan meets all ordinance requirements.
He replied to inquiry that this site is to the north of the residential house, which was being
used as a construction office.
Ms. Weiss inquired as to whether there are any plans to pave Hengesbach.
Mr. Santia replied that it is a local road and if the owners want it paved, they would have
to request a Special Assessment District.
Mr. Holsbeke informed that they have tried to purchase additional property, but they have
been unsuccessful up to this point. He indicated that two firms control approximately
50% of the road, and they are not in favor of a Special Assessment District at this time.
He is hopeful that they will be able to establish a Special Assessment District in the
future.

Chris Sorrentino, 35520 Forton Court, Clinton Township, Michigan 48035, offered to
answer any questions.
Patrick Findlan, LehnerFindlan Architects, 17001 Nineteen Mile Road, Clinton
Township, Michigan 48038, stated they satisfied most of the requirements of the Zoning
Ordinance, and made some adjustments to address two of the comments received from
the reviewing agents. He noted that they made some modifications to the berm.
Mr. Sorrentino replied to inquiry that he does not own Dirty Harry’s, which is now
known as “Fast Track”. He stated he is now building this car wash for the owner of Fast
Track, and that this will be a “quarter” car wash, whereas the existing car wash is full-
service. He replied to inquiry that the common drive is so that patrons visiting
McDonald’s Restaurant can access their site directly without having to travel on 15 Mile
Road, thereby relieving some of the traffic on 15 Mile Road.
Mr. Gibson felt the cross-access easements are good and that they reduce the number of
accidents.
Mr. Sorrentino replied to inquiry that they are erecting the required masonry wall.
Mr. Santia replied to inquiry that residents were not notified of this site plan because the
property is zoned properly for the use, the petitioners are not requesting any variances
and they are not seeking a waiver of the required wall.
Mr. Yurkie recalled that the last time a plan for a car wash was submitted to the Planning
Commission, there were approximately 100 concerned residents in attendance.
Mr. Santia explained that was because the petitioner was seeking permission to put the
car wash in a B-2 district, whereas this is a B-3 district and Special Land Use approval is
not required.
Ms. Weiss expressed her hope that the petitioners will be courteous when placing the
vacuums on the site so they do not bother the abutting residents.

Mr. Findlan felt the development is quite far from any residential homes, so he did not
feel it will be a problem.
Ms. Weiss agreed that the development is a considerable distance away from any
residential development.
Motion by Mr. Truax, supported by Ms. Trombley, with reference to File #6075 and
application from Christopher Sorrentino, Clinton Excavating, Inc., 35520 Forton Court,
Clinton Township, Michigan 48035, as represented by Patrick D. Findlan, A.I.A.,
LehnerFindlan Architects LLC, 17001 Nineteen Mile Road, Suite 3, Clinton Township,
Michigan 48038, concerning the proposed site development for Sorrentino’s Self-Service
Car Wash, to be located on 0.96 acre of land fronting the west line of Utica Road, north
of 15 Mile Road (Section 30), that recommendation be submitted to the Clinton
Township Board for approval of the site development plan as submitted, subject to the
following conditions, as specified in the letter to the Planning Commission dated October
3, 2005: 1) The Department of Public Works is allowing the proposed development to
share a dumpster with the site adjacent to the west (Dirty Harry’s); 2) The front yard
setback from Utica Road will be landscaped but the required 30-inch-high berm will not
be continuous so as to allow the existing water main easement, fire hydrant, storm sewer
man hold and a tiny segment of the Crooked Brook Drain to remain in place; and 3) The
“parking lot connection” from the subject site to Dirty Harry’s is not shown on the Dirty
Harry’s site plan, so that site plan needs to be revised to reflect that connection. Roll Call
Vote: Aye – Truax, Trombley, Gibson, Matway, Moseley, Pearl, Weiss, Yurkie. Nay –
None. Absent – Tomlinson. Motion carried.
REPORT OF MEETING

DISCUSSION ON NEXT MEETING AGENDA
Mr. Santia indicated the following items are anticipated to be on the next Planning
Commission agenda:
Proposed rezoning of property at the northeast corner of 18 Mile Road and
Garfield from B-2 to B-3. Mr. Santia indicated that the petitioner is seeking a
rezoning so he can provide U-Haul rentals at his existing gas station.
Proposed rezoning of property located on the south side of Clinton River Road,
west of Garfield Road from R-3 and FW to RML.
Site Development Plan for a duplex on Ramsgate.
Proposed Text Amendment to delete the language allowing crematoriums in the I-
1 Light Industrial District.

Ms. Weiss advised that the Landscape Committee met regarding the requested waiver of
the wall for Sunnyview Estates, and the neighbors wanted vinyl fencing rather than a
masonry wall.
