This concept was advanced during our June 25th VTC by D-5, D-3, D-8

and D-10 to remove the funding source information and provide a lump

sum amount in the category. The reasoning was that the funding source

information is found in TRAMS or CTIPs and historically has been checked

there and not in the coops. Bill Lewis concurred that funding source

changes should not trigger an amendment as long as the total dollar

2193 3 Development

amount does not change. Suggest amending Funding Summary to

accommodate this request quickly to help avoid future amendments that

would otherwise not be necessary...or provide a note in the Funding

Summary indicating that any change to the Funding sources will not trigger

an amendment, we will also need to modify article (L.l.8) which needs to

excluded Funding source changes.

We need to include language consistent with the attached June 2008 CTC

resolution, please review under "Project Cost Savings". Our PACT article

states that "Changes to PROJECT funding commitments will require an

amendment to BASELINE AGREEMENT and this cooperative

agreement.": however, if there are savings could be applied to other

phases (PA&ED, PS&E, R/W, and Construction) with an agreement

among funding partners and approval from CTC or savings could go back

to funding partners based on the proportionate contributions. If funding is

2194 added to any phase subsequent to the baseline agreement funding, any

savings resulting from that phase can first be credited to the contributor

who provided funding to either complete the phase or award the contract.

So, most of the partners, if contributing additional funds subsequent to

baseline agreement, will be asking for savings to be credited to them first

before applying proportionate savings based on the baseline agreement

funding contributions. We must include this language in the coop

agreements. In other words, whoever adds funding last, can take the credit

first from savings.

There are Constructions articles that don't apply when the State is doing

the work. S.g.2; S.i.13;S.i.15;S.i.16;S.i.17 and S.I.18 should be deleted

from the LL. All these articles should be replaced with: "CALTRANS will

construct PROJECT according with CALTRANS accepted PS&E and

CALTRANS Construction Manual at [Party A] expense". When [Party A] is

selected, we should insert under "Construction Scope": "CALTRANS to

2195

perform source inspection and any other services requested for PROJECT

completion, as outlined in the Construction Manual Supplement for Local

Agency Resident Engineer, and Local Agency Structure Representative

Guidelines." Also, we should ask questions regarding to Construction

Support cost for State-furnished Materials and Source Inspection and

other services provided..

When an agreement is made involving PS&E but does not involve

Construction, the following article is presented: "The responsibility to

advertise, open bids…will be handled outside the commitments of this

agreement." This is completely appropriate UNLESS, the local agency is

the IA for PS&E and it is intended that CALTRANS will be IA for

Construction...In that specific situation, by confirmation from John

McMillan, Brian Lee and Rebecca Harnagle, CALTRANS must perform the

OE review (which is activity 3.260 in PS&E). Therefore it is important to

2196 2 Development know who will is being selected for Construction even when we are

entering a contract for PS&E. It does not matter for PA&ED only or for

R/W Capital. Furthermore we will need to add the following language for

this condition (which has been vetted through Meera Danday and Rick

Gifford: (S.g.4a) "The responsibility to advertise, open bids, award, and

approve the construction contract (AAA) will be handled outside the

2229 logic

C.x.1 did not show

It is not clear from C.b.27 and C.b.28 articles that HM-1 management is not part

of the project scope or of the agreement scope and that the Scope summary does

not pertain to HM-1 work. I suggest we add an article that clearly state that HM-1

management in not part of the project scope and that the scope summary does not

pertain to HM-1 activities. The bigger issue is that the current language obligates

2230 logic CALTRANS to undertake HM-1 activites with minimum impact to project

schedule. How can we make this general promise without first knowing the facts. I

think a reflection of Bill Bassetts old language is appropriate . That language

basically said we will do our best not to hold up the project but is we don't have

the funds the LA may provide the funds to expidite the HM-1 clean up so that the

project can move forward.

Modify the Article to read "11. All WORK will be performed in accordance with

federal and California laws, regulations, and standards as well as, FHWA

2231 Language

STANDARDS and CALTRANS STANDARDS." - This simplifies and improves

the language.

HQ IT has the CutePDF software. This software has capability to convert

word documents to PDF, please see the latest PACT language library. It is

my understanding that PACT users will not need any special licenses for

this CutePDF software. I propose that we change the format from word to

PDF on the PACT downloaded cooperative agreements. HQ OCA

2233 Management

coordinators will be able to review the cooperative agreement in both

formats (PDF and word) . Please note that if any Districts has the full

"Adobe Acrobat Pro", they will be able to convert the PDF document into a

word document, but we will notice their changes. By doing this effort, the

OCA will provide a quality control on the final language.

5-20-09 Emailed HQ RW for theie consideration of this issue.

5--29-09 email response:

We talked it over and are think the language is good as is. It hasn't been a

problem so far, and is technically correct, since the Cert does need to

precede advertisement.

This modification is agreement specific only.

This revsion is built into PACT but Project Management has given an

umbrella exception to this issue so the new work is turned off.

Gary forwarded this article to me from the ARRA Delivery team. There is still

a need for a formal owner for ARRA related issues.

Gary received this from Faradad. LOTS of history behind this particular

article, but it is also part of the language requested by Audits.

email from Rubin Woo via D-4 Co-ops.

Email Encroachment permits and got a response 5-21-09. Should be done

per encroachment manual policy. District Permit Engineer makes the call.

I believe that this is not an issue as it was considered at length in PACT

development. Getting a resolution should be the responsibility of the District.

Martin pointed out that 9.1 3/31/08 version is not working. PACT 9.1 5/26/09

should catch it.

This adjustment came form a discusiion regarding billing and payment and

the push to simplfy the level of financial detail captured in a co-op.

There is a conflict between phases when a different selection of permits and

responsibilities is made.

This idea has been around for a while but has not been a priority. It has been

brought up again as part of D-7's introduction of PACT to LAMTA.

This work was completed by Brinton while building WBS 10. It was requested

by Planning as part of their effort to get reimbursed for PID oversight and

work efforts. Legislation was deferred.

"WORK" has been redefined in PACT 10.0 and therfore the "completion of

the issue. Don't know who the author of this comment is.

this change has been confusing due to various directions on weather it is a

fatal flaw or not. Final decision on 5/11/10 that it is not a fatal flaw.

Part of list of changes from Construction.

Talked to Carol and got resolution on the issues in March.

Need to confirm implementation. 5/5/10

A concern about addressing savings was raised by local agencies during the

monthly phone conference. Gary will draft an article to be included in COST

GENERAL for all agreements.

2-2-10, This is on hold pending the discussion with PRSM-EFIS.

this could be tricky because it is an issue with generating estimates now.

Perhaps PACT could include the ICRP rate that was used for the estimate.

5/18/10 Discussed with Gary and agreed that this is not the level of detail

needed in a co-op and the information is aviable in the workplan and

estimate.

Accounting is OK with the term. Legal seems to have made a change on one

agreement only.

Revision notes or questions

If you select "In Arrears":

The "Thirty days prior…." variables should be filled in with the party names

from previous questions.

The "installments" fields are displayed here instead of the "in arrears" fields.

Issue: It appears that when the user changes other information in the

agreement, such as the Partner AKA name or the Cost Summary (fund types),

the summary table is not updated. We did not test any other scenarios.

Issue: Changes to this page are not saved on either CLOSE or CONTINUE.

Make it clear there are three sections in both of these dialog boxes (a divider of

sorts, maybe):

Project Management Contact Information

Billing Contact Information

Signature Page Information (first field is Who will approve this agreement?)

This dialog should not display if Construction is not selected on the Project

Development Agreement dialog (This agreement will include work…)

We no longer need the IQA fields and calculations on the Cost Summary.

Please delete them. (Max, we hope this makes life easier.)

Rename this column "Funding Partner"

Rename this column "Funding Type"

Change the title to:

Funding Summary: Where the money is coming from

Change the name of this spreadsheet and dialog to Funding Summary

The Cost Summary is not updated when the user changes other information in

the agreement, such as the Partner's AKA name. We did not text any other

scenarios.

We finished an answer file with a couple of questions left blank, and it says we

have 17 unanswered questions. We could not find 17 unanswered questions.

Add a summary table that shows the totals of the percentages entered when

the totals do not equal 100% (by phase)

Add percentage fields for R/W support and R/W capital, and CONS support

and CONS capital.

Issue: The partners dropdown is not working. We get no choices.

Since this is a repeating dialog, the user should not be allowed to select both/all

parties. Instead, the materials/supplies provided by each party should be

outlined on separate dialogs.

The answer to this question (the partner's informal name) should be formatted

as all CAPS in the printed agreement.

We'd like to make this field accept only up to 10 digits so the user can enter a

five-digit ZIP (xxxxx) or a five-plus-four-digit (xxxxx-xxxx) code, but no more

than that.

Selecting "All of the above" does not appear to select Right of Way and

Construction (the dialogs for them do not appear).

Delete all options except for Amendment to Previous Agreement and Project

Development Agreement.

Swap the order of these two question so that District Agreement Number is the

last question asked on the dialog.

The format looks funky today, 11/21/06. Please double check to make sure it's

okay.

Move to Construction Info dialog.

If the user marks an item as "N/A" and that item is an expandable task, mark

all corresponding subtasks with N/A as well.

Also, add a generic article to the agreement that says something like: "Tasks

designated as "N/A" on the Scope Summary will not be performed."

Question: Is it possible to put the Summary/Detail buttons on the Scope

Summary screen so the user can switch views mid-stream?

Delete the IQA page (the task items that is disguised as a WBS item). It is no

longer a question that needs to be asked.

It will be unclear to new users which view they are looking at. Could you

highlight the button identifying the view that is displayed, or gray out the button

that is not the view that is displayed?

Change the title to:

Scope Summary: Who is doing what

Change the title to:

Spending Summary: What the money is paying for

Make the dollar columns wide enough to handle $999,999,999.99

This EA needs to be 5 digits not 6.

We need to have the N/A field work sort of like any other partner. When the

user clicks a party to the agreement and N/A for the same task, expand the

task to force the user to identify which subtasks will be completed by the party

and which ones are not applicable to the agreement.

Wherever the close button appears, please add a forgiveness warning to it so

that when the user clicks close a little message appears (Changes have not

been saved. Are you sure you want to close? - or something like it) and let the

user back up to save first.

The URL doesn't work, and it appears that the two capital letters are causing it.

This is the correct URL:

http://www.dot.ca.gov/hq/projmgmt/documents/responsibilities_of_implementin

g_agencies_v22.doc

Add a link to the State Cooperative Agreement Office page at:

http://pd.dot.ca.gov/design/coop.asp

When ever this item is selected by a non-Caltrans party, the agrrement

becomes non-preapproved. Can we do a warning right there on the scope

summary when the box is checked. The warning should read "WBS activity

4.225.55.25, Right of Way Condemnation, has been selected for a Partner

other than Caltrans. Per Chapter 17 of the Right of Way Manual permission to

process Resolutions of Necessity must be granted by the Division Chief of

Right of Way. This agreement is not preapproved until that permission is

confirmed by the HQ Office of Cooperative Agreements.

Please change question to read: Agreement will terminate upon

COMPLETION of WORK. On what date do you estimate WORK will be

completed?

Change "Capital" to "Capital funding"

Change "Support" to "Support funding"

This needs to be an optional field, not required.

Question/Request: Can we have the field programmed so that if the user keys

any ending punctuation (,.;:!?) at the end of the sentence or whatever is

entered in this field the system removes it when the text prints

No matter what we key, the field always defaults to xx-xxxx, which is an

indicator of the format. It should let the user key 6 characters and then have the

system format it as xx-xxxx.

Please delete this field. We don't need it.

The dropdown list needs to include "Demo" and we need to have the ability to

type over so the user can put in any funding source they want.

Question/Request: Max, is it possible to make the chart part of the Scope

Summary a scrolling region and keep the top area (Title, buttons, run meter,

etc.) in view?

- OR -

Can we have a message in the status bar that indicates the page is processing

or working after the user checks/unchecks a box?

Change the word "clause" to "article" wherever it appears.

Change the term "Cost Summary" to "Funding Summary."

Whenever we finish without any unanswered questions, we end up with an

error stating that some questions are unanswered. We cannot see them.

Please change "You're" to "Your."

We would like add "N/A" as a third choice for the answer to this.

Please remove the questions on this page as currently shown.

The message that appears after you click the CLOSE button should have a

Yes and No buttons. Yes - close the summary. No - close the message

dialog.

For the record: We realized that the 6th digit identifies a

phase of work, so if the agreement covers more than one

phase then the EA for the agreement can only be 5 digits

long.

We thought that some users may not know that Capital and

11/30/2006

Support are funding items.

The Federal Number is not required for every cooperative

11/30/2006

agreement.

The reasoning for that is that there is a period at the end of

the sentence in the printed agreement template and if the 11/30/2006

user keys the punctuation it shows up twice.

11/30/2006

If the users want the previous agreement effective date,
