According to term 13. stand 1. point 1. of the Statute of Foundation „Archaeological Park: Bosnian
Pyramid of the Sun“ at the meeting held on May 27th 2010. Board of directors of Foundation
establishes:
VOLUNTEERING REGULATIONS
1. GENERAL REGULATIONS
Term 1.
Volunteering is a voluntary investment of personal time, effort, knowledge and skills with which are
performed services and activities for other person's well being or general welfare.
Volunteering in Foundation „Archaeological park: Bosnian Pyramid of the Sun“ is in a compliance
with the Statute and other acts of Foundation.
Term 2.
A volunteer can be any person who shows interest for volunteering in the Foundation
„Archaeological park: Bosnian Pyramid of the Sun“, and is familiar and supportive of vision, goals,
activities, plans and purpose of Foundation's function, according to Statute and without payment of
pecuniary award or claim of other property gain for accomplished volunteering.
Term 3.
Volunteering is not: voluntary that is not accomplishing services and activities that are contrary with
the Constitution of Bosnia and Hezegovina, other regulation of Bosnia and Herzegovina and taken
international law obligations, performing services or activities for which exists term of payment or
claim of other property gain that are performed without establishing employment arranged by
Labour law, performing tasks that considering the work profile and employer's authorities have
criterion of labour for which is established emloyment according to Labour law, expert training
without establishing employment (volunteering) arranged by Labour law or other regulations,
performing services and activities that one contracting party is obligated to provide to the other
contracting party according to law or other regulations, performing specific obligations according to
court's decisions and verdicts, performing activities that are common in family, friends, neighbor
relations..
Term 4.
Volunteering is organized by volunteering organizer, that is according to this General regulations the
Foundation „Archaeological Park: Bosnian Pyramid of the Sun“.
2. GENERAL PRINCIPLES OF VOLUNTEERING
Term 5.
Foundation „Archaeological Park: Bosnian Pyramid of the Sun“ is due to proceed toward volunteers
according to the principle of equal possibilities for everyone regardless of: age, race, skin color,
language, religion, sex, sexual orientation, gender and gender expression, political or other belief,
national or social origin, assets, education, social status, marital status, family obligations,
membership in a political party, association or syndicate, physical or mental difficulties or aliments
and other personal characteristics.
Term 6.
Foundation „Archaeological Park: Bosnian Pyramid of the Sun“ is due to dedicate special attention to
selection and education of volunteers who are volunteering in a field of scientific research area, and
volunteering is forbidden to: person who is on psychiatric treatment or compulsory treatment of
addiction or a ban on performing profession, activity or duty that is related to the activities of
volunteering persons convicted of a crime against life and body against sexual freedom, against
marriage, family and youth and those who had been sentenced to a misdemeanor legal sanctions
prescribed by the Law on Protection against Family Violence.
Term 7.
It is forbidden to volunteer to replace work done by workers employed under the Labour Act as well
as volunteering to replace the jobs they perform operations on the doers of contract.
It is forbidden to volunteer for a period longer than 40 hours per week over a period of six months
without break of at least six months.
It is forbidden to exploit and abuse the volunteers to obtain or increase profits.
Term 8.
A minor younger than 14 years and older minor may be contracted as volunteer only with the written
consent of legal representatives or agents.
Juvenile volunteers may only volunteer activities appropriate to their age, physical, mental and moral
development and level of skills which do not pose a risk to their health, development and success in
carrying out school obligations.
Volunteering by underage volunteers is performed with the obligatory perception and support by
volunteering organizers, the user volunteering, law representative of underage volunteers and other
adults.
Foundation must pay special attention to protection of the welfare and health of underage
volunteers who may not be exposed to: volunteering outside the borders of Bosnia and Herzegovina
without the consent of legal representatives and unaccompanied by legal representatives or
organizer of voluntary work, long-term volunteering, volunteering associated with severe physical
exertion or risks that threaten or could threaten their life, health, development or performance of
school duties.
Juvenile volunteers have all the rights of volunteers determined by this ordinance.
Term 9.
Persons partially deprived of legal capacity can volunteer in the remaining part of business skills, if
he/she owns or completes the remaining work capacity, with the written consent of the guardian
and responsible welfare center.
Volunteering is banned to person completely deprived of business skills.
Term 10.
Volunteer can not volunteer requiring the fulfillment of any performance (welfare, act, omission or
suffering) or the acquisition of property, monetary rewards or benefits.
A cash reward or material gain for the volunteers do not consider the following cash compensation
for the costs of volunteering: account verified compensation paid to pay for work clothes, equipment
and items necessary for the protection of volunteering, account confirmed compensation paid for
travel costs, accommodation and food incurred in connection with the volunteer, an account
confirmed by compensation paid for nutrition, fees paid to payment of medical services and
vaccinations received for the purpose of performing voluntary work, an account confirmed by
compensation paid to the costs incurred in connection with the execution of voluntary services and
activities, compensation insurance premiums paid in a case of death, body injury or occupational
disease in volunteering or monetary compensation for the purpose of ensuring accountability for
damage caused by the organizers of volunteering or a third person, travel allowance paid to
volunteers, with the condition that the amount of pocket money does not exceed the amount
prescribed for civil servants, funds paid to reimburse the costs of obtaining documents or payment of
fees necessary to enable volunteering, confirmed account compensation paid for other expenses
incurred in connection with the performance of volunteer services and activities.
Term 11.
Volunteering are voluntary and jointly carry out activities or services by freewill volunteers.
Settled activities or services not obtained by freewill of volunteers or as provided in this ordinance
shall not be considered volunteering.
3. CONTRACT ON VOLUNTEERING
Term 12.
By the contract on volunteering volunteer, and the Foundation „Archaeological Park: Bosnian
Pyramid of the Sun“ agree to the mutual rights and obligations and specificity required for a specific
volunteer activities or the provision of individual voluntary service.
The contract on volunteering can be concluded orally or in writing.
Agreement on volunteering in writing is mandatory in cases of:
- volunteering associated with increased risks for life and health of volunteers,
- volunteering of citizens of Bosnia and Herzegovina abroad which is organized by organizers or co-
organizers volunteering with headquarters in Bosnia and Herzegovina,
- long-term volunteering,
- when the volunteer requires it.
At the conclusion of agreements on volunteering in the oral form of the Foundation "Archaeological
Park: Bosnian Pyramid of the Sun“ is required to issue a written confirmation.
Term 13.
Important elements of the contract on volunteering are the information about:
- the contracting parties and their residence or headquarters,
- a place of volunteering and the duration of volunteering,
- volunteering activities or services to be performed,
- the specific rights and obligations of the volunteers,
- training for volunteering,
- personal security during the volunteering period on arrival at the place of volunteering and
voluntary return to the place and during the time for education,
- the costs related to volunteering and their compensation,
- how the contractual rights of volunteers are ensured,
- a termination of the volunteering.
An essential element of the contract on volunteering is the statement with duly certified signature of
volunteers that there are no circumstances that prevent him or her or significantly impede the
performance of activities form the contract on volunteering or endangering life and health of persons
with whom the volunteer is to come into contact.
An essential element of the contract on volunteering is an excerpt from the criminal records of
volunteers or other evidence that there are no circumstances from Term 6. of this Ordinance, and
they will obtained by a volunteering organizer in the line of duty.
Term 15.
Volunteers or their guardians or legal representatives can always unilaterally terminate the contract
and stop volunteering, except when this would cause a direct and immediate harm Foundation.
Term 16.
The Foundation may terminate the contract on volunteering:
- when there is no longer the need for volunteering,
- if it is not in a position to provide conditions for further volunteering,
- if it finds that the volunteer does not meet contractual obligations,
- for violations of additional ethical rules adopted for certain forms of volunteering,
- when there is violation of the constitutional rights of the Foundation which are characterized by the
Statute of the Foundation,
- when the conditions specified in the contract of volunteering are completed.
4. RIGHTS AND OBLIGATIONS OF VOLUNTEERS AND VOLUNTEERING ORGANIZERS
Term 17.
Volunteer has the right to:
- written confirmation of volunteering,
- sign on volunteering in writing, if requested,
- the appropriate training to improve the quality of activities performed and services provided if
required by the nature of volunteer activities and services offered,
- the expertise and support in volunteering,
- to familiarize themselves with the terms of volunteering, activities to be performed, the services to
be provided and the rights which belong to them under this ordinance,
- adequate and safe working conditions in accordance with the nature of volunteer activities done,
- the protective equipment in accordance with the nature of volunteer activities performed and
services provided,
- to become familiar with the dangers related to the specific form of voluntary work carried out,
- on the agreed day rest period,
- the protection of privacy and personal data,
- participate in deciding on issues related to volunteering opportunities in accordance with the
organizers of volunteering and volunteer form.
Justified absence from volunteering can not be a reason for the loss of any rights of volunteers.
Term 18.
Volunteers are required to:
- volunteer in accordance with professional regulations and ethical rules and instructions received
from the foundation,
- to keep official secrets and confidential and personal information of the foundation,
- refuse volunteering that is contrary to regulations,
- carry out the instructions of the foundation, except for instructions regarding volunteering that
are: dangerous to life and health of volunteers or other persons, morally unacceptable to volunteers,
contrary to the contract on volunteering.
- if completing the instructions can cause damage to volunteers,users or third parties, volunteers are
required to to warn the foundation.
Volunteer is not responsible for the damage, if the foundation has been warned previously of a
possible danger.
Term 19.
Foundation "Archaeological Park: Bosnian Pyramid of the Sun" is required to:
- respect the rights of volunteers,
- fulfill commitments to volunteers,
- provide the conditions for the respect of volunteer's rights,
- issue a written confirmation of volunteering to volunteer, with the data prescribed by this
ordinance
- provide materials and resources for performance of volunteer's activities,
- provide volunteers confidentiality of personal data and privacy protection,
- ensure other conditions and respect the rights prescribed by this ordinance.
Term 20.
Certificate of volunteering includes: personal information about volunteers, information about the
time of volunteering, education, a brief description of volunteering activities, and other specifics of a
particular form of volunteering.
Certificate of volunteering includes volunteer's signature, the signature of the person authorized to
represent the volunteering organizers and a stamp of volunteering organizers to ensure the accuracy
of these data and other information required by this Regulation.
Foundation may publish cards, booklets and other documents for evidence of volunteer's status, and
they can be considered a confirmation.
Term 21.
Volunteer who while volunteering intentionally or due to gross negligence causes harm to users of
volunteering, volunteering organizer or third parties is obliged to compensate damage in accordance
with general rules of mandatory law.
Volunteering organizer responds for the damage caused by a volunteer to users or third parties
during the volunteering on the principle of strict liability, unless they can prove that there were
reasons to exclude its liability.
Volunteering organizer who compensated the damage to the users of volunteering, or a third person
is entitled to seek indemnification from volunteer, if it is proved that the volunteer caused the
damage intentionally or through gross negligence.
5. FINAL PROVISIONS
Term 22.
This Law shall enter into force upon its adoption.
