                            PURPOSE AND INTENT
This Scholar Handbook is published by The ASK Academy (ASK) for the
purpose and intent to enable the ASK Scholars to experience a positive
school spirit and express pride and respect in the appearance of their school
community. Please sign and return the last page to ASK so we have a record
that you are familiar with ASK Procedures and Policies. Thank you for your
cooperation.

     "ASK will build relationships based on trust, responsibility and respect."

                        1 SCHOLAR RESPONSIBILITIES
Appropriate disciplines and behavior policies at ASK are outlined in the
scholar handbook. Any additions, revisions, change, or deletions will be the
responsibility of the General Manager (GM).

                      2 EQUAL OPPORTUNITY EDUCATION
Every scholar has the right and has access to a public education. No scholar
(Scholar)will be subjected to discrimination, harassment, or obstacles to his
or her democratic right to benefit from a public education.
ASK will not allow the following forms of discrimination based on religion,
culture, ethnicity, race, sex, sexual orientation, political beliefs, disabilities, or
the scholars within this policy. This also includes marital status and
pregnancy. ASK will observe all provisions of section 504 and ADA.

                                3 LOTTERY POLICY
Please refer to Policy kept in the GM Office and given to parents upon
request.

                    4 COMPULSORY ATTENDANCE POLICY
Please refer to State Policy which is kept in the office of the GM and given to
parents upon request.

                                   5 UNIFORMS


The ASK Academy Charter School requires all Scholars (Students) to wear a
prescribed uniform. ASK is a Science, Technology, Engineering, and
Mathematics institution; the school is a pipeline for STEM careers and
educational programs.

ASK has developed a Dress for Success uniform policy to improve the learning
environment and train the scholars of the importance of making first

impressions in these professional fields and careers. An important
consideration in the uniform policy is safety and the type of work that ASK
scholars perform during the school day. The uniform is important as scholars
are designing and producing products, analyzing chemical reactions, and
studying the effects of microbes in the micro-biology lab. These are examples
of activities that require professional wardrobe. The Uniform Policy will be
enforced during all school days that The ASK Academy is in session.

The ASK Dress for Success Uniform is mandatory for all scholars.

There will be specifically indentified days during the school year that are
designated for special wardrobe choices, such as: jeans day, funny hat days,
ASK sponsored competitions day, sports day, etc. These days can be
organized by the scholar’s council, but must be ASK executive council
sanctioned.

Tops:
Scholars must wear an ASK polo, with ASK logo, purchased from the sole ASK
vendor that identifies them with the career pathway they are members of.
See ASK Administration for location of this vendor.

      Engineering & Design Colors: Cobalt-Blue/Lucky Penny
      Biomedical Science Colors: True Green/Royal Amethyst

These polo shirts will not be overly baggy. Shoulder seams must be at the
shoulders, and shirts cannot hang down below mid thigh level.

Jackets will not qualify as a replacement to an ASK polo. Jackets may be worn
as long as they are not excessively baggy, shoulder seams are at the
shoulders, and jackets cannot hang below mid thigh level (tips of fingertips
when arms are at sides). If worn inside, jackets must allow full view of dress
requirements.
Text on jackets or backpacks, (or items on attached to jackets or backpacks),
that promote violence, alcohol, gangs, tobacco or drugs is prohibited and
clothing that is associated with a gang is not permitted. (Determination made
by ASK administration).

Bottoms:
    Allowable colors of pants are Khaki and Black. No excessive “sagging
      or baggy” pants are allowed (to be determined by the ASK
      administration and staff)

      Inseam of pant must be where legs and torso join.
      Denim pants are allowed on the specially designated denim days only.
      No Shorts, Skorts, Skirts or Cargo Pants

Other:
    Scholars must wear closed toe shoes at the Academy.
    No slippers allowed
    Clothing, jewelry, or appearances that are determined by the
       administration/staff and or faculty to be distractive to the learning
       environment will not be permitted.
    No head wear (hats) allowed inside the Academy.
    There may be exceptions based on religion which would be reviewed
       by the ASK GM.

The faculty, staff and administration of ASK reserve the sole right to interpret
and enforce the Dress for Success Uniform policy. Parents of scholars who
violate the Uniform Policy will be required to pick up their children with one
hour of notification by ASK, unless other arrangements with administration is
made, to return home for compliance with the Uniform Policy. Failure to do
so may result in disenrollment from The ASK Academy.


                                  6 DISCIPLINE
Please refer to Policy Manual kept in the office of the GM and given to
parents upon request.
The scholars at ASK will uphold the values of respect and tolerance in their
everyday attitudes with all staff and scholars at ASK. The GM will oversee
any situations where scholars are in ethical violation and respect and
tolerance are not observed. Hazing will not be permitted as any condition in
the membership of any organization or group at ASK. Discipline violations
will be handled on an individual basis.

Each teacher will establish clear and precise classroom expectations,
boundaries, and consequences for scholar behavior. When the classroom
teacher cannot mediate or resolve a behavior conflict the Counselor shall
intervene. The final level of action regarding discipline will reside with the
GM.

All State and Federal due process laws for scholars will be followed in
accordance with New Mexico Statute 22-5-4.3 “School Discipline Policies.”
The Board of Directors (ASK SCHOOL BOARD) “shall establish discipline
policies and file them with the New Mexico Public Education Department.”

The school will also involve parents, school personnel, and scholars in the
development of these policies.

               7 USE OF TOBACCO PRODUCTS/ ILLEGAL DRUGS
Please refer to the ASK Policy Manual which is kept in the office of the GM
and given to parents upon request.

In the interest of preserving the health and safety of all the scholars, ASK
intends to maintain a smoke-free, drug-free environment.

      Smoking is prohibited as well as the use of any tobacco product
       anywhere on or near school property or at school events off campus.
      Also prohibited are selling, possessing, using, or being under the
       influence of illegal drugs, alcohol, or other controlled substances, or
       imitations of such substances, or being in possession of paraphernalia
       associated with drug use anywhere on or near school property or at
       school events off campus.
      Any scholar who is found to be in violation of the school’s policy
       against smoking and drug use will be subject to immediate
       disciplinary action, up to and including disenrollment.
      Scholars who face disenrollment for violation of these rules may
       request a hearing before the Discipline Committee.
      Disciplinary Procedures will result in suspensions, referrals to ASK
       Substance abuse counseling and even expulsion.

ASK will be in full compliance with the State Board Regulation 81-3 that
prohibits scholars from using, possessing, distributing or trafficking alcohol or
other harmful and illegal substances on school property, at school, or at
school activities.

                          8 Search and Interrogation
ASK reserves the legal right to search school property, facilities, and scholar
belongings when there are just and reasonable grounds to do so. Scholars
may not be interrogated by any person not employed by ASK and without
approval of the GM.

                     9 Suspension and Expulsion of Scholars
All suspensions will be carried out in accordance with the Scholar Handbook.
All Final decisions regarding suspension shall be handled by the GM. ASK will
contact the parents/guardian in a timely process and include the parents/
guardian in all suspension or expulsion proceedings.

     Any scholar of ASK will be entitled to due process when in violation of
      the school’s discipline policies.
     There will be timely notification to law enforcement authorities of
      situations that are violations of criminal law and/or behaviors that are
      reportable by federal, state, or local law.
    ASK will comply with the GUN-FREE SCHOOLS ACT.
    ASK will comply with all scholar records management and retention
      procedures.

                   10 Scholar Possession of a Firearm/Weapon
If a scholar is found to be in possession of a firearm or weapon at school or at
a school related function the GM will take the appropriate steps to handle
the situation. The scholar will be automatically and immediately expelled
from ASK and referred to a law enforcement agency. ASK will comply with all
applicable state, federal, and local laws regarding firearms and weapons.
ANY SCHOLAR BRINGING A GUN TO SCHOOL WILL BE EXPELLED IN
ACCORDANCE WITH THE GUN-FREE SCHOOL ACT OF 1994.

Scholars will not possess or use firearms, weapons, or any other instruments
capable of harming a person or property. Weapons include, but are not
limited to guns, chains, knives, clubs, rocks, etc. or any object that can result
in injury, harm, or property damage. Possession of a weapon on campus is
grounds for expulsion for up to two years. Any scholar possessing a weapon
will be immediately suspended and recommended for expulsion. SCHOLARS
WHO HAVE BEEN EXPELLED FROM OTHER PUBLIC SCHOOLS FOR WEAPONS
VIOLATIONS CANNOT ENROLL AT THE ASK ACADEMY UNTIL THEY HAVE
SERVED THE ENTIRE TERM OF THEIR EXPULSION.

                                11 HIV/AIDS
Please refer to the ASK Policy Manual which is kept in the office of the GM
and given to parents upon request.

Human immunodeficiency Virus (HIV), the virus that causes the Acquired
Immune Deficiency Syndrome (AIDS) is not transmitted through everyday
casual contact. It is the position of ASK that scholars infected with HIV
attend school in an unrestricted manner. The school will observe all
HIV/AIDS related provisions in section 504 and the ADA.

                          12 Record Confidentiality
The Family Educational Rights and Privacy Act (FERPA) regulations protect
the privacy of scholars concerning the access and release of scholar records
maintained at schools. FERPA also gives parents rights with respect to those

records. The rights transfer solely to the scholar, or former scholar, who has
reached the age of 18.

ASK must have permission from the parent/guardian before releasing any
information from a scholar's records. ASK reserves the right to disclose a
scholar’s record without parental consent, to ASK employees and other
schools to which a scholar is transferring, specific government officials,
accrediting organizations, officials with court orders and subpoenas, and to
persons needing to know medical information regarding safety issues.
Parents have the right to inspect, review, amend, or correct inaccurate or
misleading information within the record. The parent is entitled to a formal
hearing if ASK chooses not to amend the record, and the parent may file a
letter of protest in the record if the record is not amended after the formal
hearing.
ASK respects the privacy of scholar records and recognizes that only
pertinent and factual information should be contained in the permanent
records of scholars. ASK has adopted policies to insure the rights of parents
and scholars over 18 years of age to review scholar records and to limit the
amount of scholar record information that can be made available to people
or agencies outside ASK.
Parents of scholars under 18 years of age have the right to review and
challenge the content of your scholar records. Scholars 18 years old or older,
have the right to review and challenge the content of their own records.

                                    13 TARDIES
The teacher reserves the right to determine whether a scholar is tardy. All
scholars who are tardyat the beginning of the school day must sign in at the
office before reporting to class. If tardies become habitual there will be a
scholar/ parent conference to address the situation.

                    14 LEAVING CAMPUS DUE TO ILLNESS
Scholars who become ill during the school day must get permission from a
teacher to go to the office and obtain parental permission before leaving
campus. Any scholar needing to leave the ASK campus due to illness must
sign out. Leaving the ASK campus without checking out through the office is
considered truancy. SCHOLARS WILL BE RELEASED ONLY TO THOSE PERSONS
NAMED IN THE SCHOLAR EMERGENCY CONTACT INFORMATION AND ON THE
SCHOLAR PICKUP LIST.

           15 ARRIVAL/ DEPARTURE FROM CAMPUS PROCEDURE
Scholars have two options for lunch:
   1. Eat at The ASK Academy Facility
   2. Scholar may leave campus for lunch ONLY if they have a signed Off-
       Campus Permission Form signed by their parents. Scholars may NOT
       drive vehicles during the lunch period. Scholars are expected to

return to class on time or they are subject to Lunch Detention, In-School
Suspension (I.S.S.), or losing their off-campus lunch privilege.
When it is time to leave school, the PARENT OR DESIGNATED PERSON listed
on the PERMISSION TO PICKUP FORM must sign out in the office. Leaving
campus without doing so is considered truant.

SCHOLARS WILL BE RELEASED ONLY TO THOSE PERSONS NAMED IN THE
SCHOLAR EMERGENCY CONTACT INFORMATION AND ON THE PERMISSION
TO PICKUP LIST (Pickup person must show identification).

If a scholar comes to school late or returns to campus that day, the PARENT
OR DESIGNATED PERSON listed on the PERMISSION TO PICKUP FORM must
sign-in at the office before the scholar returns to class. If the parent or
designated person does not sign the scholar in, the scholar will received an
unexcused absence or tardy.

                          16 MEDICATION GUIDELINES

In order to protect all scholars ALL Medications, including both prescription
and over-the-counter medications, must be registered with the school
Health Room. This includes medications kept in the Health Room and those
carried by the scholar.

ASK will provide over-the-counter medications like acetaminophen (ex:
Tylenol), ibuprofen (ex: Advil, Motrin), antacids (ex: Tums), cough drops, etc.
if a parent/guardian has signed the Over-the-counter Medication
Authorization Form for the current school year.

If a scholar must take a prescription medication at school, the Medication
Authorization Form must be completed by a physician EVERY YEAR.

If a scholar must take an over the counter medication at school which the
school does not provide or a prescription medication for a short period of
time, an Over-the-Counter/Short Term Prescription Form must be

completed for the period of time the medication needs to be taken at school
for the period of time the medication needs to be taken at school.

If a scholar has asthma, an Asthma Action Plan must be completed by a
physician EVERY YEAR.

If a scholar has allergic reactions which may require an EpiPen, an EpiPen
Authorization Form must be completed by a physician EVERY YEAR.

ASK will provide a locked storage area for all medications scholars need to
take at school, whether it be prescription or over-the-counter. All
medications must be in their original container, this goes for both
prescription and over-the-counter medications.

See the ASK Health Room personnel for necessary paperwork or if you have
questions.

                          17 IDENTIFICATION CARDS
Scholars will be issued ASK Identification cards and should carry the cards
with them at all times when they are at school. If a scholar loses their
identification card, they must purchase another one for a fee.

                                  18 VISITORS
ASK has a NO VISITOR POLICY so scholars are not allowed to bring other
scholars who are not enrolled at ASK on campus during the regular school
day. Other adult visitors are required to sign in and sign out through the front
office. Parents are always welcome at ASK, but should receive permission
from the GM if they would like to be on-campus during the regular school
day.

         19. PARENT VOLUNTEERS AND BACKGROUND CHECKS

Parent Volunteers are welcome at ASK to participate in scholar activities such
as field trips and assisting teachers with projects. Parents, however, must
complete a $12.00 notarized Department of Public Safety Background Check
in order to volunteer to chaperone or volunteer at the ASK Academy on a
regular basis. The Background Check form may be obtained through the
main office.

                             20. SCHOLAR PARKING
A parking permit must be obtained to park at school. There is NO fee for the
permit and only one permit per scholar will be issued. All scholars' vehicles
must be registered through the office with proof of driver’s license,
registration, and insurance. This does not guarantee the scholar a parking
place.
Any vehicle that does not display a parking pass will be treated as a non-
registered vehicle. If a vehicle is illegally parked, or if a vehicle does not have
a permit, the school has the right to have the vehicle towed and impounded.
Towing expenses, fines and accrued storage fees are the responsibility of the
vehicle owner. Parking privileges can be revoked if a scholar is speeding, or
exhibiting any unsafe vehicle operation. SCHOLARS MAY NOT DRIVE THEIR
VEHICLES OFF-CAMPUS FOR LUNCH.

           21 SCHOLAR DISRUPTION OF THE EDUCATION PROCESS
Scholar at ASK, enjoy the right to a quality education, free from unnecessary
disruptions and distractions. The ASK community, including scholars, parents,
faculty and staff share in the responsibility of maintaining a respectful
campus environment. The administration, teaching staff and others have the
responsibility to determine when scholar’s behavior is inappropriate and
disruptive, or in violation of local school rules or regulations set forth by the
ASK School Board.

                             22. GOOD NEIGHBOR
All scholars will demonstrate the ASK’s Trust Responsibility and Respect
attitudes to the community from the time a scholar leaves home in the
morning until the scholar arrives home after school; including lunch time,
field trips, and off campus activities.

                      23 PUBLIC DISPLAYS OF AFFECTION
Any inappropriate displays of affection will be determined by the GM/Staff.
Holding hands is appropriate. Staff will initiate the preliminary discipline
steps before filing an incident report.

                24. DESTRUCTION OR THEFT OF PROPERTY
The destruction, theft or vandalism of any school or personal property is
prohibited.

                       25. FIGHTING/MUTUAL COMBAT
Please refer to Bullying Prevention Policy kept in the Office of the GM and
given to parents upon request.

As with all other rules that are broken at ASK, fighting among scholars is
subject to consequences determined by The ASK GM. It is the belief of ASK
that different situations call for different consequences; therefore, any rule
that has been violated will be considered on a CASE-BY-CASE BASIS.
Parents will be contacted and required to attend a mandatory mediation
meeting with their child where an appropriate consequence will be
determined for the scholars involved in the incident. Although we believe
that suspension has a negative academic effect on scholars, we also
recognize that suspension may be necessary in the event of persistent
misbehavior.

Scholars shall not fight, push, intimidate or otherwise abuse other scholars.
For the purpose of reprimand, suspension and expulsion, fighting/mutual
combat/intimidation shall include but not be limited to the following types of
conduct:

         Behavior that intentionally, knowingly or recklessly causes physical
          injury to another person.
         Behavior that intentionally places another person in reasonable
          fear of immediate physical injury.
         Intending to injure, insult or provoke another person by knowingly
          touching him/her.
         Acting together (two or more scholars) in a way that recklessly
          uses force or violence or threatens to use force or violence that
          disturbs the normal operation of the school, or a school sponsored
          activity or threatens to create disruption or injury to scholars,
          guests or employees of the school.
         Engaging in fighting, violent or seriously disruptive behavior.
         Making unreasonable noises, use of abusive or offensive language
          or gestures to another scholar in any manner likely to provoke
          physical retaliation.
         Making protracted commotion, utterances or displays with the
          effect of preventing the orderly administration of the school.
         Refusing to obey a reasonable order of an employee of ASK
          Academy.
         Threatening by word or conduct to cause physical injury to another
          person or serious damage to property.

         Threatening to use or using physical force against another in
          response to a verbal statement.
         Scholars who violate this policy are subject to a five (5) to (9) nine-
          day suspension. The second offense will result in the scholar being
          suspended long-term from ASK Academy. A review for re-
          enrollment may take place by the board after one semester.

                         26. SEXUAL MISCONDUCT
Inappropriate public displays of affection or sexual misconduct are
prohibited.
                         27. SEXUAL HARASSMENT
Sexual harassment of or by any scholar is prohibited. Prohibited harassment
includes, but is not limited to; unwelcome sexual advances, requests for
sexual favors and other verbal, visual or physical conduct of a sexual nature.

                     28. RACIAL OR OTHER HARASSMENT
Racial and other harassment based on race, color, religion, gender, national
origin, age or disability is prohibited. Harassment is defined to include, but is
not limited to, verbal or physical conduct that creates an intimidating, hostile
or offensive school environment or that which unreasonably interferes with a
scholar's work performance.

                    29. GANG ASSOCIATION OR ACTIVITY
For the purposes of disciplinary action, a gang shall be defined as a group of
three or more people who have a name, claim a territory, have
rivals/enemies, interact together to the exclusion of others and exhibit anti-
social behavior often associated with crime or threat to the community.
Behavior that initiates advocates or promotes activities that threaten the
safety or well being of others will not be tolerated.

                          30. VERBAL ABUSE OF STAFF
Scholars shall not insult or verbally abuse staff members.

                        31. PHYSICAL ABUSE OF STAFF
Scholars shall not intimidate or physically abuse school staff. Staff may use
reasonable restraint to protect themselves, other staff, scholars, school and
personal property. Any scholar who violates this rule will be expelled from
ASK and removed from the campus immediately. The police will be called to
the school and a report will be filed with the appropriate law enforcement
agency. This could also lead to an expulsion hearing. The staff involved may

be on paid leave for the remainder of the day. The appropriate ASK staff will
enter the classroom for de-escalation service.

                 32. INCITING TO RIOT OR DEMONSTRATION
Scholars are not to incite or demonstrate in a disorderly or unauthorized
manner on or adjacent to school property.

                  33. FIREWORKS AND EXPLOSIVE DEVICES
Scholars are prohibited from possessing or using fireworks or explosive
devices on campus.

                          34. RIGHTS UNDER TITLE IX
ASK does not discriminate on the basis of race, color, national origin, sex or
handicap in its educational program or activities as required by Title VI of the
Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, and
of Section 504 of the Rehabilitation Act of 1973, respectively. Inquiries
concerning application of the above Federal regulations to the school's
program or activities should be directed to the ASK GM.

                     35. SCHOLAR CELL PHONE/ TEXTING
There is educational value in utilizing portable electronic devices in class or
during instructional activities when such devices aid in extending, enhancing,
and/or reinforcing the scholars' learning process related to the instructional
objectives of the class they are attending. Approval for scholars' use of such
devices will be at the discretion of the classroom teacher and/or site
administrator unless such device is mandated in the scholar's individualized
education program (IEP) or the extreme nature of a bona fide emergency
renders the securing of such permission impractical under the circumstances.
Use of cameras or the camera features on a cell phone or other portable
electronic device in a restroom or a locker room or for any use constituting
an invasion of any person's reasonable expectation of privacy is strictly
prohibited.

       37. ACCEPTABLE/ UNACCEPTABLE USE OF SCHOOL COMPUTERS

These guidelines must be followed to prevent loss of network and Internet privileges
at ASK. The following guidelines should be practiced whether ASK computers access
the ASK network or the Internet on or off campus at any time of day or night.

       All use of ASK computers, networks, and the Internet must be in support
       of educational goals.
       Respect all people and their work when using ASK technology. Do not
       use a computer to harm other people or their work.
       Respect ASK computers and the network by treating them with care
       Download only ASK approved software, shareware, or freeware within
       ASK’s licensing agreements.
       Respect all copyright laws.
       Tell an adult in charge immediately if you encounter materials which
       violate the rules of appropriate use.
       Keep your password and login information to yourself.
       Open someone else's folders, work, or files only with permission.
       Use ASK resources efficiently. Think before printing; consider storage
       space requirements and bandwidth issue.
       You will be held accountable for your actions. Failure to follow these
       policies will severely impact your education. By violating the rules of
       appropriate use, you may lose network and Internet privileges and be
       subject to disciplinary action.
       Understand that email on networks should not be considered
       absolutely secure or private. Scholars should exercise caution before
       opening attachments to e-mail received from outside the School. There
       is a risk that such attachments may contain programs or executable files
       that carry viruses. Do not open attachments unless the source and/or
       sender can be verified.
       Keep personal information private; home addresses, telephone, etc.


PRIVACY: Computer storage areas may be treated like school lockers.
Network administrators may review communications to maintain
system integrity and to insure that staff members are using the system
responsibly.
STORAGE CAPACITY: Users are expected to delete email or other material
that takes up excessive storage space.
ILLEGAL COPYING: Scholars should never download or install any
commercial software, shareware, or freeware onto network drives, hard
drives, or disks without proper licensing. Nor should Scholars copy other
people's work or intrude into other people's files.

INAPPROPRIATE MATERIALS OR LANGUAGE: No profane, abusive,
impolite, racist, or sexist language should be used to communicate across
the school's network or the Internet, nor should materials be accessed or
distributed which are not in accordance with the rules and expectations of
school behavior. Pornographic images are unacceptable material. If you
encounter material by accident, please notify the adult in charge
immediately. (Questions should be directed to the GM for clarification).

Unacceptable Computer Use Consequences:

       FIRST OFFENSE: The laptop will be confiscated immediately by staff
       member who verifies that the scholar is using the computer
       inappropriately. The laptop may be returned to the scholar by the
       staff member at the end of the school day.

       SECOND OFFENSE: The laptop is confiscated by the staff member and
       the laptop is taken to the GM where the parent is contacted by the
       GM of the inappropriate use. The parent must physically come to the
       school in order to release the computer back to the scholar.

       THIRD OFFENSE: The laptop is confiscated by the staff member and
       taken to the GM. The scholar will receive an incident report for
       inappropriate computer use, the parent will be notified, and the
       laptop will remain confiscated with the GM until the end of the
       semester.

                          #38 DISTANCE LEARNING
The ASK Academy strives to provide a high quality education for all scholars
that uses and develops 21st Century teaching and learning skills. The Director
or the Director’s designee is authorized to establish Distance Learning as per
6.30.8 NMAC, a process used to provide instruction for credit when the
scholar and primary instructor are not necessarily physically present at the
same time and/or place. ASK will assure that scholars enrolled in a distance
learning program have the necessary access to technology at school for all
classes or activities.

          #A THE ASK ACADEMY DISCIPLINE PROCEDURE MATRIX

It is the intent of The ASK ACADEMY to strive to keep scholars in classes and
provide ongoing education. Discipline procedures are needed to modify the
behavior of individuals who engage in unacceptable behavior. An incident
report will be filed in the scholar’s personal file anytime he/she violates The
ASK ACADEMY Scholar Handbook policies.

Consequence Chart

When policies have been violated, each incident shall be considered in light
of the number of other incidents involving that scholar. Scholars will have
access to the teachers and homework while serving discipline consequences.

The GM reserves the right in any disciplinary situation to use Lunch
Detention and/ or I.S.S.as a consequence for scholars violating the ASK
Scholar Handbook Rules and Procedures.

      First Violation/ Second Violation – Consequence: Mediation
       Scholar will mediate with GM or ASK Director on the incident. The
       parent will be called on the second offense, and preferably mediation
       will be done before the start of classes the next day. ISS may also be
       used depending on the nature of the offense.

      Third Violation – Consequence: 2-3 day suspension
       Parents will be called to pick up scholar. Parent will be notified of the
       suspension and scholar, parent and ASK staff will have a mediation
       conference on the day scholar will return. Consequences may also
       include ISS and lunch detention depending on the nature of the
       incident. Scholars may also have to write about the incident and
       provide solutions for stopping the behavior.

      Fourth Violation – Consequence: 5-day suspension
       Scholar will leave for the remainder of the day. The scholar may not
       return to classes until mediation occurs with scholar, parent, and ASK
       staff. ASK Administrator will mediate with the scholar and parent to
       discuss the severity of the scholar’s predicament.
       The ASK administration and the case manager will determine if the
       scholar needs counseling, therapy, or ancillary services to modify the
       scholar’s behavior. Scholar may be assigned ISS and/ or detention

       and/or duties within the school as part of the consequence. Scholar
       and parent will also be informed that scholar may be long-term
       suspended if negative behaviors persist.

      Fifth Violation – Consequence: Disenrollment
       Scholar will be dis-enrolled from ASK after multiple infractions of the
       ASK Scholar Code of conduct and when numerous consequences
       have been unsuccessful in modifying the scholar’s behavior. It is the
       intent of ASK to relocate scholars to an educational setting that is
       more suitable for their needs. It is not the intent of ASK to long-term
       suspend or expel scholars since that may result in keeping them out
       of all New Mexico schools. When the overall safety and educational
       process of the staff and scholars of ASK is jeopardized, however, it is
       the prerogative of ASK to take the appropriate steps to remove the
       guilty scholar from ASK.

GM Discretion
The number of incidents does not take precedence over the “severity” of
incidents in which the scholar is involved. If any situation jeopardizes the
safety, well being, and/or educational progress of ASK the GM has the
authority to act with discretion and implement resolution decisions
immediately.

DUE PROCESS
Parents will receive verbal and written notification as well as an e-mail
informing them that their scholar will be dis-enrolled, long-term suspended,
or expelled from ASK. Parents have five (5) working days to file a REQUEST
FOR HEARING with the ASK SCHOOL BOARD that their scholar be reinstated.
An ASK School Board committee will meet to determine if the disenrollment
merits a hearing. If the disenrollment does merit a hearing The ASK SCHOOL
BOARD will set up a hearing with the scholar and his/her parents to hear the
argument for reinstatement. The ASK GM must also attend the hearing to
represent the school’s case for disenrollment, long-term suspension, or
expulsion. This ASK SCHOOL BOARD COMMITTEE meeting must take place
within ten (10) days from the date of receiving the Request for Hearing
letter.
 After the scholar, parents and GM have presented their cases, the ASK
SCHOOL BOARD COMMITTEE will determine if the scholar should be
reinstated into ASK or if disenrollment, long-term suspension, or expulsion
will remain in effect.

  B# Procedure for Resolution of Parent/Teacher (Staff Member) Conflicts

A grievance will be defined as a dispute between a parent/guardian and the
ASK Academy. The School’s conflict resolution (i.e. grievance) procedure is
designed to ensure a parent/ guardian and the school a fair hearing of
legitimate grievances.
The GM/ Principal will determine if the dispute merits exercising the Conflicts
Resolution Procedure will determine if the dispute merits exercising the
procedure if the GM is the object of the dispute.
The grievance will be initiated by the parent / guardian against ASK as an
organization.
A parent/ guardian should make every effort to resolve the issue with the
classroom teacher with two formal letters and meeting with the teacher.
A written record of each meeting will be made and kept as part of the
personnel file of the aggrieved person.


                    Level I Teacher-Parent Formal Letter
                     (Aggrieved always must begin with Level I)

Parent will make at least two (2) FORMAL written attempts to resolve the
conflict with the teacher. E-Mail will not be considered as a formal written
request.
 The parent will write their letter and present it at a scheduled short meeting
with the teacher where they will mediate the issue. If the parent is not
satisfied with resolution of the meeting they must then write a second
formal letter to the teacher describing the conflict. The teacher will then
give a formal letter response to the parent/guardian.

Timeline: Within 3 working days to schedule meeting on receipt of first letter
and 3 working days for the teacher to respond to second formal letter.

                                   Level II
                         GM-Teacher-Parent Meeting
The parent files a written grievance with the GM who will schedule a meeting
with the Teacher and Parent involved. Both formal letters to the teacher and
formal letter to the GM will be available at this meeting.

                                     GM
         Resolves issue, followed by written response to parent.

                                    Level IV
                 GM, Parent, Board Member Grievance Review
If an issue is not resolved then a meeting with the GM, Parent, and Board
Member will be scheduled for the person filing the grievance. The Board will
review all documentation surrounding the grievance and issue a written
resolution to the person filing the grievance. All written documents prior to
this step must be available for the Board review.
