SOS Outreach Release of Liability
LIABILITY AGREEMENT AND RISK RELEASE
Participant: (Please Print)___________________________________________________________ Age: ________ Sex: _______
Mailing Address:__________________________________________City/Town:__________________State:______Zip:_________
Date of Birth: Phone: ( ) Email Address:
The activities of SOS Outreach may involve strenuous physical exercise, exposure to changing weather and terrain elements, and the use of
potentially dangerous equipment. They also demand the total attention and responsibility of each participant, either as an individual or part of
a cooperating group. In addition, these activities include the inherent risk of fatigue, mental stress, injury or death. Your permission,
indicated below, acknowledges these risks.
1. I understand that outdoor recreational activities and sports such as snowboarding, skiing, rock climbing, hiking, camping and
teambuilding are HAZARDOUS ACTIVITIES. I understand that participation in such activities and the use of associated equipment
involves risk of injury to any and all parts of my body. I understand that having an SOS Outreach employee, representative or volunteer
present does not lessen the amount or severity of the risks of these activities. I understand that SOS is not responsible for my safety. It is
further understood that training or competing is more hazardous than recreational participation. Furthermore, I understand that I must
keep deliberate and conscious control of my physical body, both on the ground and in the air, while properly using my equipment in
variable terrain and weather conditions. My participation in this activity is purely voluntary, and I elect to participate in spite of the
risks.
2. I hereby certify that I am physically fit and have no medical conditions or allergies that affect my ability to participate in these activities.
3. I hereby freely and expressly assume and accept the responsibility for any and all risks of injury or death while participating in these
activities or related activities, and I agree to RELEASE, FOREVER DISCHARGE, INDEMNIFY, DEFEND and HOLD HARMLESS
SOS Outreach, its directors, officers, agents, employees, sponsors, and volunteers, the United States Forest Service, the equipment
manufacturers and distributors, all event sponsors and all of the resorts or entities that provide facilities for the conduct of these activities
(hereinafter “releasees”) from any and all losses, damages, costs and attorney’s fees resulting from any and all claims or suits for
personal injury, death and/or property damage that may in any way arise out of my participation in these activities, related activities, or
my use of the releasees’ premises or equipment, regardless of how or by whom or by what the personal injury, death and/or property
damage was caused. As a condition of my, or my child, being entitled to participate in such SOS activities, I hereby promise not to bring
(on my behalf, on behalf of my child or otherwise) any claim against or sue RELEASEES in connection with such activities.
4. I voluntarily agree to release, forever discharge, indemnify, defend, and hold harmless the releasees from any and all claims, suits, costs
and attorney’s fees for damage and personal injury to me, my child or my property resulting from the negligent acts or omissions of the
releasees. I understand that the releasees are not responsible for the consequence of their own negligence, that is, their failure to use
reasonable care in any way.
5. I understand that this agreement shall be binding upon my heirs, executors, administrators, and assigns and shall be governed by the
applicable laws of the State of ________________. I also understand that if any part of this agreement is determined to be
unenforceable, all other parts shall be given full force and effect.
6. I consent to the use by releasees of any pictures (video and print) for commercial purposes, or otherwise, of me in connection with the
activities of SOS.
7. I agree that in the event of a medical emergency, SOS Outreach, its agents, employees and volunteers, may provide emergency medical
assistance deemed necessary under the circumstances. I further agree and authorize SOS Outreach, its agents, employees and volunteers,
to make any and all necessary arrangements for emergency care and I agree that these parties shall be free from any liability to me or my
heirs for personal injury or loss resulting from my transportation to a medical facility.
8. I understand that permission to participate in an SOS program and to use its equipment is being given to the undersigned participant in
exchange for the execution of this Liability Agreement and Risk Release. I have read the above paragraphs and fully understand them. I
understand that this is a RELEASE OF LIABILITY which will legally prevent me or any other person from filing suit or making any
other claims for damages in the event of personal injury, death or property damage. I freely and voluntarily enter into this agreement. I
have made no misrepresentations to releasees regarding my name, age, or medical condition.

THE RISK OF PHYSICAL INJURY AND/OR DEATH.
2. The Undersigned are advised that a person using any of the facilities of the ski area is considered a skier. The Undersigned acknowledge
and understand the dangers and risks of skiing and understand that the Student, as a “skier” under Colorado law, ASSUMES ALL INHERENT
DANGERS AND RISKS as provided by the Colorado Ski Safety Act (“Act”).
3. The Undersigned further understand and agree that in signing this Agreement, the Undersigned are expressly acknowledging and

people; falling objects; encounters with snowmobiles and/or other motor vehicles; becoming lost or separated; lack of shelter; lift loading,
unloading, and riding; storms, lightning, hail, snow and other adverse weather; limited access to and/or delay of medical attention;
Student’s health condition; strenuous activity; fatigue; exhaustion; dehydration; hypothermia; high elevation; altitude sickness; frostbite;
& mental distress from exposure to any of the above.
4. Pursuant to Colorado law, Student assumes the responsibility of maintaining control at all times while engaging in the Activity. Student is
responsible for reading, understanding and complying with all signage, including instructions on use of lifts. Student must have the physical
dexterity and knowledge to safely load, ride and unload the lifts. The Undersigned understand that a minor Student may use the ski lifts
without an adult present. The Undersigned are advised that snowmobiles, snowmaking, and snow-grooming equipment may be encountered
at any time, and the Undersigned recognize that falls and collisions occur and injuries are a common and ordinary occurrence of the Activity.
5. The Undersigned acknowledge and understand that the description of the risks listed above are not complete and that participating in the
Activity, whether or not described, may be dangerous and may also include risks which are inherent and/or which cannot be reasonably
avoided without changing the nature of the Activity.
6. Additionally, in consideration for allowing the Student to participate in the Activity, THE UNDERSIGNED AGREE NOT TO SUE Vail
Resorts, Inc., The Vail Corporation d/b/a Vail Resorts Management Company (“VRMC”), their affiliated companies and subsidiaries, including
but not limited to those that operate the Vail, Beaver Creek, Keystone and Breckenridge resorts, Octagon, Inc. d/b/a NASTAR, World Class V
Simulator, the United States, and all their respective insurance companies, successors in interest, commercial & corporate sponsors, affiliates,
agents, employees, representatives, assignees, officers, directors, and shareholders (each a “Released Party””) for any property damage,
injury or loss to Student, including death, which Student may suffer, arising in whole or in part out of Student’s participation in the Activity.
Further, the UNDERSIGNED AGREE TO HOLD HARMLESS AND RELEASE EACH AND EVERY RELEASED PARTY FROM ANY AND
ALL LIABILITY and/or claims for injury or death to persons or damage to property arising from Student’s participation in the Activity,
including, but not limited to, those claims based on any Released Party’s alleged or actual NEGLIGENCE.
7. The Undersigned represent that Participant is in good health and there are no special problems associated with Participant’s condition.
The Undersigned: 1) authorize a licensed physician and/or other medical care provider to carry out any emergency medical care for
Participant; 2) authorize any Released Party and/or their authorized personnel to call for medical care for the Participant or to transport the
Participant to a medical facility or hospital if, in the opinion of such personnel, medical attention is needed; 3) agree that upon Participant’s
transport to any such medical facility or hospital that the Released Party shall not have any further responsibility for Participant; 4) agree to
pay all costs associated with the medical care and related transportation provided for Participant; and 5) shall indemnify and hold harmless the
Released Parties from any and all liability and/or claims associated with such medical care and/or related transportation.
8. The Undersigned grant VRMC the right of publicity to own and use any image collected of Participant while participating in the Activity.
9. The Undersigned AGREE THAT ANY AND ALL CLAIMS for injury and/or death arising from the Student’s participation in the Activity shall
be GOVERNED BY COLORADO LAW and EXCLUSIVE JURISDICTION of any claim shall be the STATE DISTRICT COURT RESIDING
WHERE THE ALLEGED INCIDENT OCCURRED or in the FEDERAL COURT FOR THE STATE OF COLORADO.
10. In the case of a minor Student, the Undersigned parent or legal guardian acknowledges that he/she is signing this Agreement on his/her
behalf and is also signing on behalf of the minor and that the minor shall be bound by all the terms of this Agreement. By signing this
Agreement, the parent or legal guardian understands that he/she is also waiving certain rights on behalf of the minor that the minor otherwise
may have. The undersigned parent or legal guardian agrees that but for the foregoing, the minor Student would not be permitted to participate
in the Activity. By signing this Agreement without a parent or legal guardian’s signature, Student, under penalty of fraud, represents that
he/she is at least 18 years of age. If signing as the parent or guardian of a minor Student, signing adults represent that they are a legal parent
or guardian of the minor Student.
11. THE UNDERSIGNED AGREES TO INDEMNIFY THE RELEASED PARTIES FOR ALL LIABILITY AND CLAIMS,
INCLUDING ATTORNEYS FEES, ARISING FROM ANY MISREPRESENTATIONS OR FRAUDULENT EXECUTION OF
THIS AGREEMENT.
12. The Undersigned understand and acknowledge that this Agreement is a contract and shall be binding to the fullest extent permitted by
law. If any part of this Agreement is deemed to be unenforceable, the remaining terms shall be an enforceable contract between the parties.
It is the Undersigned’s intent that this Agreement shall be binding upon the assignees, subrogors, distributors, heirs, next of kin, executors and
personal representatives of the Undersigned.

“ADULT” means the undersigned parent or legal guardian, being at least 18 years old, signing on behalf of himself/herself, as well as on behalf of the minor child named
above. “CHILD” means the minor child named above. ADULT and CHILD shall collectively be referred to hereinafter as “RENTER.” RENTER understands and agrees that
skiing, snowboarding and using ski area facilities, including the lifts, for any purpose can be HAZARDOUS AND PRESENTS A RISK OF PHYSICAL INJURY OR DEATH.

RENTER agrees to accept for use the equipment listed on this form “AS IS.” ADULT accepts full responsibility for the care of the equipment during the rental period and
agrees that ADULT will be responsible for the replacement at full value of any equipment rented under this form and not returned, or returned in a damaged condition.
RENTER represents that no misrepresentations have been made to the Children’s Rental Center, or any employee thereof, in regards to the height, weight, age and/or
skiing/snowboarding ability level listed on this form. RENTER further agrees that the person listed on this form will be the only person using the equipment.
RENTER UNDERSTANDS THAT THE BINDING SYSTEM CANNOT GUARANTEE THE USER’S SAFETY. In downhill skiing, the binding system will not release at all HELMET
times or under all circumstances where release may prevent injury or death, nor is it possible to predict every situation in which it will release. RENTER further agrees and
understands that the downhill ski binding system DOES NOT REDUCE THE RISK OF ANY TYPE OF INJURY TO CHILD, INCLUDING BUT NOT LIMITED TO KNEE
INJURIES. RENTER understands that in snowboarding, cross-country skiing, skiboarding, snowshoeing and other sports utilizing equipment with non-releases bindings, the
binding system will not ordinarily release during use; these bindings are not designed to release as a result of forces generated during ordinary operation. RENTER
acknowledges and agrees to assume and accept any and all known and unknown risks of injury to CHILD while using this equipment. Make: Din#:
RENTER acknowledges and understands that a skier ASSUMES THE RISK OF THE INHERENT DANGERS AND RISKS OF SKIING. RENTER acknowledges that falls BINDINGS

Chaperones
Expectations of Chaperones
Chaperones are a very important part of the SnowCore experience and integral
to ensuring that every participant has a wonderful experience. A positive role
model is what many SOS Outreach participants need.
Chaperones will receive a lift ticket, rental equipment, and clothing for the day.
Chaperones need to bring up a lunch/money for lunch.
Chaperone Responsibilities
Chaperones must be with groups at all times. SOS Outreach and the resorts
expects this of chaperones for several reasons:
Knowledge and care of participants in case of emergency
Help participants who need assistance
Assist instructors with any behavior issues
Provide the youth with one amazing day by giving them the personal
attention, positive encouragement, and a positive role model. THIS IS
THEIR DAY!
Any chaperones that leave their group will have their lift ticket revoked.
It is permissible if chaperones would like to stay at the base of the mountain, as
long as their location is known and are available for all staff and participants.

WHAT TO WEAR ON THE MOUNTAIN
SOS Outreach can provide coats, jackets, goggles, gloves, and hats, but you need to
bring the following:
- Long Underwear (pants and long sleeve shirt; Non-Cotton)
- Socks (wool or non-cotton material is best, remember 1 pair at a time, if you
only have cotton socks pack 2-3 pairs for one day)
- Fleece or Wool sweater
- Neck gator, scarf, or bandana (this will protect your neck and face from the
wind)
- Sunscreen, chapstick/lip balm
We highly recommend that you wear a synthetic material as a base layer (anything
that is in contact with your skin). If you have something like a nylon mesh, waffle
pattern material, or anything non-cotton, even wool, will work well. These materials
keep moisture away from your body and don’t get wet easily, keeping you dry and
warm.
Wear multiple layers so that if you get too warm you can always remove a layer,
rather than getting cold and needing a layer to add.

BUS ORIENTATION
1. Information to share with everyone on the way up:
Loaned Gear
All clothing that you received from the bags is your responsibility. If it is lost, it will
need to be replaced. Please remember everything that you take.
Backpacks
Leave belongings on the bus. There are no areas for backpacks at the resort.
Do bring anything absolutely necessary (inhalers, medicine, etc.).
You will leave your shoes at the rental area and will be stored in a safe place.
Switching Sports/Free Riding
You cannot switch sports. The sport you signed up for is the one you have to do
because the rental shop has prepared your equipment and the correct instructors
are waiting to help you.
You have signed up to take a lesson today, so there is no riding on your own.
Safety
Everyone has to wear a helmet.
Drink lots of water and apply sunscreen often. Altitude sickness is a major problem
and can lead to headaches, fatigue, dehydration, and nausea. This can all be
prevented by DRINKING WATER! You are also closer to the sun at this altitude and
can get sun burned easily.
Lunch
Every participant will receive a $15 lunch voucher from their instructor at lunch time.
Please eat healthy foods and stay away from carbonated beverages.

connectors on the gloves. If it doesn’t have a connector, stuff one glove into the
other.
Make sure everything is out of the pockets of the coats and pants.
Wanna Ski/Snowboard Again?
For anyone who wants to go up again and really learn the sport, please tell me
(Youth Agency Coordinator) as SOS Outreach has programs where you can go up 5
times or even get a season’s pass. Both programs cost only $75.
